CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY,MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST FROM MIDWEST RETAIL VENTURES LLC, OWNERS
OF THE STILLWATER CROSSING SHOPPING CENTER, FOR A
VARIANCE TO ALLOW TWO SIGNS ON ONE BUILDING
ELEVATION, LOCATED AT 14727 60th STREET NORTH BE
APPROVED WITH CONDITIONS
WHEREAS,the City of Oak Park Heights has received a request from Midwest Retail
Ventures LLC, owners of the Stillwater Crossing Shopping Center, for a Variance to
allow two wall signs on one building elevation for Good Times Tattoo and Lace Design
at 14727 60th Street North; and after having conducted a public hearing relative thereto,
the Planning Commission of Oak Park Heights recommended that the request be
approved with conditions. The City Council of the City of Oak Park Heights makes the
following findings of fact and resolution:
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting documentation
to the Community Development Department consisting of the following items:

and
3. The property is zoned B-2 General Business District in which the
shopping center is a permitted use; and
4. The sign regulations, in Section 401.15.G.9.c.3) specify that "Except as
provided for in Section 401.15.G.10 of this Ordinance, individual tenants of a multiple
occupancy building shall not display separate wall signs unless the tenant's business has
an exclusive exterior entrance. The number of individual wall signs shall be limited to
one (1) per entrance, and each sign shall be limited to the maximum wall sign allowances
permitted in the district. Tenants on building ends may have a maximum of two (2) signs
each to be located at the front and side elevations of the tenant space. The individual
signs shall be located only on exterior walls which they are directly related to the use
being identified."; and
5. The floor plan indicates that the two businesses will have one entrance;
and
6. A Variance is required to allow two signs for one building entrance, one
sign for Good Times Tattoo and another for Lace Salon; and
7. The design of the building will easily accommodate the second sign in a
separate building bay; and
8. City staff prepared a planning report dated May 2, 2019 reviewing the
request; and
9. Said report recommended approval of the request, based upon a review of
the Variance criteria found in Section 401.04 of the Zoning Ordinance, as well as the
fulfillment of conditions; and
10. The Planning Commission held a public hearing at their May 9, 2019
meeting, took comments from the Applicants and public, closed the public hearing, and
recommended the application with conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES
THE FOLLOWING:
A. The application submitted by Midwest Retail Ventures, owners of the Stillwater
Crossing Shopping Center, for a Variance to allow two wall signs on one building
elevation for Good Times Tattoo and Lace Design at 14727 60th Street North, should be
approved and affecting the real property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights
with the following conditions:
1. All proposed signage shall require a sign permit and shall be in compliance with
Section 401.15.G of the Zoning Ordinance for size and illumination.

Variance - Lapse of Approval:
Unless the City Council specifically approves a different time when action is officially taken on
the request, the variance shall become null and void twelve(12) months after the date of
approval, unless the property owner or applicant has substantially started the construction of any
building, structure, addition or alteration, or use requested as part of the variance. An application
to extend the approval of a variance shall be submitted to the Zoning Administrator not less than
thirty(30) days before the expiration of said approval. (401.04.C.4.1 and 2)
