A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST BY BOO BOO'S GARAGE FOR A CONDITIONAL USE
PERMIT TO ALLOW A PRIVATE AUTO CLUB WITH AUTO
SALES, MINOR AUTO REPAIR AND OUTSIDE STORAGE AT 5899
NOVA SCOTIA AVENUE NORTH BE APPROVED WITH
CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from Boo Boo's
Garage for a Conditional Use Permit to allow a private auto club with auto sales, minor
auto repair and outside storage at 5899 Nova Scotia Avenue; and after having conducted
a public hearing relative thereto, the Planning Commission of Oak Park Heights
recommended that the application be approved with conditions. The City Council of the
City of Oak Park Heights makes the following findings of fact and resolution:
I. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting documentation
to the Community Development Department consisting of the following items:

3. The property is zoned B-4, Limited Business District. Indoor auto sales is
a Permitted Use but a Conditional Use Permit is required to allow minor auto repair and
outdoor storage; and
4. The minor auto repair will involve oil changes, tire service and car
washes, which is allowed under the definition of minor auto repair; and
5. The Applicant has proposed parking a 28 -foot enclosed trailer in the
parking lot, which is considered as outdoor storage. No other outdoor storage of auto
parts or trash/recycling is proposed; and

6. Design Guideline/Site Plan approval is not required in that no exterior
building or site changes are proposed; and
7. City staff prepared a planning report dated September 6, 2019 reviewing
the request; and
8. Said report recommended approval of the Conditional Use Permit subject
to the fulfillment of conditions; and
9. The Planning Commission held a public hearing at their September 12,
2019 meeting, took comments from the applicants and public, closed the public hearing,
and recommended the application with conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES
THE FOLLOWING:
A. The application submitted by Boo Boo's Garage for a Conditional Use Permit to
allow a private auto club with auto sales, minor auto repair and outside storage at 5899
Nova Scotia Avenue and affecting the real property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights
subject to the conditions as follows:
1. A rapid entry lock box shall be installed at the entrance gate to provide
police, fire and emergency services access.
2. The Applicant shall provide a structural plan for the wood access ramp
that has been installed.
3. All new lighting fixtures shall be full out off and installed in compliance
with the lighting standards of the Zoning Ordinance.
4. The outdoor lighting shall be turned off one hour after closing, except for
approved security lighting.
5. Major changes to the landscape or new plantings are subject to review and
approval of the City Arborist.
6. Changes to the building to accommodate car storage and repair shall
require a Building Permit from the City.
7. Any new mechanical equipment that is located on the roof or ground level
and visible from street level or from neighborhood properties shall be
screened with materials that blend harmoniously with the building facade
materials.
8. Any additional signage shall be subject review and approval of City Staff
for conformance with Zoning Ordinance standards.
9. All noise generated from the business shall be compliant with Section
401.15.13.11 of the Zoning Ordinance. The service door to the building
shall be closed at all times except when vehicles are moved in and out of
the service entrance.
10. All auto sales and auto repair activities shall be conducted indoors and
shall be limited to the private auto club members.
11. All storage of trash, recycling, materials, parts and supplies shall be
interior to the building.
12. The applicant shall receive and retain, if required, a Hazardous Waste
Generators License for batteries, oil and tires from Washington County.
13. If the City receives complaints on the location of where the enclosed
trailer is located, the City Council may reconsider the storage location or
require additional screening through an amended Conditional Use Permit.
Approved by the City Council of the City of Oak Park Heights this 24`d day of

Conditional Use Permit - Lapse of Approval:
Unless the City Council specifically approves a different time when action is officially taken on
the request, the conditional use permit shall become null and void twelve (12) months after the
date of approval, unless the property owner or applicant has substantially started the construction
of any building, structure, addition or alteration, or use requested as part of the conditional use.
An application to extend the approval of a conditional use permit shall be submitted to the
Zoning Administrator not less than thirty (30) days before the expiration of said approval.
