The Amended Conditional Use Permit and Design Standards/Site Plan is to allow the expansion of the building for a cooler and freezer as well as an update to the exterior of the building and site improvements. The Taco Bell was originally approved by the City Council in January of 1994. A Variance to allow at 97 square foot pylon sign was granted in March of 1994. EXHIBITS The review is based upon the following submittals: Exhibit 1: Project Narrative, Planforce Exhibit 2: Survey (SR1.0) Exhibit 3: Site Plan (C1.0) Exhibit 4: Photometric Plan (PM1.0) Exhibit 5: Existing Landscape Inventory Exhibit 6: Landscape Plan (L1.0) Exhibit 7: Floor Plan (A1.0) Exhibit 8: Exterior Elevations (A4.0) Exhibit 9: Exterior Elevations (A4.1) Exhibit 10: Colored Elevations (A4.2) Exhibit 11: Taco Bell Portal Elevation Exhibit 12: Taco Bell Outdoor Digital Menuboard (6 pages) Exhibit 13: Light Fixture Specifications (6 pages) Exhibit 14: Report of the City Arborist PROJECT DESCRIPTION The Project Architect has provided a narrative that describes the project in Exhibit 1. The project will consist of a remodel of the existing Taco Bell. A cooler and freezer addition is being added. The exterior parapets will be raised. A new brick exterior and new signage will be installed. New building and lot lighting will be installed. New landscaping will be installed. The interior of the building will have a new decor and interior finishes installed. The addition of an escape lane at the drive was looked at and found not to be feasible because there is not enough room between the building and property line. 20 foot minimum would be needed and there is 17 feet existing. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The Taco Bell restaurant is consistent with this land use designation. Zoning. The property is zoned B-2 General Business District. Restaurants are a permitted use but drive through and convenience food establishments are a listed conditional use. The changes to the building and site would require an Amended Conditional Use Permit. Section 401 .301.E of the Zoning Ordinance lists criteria for review of drive through and convenience food establishments. All of the issues raised in those criteria have been addressed in this report. The one item that should be reviewed carefully by the Planning Commission is the first criterion that specifies compliance with the Design Guidelines. Setbacks. Building setbacks required in the B-2 District include a 40-foot front yard, 10-foot side yard, and 20-foot rear yard. The building setbacks with the addition of the cooler and freezer are complaint with the Zoning Ordinance requirements. A ten-foot setback is required for parking and driveway areas. The west and north parking setbacks are compliant. The site as approved in 1994 included 5-foot parking and driveway setbacks on the south and east property lines, as was consistent with the regulations at the time. The location of the drive through is not changing with this remodel and is grandfathered. Building Height. The building height maximum in the B-2 District is 35 feet. At its highest point, the building will be 20 feet, six inches. Traffic Circulation/Curb Cuts. The site will be accessed by curb cuts at 60th Street St and Omaha Avenue North. There are no changes to the access with this remodel. 2 Parking. The following table provides an analysis of proposed and required parking spaces: Parking Area Required Requirements Spaces 1 per 35 square feet 823 X .9 = 741 SF dining/service 21 1 per 80 square feet 1,388 X .9 = 1,249 SF 16 kitchen/storage/misc. 2 spaces Drive-through window 2 TOTAL 39 Per ordinance, the site would require 39 parking spaces. Currently, there are 45 spaces, two of which are disability accessible. The current configuration and number of parking stalls will not be altered. In addition to the parking requirements, 180 feet of stacking space is required for the drive-through facilities. There is more than 200 feet of stacking space provided. The drive through and stacking area is not changed with this remodel. Landscaping. The submitted landscape plan is subject to City Arborist review and approval. City Arborist comments are found as an exhibit to this report. As part of the plans, three Spruce at the rear of the building and one Boxelder at the south property line are being removed while seven trees are to be protected and remain. The area around the building and throughout the site will be re-landscaped. Lighting. The submitted photometric plan illustrates light levels that exceed the maximum of .4 foot candles. The lighting must be revised, and a photometric plan must be submitted that complies with Section 401.15.B.7.d. This section reads: "No light source or combination thereof which cast light on a public street shall exceed one (1) foot candle meter reading as measured from the centerline of said street nor shall any light source or combination thereof which cast light on adjacent property exceed four- tenths (0.4) foot candles as measured at the property line." The light levels on the east and south property lines exceed the allowable light levels. The parking lot light fixtures, as provided in the application materials, are full cut off and are to be installed on the existing poles. Light standards may not exceed 25 feet from the ground surface to the top of the light fixture. The Applicant should verify the height of the existing poles and the total height with the new fixtures. The specifications for the exterior wall sconces indicate that the fixtures are not full cut off. The light source cannot extend below the shield. The lighting plan shall be revised to comply, subject to review and approval of City staff. Trash Storage. Plans are included for the trash enclosure and indicate materials and colors that match the Taco Bell building. 3 Mechanical Screening. Any exterior mechanical equipment, either on the roof or ground mounted will need to be screened in accordance with Section 401.15.E.10.e. of the Zoning Ordinance. The Project Architect has indicated that the mechanical units would be mounted on the roof and screened by the parapets. Noise. Sound levels from ordering and announcement equipment shall be in compliance with Section 401.15.6.11 of the City Zoning Ordinance. This section states that the emission of noise by any use shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Regulation NPC 7010, as may be amended. Grading, Drainage, Erosion Control and Utilities. Grading, drainage, erosion control, and utility plans are subject to review and approval by the City Engineer. Storm water issues are also subject to review and approval by the Middle St. Croix Watershed District. Signage. Freestanding Sign. The applicant has proposed that the existing freestanding sign at the front of the site remain as is. The sign is 96 square feet, but a variance was granted in 1994 to allow a 97-foot sign. The Zoning Ordinance would allow one freestanding sign at a maximum height of 20 feet. The Applicant should verify the height of the existing pylon. If over 30 feet, the City could require at this time that the Applicant reduce the height to a conforming 20 feet. The Planning Commission should discuss the sign height. Wall Signage. The total square footage of wall signage shall not exceed 150 square feet for the site. The total wall signage proposed is 66.6 square feet. There are two wall signs on each façade. Section 401.15.G.8.d.2) allows for an exception in numbers of signs on one façade by Conditional Use Permit if in accordance with Section 401.03 of the Zoning Ordinance. Staff does not see an issue with allowing two signs on each façade in that the signs are small, and the total wall signage proposed is 4 much less than what is allowed. From a distance, the signs would read as one sign. For other businesses along Highway 36, the City has granted Conditional Use Permits for numbers of allowable signs. Menu Boards/Directional Signage. The site plan does not include plans for any directional signage. The Applicant should verify if directional signage is to be used, and if so, provide a diagram that shows the location of all freestanding signage. The plans indicate a 10-foot portal at the entrance and an order board on the south east site of the drive through lane. The City shall determine the sound levels that are appropriate from the speakers and light levels from the order board. Sign Illumination. The wall signs are proposed to be lit with down lighting, up lighting spots and LED strips. The sign lighting shall be designed to comply with the Zoning Ordinance lighting requirements. Staff will approve the lighting specifications for the signs at the time of permitting. The spot fixtures and LED strips may be used if the lighting is directed at the sign and designed so that the light source is not visible. Design Guidelines Architectural Guidelines. Façade Treatments The building will have a definite base, middle and top. The façades feature differences in materials and brick colors to provide architectural interest. Ground Level Expression This is a one-story building with a raised tower feature at both entrances. The entrances are well defined by the awnings and signage. Transparency The building uses glass on all of the facades except for the rear. The Design Guidelines requires at least a 20 percent transparency on ground floor, street facing facades. The façade facing Highway 36 is 24.4 percent transparent. The façade facing Omaha Avenue North is 15.6 percent transparent. The Planning Commission should comment on the transparency. Entries The building features prominent entries with doors surrounded by glass, a canopy and signage above the door. Roof Design The roofline is broken at north and west elevations with raised parapets above the entry doors. 5 Building Materials and Colors The applicant has provided color elevations for review. The primary building materials of brick, glass, and EFIS are compliant with the standards. Building material samples will be available at the Planning Commission meeting. This should be discussed by the Planning Commission. Franchise Architecture The building is a franchise design, but it is consistent with the basic principles of the Design Guidelines. This should be discussed by the Planning Commission. Site Design Guidelines Building Placement The proposed building has well defined entrances facing Highway 36 and Omaha Avenue. The building is set back to allow for sidewalks and landscaping. Parking Areas The parking area is landscaped with perimeter plantings. Storm water Storm water will be addressed by the City Engineer. Pedestrian and Common Space Currently, there is a trail along 60th Street at this location. Landscaping Landscaping is provided around the perimeter of the parking lot and in the front of the building. Trees/Shrubs The trees and shrubs used in the landscape plan shall be subject to the review and approval of the City Arborist. Utilites/Service/Loading/Drive-Through/Storage Areas Addressed elsewhere in the planning report. Lighting Addressed elsewhere in the planning report. Signage Addressed elsewhere in the planning report. Pedestrian/ Bicycle Routes A trail exists along 60th Street North. A bike rack will be required. The plans indicate the location near the front entrance. 6 CONCLUSION / RECOMMENDATION Subject to the preceding review, City staff recommends approval of the following listed requests subject to the conditions that follow: • Amended Conditional use permit (CUP) for a fast food restaurant with drive- through. • Conditional use permit to allow more than one sign per building elevation. • Design Standards/Site Plan Review 1 . The applicant shall provide a revised photometric and lighting plan that complies with the provisions of Section 401.15.B.7.d of the Zoning Ordinance. All light fixtures shall be full cut off and compliant with the Zoning Ordinance. The parking lot lighting shall not exceed 25 feet from ground level. 2. All mechanical equipment on the roof or on the site shall be fully screened in accordance with the provisions of the Zoning Ordinance. 3. All noise generated from the store shall be compliant with Section 401.15.B.11 of the Zoning Ordinance. 4. All grading, drainage, erosion control, and utility plans are subject to review and approval of the City Engineer. Storm water plans are also subject to review and approval of the Middle St. Croix Watershed District. 5. The Planning Commission and City Council shall comment on the building design and building materials. The applicant shall provide building material samples for Planning Commission and City Council review. 6. The freestanding Taco Bell sign shall comply with the 20 foot signage height requirements of the Zoning Ordinance. 7. The plans should be revised to indicate details and location of any directional signage. 8. Outdoor lighting for the parking areas shall be turned off one hour after closing, except for approved security lighting. 9. No strip lighting of the building, canopy or freestanding sign shall be allowed. 10. All signs shall be designed to comply with the Zoning Ordinance requirements for illumination. The spot fixtures and LED strips may be used if the lighting is directed at the sign and designed so that the light source is not visible. Staff will review the lighting specifications at the time of permitting. 7 11. The landscape plan shall be subject to the review and approval of the City Arborist. 12. The following includes my comments and/or recommendations: Tree Inventory The plans submitted did not include a tree inventory table of all existing significant trees on site (please reference City Ordinance 1307 and pages 11-15 in the Development Application packet). The tree inventory should not be included in the Plant Schedule. The inventory should include tree ID, species, size (in DBH), notes, and if the tree will be removed or preserved. This must correlate to the plan submitted and is also needed to complete the tree replacement calculation if required. Please verify the sizes of all trees included since the sizes appear very large, I have included an example for the tree inventory below. Tree Protection A tree protection plan must be submitted with the final plans to protect the trees which are in close proximity to the construction zone. The fencing should be placed at the drip-line of trees to be preserved, and should be described in the tree protection specifications (including a diagram) (please reference City Ordinance 1307). Landscape Details and Notes The landscape legend shows a satisfactory choice of plants some native or improved cultivars of natives. Most of the trees and plants chosen are hardy under local growing conditions, relatively insect and disease free and fairly low maintenance. The following items must be addressed in the final plans: 1. The landscape contractor for the project is required to plant trees according to the approved planting detail submitted with the approved landscape plan. This will be checked after planting and any deviations from the detail will need to be corrected before the landscaping will be approved by the City. This needs to be included in the final submitted landscaping plans in the Landscape Notes section. 2. Please include the type of mulch and edging that will be used in the Landscape Notes section.
