Energy 1103 Ding Plant road Bayport, MT 55003 RE: ME RP Building Permit Application Dear Mr. G irtz, Thank you again for taking the time to meet with City Staff on December 21 2004 to come to a viable approach on how we handle the issuance of City building permits for the MERP. The following is the approach that will be utilized: 1) City Building Permits are needed for all typical buildings /structures and for all footings and foundations that be utilized for equipment, buildings, towers, etc. It is estimated that there are 10 +f- buildings that will require the typical building permit and 30 +I- footing and foundation permits. No work may continence, including excavations, until City permits are issued. 2) xcel Energy will need to submit the full scope of the plans and specifications for all structures that are typically required for any construction in the City — such as .a shell building. Xcel is also required to submit the full footing and foundation plans, including side elevations, as proposed to accommodate the installation anticipated equipment. Load calculations must be. submitted with these footing and foundation plans. All plans submitted shall be approved and signed --off by Xcel' s Engineer(s); all such engineers shall be licensed and registered in the State of Minnesota. 3) All subrm* scions shall include as a cover page, the appropriate Submission Form, a DRAFT form is attached hereto. The actual final form to be utilized must include the information as outlined, but may contain additional information. Once such Form is agreed upon, the same form shall be utilized throughout the project. Again, such form shall be the cover sheet for each submission and shall be on BLUE paper. It is understood that there will be approximately 40 +/- separate submissions. Additionally, Xcel shall submit a master list of projects depicting each element o.. an appropriate site reap. This will aid th,J .-"lity in referencing each project. 4) Upon the receipt of a Building Permit Application utilizing the Submission Form., the City will review tie application and accompanying plans /specifications for completeness. once deemed complete and an actual review is completed, the City may then issue a "Building Permit ". It is understood that the submissions for a building permit from xcel may net be actual final design drawings, but shall and must represent better than 95% of the anticipated scope of the proposed element but shall be in full compliaace (100 %) with the City's Conditional Use Permit as issued *n 2004 for the MERP. Assuming a positive review, the City will then issue a building permit for these submissions that meet the 95 % threshold and construction (including excavation) may then commence. However, the City will not grant occupancy or allow continued installation of equipment until xcel submits to the City for approval the actual original "as. built" drawings that are WET SSIGlIE'D by Xc el' s Engineer as well as a short written statement that all construction is in compliance with the State of Minnesota Building Code(s). Any such revisions in the "as- built §" shall be clearly "clouded" on the revised drawings showing the changes. Because final plans are not being submitted to the City, xcel may incur re- inspection fees. All plan review and permit fees will be calculated by the City and must be paid prior to the issuance of a Building Permit. 5) 'There shall be no filling of any additional lands without the City's written approval. All excavated materials shall be either removed from the City Limits or shall be utilized on site for "final" grading purposes. xcel shall submit a FINAL site grading plan by Feb 41h, 2005 for City review and approval that depicts and discusses all anticipated areas to be filled. No other areas may be disturbed, filled or cut without a separate Conditional Use Permit from the City, Please also indicate if there is to be any stockpiling of any fill material, 6) .Towable construction hours in the City are Monday — Saturday from 7 am to 10 pm. The purpose of the rule is to ensure the appropriate repast of City residents from construction noise. The City cannot authorize a deviation from this rule. However, this rule is applicable to heavy construction equipment, back-up beepers and noise that emanates from the site during off - hours. Xcel may undertake operations during these off -hours that do not create such noise conflicts. Should the need arise for operations that would be 'n conk ict of this time requirement, xcel Energy shall notify the City and property owners within V2 mile, no more than two -weeks in advance that discusses such off -hour operations and when residents can expect the operations to cease. Such off hour operations that generate noise shall not exceed seven days. 7) Herewith, the City is returning to your attention all documents, plans and 0 specifications that have been previously submitted to the City for this project 1. (dated 11/24104) as these documents have been determined as incomplete relative to our recent meetings. Additionally, to date the City has not accepted any building perm. _ ecs or application fees for this project. future submissions shall follow the protocols as outlined in this correspondence. S) The City suggests that Xcel Energy prepare an informational document that will be provided on a semi- annual basis to the local community that outlines the MEP.P progress and where someone can secure information from Xcel about the project and how persons may be able to deal with potential conflicts that may arise. This. document should be mailed to the City and to all. property owners within 1 Iz mile of the plant's southern. most STH 95 entrance. A. complete mailing list and ready - labels can be secured from Washington County Surveyor's Office that incorporates such radius. The City recommends that we continue to meet on a consistent basis this winter and early spring to ensure that our efforts are coordinated. The City understands that Xcel does have important timelines; likewise the City also has critical timelines and requirements that may not have been enumerated here that help to ensure that permits are correctly in place and that all parties in the City are treated similarly.
