RE: Xcel Ener — Fill Permit CUP Re — Road Construction
Summar
Xcel Ener has submitted a plan to construct a new roadwa near their northerl entrance, please see
Exhibit I - the area is zoned Industrial. The Purpose of this new roadwa is to better facilitate the
movement of material and personnel between the main power plant area and the "la down" area l to
the north without bein encumbered b railroad tracks and the coal trains that can stack across their current
drives den them access to the la down area. The la down area is utilized to store e and will
eventuall hold a 4,000 s foot warehouse-t facilit

Upon review of the submitted information, there appears not to be an detrimental social, economic or
environmental impacts and that Staff recommends that the Conditional Use Permit be approved as
re b the applicant with the followin conditions:
Xcel Ener must provide a specific wetland inventor / wetland surve as well as a "Notice
of Wetland Conservation Act Decision" which must state that the wetlands, ( if an that are to
be filled in, are "incidental" and not naturall occurrin wetlands; Or the Notice of Wetland
Conservation Act Decision must make an alternate determination that the wetlands are subject
to wetland restrictions and Xcel Ener shall submit for Cit review a full wetland inventor
and remediation plan for review. Xcel must then implement such plan with conditions as
specified b the Cit En prior to the commencement of an roadwa construction
activities.
2. Final draina plans and desi shall be subject to the final review and approval of the Cit
En
3. Xcel Ener shall submit draina plans to the Middle St. Croix Water Mana
Or for final review, once comments are provided Xcel ma then potentiall
proceed. Comments received shall be provided to the Cit prior to the commencement of
roadwa construction
4. Xcel Ener shall submit draina plans to Minnesota DNR, Ms. Moll Shodeell for review,
once comments are provided Xcel ma then potentiall proceed. Comments received shall be
provided to the Cit
5o Prior to roadwa construction Xcel Ener pa the Cit the re tree replacement fee, as
calculated b Cit Arborist Kath idln, of $2,0W
6. Barbed-wire must be eliminated from the proposed g ate/fence.

Sharon -
Thanks for sending me this information. Yes, this is sufficient for the project and I
do not need to make a site visit. Is Xcel planning to plant new trees on the site? I
thought that is what they did for the last tree removal at the King plant rather than
sending the city a check for replacement trees. The city would probably prefer re-
planting by Xcel on site or even planting the replacement trees near the 58th St. cul -de-
sac by the ash landfill. Let me know what they would like to do.

In response to y ou letter dated Ma 20, 2005 enclosed are our responses.
1. Attached are 3 full size and 20 11 x17 copies re topo drawin
These show the proposed road ali and road cross-section.
2. We have completed a tree surve in the impacted area and found the followin
a. 1 g reen ash - 11" dbh
b. 9 black willow — (121) dbh) 10.5" dbh, 12" dbh) 9" dbh, 1313 dbh, 1059 dbh, 11
dbh, 10" dbh, 1499 dbh
c. All the aspen in this area are diseased.
d. The two scotch pine to be removed are under 10 feet tall.
Xcel Ener will calculate the value of these trees per the Ordinance and will submit
pa after the trees are removed. This information was discussed with the Cit
Arborist. An e-mail is attached that documents the communication.
3. We are currentl assessin the area impacted b this chan as related to the
Wetlands Conservation Act. We will submit the determination at a later date.
