Re: 2010 Preliminary Budget
1« order to Dave an estimated zero increase iii tax impact, the expenditure budget would need to
be reduced by $166,500,
I have recalculated the salaries and insurance premiums for Finance and Public Works to
reflect the replacement Ior the Finance Director to take place as of June I" rather than
May I" and to reflect the position change of the Public Works Director and the timing of
hiring an additional employee for Public Works. The adjustments to salaries, PERA,
FICA, and insurance premiums result in a decrease of $34,760 to the General Fund
expenditure budget. The tax levy will also be reduced by that amount. They are as
follows:
1. Reduce Finance Salaries, PERA, FICA $7,920- hire date for new Finance
Director June 1, 2010 rather than May 1, 2010.
2. Reduce Streets Salaries, PERA, FICA, $3,290 to reflect job position
changes and no new hire until May 1, 2010.
3. Reduce Streets Salaries, PERA., FICA, $16,550 to reflect job position
changes and no new hire until May 1, 2010.
4, Reduce Insurance Premiums for Health /Dental /Life $7,000 to reflect
change in hire date for Finance position, Public Works job position
changes and no new Public Works hire until May 1, 2010
In addition to the above adjustments to salaries and insurance, the Council
would have to reduce the expenditure budget an additional $131,740. There
are several areas of the expenditure budget that could be reduced to achieve a
zero increase:
1. Eliminate Grants/ Contributions $9,500 - out contribution to Youth
Service Bureau
2. Eliminate Parks Grants $5,032 - cut contribution to Lucy Winton Bell
Athletic Fields
3. Reduce transfers to Street Reconstruction $100,000.
4. Reduce transfers to Storm Sewer Renewal/ Replacement Fund $50,000.
5. Reduce transfer to Budgeted Projects Fund for Police Vehicles $5,000.
6. Reduce transfer to Budgeted Projects Fund for Public Works Vehicles
$10,000.
7. Reduce transfer to Budgeted Projects Fund for computers $1,500.

Ms. Molly Shodeen from the DNR revoked MNDOT's permit to proceed with test
piers in the St. Croix River due to fhe incorrect notices, being sent to the Stillwater, not
Oak Park Heights. I have enclosed Ms. Shodeen's notice of revocation to MNDOT as
well as the application originally solicited for comments.
It is important to note that the DNR has indicated that the City does have until Dec 23
to provide comments on such testing. Mayor Beuadet provided a letter to Ms. Shodeen
indicating that additional information is needed to perform a proper review. It appears
that the Mayor's office has the ability to seek additional information, (enclosed) but
Council action may be additionally be sought as a follow -up measure to meet the Dec
23 deadline.
Ms Shodeen has also expressed a willingness to meet with the City Council on Dec 8
to discuss the matter. I have asked if she is willing to attend the work session on Dec 8t
And at this point is slated to in fact be present to discuss the matter.

Dear Tula. Lamb:
It has been brought to my attention that the review notice and request for comments dated August 28,
2009 for Permit #2010 -0117, was mistakenly sent to the City of Stillwater instead of Oak Park Heights.
This was due to an error on my part. Therefore, because the permit was issued in violation of
Minnesota Statutes, Section 103G.301, Subdivisions 6 and 7, we are terminating Permit #20100117,
effective immediately. The pen will be reconsidered for issuance after the City of Oak Park Heights..

Toad Test for St. Croix River Crossing
Mn/DOT is planning two structural load tests in preparation. for Final design and
construction of the proposed bridge crossing of the St. Croix River'at Stillwater,
Minnesota.
The activity in the river bed will incline one test utilizing a 7 -foot diameter
(approximate) drilled shaft and one test utilizing a 4 -foot diameter (approximate) driven
pile, Each test will be. conducted to a depth of approximately 150 feet below the river
bed.
Barges will be used to perform the tests. A• temporary boat launch/access point will be
utilized on the Minnesota side of the St. Croix River. The area of work will be-limited to
where the tests will be performed. However, barge traffic between the shore and test
areas is expected.
The total project footprint within the mater body is estimated at 0.11 acres. This assumes
a 50 -foot by 50 -Foot area of disturbance for each test location, which allows for barge
spuds as well as the test itself.
The drilled shaft will be executed on the Minnesota side of the river. The drilled shaft
will have a permanent casing, easily inserted into soft river bed material, prior to any
drilling to remove material. This will minimize sediment and turbidity impacts. Any
drilled material will be contained in avessel on a barge and then of in a non -
wctland area on the Minnesota side. Concrete will be pur ped into the casing for the
drilled shaft.
The drilled shaft and driven pile will be partially removed at the end of the load test.
Mi /DOT intends to remove the shaft and pile such that the ends axe a few feet below the
bottom of the river.
MnIDOT is targeting execution of the work from approximately October to mid-
November, 2009:

One alternative considered was a "do nothing" alternative. However, a "do noth ne' is
not deemed feasible in the context of safe and d-efective engineering. This proposed
activity is considered paramount to successful design and construction of the proposed
bridge crossing.
Since this is a test, and not a project, no other alternative other than "do nothing" can be
reasonably considered.

Whatever you sent to the Corps, you should send to Molly Shodeen, via email will be fine. While we (DNR) have decided to
amend the old permit for this, it will take some dusting off the files to get anew copy out and signed. From the DNR webite, the St
Croix OHW Is 680' 1912 datum, but I do not know the conversions to other datums. Same goes far wisconsin:

Regardless, that level Is a bit over 4 feet higher [lien current water levels:

So I gather that some of the wetlands you mentioned may be below the 680' elevation. Molly Is the one to make the call on the

Just to follow up on our brief hallway discussion yesterday, here's the permit status for the St. Croix Load Test
1. Appiicatlons to Corps signed and sent August 10
2. Wisconsin DNR has no issues (Wesley corresponded with Lisle Kitchel to aid Wlsc DNR coordination)
1 US F &WS has no Issues (Jason informed F &WS project Is state funded)
4. MN DNR has indicated project will be approved under old permit
5. No shipwrecks In area
6. Todd Clarkowski forwarded zebra mussel decontamination plan to project engineer.
Remaining issue regards disposal of material; still need to understand where boring slurry will be disposed.
Depending on how barge access site is managed, project may or may not need Middle St. Croix WMO project review. ( "Any
project with grading within the wetiand /public water buffer or within 40-feet of the bluff line.')
My understanding from Todd C is the load test will be let In September,

Dear Ms. Shodeen:
Your application dated November 24, 2009, and sent to me, for test foundations in the Protected
St. Croix River is rejected. The following information is required to (review the application and
approve the permit.
Under Administrative Rule 611 5.0240 Application for Public Water Work Permits, a complete
application must follow Subpart 3 and provide proof of application under E to the Middle St.
Croix Water Management organization and the Washington County Soil and Water Comervation
District Office.
Additional detail information on the following: the native mussel plan, prevent aquatic invasive
species plan, the St, Croix River mooring location and its design, the reports and location snaps
of all previous river studies relating to foundation construction in the St Croix River for the years
196I -1962, 1995 -1998, 1999 -2000 and 2006 to the present, review of options that snake no
further foundation testing required in the protected St Croix River, the removal plan for the entire
structure placed into the protected ,St Croix Rivet', the plan to remove the mooring site on the St.
Croix River, copies of the Minnesota DNR permits for foundations and core samples from the St.
Croix River in the time periods listed above, constriction plans and specifications for all
foundation locations.
1 will also be requiring MNDOT staff to present to the public, at an Oak Park Heights City
Council meeting, within the 30 days following a complete application, the information presented
to contractors this past fall in Minneapolis, on the geology of the bottom of the St Croix River.
Mit.rnesota DNR staff will be available at the same meeting time to answer questions concerning
the foundation permit of 2009.
