Adi ournment. f kP rkHeights City o Oa a Memo To: Planning Commission From: Julie Hultman Date: February 16, 2007 Re: Annual Meeting: Commissioner Terms and Officer Election Commissioner Terms: I have thoroughly researched City Hall records as they pertain to all Planning Commissioner appointments and terms as well as to the elected Officers to the Planning Commission. Individual summaries and documentation are in each members Commission file. Attached for your reference is a summary for the current Planning Commissioners. In concurrence with this review, Commissioners Liljegren and Wasescha are both completing their first full 3 -year terms as Planning Commissioners and may seek reappointment. Letters were mailed to both Commissioner Liljegren and Wasescha as to their terms culminating May 31, 2007, noting that they will be requested to declare whether or not they wish to seek reappointment at the Annual Meeting on March 8, 2007. These letters are attached for your reference. As of this writing, I have been notified by Commissioner Wasescha that he does wish to seek reappointment. Election of Chair and Vice Chair: Also attached for your convenience are the Planning Commission Bylaws. Please refer to Planning Commission Bylaws Article 4 Officers, Duties and Election of Officers, section D, which states: "Terms. The Planning Commission officers shall be elected from among its appointed members for the term of two years. No member shall serve as Chairperson or Vice - Chairperson for more than two consecutive terms. The election shall occur at the Planning Commission's annual meeting." Mike Runk is currently serving his second full Commission term, has served one full term as Vice Chair (2003 -2005) and is completing his first full term as Chair (2005- 2007). In accordance with Article 4, Mike may be elected to either Chair or Vice Chair, should the Commission desire. Mike Liljegren is currently serving his first full Commission term and is completing his first full term as Vice Chair (2005- 2007). In accordance with Article 4, should Mike seek and receive reappointment to the Planning Commission he may be elected to a second term as Vice Chair or to the position of Chair, should the Commission desire. M City of Oak Park Heights With the above information in hand, I respectfully request: (1) That Commissioner Mike Liljegren and Commissioner Warren Wasescha declare their intentions to resign or seek reappointment; and (2) Recommendation be made to the City Council as to reappointing those Commissioners seeking reappointment to the Planning Commission fora 3 year term, commencing May 31, 2007 and ending May 31, 2010; and (3) If necessary, direction to advertise for Commission vacancies, with an application deadline being established; and (4) If necessary, scheduling of a date and time for Commission applicant interviews and Commissioner volunteer(s) designated to partake in the interview process; and (5) That the Commission nominates and elects a Chairperson and aVice- Chairperson to take office at this annual meeting and to continue in their respective elected role until the March 2009 annual meeting. At this meeting, a Chair and Vice Chair are elected by the Commission for a 2 -year period of Office. Commissioner's whose terms culminate this year will also be asked to declare whether or not they wish to seek reappointment. The City Council appointed you to the Planning Commission for a 3 -year term in 2004, which will culminate on May 31' of this year. As this is your first full term on the Planning Commission, the Planning Commission. Bylaws allow your reappointment to a second 3 -year term, should you desire it. Cordially, J e r ultman Plannin g & Code Enforcement JH: Tree Cit y US.A. ti CITY OF OAK PARK HEIGHTS PLANNING COMMISSION BYLAWS ARTICLE 1 - ORIGIN AND POWERS A. Authorization. The City is authorized and empowered to establish a Planning Commission by the provisions of Minnesota State Statutes 462.354. B. Establishment. The Planning Commission was created in an advisory capacity by action of the Oak Park Heights City Council on April 14,1998 by the adoption of Ordinance 210 and the amendment of Section 401, the Oak Park Heights Zoning Ordinance. ARTICLE 2 — DUTIES AND OBJECTIVES A. Advisory Capacity. The Planning Commission is designed to serve in an advisory capacity to the Oak Park Heights City Council. B. Objectives. The objectives of the Planning Commission are to make recommendations to the City Council which will guide the development of land, services and facilities within the City, so as to promote the public health, safety and general welfare. C. Public Hearings. The Planning Commission shall hold public hearings for variances, conditional use permits, subdivisions, PUD permits, and other applications to the City in accordance with the City Zoning Ordinance and shall make recommendations on said applications to the City Council. D. Special Public Hearings. The Planning Commission may hold such public information hearings as the City Council deems necessary and may make recommendations on applications for building permits or site plan review when requested by the City Council. ARTICLE 3 — MEMBERSHIP A. Voting Members. The Planning Commission shall consist of five citizen members who are eligible voters residing within the Oak Park Heights City limits and who are appointed by the City Council. c B. Ex- Officio Members. There shall be a City Council person designated by the Mayor, with the consent of the City Council, to be a liaison to the Planning Commission. Such City Council person shall serve without voting power and in a capacity as ex- officio to the Planning Commission. The Mayor, with the consent of the City Council may also appoint non - voting, ex- officio members to represent other groups or organizations from the community. *C. Terms. The five members of the Planning Commission shall be appointed by the City Council. All such appointments shall initiate and be established by resolution of the City Council. The term of each member shall be for three years with initial terms being staggered by the City Council resolution of appointment. Unless extended by special order of the City Council for a period of one year, no member shall serve more than two consecutive terms on the Planning Commission. *D. Absenteeism. If any voting member fails to attend three consecutive meetings or a total of four meetings (or 25 percent) during the calendar year, the City Council shall be notified with a recommendation by the Planning Commission. Planning Commissioners shall notify the Chairperson or City staff when an absence if anticipated. E. Removal. Any member of the Planning Commission may be removed at any time by a four - fifths (4/5) vote of the City Council with or without cause. F. Compensation. Compensation of Planning Commission members as selected by the City Council shall serve without compensation except as otherwise established by resolution of the City Council. G. Training. The Chairperson and the City staff shall meet with each new Planning Commissioner to explain Planning Commission procedures. Within the first year of appointment, each new Planning Commissioner shall attend a Government Training Service, Planning Commission training session at City expense. H. Resignation. A member who wishes to resign shall submit a written resignation to the Chairperson, who shall in turn forward the same to the City Council. I. Vacancies. Vacancies occurring within the Planning Commission shall be filled for the balance of the appointment by the City Council. * Amended June 6, 1999 2 ARTICLE 4 — OFFICERS, DUTIES AND ELECTION OF OFFICERS A. Officers. The officers of the Planning Commission shall be Chairperson and Vice- Chairperson. B. Duties of the Chairperson. The Chairperson shall preside at all meetings, appoint Planning Commission members to committees, appoint Planning Commission representatives, rule on procedural questions (subject to reversal by a two - thirds (2/3) vote of those members in attendance), meet with all newly appointed members, exercise the same voting rights as other Planning Commissioners and car out such other duties as are assigned b the Planning carry g Y g Commission or by the City Council. C. Duties of the Vice - Chairperson. The Vice - Chairperson shall act in the absence or inability to act of the Chairperson, and in such instances shall have the powers and functions of the Chairperson. D. Terms. The Planning Commission officers shall be elected from among its appointed members for the term of two years. No member shall serve as Chairperson or Vice - Chairperson for more than two consecutive terms. The election shall occur at the Planning Commission's annual meeting. E. Vote. Candidates for office receiving a majority vote of the entire membership (three -fifths (3/5)), shall be declared duly elected. F. Date of Office. Newly elected officers shall take office at the annual meeting in March. G. Vacancies. Vacancies occurring in the offices of the Planning Commission shall be filled immediately by the above election procedure. ARTICLE 5 — MEETINGS *A. Annual Meeting. An annual organizational meeting shall be held the second Thursday in March of each year. Election of officers shall be conducted at that time. *B. Regular Meetings. Regular meetings of the Planning Commission shall be held at 7:00 PM on the second Thursday of each month in the City Hall Council Chambers. The regular meeting date of the Planning Commission may be changed by resolution of the City Council. * Amended December 28, 1999 3 N I II y C. Special Meetings. Special meetings may be called at the discretion of the Chairperson, after consultation with City staff. D. Notice of Meetings. Notice in writing of all regular and special Planning Commission meetings, setting forth the time, place and agenda of such meetings, shall be mailed by the City staff to all Planning Commission members at least five days in advance of each meeting. E. Site Investigation. Prior to each meeting, all Planning Commission members shall endeavor to visit any properties to be discussed at the meeting. F. Planning Commission Representative at City Council Meetings. Each Planning Commission member shall in turn represent the Planning Commission at regular City Council meetings. ARTICLE 6 — PRE - MEETING PROCEDURES A. Agenda. The agenda for each meeting of the Planning Commission shall be developed in writing by the City staff and shall be available at the City Hall prior to each meeting. B. Withdrawal. If a petitioner or applicant desires to withdraw a matter from an agenda, such request must be submitted to the City staff in writing, and if any public notice has been given, all persons appearing at the noticed hearing on said petition or application shall be entitled to be heard. ARTICLE 7 — PUBLIC HEARING PROCEDURE A. Time. The time of each public hearing shall be stated on the agenda, and no hearing may begin before this time. Each hearing shall begin as soon as possible after this time. B. Presentation. If a public hearing is required for a request by a petitioner, the petitioner or an appointed representative shall state the request, explain the proposal and answer questions of the Planning Commissioners. If no petitioner is involved, the Chairperson or the City staff member shall explain the purpose of the hearing. The Chairperson may impose reasonable restraint upon the number of times one individual may speak. 4 C. Termination of Hearing. The Chairperson may close a public hearing after hearing those present who care to speak, or any member may move to continue the public hearing until a specified date. If a hearing on the petitioner's request is closed, the Planning Commission shall make a recommendation to the City Council within 30 days following the close of the hearing. If a hearing is continued, mailed notices of the continuation may be requested by any voting member. ARTICLE 8 — MEETING PROCEDURES A. Rules of Order. Unless otherwise specifically designated, Roberts Rules of Order, as most recently revised, shall govern the meeting procedure. B. Quorum. A majority of the voting membership (three -fifths (3/5)) shall constitute a quorum for meeting purposes. C. Conflict of Interest. Whenever a Planning Commission member shall have a direct or indirect personal or financial interest in an application or petition before the Planning Commission, that member shall declare such interest and excuse himself /herself from the discussion and vote. D. Agenda. The order of business at regular meetings generally shall be as follows: 1. Call to order. 2. Roll call of members. 3. Approval of the minutes of the previous meeting. 4. Public hearings. 5. Informational hearings. 6. Old business. 7. New business. 8. Adjournment. E. Appearance of Petitioner. No application or petition shall be given final approval unless the applicant or petitioner appears personally or by representative at the hearing called thereon, or unless he /she makes satisfactory explanation or presentation in lieu thereof. F. Tabling. A tabling motion, if passed, has the effect of laying a matter over until the next regular meeting, unless otherwise specified. 5 G. Reports. Any matter may be tabled for a technical report or study which the Planning Commission may make or request of the petitioner, the City staff, the City Attorney, the City Engineer or other sources. Such report shall be presented to the City staff for forwarding to the Planning Commission at least five days prior to the meeting at which said matter will be heard again. H. Non - Agenda Matters. No binding or final action may be taken on any matter not on the written agenda except by unanimous vote of the members in attendance or four - fifths (4/5) vote of the entire membership. ARTICLE 9 — COMMITTEES A. Planning Commission Committees. The Planning Commission may establish committees of its own membership for a specific purpose and duration. B. Ad Hoc Committees. The Planning Commission may request that the City Council appoint other members of the community to Ad Hoc Commission committees, which may be created by the Planning Commission for a specific purpose and duration. At least one voting member of the Planning Commission also shall be appointed to each such committee. ARTICLE 10 — RECORDS A. Minutes. The City shall supply a secretary at all regular and special meetings of the Planning Commission who shall be responsible for taking full and complete minutes and record all such meetings. The City staff shall be responsible for keeping a record of all Planning Commission resolutions, transcriptions, minutes and findings. B. Open Meetings. PLANNING COMMISSION MEETING MINUTES Thursday, January 11, 2007 Call to Order / Approval of Agenda: Chair Runk called the meeting to order at 7:10 p.m. Present: Vice Chair Liljegren, Commissioners Powell and Wasescha, City Administrator Johnson, City Planner Richards and Commission Liaison Abrahamson. Absent: Commissioner LeRoux. Commissioner Wasescha, seconded by Commissioner Vice Chair Liljegren, moved to approve the agenda as presented. Carried 4 -0. Approve Minutes of December 14, 2006: Chair Runk, seconded by Commissioner Wasescha, moved to approve the Minutes as amended. Carried 4 -0. Department /Commission Liaison Report /St. Croix Crossing Update & Other Reports: Chair Runk welcomed City Councilman Les Abrahamson as the new Commission Liaison. Visitors/Public Comment: None. Comprehensive Plan Update: City Planner Richards announced that the 2008 Comprehensive Plan update processed has commenced with the first meeting of the Comprehensive Plan Update Committee preceding the Planning Commission meeting. Richards stated that discussion would continue monthly at workshops scheduled preceding the regularly scheduled Planning Commission meeting and encouraged anyone interested in the comprehensive plan to attend the workshops, the Planning Commission meetings or to contact City Hall to learn where things are at with the plan updating process. Chair Runk clarified that, during the comprehensive plan updating process, the workshops would be held at 6:30 p.m. in the large conference room at City Hall, the same evening as the regularly scheduled Planning Commission meeting, which would follow the workshop at 7:30 p.m. r Planning Commission Minutes January 11, 2007 Page 2 of 2 Informational: A. City Administrator Johnson discussed a possible Technical Corrections Bill that was hopeful to clear Congress this session. The Bill would clarify some of the appropriations made in the 2005 Transportation Bill which identified approximately $400,000 originally slated for the specific study of the `cut and cover' layout for Hwy. 36. It is hoped that the Bill will provide a more generic language, allowing those funds to be used for other potential designs. The .91 acre site will be partially encumbered by an easement for the Wal Mart entrance and has not been developed. The subject site is currently zoned B -4, Limited Business District. No conditional use permits or variances are necessary for this request, thus a public hearing is not required. Site plan and design review requires Planning Commission consideration with City Council approvals. The Comprehensive Plan guides the subject site for commercial land use and as such, the proposed retail development is in compliance with the Comprehensive Plan. Zoning. The subject site is zoned B -4, Limited Business District The applicant is proposing retail and service uses that are consistent with the permitted uses of the B -4 District. The site, as configured, does not have allowance for a drive - through facility. Any drive - through facility would require a conditional use permit. The limitations on parking for the site would not allow for a sit down restaurant facility. Manley Commercial is currently working with Wal Mart to develop an off -site parking agreement to allow the flexibility of locating food establishments in the proposed building. Allowances for off -site parking could be made by the City through consideration of a conditional use permit. Wal Mart currently has excess parking stalls by City standards. Lot and Setback Provisions. As shown in the table below, the proposed building and parking meet the required lot area and setback standards of the B -4 District. The subject site access is from the existing driveway created by Wal Mart that connects 60 Street North to the north edge of the Wal Mart parking lot. When originally approved, the Wal Mart plat included the driveway and the property under the existing. Wal Mart freestanding sign as part of the overall Wal Mart site. Lot 2, Block 1 was created as a separate commercial property. Wal Mart sold the driveway /sign portion of the lot to the current owner of Lot 2, Block 1. Manley Commercial will take the entire site, and create an easement for the driveway. The Wal Mart sign will be removed. The existing driveway will be reconstructed at the south end of the site to provide a straight access roadway between 60 Street North and the northern driveway in the_ Wal Mart parking lot. The driveway will remain at least 10 feet from the property line, consistent with the Zoning Ordinance setback requirements. One access is shown into the proposed commercial site from the driveway. The parking lot in front of the building would also be provided with one access, although adequate space exists with the parking configuration and drive aisle to accommodate vehicle turnaround. 2 A bituminous trail is shown on the site Ian ad'acent to 60 p Street North in conformance 1 ' not extend the full length with the City's Trail Plan. Based on the proposed retail and services uses, the required number of off - street parking spaces is shown below: (11,050 square feet X .90) _ 200 square feet = 50 spaces The submitted plans indicate a total of 55 parking spaces, including three which are disability accessible. The site is consistent with the parking standards unless a sit down cafe, coffee shop, or restaurant is included as a tenant. Manley Commercial is discussing an off -site parking agreement with Wal Mart. If the agreement is pursued, a conditional use permit will be. required to address the off- street parking arrangement. The parking area and driveway are proposed to be curbed and paved with bituminous surfacing. All of the stalls and driveway dimensions are consistent with the Zoning Ordinance standards. Landscaping. A landscape plan has been reviewed by City staff, including the City Arborist. The plan lacks species diversity, especially for the deciduous trees proposed for the site. The landscape plan shall be subject to the City Arborist's approval. Grading, Drainage and Utilities. Preliminary construction plans have been submitted. All grading, drainage and utility plans are subject to review and approval of the City Engineer. Lighting. A lighting plan with photometrics was submitted based upon an earlier plan submittal. The lighting plan and photometrics will need to be updated based upon the most recent submitted plan. The lighting plan should also include fixture specifications. The decorative wall lights on the building appear to feature lenses that extend below the light shield. All fixtures shall comply with the full cut -off requirements of the Zoning Ordinance. Signage. The plans indicate that the existing Wal Mart pylon sign will be removed. This will be made a condition of approval. One freestanding sign has been proposed in the northwest corner of the site which would be 20 feet in height and include 100 square feet of identification and tenant signage. The freestanding sign is consistent with the Zoning Ordinance requirements. The elevations include proposed locations for wall signage. The illustration is generally consistent with the ordinance requirements. Prior to erection of any signage on the subject site, a sign permit must be obtained, subject to City staff approval and consistent with Zoning Ordinance requirements. Trash Enclosure. A trash enclosure plan has been submitted. The enclosure is situated at the south side of the property and will be constructed out of the same CMUs (concrete masonry units) and brick as the principal building. The gates will be constructed from pre- finished metal panels. 3 Snow Removal. A snow removal plan should be submitted for the site subject to City staff review and approval. Xcel Distribution Wires. The City will require the applicant to bury the overhead distribution lines on the north property line. The timing of that improvement shall be coordinated with the burying of the distribution lines in front of Lowe's. The applicant shall escrow sufficient funds, as specified by the City Engineer, to complete that improvement or agree that the City will complete the work and petition for the public improvements, waiving notice of public hearing and assessment. Building Design. The submitted plans indicate that the building would be one story, approximately 25 feet in height, and with a total of 11,050 square feet. The primary fagade metal is proposed to be brick and simulated stone. Decorative CMUs, fabric awnings, ar�d pre- finished metal are to be used as accent materials. The front and side facades will include significant window areas, consistent with the Design Guidelines. The applicant has submitted colored building elevations indicating the building and proposed awning colors. The applicant shall be required to provide building material samples for Planning Commission and City Council review. The building plans do not indicate the location of heating and air conditioning or other mechanical units. If located on the roof, they shall be completely screened by the parapets. The plans shall be revised to include mechanical locations and screening. Each tenant bay will have a glass door entrance surrounded by large window areas. The proposed building will have architectural interest in the form of varied roof lines for different sections of the building's fagade. The proposed retail building is consistent with the requirements of the B -4 District and the City's Design Guidelines. CONCLUSION /RECOMMENDATION The applicant has submitted the necessary materials for the proposed application. The proposed use and site design are consistent with the requirements of the Zoning Ordinance and the direction of the Comprehensive Plan. Based on the information contained in this report, our office recommends approval of the site plan and Design Guidelines review for the Oak Park Center retail building subject to the following conditions: 1. The Wal Mart freestanding sign, including foundations, shall be removed no later than May 1, 2007. The applicant shall post a cash escrow, as specified by the development agreement, that will be released upon sign removal and as approved by City staff. 2. The grading, drainage and utility plans are subject to the review and approval of the City Engineer. 4 3. The proposed signage for the site shall be consistent with Section 401.15.G of the Zoning Ordinance. A sign permit shall be obtained prior to the erection of any signs on the subject site. 4. Landscape plans shall be subject to the review and approval of the City Arborist. 5. The applicant must submit updated lighting plans detailing the proposed parking lot and exterior building lighting, subject to City staff's review and approval. All lighting shall be full cut off fixtures and compliant with Section 401.15.6.7 of the Zoning Ordinance. 6. The applicant shall provide building material samples for Planning Commission and City Council review and approval. 7. A snow removal plan shall be submitted for City staff review and approval. 8. The applicant shall provide a plan indicating locations of mechanical equipment and screening subject to review and approval of City staff. 9. The applicant shall bury the overhead distribution lines along 60 Street North. The timing of that improvement shall be coordinated with the burying of distribution lines in front of Lowe's along 60 Street North. The applicant shall escrow sufficient funds, as specified by the City Engineer, to complete the improvement or agree that the City will complete the work and petition for the public improvement, waiving notice of public hearing and assessments, as required under Minnesota Statute 429. 10. The Wal Mart access agreement and easements shall be provided to the City Attorney for review and approval. 11. The final trail location and placement along 60 Street North shall be subject to review and approval of the City Engineer. 12. The plan is better and will complement the building and site more favorably. The shrubs have been decreased slightly, but a little more variety has been added. A nice addition is a shrub bed just north of the building which includes an ornamental crab. There are a few more trees in the plan now. A couple shrub beds in the east parking lot have been removed to widen the median on the east to accommodate 4 trees. This wider median will provide a better growing site for overstory trees. The medians at the south end of the east parking lot are too small to include 'Autumn Blaze' maples. A smaller - statured tree, which is also tolerant of de -icing salts, such as Japanese tree lilac, should be used in those medians instead.
