The applicant is responsible for assuring all required inspections are requested in conformance with the Minnesota State Building Code. SEPARATE PERMITS REQUIRED FOR WORK OTHER THAN DESCRIBED ABOVE. a 411111 City of Oak Park Heights-Addendum to Demolition Permit: Additional Conditions Agreement Property Owner, Jennifer M Weiss, (the "Applicant") has petitioned the City of Oak Park Heights, (the "City"), for a Demolition Permit to demolish the home and structures located at 15269 Upper 61st Street(See map below)in the City of Oak Park Heights. The Applicant has also pursued the following and warrants to the City that: 1. The Applicant has contracted with the Bayport Fire - • ..t Department to manage and oversee a proposed structure burning exercise for the home and all i ' _ structures on this property. 2. The Applicant has contracted with Bell's Excavating to perform the final demolition and site restoration to be completed after any fire training exercises in a timely fashion. fi `` The City does hereby permit the above actions pursuant to the I I " "`' following Terms: 1 I Terms and Conditions of Demolition Permit: . , 1. Prior to the commencement of any training exercise(s), the r-.-4 _ f,- .,. Applicant shall provide documentation and certification to the City that all asbestos, lead or other hazardous materials have been removed from the property and all wells have been appropriately capped. Training exercises may not commence on any home unless and until this documentation has been received by the City. The responsibility remains with the Applicant and its agents to ensure these documents are complete and all required elements are completed pursuant to State and Federal law. 2. Following the completion of the "training exercise" at the property, the Applicant shall within 10 calendar days fully demolish and remove all remaining structures and debris from the City and shall fully restore the property (or properties) to a clean, level condition. The Applicant shall also remove all in-place septic system infrastructure, cap any known wells and shall place a final topsoil application to all areas and a grass cover shall be established and maintained. 3. Should no fire training exercises occur the Applicant shall fully demolish and remove from the City all structures including all basements, foundations, wells and septic infrastructure and shall restore all such sites to a clean, level condition not later than November 30th, 2019. 4. Water and sanitary sewer service utilities must be appropriately capped by the Applicant at or near the right of way line — or "house side" of the curb. Prior to the issuance of any permit, the Applicant shall provide to the City of Oak Park Heights a cash deposit in the amount of$10,000.00 securing the final demolition and site remediation of the structures, utilities, septic and wells (if any). The deposit shall be released by the City when all structures, foundations,wells, septic systems are fully removed (or capped water and sewer) and when all property has been returned to a clean, level condition. 6. The Applicant does hereby grant the City the unilateral right to complete any demolition and debris removal should the Applicant fail to complete any required restoration actions in a timely manner. The Applicant shall be responsible to the reimburse the City for all costs associated with such actions required on the part of the City to ensure the sites are clean, safe and presentable to the general public; including waiving all rights objecting to special assessments to recover any costs by the City. Should the City be required to take remediation actions, the Applicant shall also forfeit the$10,000 escrow to the City as an additional penalty. 7. The City will not charge the Applicant for costs associated with additional staff time required by the Public Works Department nor for reasonably anticipated water usage. 8. The City provides no warranty or guaranty that this property or any structures are in a condition suitable for fire training exercises. The Applicant agrees to indemnify and hold harmless the City, its agents, officers, and employees from any and all claims, causes of action, liabilities, losses, damages, costs, expenses including reasonable attorneys fees, suits, demands and judgments of any nature, because of bodily injury to, or death of, any person or persons and/or because of damages to property of the Applicant or its Contractors or Agents or others, including loss of use from any cause whatsoever,which may be asserted against the City on account of any act or omission, including negligence, of the Applicant, or the Applicant's employees, agents or contractors in connection with the performance of the work contemplated in the Permit. The Applicant agrees to defend any action brought against the City on any such matters, and to pay and satisfy any judgment entered thereof together with all costs and expenses incurred in connection therewith. The City shall in no way be liable for any claims or charges incurred by the Applicant or its Contractors. 9. The City is not responsible for any site security, site protection or other measures to prevent injury, damages, property theft of loss,etc.of the Applicant,their contractors or agents. 10. The City may revoke any authorities conveyed to the Applicant in this document at any-time and for any reason. Such revocation shall be in writing by the City Administrator and/or Building Official. 11. Following demolition of the buildings,erosion and silt control measures shall be coordinated on the site as directed by the City Engineer. Appropriate control measures as required by the City Engineer shall be installed prior to development and as may be necessary to control erosion and shall at a minimum follow "best management practices". The Applicant does agree to all terms and conditions listed above and are in addition to all federal,state and local rules,ordinances,laws and requirements of record. AGREEMENT THIS AGREEMENT, entered into this 5th day of November 2019 by and between Jennifer Weiss, the CITY OF Bayport,a Municipal Corporation(the City), and the Bayport FIRE DEPARTMENT(the Fire Department). WHEREAS, Jennifer Weiss is the building owner of certain real property the Property 15269 Upper 61st ST N,Stillwater, MN 55082, legally described as Lots 12, 13, 14 and 15, Block 14, Elfelt's Addition to Oak Park, County of Washington, State of Minnesota; and, WHEREAS,there are 2 buildings(s) (a house and a garage} located on the Property;and WHEREAS,Jennifer Weiss desires to have the Building(s)destroyed;and WHEREAS,the Fire Department is willing to destroy the building(s)by fire if the building(s)can be used for smoke drilling and other training exercises before and during their destruction by fire. NOW,THEREFORE, the parties hereto in consideration of the mutual covenants and considerations hereinafter set forth do agree as follows: 1. Enter onto the Property Authorized. Jennifer Weiss hereby expressly authorized the Fire Department and the City to enter onto the Property one or more times for the purpose or conducting smoke drilling and other training exercises(the Training Exercises and related activities in the Building(s)and on the Property.) The City and Fire Department shall enter the Property solely for the purpose of conducting training exercises and for related activities such as preliminary and follow-up inspections. 2. Waiver of Trespass. Jennifer Weiss expressly waives any claim of trespass against the Fire Department or the City for entry onto the Property for the purposes of conducting training exercises and related activity on the Property. 3. Waiver of Damages. Jennifer Weiss expressly waives any claim against the Fire Department or the City for any damages to the Property or the Building(s) caused or allegedly caused by the Fire Department or the City in the course of performing the Training exercises and activities related thereto. 4. Liability and Indemnification. The City and the Fire Department shall be solely liable for any injury to the Fire Department personnel or other persons caused by or as a direct result of the Training Exercises.The City and the Fire Department shall indemnify and save Jennifer Weiss harmless against any and all claims by or on behalf of any person or persons arising from the conduct of the Training Exercises.The City and the Fire Department shall not,however,be liable for any injuries caused by or resulting from Jennifer Weiss'failure to clean up the Property and remove the debris of the Building(s)within the time period allowed by Section 5 of this Agreement. 5. Clean Up. Jennifer Weiss shall be solely responsible for removing all debris from the Property following completion of the Training Exercises,regardless of the condition of the Property and/or the Building(s)following completion of the Training exercises.The City shall notify Jennifer Weiss in writing when the Training Exercises are completed and Jennifer Weiss shall have thirty(30)days from the date of that notice to complete the removal of all debris and remnants of the Building(s) so that the condition of the Property is in full compliance with the City Ordinances.The City reserves the right to inspect the Property from time to time as necessary to insure Jennifer Weiss compliance with this obligation to clean up the Property.
