Page 7 of 50 CITY OF OAK PARK HEIGHTS CITY COUNCIL WORKSESSION NOTES TUESDAY,JULY 23,2019 Present: Mayor McComber, Councilmembers Dougherty,Johnson, Liljegren and Runk; City Administrator Johnson; City Attorney Sandstrom; City Engineer Mann; Finance Director Caruso; Police Chief DeRosier; Public Works Director Kegley and City Clerk Pinski. Absent:None, 1. Call to Order: Mayor McComber called the meeting to order at 5:00 p.m. 2. 2020 Budget: Finance Director Caruso provided a report on the overall preliminary 2020 budget. Chief DeRosier reviewed the proposed Police Department budget and Public Works Director Kegley reviewed his department budgets. Mayor McComber suggested that Kegley look into sharing street sweeping services with Bayport. McComber also suggested that exercise equipment in a city park could come from park dedication. She said to take that out of the budget. She also requested the conference fee for the Mayor/Council budget be increased by$2,000. Councilmembers Runk and Dougherty wanted to leave it at$10,000. Councilmember Liljegren suggested allowing the increase of$2,000, but it would be the first line item to be cut if the budget needed to be adjusted. Caruso asked if the City Council wanted to leave the Youth Service Bureau grants in the budget. McComber said to leave it but revisit it if cuts needed to be made, Councilmember Runk suggested setting aside the entire cost of a copy machine. He also said the watershed budget was increasing by nine percent. Caruso reviewed the tax impact worksheet. No action was taken. 3. 90-Gallon Solid Waste Container: City Administrator Johnson said the City could save approximately$15,000 if they created a policy to try to reduce the number of households with a large trash container. McComber said that could create a problem with people putting their garbage in the recycling bin, so the City should focus on education if the change was made. Councilmember Dougherty said the change could encourage people to recycle more. Councilmember Runk said he thought the City should institute a policy effective the first day of 2020. Councilmembers Liljegren and Dougherty and Mayor McComber agreed. Councilmember Johnson said she would like the status quo and to offer an incentive instead. Runk requested the item be placed on the next City Council agenda. No action was taken. 4. 2019 City Goals Update: This item was placed on the City Council agenda for that evening instead of being discussed in the Worksession. 5. Staff present: City Administrator Johnson, City Clerk Pinski, City Attorney Sandstrom, Police Chief DeRosier, City Planner Richards, and City Engineer Mann. Absent: None. Ma or McComber: She reported last week she attended the Regional Council of Mayors meeting with Superintendent Pontrelli, the NLC Transportation and Infrastructure Committee conference call, the LMC Improving Local Economies meeting, and the League of Minnesota Board of Directors meeting. She also reported the following week she would be attending a NLC Transportation Committee conference call, a historic preservation tour,the MetroCities Transportation Policy Committee meeting, Center for Energy and Environment interviews regarding the King Plant, the new MCF-Stillwater warden reception, the Minnesota Mayor's Association executive committee meeting, meetings on the Xcel Integrated Resource Plan, an open house at Oak Ridge Place on August 26. She also said the Wall of Healing would be at the old athletic field the following week, and the JAZB was seeking a citizen alternate. B. Councilmember Dou e :No report. C. Councilmember Johnson: She reported she attended the Browns Creek Watershed District meeting,the LMC Improving Service Delivery Policy Committee meeting, and the Parks Commission meeting. She also reported that the 60'h Anniversary event was scheduled for August 15, 2019 at Autumn Hills Park. D. Councilmember LilieUen:No report. E. Councilmember Runk: No report. F. Staff. City Clerk Pinski reported that Tom Walberg of 5565 Oakgreen Avenue North and Chris Zeuli of 5681 Novak Avenue North were chosen as the recycling award winners for July. Old Business: A. 5627 Perkins Ave—Site Conditions/Action: City Administrator Johnson reported that the deadline for repairs had passed, and there was a Contract for Deed for the renter who was now the owner. He suggested extending the deadline to September 30, 2019 to work with the new owner. Councilmember Runk, seconded by Councilmember Johnson, moved to extend the deadline to September 30, 2019. Carried 5-0. B. 2019 Cily Goals Update : City Administrator Johnson reviewed the spreadsheet he provided to the City Council. The City Council gave him direction on the DNR boat ramp issue.No action was taken. VII. New Business: A. Approve the Listing Agreement with Telus Propert_ Services for the"Bell Pro e�rty" located at 5416 Stagecoach Trail: City Administrator Johnson reported that the City received a new listing agreement with the same agent under a different agency that would expire June 18, 2020. Councilmember Runk said the City may want to look into listing with the same agent who was listing the bus garage site. Councilmember Runk, seconded by Councilmember Liljegren, moved to table the agenda item. Carried 5-0. B. Provide Letter of Su ort—Washinglon County—TED Grant Application: Councilmember Runk, seconded by Councilmember Johnson, moved to direct staff to send the letters. Carried 5-0. Swing Set Installation—Cover Park: City Administrator Johnson reported that the City received a request from a resident for a swing set at Cover Park, and he secured a quote for the equipment and would obtain a second quote. Mayor McComber said funding could come from the park dedication fund. Councilmember Johnson, seconded by Councilmember Liljegren, moved to authorize the installation. Carried 5-0. VIII. Other Council Items or Announcements: None IX. Closed Session - closed pursuant to MN Stat. 13d.05. City Attorney Sandstrom reported that the City Council would go into a closed session to discuss two items: a pending lawsuit filed under seal by Kleiber and the City Administrator annual performance review. Councilmember Johnson, seconded by Councilmember Dougherty, moved to close the meeting at 7:05 p.m. Carried 5-0. Page 15 of 50 r� City of Oak Park Heights 14168 Oak Park Blvd Me Oak Park Heights,MN 55082•Phone(651)439-4439•Fax 4390574 Memorandum To: Eric Johnson,Administrator Cc: Mayor and Council From: Andrew Kegley, Public Works Director Dater 08/20/19 Re: Kern Lift station Pump Replacement In the spring of 2019,the City contracted with Electric Pump to have all lift station pumps pulled and inspected for preventative maintenance.The report indicated that the Kern lift station had badly worn impellers and bases. When Minnesota Pump was in town replacing pumps at Kruger Lift station,we had them pull the pumps at the Kern Lift station for a second opinion; MN Pump's crews had the same opinion as EP's.Staff requested quotes from both Electric Pump and MN Pump, but Electric Pumps quote was overly expensive, and working with their staff at Sunnyside has been less than positive.Therefore,we opted to negotiate with Minnesota Pump. The pumps at Kern were installed in 1999,so they have roughly twenty(20)years of service. Given the age of the pumps and the bases, the exact parts are no longer available. Minnesota Pump offered a quote to replace the impellers and install a used base and a manufactured base for$15,372 not including labor. New pumps with new impellers and new bases was quoted for$17,113, including the labor to install. It is a good possibility that the labor to remove the old equipment and install bases and impellers will bring the cost to replace only the impellers and bases higher than purchasing new pumps with all new equipment. Ultimately, replacing the entire pump and bases with new equipment is more economical and an advantage to the City.This is the option the City should choose.The pumps should be replaced while they are still pumping sewage, rather than deferring the work until it becomes a costly emergency situation. Funding to replace the pumps should come from the$348,740 that remains from the Met Council refund. Staff would propose an initial pay rate of$64,425 per year which is 85% of the current full wage for the position. The full wage would be implemented in two steps over the next 24 months. This is a NON- UNION,Non-Exempt position. Ms. Zegarski did sign all requested documentation including a tentative Position Offer—(See attached). The Applicant is asked to execute such Offer sheet so that the City may have some further assurance that the applicant will ultimately accept the position. Mayor ATTEST: City Clerk Page 32 of 50 MEMORANDUM OF UNDERSTANDING Concurrent Detachment and Annexation Cities of Oak Park Heights and St INMer The Cities of Stillwater and Oak Park Heights have a mutual interest in the detachment and annexation of certain lands which provides reasonable benefits to each city. The following terms outline commitments and timelines upon which both parties can rely to contemplate and complete such transfers in a timely fashion. The Parties Agree as Follows: 1. The City of Stillwater will detach parcels/lands listed or shown in Exhibit A for concurrent annexation into Oak Park Heights. The City of Oak Park Heights will detach parcels/lands listed or shown in Exhibit B for concurrent annexation into Stillwater. 2. Pursuant to the Oct. 4th, 2005 Washington County Government Center Agreement- Sec. 111, Part 6, Oak Park Heights will also detach the parcel shown in Exhibit C for concurrent annexation into Stillwater. The PID for this parcel is#3403020330106. 3. The City of Stillwater commits and warrants to Oak Park Heights that should any redevelopment,expansion or change of use be sought upon lands lying east of Ozark Ave, West of Panama Ave and South of Orleans Street the parties agree that: a. INGRESS or EGRESS access may remain from Ozark to serve existing residence at 1495165th Street. b. At such time as the property at 14951 651h Street and/or upon directly adjacent lands lying west of Panama Ave and south of Orleans St. is sought for expansion or redevelopment, all access to Ozark Ave shall be removed and substantial berms and/or other landscaping shall be installed to prevent alteration and access. Landscaping, including for example low berms, evergreen trees and other traditional screening shall be installed along the westerly side so as to provide further visual buffers to the residential areas. c. At the time of redevelopment (or any replacement of fixtures) all building and site lighting shall and compliant with both cities lighting regulations—whichever is more restrictive, including the use of"full- cut off"lighting. d. There shall remain a minimum 30'buffer from the eastern ROW line of Ozark Ave and no development may occur in in this area—(See Exhibit B)and shall remain as a wooded 1 natural area.This area also contains a stormwater basin that serves both OPH and STW and which shall not be altered without further written agreements. The eastwardly limits of this buffer area is approximately 60'from the center line of the Ozark Ave roadway. e. Any storm water improvements from the Ozark and 64th Street drainage district shall be cost shared between both Cities based on the contributing drainage area from each respective City. 4, The City of Oak Park Heights commits and warrants to Stillwater that all lands transferred into Oak Park Heights shall remain in public ownership and that the City of Stillwater is not responsible for any further site maintenance of these parcels. 5. The City of Oak Park Heights shall assume all maintenance of the trail-way located along the eastern side of Lookout Trail relieving Stillwater of this specific obligation that may be found in the MOU Agreement dated 918/06,Part 8.Sec.a and/or its subsequent Agreements being MNDOT Contract No.01433 and Mn DOT Contract No.04958.The August 22,2019 Page 33 of 50 City of Oak Park Heights shall work with Stillwater to initiate any necessary amendments with MNDOT regarding these agreements. These Agreements are incorporated by reference. In all cases, except for this specific trail area along Lookout Trail all other responsibilities found the Agreements remain with the City of Stillwater. 6. Subject to the approval of the Oak Park Heights City Engineer,the City of Oak Park Heights shall provide access to its sanitary, storm and water systems for any further redevelopment of the properties located at 6450 Panama Avenue,375 Orleans St East and 1495165m St,but such access shall be consistent with other policies and regulations that are in effect in Oak Park Heights.Any access to Oak Park Heights utility systems shall be subject to the review and approval of the Oak Park Heights City Engineer, but may not be unreasonably conditioned, withheld or delayed. The Developer of such lands shall be responsible to cover any Oak Park Heights costs, fees or permits typically required under Oak Park Heights regulations should access be sought. 7. There are no supplemental payments,transfer of taxation capacity or special assessment privileges provided for in this MOU. 8. The Public Works Department for both Cities agree to meet and discuss routine maintenance responsibilities of Ozark and 64th,Streets including street sweeping, pot hole patching and snow and ice control. Street rehabilitation or reconstruction project cost shall be split 50%150%. 9. Oak Park Heights shall be the lead agency and shall initiate and proceed with the annexation and detachment process with the Office of Administrative Hearings. Stillwater shall cooperate with Oak Park Heights throughout the process.The Cities shall negotiate and finalize a Detachment&Annexation Resolution to be adopted by both parties. Until recently Stillwater has been reticent to detach such parcels; we understand that there may have been some confiision on what was being asked of them from the State relative to other maintenance of these lands not being part of any roadway. At this time, with a possible Canvas Health project near Panama Ave. in the offing, respective Staff has had some dialogue where there could be a transfer of jurisdiction of lands that each City might desire. The lands being exchanged are all"Tax Exempt"(see tax reports attached).Further we have clarified that UNDOT would still be responsible for management of its own lands(not in the ROW), as the land ownership is not changing,only its jurisdiction. To move the project forward and implement a boundary adjustment both parties must agree to such exchange and pass relevant resolutions and submit to the State of Minnesota.
