The meeting was called to order at 7:03PM by Chair . John
McPherson . MOTION WAS MADE by O'Neal and SECONDED by Gates to
approve the minutes of the October 25. 1995 meeting .

TREASURER'S REPORT
O'Neal presented a written Treasurer 's report with a balance of
$2995. 17. It was MOVED by Schultz and SECONDED by Cobb to accept
the treasurer 's report subject to audit . MOTION CARRIED.
MOTION WAS MADE by Hanson and SECONDED by Schultz to pay the

The revised draft of the Joint Powers Agreement was distributed.
It was determined that each governing unit shall have until the
April 1496 meeting (April 24) to review and sign the JPA. The
original JPA shall be kept at the SWCD office and all
Mayors/Chairs shall sign three such documents in that office Cone
for the Attorney , one for the Secretary , and one for the SWCD) .
MOTION WAS MADE by Schultz and SECONDED by O 'Neal to approve the
revised JPA and the arrangement for signature . MOTION CARRIED.

Cobb stated that the monitoring of Lake McKusick by the Met .
Council has been confirmed at the $800 . charge .

MOTION- CARRIED.
PERRO CREEK/PERRO POND. Ken Hartung discussed the potential
problems still possible with overflow of Perro pond and
consequential flooding of property surrounding Pecro Creek . He
asked for interest in seeking RFPs on Option 5 of the original
Perro pond study to construct an outlet structure on the north
end of the pond. O'Neal thinks its important that we be
proactive and request RFPs along with assistance from the county •
and state .

subwatershed district of Stillwater . Baytown Township . Bayport
and Oak Pack Heights seek RFPs on Option 5 for Perro Creek .

Meeting was called to order by Chair Ann Terwedo .
Minutes accepted with the following corrections: Testing of McCusick Lake
thru the Met Council for $860. Motion made by Gates and seconded by Burton to
approve the minutes of the Oct. 26, 1994 Motion carried.
Treasures reportio3/9-•35 accepted and audit will be done by Feb. meeting.
Motion to accept made by Hansen, seconded by Gates. Motion carried.
Presentation by the representatives of Youngdahl Ins. regarding open
meeting coverage for the W.M.O. Policy is thru the League of Minnesota Cities
and basically the same as the city of Bayport. Motion to accept the General
Liability coverage and the Open Meeting coverage only made by O'Neal and
seconded by Schultz. Motion carried.
Discussion on the new formula for assessment of member municipalities led by
Ken Hartung and Tim Fredbo. New assessment sheets given to each member. No
motion
Discussion of need for administrative help from Mary Moga an intern with the
city of Bayport. Decided that we did not need anyone at this time. No motion
Introduce Nancy Schneider of Lake St. Criox Beach. Nancy will be co-
representative with Emerson Gates. No motion.
Discussion of signatures and designations:
Move to have Barb O'Neal and John ;McPherson as signatories on the
check book.. Made by Gates and seconded by Schultz. Motion carried.

Dear LaVonne:
. I am writing this letter to share a conversation I had with
Joe Gibson of the Department of Natural Resources. You may
recall, the City of- Bayport submitted, a Grant Application to help
fund the Perro Creek Study with the' DNR.. Mr. Gibson had
indicated there is a very good chance for the Perro Creek Study
to receive -a 50% funding from the DNR. Unfortunately, according
to Mr. Gibson, the 1993 floods have required the DNR to use their
Grant Funds for restoration and repair of flood damaged property.
Consequently, Mr. Gibson had indicated there is no chance for
funding the Perro Creek Study until April of 1994 .
Washington County is planning to go ahead with its
improvement of County Road 21. They will need the data
associated with the Perro Creek Study in early January or
February at the latest. Therefore, it is necessary that we move
ahead with the Perro Creek Study without Grant Funding.
Proceeding with the Study now will facilitate generating the data
required by the County to design the outlet structure on the
Prison Pond.
In previous discussions with representatives of
participating local governments, an Agreement had been reached
regarding the Study funding, if, Grant Funds were not available.
The Agreement-was reached at a sub Watershed Group .meeting
consisting of representatives of Oak Park Heights, Stillwater, _
Baytown Township and Bayport at Stillwater City Hall on
Wednesday, March 24, at 6:00 PM. Representatives of. each local
government agreed to the following funding allocation if a Grant
was not available:

Oak Park Heights 27,350.00
To facilitate going forward with the Perro Creek Watershed
Study, I would appreciate you forwarding to me a letter or a copy
of your local government's minutes indicating there is a
commitment by your local government to fund $27,350.00 e4 the
Perro Creek Study. I would appreciate your attention to this
matter at your earliest convenience.

Dear LaVonne:
The City of Bayport has been successful in acquiring a
,$16,500.00 loan from the Metropolitan Council for the first phase
of the Consolidation Study. I have enclosed a copy of the Loan
Agreement with this letter.
The City of Bayport is required to begin paying back the loan
:in equal payments _of $5,500.00 beginning on April 18, 1994, on
February 18, 1995 and on February 18, 1996.
The loan was for $16,500.00 and the actual cost of the Study
was set at $22,000.00. Therefore, it is necessary for the Cities
to cover $5,500.00 of the difference between the loan and the Study
cost during this year's budget. Based on the Agreement signed
between Baytown Township, the City of Bayport and the City of Oak
Park Heights, your total share of the Studycost is $11,200.00.
For convenience sake, weinto have broken it down 4 equal payments
of '$2,779.66. This year's fee also includes Oak Park Height's
share of the Application Fee required by the Met Council which was
$81.37. The total payment for this year combines the Application
Fee of $81.37 and the initial'payment of $2,779.66 for a total of
$2,861.03. I have also included a copy of the Memorandum of
Understanding Between the Cities of Bayport, Baytown Township and
Oak Park Heights regarding each local government's contribution to
the Phase 1 Consolidation Study. For your information, I have also
included a payment schedule for the Phase 1 Consolidation Study.
The City of Bayport would appreciate receiving a check for
$2, 861.03 as soon as Springsted, Inc. and Tautges, Redpath, Ltd. ,
bill the City of Bayport for the Phase One Consolidation Study. I
will be contacting you informing you of their billing date, so that
you begin to process a check for your contribution.

THE METROPOLITAN COUNCIL
AND
THE CITY OF BAYPORT
THIS AGREEMENT is made and entered into this day
1993, by and between the Metropolitan Council, hereinafter refer ed of
the City of Bayport, hereinafter referred to as the "Lendee." to as the "Council," and
WHEREAS, the Council is authorized by Minnesota Statutes, Section
to establish a planning assistance fund to assist local governments in
activities and to adopt uniform procedures for the award, disbursement 473.867,

contained in Appendix A, and with other provisions contained in this
Loan Agreement. It is further understood and agreed that the
costs and expenses shall be the only costs and expensespaid for out
of loan proceeds: out
1. Compensation of existing staff.

2. Compensation of newly hired staff.
3. Employment of a qualified consultant(s).
4. Payment of other costs such as overhead, rental of space and
equipment, purchase of supplies, printing and publishing.

A. The Lendee agrees to establish and maintain an accurate and
complete
separate control account for loan funds received, and to maintain
accurate and complete accounts and records relating to the receipt and
expenditure of any and all loan funds including, but not limited to
documentation and information relating to the selection and payment of
consultants.
B. The above accounts and records of the Lendee shall

Lendee's premises or otherwise by individuals or organizations
designated and authorized by the Council, following reasonable

B. Final Progress Resort. The Lendee agrees that upon

that:
1. The planning costs funded by this loan did not exceed
seventy-five percent (75%) of the total cost of the work program.
2. The scope of work was completed.
3. The terms of this Loan Agreement were met.
The final progress report is due December 17, 1993.
6. General Conditions
A. Duration. The period of loan award specified herein shall commence on
the execution of this agreement and remain in force and effect until
February 18, 1996.
B. Re a ment. The Lendee agrees to repay the Council in accordance
with the following schedule:
1. The Lendee will remit to the Council on or before February 18,
1994 an initial payment of $5,500.00.
2. The Lendee will remit to the Council on or before February 18,
1995 a second payment of $5,500.00.
3. The Lendee will remit to the Council on or before February 18,
1996 a final payment of$5,500.00.
C. Breach. In the event that the Council finds that there has been a failure
to comply with the provisions of this Loan Agreement, the Lendee
agrees to repay to the Council funds not used in accordance with this
Loan Agreement. These funds shall be repaid at an interest rate of 8
percent per year, compounded annually, from the date of the act which
was in breach of this Loan Agreement. In addition, the Council reserves
the right to take other action it deems necessary to protect its interests
in the event of a breach by the Lendee.
• D. Changes. The terms of this Loan Agreement may be changed or
modified by mutual agreement of the parties hereto. Such changes or
modifications shall be effective only upon the execution of written
amendments signed by authorized representatives of the Council and
the Lendee.
E. Nondiscrimination. The Lendee agrees to comply with all applicable
laws relating to nondiscrimination, affirmative action, public purchase,
contracting and employment.

MEMORANDUM OF UNDERSTANDING
PREFACE
Thecommunities of Bayport, Baytown Township and Oak Park
Heights have agreed to review the pros and cons of possible
consolidation, either in part or in whole between the three
communities. As a part of that process, an application has been
made to the Metropolitan Council for a local planning assistance
loan to assist the three communities in funding Phase I of the
consolidation study which is anticipated to cost Twenty Two
Thousand Dollars ($22,000.00) . The loan requested would provide
funding from the Metropolitan Council not to exceed Sixteen
Thousand Five Hundred Dollars ($16,500.00) . Additionally, the
terms of the loan are that it is to be repaid to the Metropolitan
Council over a period of three (3) without interest.
Each of the three communities have passed resolutions
authorizing the application for the loan to the Metropolitan
Council for the Phase I study of the consolidation proposal. Each
community has made a commitment to repay its fair share of the loan
and the cost of the consolidation study anticipated to be
,: approximately $22,000.00 with the allocation of the expenses to the
communities being prorated among them based upon population (less
prison population) using the 1990 census.
AGREEMENT
Based upon the foregoing, the communities herewith acknowledge
their individual responsibility for financial participation in the
Phase I study of the consolidation proposal in the following
amounts:

the three communities as part of the Phase I Consolidation Study.

We appreciate the opportunity to provide the Middle St. Croix Watershed Management
Organization with engineering services for the above-referenced project. The MSCWMO
agrees to furnish us with full information as to your requirements,including any special
considerations for the project.
Scope
Our services are defined in the attached "Scope of Work." Information/services to be
provided by the MSCWMO are also outlined.
Method of Compensation
For preparation of the items identified in the Scope of Work.Compensation will be based
on an hourly basis with a maximum of$54,664 using SEH's present multipliers.
SEH will be compensated for the hourly cost of personnel and reimbursable expenses
induding reproductions, mileage, and equipment utilization (computers, survey
equipment,and van, etc.).
Should additional services be required, we request that written authorization be given
prior to undertaking the additional work.Compensation for additional services will be as
addressed above.
Invoicing
We will invoice you monthly based on the Method of Compensation for all services.

SEH will start work on the work as soon as we receive authorization. Mapping and the
related surveys will take about two months.The study portion of the project will also take
approximately two months. If all goes well, the study should be complete by the end of
October 1993.

Modifications and Termination
This Letter Agreement, which consists of two pages, and attached Scope of Work the
entire understanding between the Middle St. Croix Watershed Management
Organization and SEH in respect to the project, and may only be modified in writing,
signed by both parties.This agreement may be terminated by either party upon seven(7)
days'written notice should the other party fail substantially to perform as outlined herein
through no fault of the party initiating the termination. In the event of termination, SEH
shall be compensated for services performed to termination date including all terminal
expenses.
If this document satisfactorily sets forth your understanding of our agreement,we would
appreciate your signing both copies of this agreement in the space provided below.

The meeting was called to order at 7: 10PM by Chair, Ann
Pung-Terwedo. MOTION WAS MADE by O'Neil and seconded by
Schultz to approve the minutes of the April 21st and June 23rd
meetings. MOTION CARRIED.
SPCPETAPY'S REPflPT
Cobb repotted that the St . Paul Dispatch , the official WMO
publication, ran the meeting notice at $6.40 per line (25
characters per line) or four lines at approximately $25.60 for a
one day publication. She will check into costs at the Courier.
Cobb reported receipt of a letter from the Met . Council regarding
their citizen-assisted LAKE MONITORING/TESTING PROGRAM for 1994.
Due to their budgeting process, they wanted " Interest" shown now
for the 1994 program which would include 14 sampling visits
(April thru Oct . ) plus equipment , lab analysis, and data reports
for an estimated $1000 per lake. Since the WMO's prior lake
water testing program fell through, she agreed to show interest
in testing Lake Mucusik and Lilly Lake on behalf of the WMO.
Members agreed with this show of " interest" and Shultz thought
she could find citizen volunteers.
TREASURER'S REPORT
Schultz presented a written Treasurer's report with a balance of
$4092.97 (which includes some monies of the sub-watershed for
payment of the Phase I study) . It was MOVED by O'Neal and
Seconded by O'Bryan to accept the treasurer's report . MOTION
CARRIED.
Schultz reported that statements for the 1993 WMO subsidy have
been sent and that to date, only Lakeland and St . Mary's Point
have not paid their portion
Schultz presented a 1992 audit option with the firm, Tautges,
Redpath & Co. , at a maximum cost of $500 . Schultz will contact
Dave Truax of Browns Creek WMO regarding a contact within the
state auditors office for an additional audit option.
FERRO CREEK REPORT
Fredbo stated that now that matching funds within the WMO have
been secured, he will meet with Ken Hartung, Bayport , to prepare
the DNR grant application .

Both Schultz and O'Neal stated that they want a DETAILED contract
from SEH with specifics and itemized costs. The sub-watershed
will need to meet to approve the SEH contract through formal
motion. The Oak Park Heights lawyer will review the contract on
behalf of the sub-watershed. No formal date was set, but Fredbo
will contact Jeff Davis, SEH, to arrange contract preliminaries.
O'Neal reported that the County may put in gravity outlet
overflow pipes when redoing Cty. road 21 , although no formal
presentation has been made by the county to the cities effected.

Fredbo will prepare a model joint powers agreement including the
new BWSR requirements for the June meeting.
He presented a sheet on the Annual Reporting requirements and
discussion followed on who would undertake specific areas.
Cobb will handle the organization's board member listing,
advisory committee members ( NEED MOTION IN JUNE - initially
suggest Ken Hartung, OPH lawyer, need citizens-at-large, etc. ) ,
organization's employees & consultant and the assessment of the
previous years annual work plan that indicates whether goals &
objectives were achieved.
Fredbo will handle a summary of permits reviewed (#E) and local
plan adoption status (#G) .
#D, a projected work pian for 1994, will be finalized at the June
meeting from a list provided by Fredbo, as well as the operating
budget for 1994, including capital improvement budget if
necessary.

The Middle St . Croix Watershed Management Organization,
Perro Creek Subwatershed, directed me to write you
concerning the current status of the Perro Creek Study
financing arrangement. This situation was discussed at
their last meeting on March 24 , 1993 .
I understand that your city council has adopted a resolution
approving the study by SEH, Inc. and agreeing to pay
$24 , 193 .48 . The Town of Baytown has only agreed to finance
the study for $12 ,000 .00 . This leaves the Perro Creek
Subwatershed Group approximately *6, 300.00 short of the
projected study cost.
The City of Bayport proposed that Bayport and Oak Park
Heights equally share the additional cost needed for the
study. This necessitates an additional $3 ,150.00 needed
from Oak Park Heights. Please consider this request and
notify me as to whether or not your City will agree to pay
this additional amount.

January 27, 1993
A workshop meeting was held with the cities of Bayport, Oak Park
Heights, Baytown Township, and the Middle St . Croix Water
Management Organization. The meeting was called to order by
Councilmember Funke at 7 : 00 p.m.

The purpose of the meeting was to discuss the Perro Creek/Pond
Improvement Project . Tim Fredbo explained the background of the
water management plan. The Middle St. Croix WMO agreed to study
the Perro Creek/Pond problem as a condition of approval of its
plan. The WMO contracted with Jeff Davis of SEH to assist in the
study.
Mr. Davis presented a history of the problems associated with the
creek . A study undertaken by SEH in 1988 revealed numerous
inadequate culverts . Washington County is currently considering
reconstruction of County Road 21 in the area along Perro Pond .
Mr. Davis discussed five project options, and estimated costs
associated with the study. The cost would be shared among the
four municipalities involved, according to acreage . He also
stated that a grant from the DNR may be available for one-half
the cost of the study.
Motion by Mayor Schultz, seconded by Mayor O'Neal to present the
proposal to the involved cities for approval of the study, the
funding amount, and the grant application. All in favor .
Motion by Mayor O 'Neal, seconded by Mayor Schultz to set the next
meeting of the Middle St. Croix WMO for Tuesday, February 23, at
Hooley Hall in Baytown. All in favor .
Tim Fredbo will submit the grant application.

The local governments of Baytown Township,
Bayport , Oak Park Heights , and Stillwater , are
giving consideration to participating in a
Scoping Study for Perro Creek . The Middle St .
Croix Watershed Management plan requires all
local units of government to prepare and up-
date local watershed plans and the Perro Creek
study is an integral part of the local manage-
ment plan that is causing concern for our area.
The cost of the study is expected to be
approximately $74 ,000 with each local municipality
expected to contribute a dollar amount based on
acreage in and near the Perro Creek collection
area irregardless of the type of local development
that may enhance runoff rates and amounts . Baytown
has concerns about the high cost of the study for
our rural acreage with natural saturation and ponding
areas as opposed to an area with development like
Oak Park and Stillwater.
Since the old Prison Pond is involved and the -"' \ Komi 4,1.0
improvement of Washington County 21 is planned, we
would like Washington County input and an attempt at / w""'"- 2
coordinating the road and watershed plan in an
an effort to maximize resources .

discussion centered on what would be the minimum amount of
the proposed study that we could do to just design a
structure under Co . Rd . 21 . Jeff Davis, SEH Inc . , stated
that as a minimum we would need to do items 1 , 2, and a
portion of item 3 (approximately $3500.00) as listed in his
letter to me of January 29, 1993.
These three items consist of the contour mapping, the
givens, and that portion of Option 1 that looks at
increasing storage in Prison Pond by raising the road or
building a berm to keep road from overtopping. The cost of
this proposal would be $54,664.00
Listed below are each communities cost based on your acreage
in the Perro Creek subwatershed. $54,664 divided by total
acres in the watershed ( 1646 acres) comes out to $33.21 per
acre.

HELD ON FEBRUARY 1, 1993
Pursuant to due call and notice therefore, a regular meeting of the
City Council of the City of Bayport, Minnesota was duly held at the
Bayport City Hall in said municipality on the 1st day of February,

RESOLUTION, CITY OF BAYPORT, WASHINGTON COUNTY, MINNESOTA,
AUTHORIZING THE PERRO CREEK SCOPING STUDY BE CONDUCTED BY SHORT
ELLIOTT HENDRICKSON, AUTHORIZING THE CITY'S PARTICIPATION IN THE
SCOPING STUDY AND AUTHORIZING THE PREPARATION OF A MINNESOTA
DEPARTMENT OF NATURAL RESOURCES FLOOD DAMAGE/HAZARD REDUCTION GRANT
APPLICATION.
WHEREAS: The City of Bayport is a member of the Middle St. Croix
Watershed Management Organization, and;
WHEREAS: The Middle St. Croix Watershed Management Organization
adopted a Watershed Management Plan dated September 11,
1991, and;
WHEREAS: The Middle St. Croix Watershed Management Plan requires
local units of government to prepare or update local
Water Management Plans, and;
WHEREAS: The Perro Creek Scoping Study is an intrecal part of the
local Water Management Plan.
NOW THEREFORE BE IT RESOLVED: By the City Council of the City of
Bayport as follows:

BACKGROUND INFORMATION
The St. Croix Watershed Management Plan was adopted on
September 11, 1991. The St. Croix Watershed Management
Organization (MSCWMO) requires participating local governments to
prepare or update local water management plans. To date, the City
of Bayport has not addressed a specific local water management
plan.
One of the major watershed components within the City of
Bayport, is drainage of the Prison Pond through Perro Creek, which
runs through the City of Bayport. In 1973, water draining from the
Prison Pond into Perro Creek, caused flooding conditions of
individual's properties adjacent to Perro Creek. Following the
flooding, property owners went to District Court to force the City
to find a solution to flooding. The District Court issued an
injunction prohibiting the City from increasing water flow volume
in Perro Creek.
In addition to controlling the volume of water flowing in
Perro Creek during the summer, the City is faced with ice buildup
in Perro Creek during the winter which can cause flooding of
private property and residences. In past winters, the City has been
able to prevent water from coming down Perro Creek by having the
Prison engage a pump on their site drawing water from the Prison
Pond and dumping it into a storm sewer on the Prison property.
However, in the winter of 1992, the pump failed to operate and has
not operated since. Consequently, the only way to prevent the
Prison Pond from overflowing County Road 21, is for the City to
operate Perro Creek on warm winter days, to prevent the pond from
overflowing. To date, the City has been very fortunate because we
have had some unusually warm winter days allowing us to draw down
the Prison Pond. The arrangement we currently have is a disaster
waiting to happen. If we are not able to intermittently run the
Creek during warm winter days, the Prison Pond would eventually
overflow County Road 21 and we would lose all control of water
volume coming down Perro Creek. Additionally, if this were to
happen on a cold winter day, we would experience icing in Perro
Creek causing the Creek to flow out its channel and flood private
homes.

To help address this problem and to address an important
element of the City's local water management plan, the City of Oak
Park Heights, Baytown Township, Stillwater and Bayport are
considering undertaking a joint Perro Creek Scoping Study. The
Middle St. Croix Watershed ManagementOrganization has been meeting

has been working with Jeff Davis of Short, Elliott,
Hendrickson to define the work task and cost of Perro Creek Scoping
Study. The purpose of the study is to define feasible methods to
maintain a relatively consistent level of Perro Creek Pond during
all times of the year. As part of the Perro Creek Scoping Study,
the MSCWMO has identified a set of basic tasks (givens) which must
be completed along. with 5 options to maintain a constant level of
the Prison Pond. The summary of the givens and options follows:
I. Givens.
A. Develop contour mapping.
SEH currently has a U.S. Geological maps which
have a scale of 1 inch equals 2, 000, with 10 foot
to 20 foot contour lines. To do a accurate job of
determining the watershed area and water flow rate,
it is necessary to develop new contour maps which
would have a scale of 1 inch equals 100 feet and
have contour intervals of 2 feet.
B. Hydrology/Hydraulics Analysis.
1. Run off characteristics.
2 . Rainfall events.
3 . Culvert and ditch capacities.
4 . Water surface profile.
5 . Field surveys.
6 . Design new outlet for Prison Pond.
7 . Look at 5 and 10 year storm for the Minnesota
Department of Natural Resources.
8 . Design ditch for 100-year Type One AMC-2
Precipitation Event.
Ii. Options
A. Option 1.\
1. Review capacity of existing culverts and ditch
in Perro Creek from the Prison Pond to the
intersection of 2nd Street North and 3rd
Avenue North.
2 . Make recommendation for improvements on
culverts and ditches related to Perro Creek as
defined in No. 1.

3 . Perform a Phase One Environmental Site
Assessment on the Trinity Lutheran Church

would be required to cross Trinity Lutheran
Church's property.
4. Construct a preliminary operation plan based
on the feasibility of a gravity or pump

Church site to determine the feasibility of

COST ALLOCATION FOR PERRO CREEK SCOPING STUDY
The MSCWMO determined the most equitable way to finance the
study would be to apportion costs to the respective four
communities of Stillwater, Oak Park Heights, Baytown Township and
Bayport based on each communities watershed acreage contributing to
Perro Creek Watershed. Based on the analysis completed by SEH, the
following table lists the community and the number of acres
contributing to the Perro Creek Watershed.
1. Bayport - 300 acres
2 . Baytown - 551 acres
3. Oak Park Heights - 728.5 acres
4. Stillwater - 66 acres
The total Perro Creek Watershed acreage is 1, 645 .5 acres. The
per acre cost of the Study is determined by dividing the overall
cost of the Study, $73,769.00, by the total Perro Creek Watershed
acreage of 1, 645 .5 acres which equals a cost of $44 .83 per acre.
To determine each community's cost, I have constructed Table

2 . Table 2 illustrates the total cost of the Study to each City
along with the reduced cost to each City, if the Cities are
successful in applying for a DNR Grant to fund 50% of the project.

To help reduce the cost of the Perro Creek Scope Study, the
MSCWMO has explored the possibility of this Study receiving
Minnesota Department of Natural Resources Grant money for upto 50%
of the cost. At the MSCWMO meeting of November 4, 1992, Joe Gibson
of the DNR, explained the Flood Damage/Hazard Reduction Grant
Program to members of the Organization. He indicated, he believed
this Study has a good possibility of receiving Grant money from the
DNR. He noted, it would be necessary for the local governments to
complete an application to seek 50% funding for the Perro Creek
Scoping Study. He noted the application would need to be completed
in March or April and Grant funding would be determined in June or
July of 1993 . The MSCWMO has gone on record as supporting a Grant
application for the Perro Creek Scoping Study and has asked Tim
Fredbo of the Washington County Soil and Water Conservation
District to prepare the Grant application if all the local
governments authorize its preparation.
Representatives from Baytown Township Board, Stillwater City
Council, Oak Park Heights City Council and Bayport City Council met
at a Special Meeting at the Stillwater City Hall on Wednesday,
January 27, at 7 : 00 PM. The purpose of the meeting was for these
representatives to hear a presentation made by Jeff Davis of SEH.
Mr. Davis gave a history of Perro Creek and its Watershed area,
along with indicating problems associated with how the Perro Creek
Watershed area presently functions. Mr. Davis also outlined the
rational for a Perro Creek Scoping Study along with the Study
components and Options . Following Mr. Davis' presentation, the
members in attendance adopted a motion to ask the local governments
of Stillwater, Baytown Township, Oak Park Heights and Bayport to
adopt a resolution which would include the following:
1. Authorize SEH to conduct the Perro Creek Scoping Study
for a total amount not to exceed $73, 769.00.
2 . That each community commit to paying their share of the
Perro Creek Scoping Study, determined by a cost
allocation based on the number of Watershed Acres in each
community times an acre unit cost.
3. The local government authorize Tim Fredbo of the

Washington County Soil and Water Conservation District,
prepare a Minnesota Department of Natural Resources Flood
Damage/Hazard Reduction Grant application on behalf of
the City.
PRESENTATION OF FERRO CREEK STUDY
I recognize that some Councilmembers have not been heavily
involved in discussions of the Perro Creek Scoping Study. For the
benefit of Councilmembers and for residents in the community, I
will be reviewing the Perro Creek Scoping Study, its rational and
its Study components at the Council Meeting on Monday evening,
February 1.
REQUESTED COUNCIL ACTION
At this evening's Council meeting, I am asking the Council to
take specific action on the following items.
1. Authorize SEH to complete a Perro Creek Scoping Study for
a price not exceed $73,769.00.
2 . To authorize Bayport's contribution to be $13,450.00.
3. - To authorize Tim Fredbo of Washington County Soil and
Water Conservation District to prepare and submit an
application for a Minnesota Department of Natural
Resources Flood Damage/Hazard Reduction Grant on behalf
of the City of Bayport.
RECOMMENDATION
I recommend the Council adopt the attached resolution,
authorizing Perro Creek Scoping Study, authorizing Bayport's
participation in the Perro Creek Scoping Study cost at $13,450.00
and authorizing Tim Fredbo of the Washington County Soil and Water
Conservation District to prepare and submit a Minnesota Department
of Natural Resources Flood Damage/Hazard Reduction Grant on behalf
of the City of Bayport.
