1. No new applications have been receiveda meeting with Fury on Thursday, Staff does expect an application from
Fury Motors for an Interim Use Permit at their eastly site.Staff did meet with Twin Cities Orthopedics to discuss a two-story building at the site along
Memorial Ave and anticipate a development application in February. It was commented that the building would be akin to their facility near Bailey
Road in Woodbury.The Planning Commission will not be held in January 2020.
2. Several Code enforcement letters are enclosed from the Building Official.Holiday light removal,improper parking and illegal signs.
3. The City has received its BOND RATING STATEMENT from Moody's.A0.This position is to be considered"excellent"and based on
their rating criteria is likely as high as it can go for a small city with less than$1 billion in assessed values.In the vent the City does issue fronds,it
will result in lower interest rates.Beyond that,it is just an interesting piece of trivia.
4. The City's annexation and detachments with Stillwater are now complete and in-force.As we generate our new maps as part of the COMP
PLAN UPDATE, we will include these new layouts. Overall the process took several months, an underlying base agreement and several map
iterations—but was done for less than$500—in out of pocket costs.I have enclosed copies of the final orders.
& Staff has provided the BCWD with final comments on their updated rules,and we understand that these will proceed now to a 45-day rule
review and further public comment.We expect from further dialogue and clarifications. Recall,the BCWD is seeking the City take over permitting
for them—but with the caveat that OPH will only be enforcing its own rules and that BCWD was working towards adopting rules that match the City's
—more discussion forthcoming.

Dear Jeanne:
City Ordinance 401.15.G.establishes regulations for signage, both permanent and temporary within
the City. This ordinance is known as the zoning ordinance and can be found in its entirety on the City's
webpage at www.cityofoakparkheights.com.
Your business has a banner placed at its exterior wall,serving as its business sign. City Ordinance does
not qualify banners as a wall or permanent sign.
With this letter you are directed to immediately obtain a special event permit for temporary signage
at the business. Additionally, if you wish to display signage on the building wall—and your landlord
approves you to do so—you will need to apply for a permanent sign permit for your business signage.
I have enclosed a special event permit for your use;there is no charge for the permit. Failure to
obtain one prior to placing special event signage however is City Ordinance violation,which offense is
subject to a misdemeanor citation. Please obtain You special event hermit prior to Monday January
13,2020. If you opt to not obtain one the banners shall be removed no later than January 13 2020.

Re: Temporary Signs Display and Special Events (Banners)
Dear Owner/Manager:
The City of Oak Park Heights regulates temporary signs and special events through City Ordinance
401.15.G.7 Special Events. City Ordinance requires that you obtain a Special Event permit for the
temporary placement of signage upon your property. Special event permits are limited to limited
to 50 calendar days a year and have no cost.
The banner attached to the south wall of Valvoline at 5800 Neal Ave. N. is considered a
temporary sign and was placed without a special event permit having been issued.
This sign placement is in violation of City Ordinance 401.15.G -Signs and shall be removed or a
special event permit obtained for its Placement Prior to Monday January 20 2020. 1 have
enclosed the Special Event Ordinance and permit application for your use. If a special event
permit has not been issued a site check will be made to verify that the sign has been removed
after the 20th of January.

Dear Michael and Juliane,
This letter is with regard to the SUV parked upon the driveway at 15070 63rd St. N., Oak Park
Heights. The vehicle has been situated upon the driveway does not appear to have moved from
some time. The Wisconsin license plates show expired registration and the vehicle appears to
have multiple flat tires at present.
Inoperable vehicles may not be stored outside and must be stored within a garage or removed
from the City per City Ordinance 401.15 F.7 (see below).
401.15.F.7 — U.se of Required (Parking) Area. Required accessory qff street
parking spaces in any district shall not be utilized for open storage, sale or rental
of goods, repair work, storage of inoperable vehicles and/or storage of snoiv.
The vehicle in its current condition is in violation of City Ordinance 401.15.F.7 in that it is not
operable and is deemed to be a public nuisance per City Ordinance 1301.02, which is enclosed
for your reference.
Kindly address this inoperable vehicle violation no later than February 9 2020 by having it
repaired and its registration brough current, removing it from the driveway and/or placing it
within the garage of the premises. A site visit will be made after February 9"'

2.0 STORMWATER MANAGEMENT
21 Purposes and Policy.It is the policy of the District to:
2.1.1 Preserve natural infiltration,groundwater recharge and subsurface flows that
support groundwater dependent resources including lakes, streams, wetlands,
plant communities and drinking water supplies;
2.1.2 Work toward restoration of natural hydrology by limiting peak off-site
stormwater flow to pre-settlement rates;
2.1.3 Limit offsite stormwater flow volume to prevent down-gradient flooding
and thermal impacts to Brown's Creek and its tributaries;
2.1.4 Require management of stormwater flow to limit sediments,phosphorus and
other pollutants conveyed to ground and surface waters and promote water
quality;:
2.1.5 Minimize connectivity of impervious surfaces to stormwater conveyance
systems and preserve the natural hydrology of landlocked basins to minimize
basin and downgradient flood risk.-,and

pretreated for long-term removal of at least 50 percent of sediment loads.In the
event an infiltration facility is constructed in the vicinity downstream of a potential
Hot Spot,a skimmer must be installed to facilitate cleanup.
2.5.3 Basin in Contributing Area to Groundwater-Dependent Natural Resource.A
stormwater basin within the surface contributing area to a groundwater-
dependent natural resource must contain and infiltrate the volume generated by a
two-year,24-hour storm event,if feasible.The basin bottom must be at least three
feet above the seasonally high water table,bedrock or other impeding layer.If this
infiltration standard is determined infeasible,basin outflow must be non-erosive
and routed through a subsurface system, flow spreader or other device that
discharges water through or across the ground to lower discharge temperature to
that of the ambient soil.
2.5.4 Conformance to Floodplain and Drainage Alteration Requirements. Land-
altering activities subject to this rule must comply with lowest-floor elevation
requirements in subsection 7.3.2 of these rules.
2.6 Maintenance.All stormwater management structures and facilities must be designed
for maintenance access and properly maintained in perpetuity to assure that they
continue to function as designed. Permit applicants must provide a maintenance,
inspection and, if required, monitoring plan that identifies and protects the design.,
capacity and functionality of onsite and offsite stormwater management facilities;
provides specifications,methods and a schedule for the inspection and maintenance in
perpetuity of the facility,with documentation retained onsite and available to the District
on reasonable notice; and contains at a minimum the requirements in the District's
standard maintenance declaration.The maintenance plan will be recorded on the deed in
a form acceptable to the District.A public applicant may comply with this requirement
by entering an agreement with the District in lieu of a recorded document.
2.7 Required Exhibits.The following items, certified by a
professional engineer in the State of Minnesota,
land surveyor, or other appropriate professional must accompany all permit
apphcatieesapplicatior submitted to the District pursuant to Rule 2.0:

2.7.6 Existing and proposed normal and 100-year water elevations on site;

2.7.8 Elevation of the OHWL of each public water on the site,if determined by the

(b) the plan incorporates onsite BWs to mitigate impacts and provide
local benefits not provided by the regional facility.
The applicant,before commencing any land-altering activity,must demonstrate that
downgradient stormwater conveyance structures and facilities will be adequate to
handle proposed increased peak flow or flow volume from the site,it holds the legal
rights necessary to discharge to the stormwater facility or facilities in the regional plan,
and that the facility or facilities are subject to a maintenance document satisfying the
requirements of paragraph 2.6.

I can understand your concern and would like to provide some more information on this subject.
This can often times be a volatile and emotional subject and because of that has been highly controlled by State Law and
constitutional challenges about what information can be released about identification or location of subjects,etc. Win
the event a level 3 offender were to move into the city there are some restrictions provided under MN Statute. The MN
Bureau of Criminal Apprehension oversees the offender program and I have a link to the web site for

Offenders are generally required to register,we already have many offenders living and working in the city of the level 1
or 2 status. There would be a community notification process in the event of a level 3 offender moving into the
community. The banning of offenders in the city as addressed by Administrator Johnson has been an issue ruled on by
the courts and has not been allowed in the past. The state"release"committee reviews the offense and rehabilitation
factors of an offender and may place restrictions on their behavior and location in accordance with Minn.Stat. §
244.052.
1 have also attached a copy of our city police department policy on community notifications. This is standardized and
required policy by state law.

POLICY
It is the policy of the Oak Park Heights Police Department to protect the public by disclosing
information on predatory offenders residing in an agency's community.The extent of the
information disclosed and to whom is at the discretion of the agency unless otherwise noted.
However, it must relate to the level of danger posed by the offender,to the offender's pattern of
offending behavior, and to the need of community members to enhance their individual and
collective safety.
DEFINITION
Three possible risk levels can be assigned to an offender. They are:
w Level 1—low risk of re-offending
■ Level 2—moderate risk of re-offending
■ Level 3—high risk of re-offending
Note:Some offenders are not assigned a risk level due to their offense being adjudicated prior to
predatory offender legislation enactment or due to the offender's conviction not leading to
supervision by the Department of Corrections. These offenders are still subject to the predatory
offender registration statutes,though they are not subject to community notification.
PROCEDURE
A. Community Notification- For questions regarding community notification or risk level
assigned to an offender, please contact the Predatory Offender Unit of the Department of
Corrections(DOC)at 651.642.0279 or at www.corr.state.mn.us. The DOC will answer
questions about the process and responsibilities, and assist agencies in conducting public
notification meetings when an offender subject to notification moves into a law
enforcement jurisdiction. Attached to this policy are:
■ Example 1, "Community Notification: Risk Assignment Report", an internal law
enforcement document prepared by the DOC
■ Example 2, "Fact Sheet",a notice for public distribution

B. Notification Process
Level 1—The purpose is to disclose information to raise awareness.
■ Mandatory—Victims who have requested disclosure.
■ Discretionary—Witnesses or victims, other law enforcement agencies.
Level 2—The objective is to disclose information to safeguard facilities and protect the
individuals within those facilities. (Example-attachment 2, "Fact Sheet")
■ Mandatory—All persons and entities included in Level 1 disclosure.
Note: If the offender is placed or resides in a residential facility, do NOT disclose any
information until the law enforcement agency is notified that the offender has been
relocated.
■ Discretionary — Groups and agencies that the offender is likely to encounter
including staff members of both public and private schools, day care facilities and
organizations that would provide services to the individuals likely to be victimized by
the offender.
❑ Consider using the following to assist with discretionary disclosure: the offender's
prior history, offense characteristics; employment; recreational, social and
religious interests; and characteristics of likely victim.
Level 3 —The goal is to disclose information not only to safeguard facilities and protect
the individuals they serve, but also to protect the community as a whole.
■ Mandatory— All persons and entities included in Level 1 and Level 2 disclosure. A
good faith effort must be made to notify within 14 days of receiving documents from
DOC.
Note: If the offender is placed or resides in a residential facility, do NOT disclose any
information until the law enforcement agency is notified that the offender has been
relocated.
■ Discretionary — Other members of the community who the offender is likely to
encounter, unless public safety would be compromised by the disclosure or a more
limited disclosure is necessary to protect the identity of the victim.
❑ How an agency decides to inform the public is their discretion. The current
standard for a Level 3 offender is to invite the community to a public meeting
and disclose the necessary information.

C. Registration- For questions concerning registration, please contact the Bureau of Criminal
Apprehension Predatory Offender Unit (BCA POR) at 651.603.6748 / 1.888.234.1248 or at
www.dps.state.mn.us/bca or refer to the Predatory Offender Registration Manual (POR
Manual)for detailed information.
When an offender arrives at your agency to register, determine if he/she is required to
register (review list of registerable offenses in the POR Manual) and in what state the
offense was committed.
If the offender is required to register, contact the BCA POR to clarify if the offender is
registered and if a DNA sample has been submitted.
■ If the offender is already registered, complete a Change of Information Form
included in the POR Manual.
■ If the offender is not registered, complete a Predatory Offender Registration Form
included in the POR Manual.
■ If the offender is from another state, contact the state (information for each state is
listed in the POR Manual) and request a copy of his/her original registration form,
criminal complaint and sentencing documents.
It is recommended the agency verify the address of offenders living in their community.
■ If the offender is not living at the residence, contact the BCA POR to determine if a
Change of Information Form was submitted. If it was not, the offender may be
charged with failure to notify authorities of a change in residence.
■ Contact the BCA POR to request a Prosecution Packet. Submit the packet to the
county attorney's office to file a formal charge.

I hope you are all having a great start to the new year. Today marks my one year
anniversary of being sworn in as your state representative, and I continue to be
extremely grateful to represent you in the Minnesota House of Representatives.
A quick reminder that tomorrow evening I'll be hosting a Climate & Energy Community
Discussion where I'll be joined by Rep. Jamie Long, the vice chair of the House Energy
and Climate Division;,and Rev. Buff Grace of Minnesota Interfaith Power& Light. This
event is in partnership with the 100% Campaictn, and will be a great opportunity for our
community to come together to discuss how we can build an equitable clean energy
future for Minnesota. I hope to see you there!

MN Small Cities Day on the Hill and Legislative Reception,and would rather not wait for our regularly
scheduled newsletter later this month.
• It is important that we begin NOW,to get an idea of exactly who will be participating,so we can
set up the relevant meetings with your District's legislators. If you are planning to join us at the
Capitol for this event, please complete THIS FORM asap, letting us know the city you
represent and the name(s)of who will be attending.
• While the exact Agenda for the day is still being worked out,you should plan on spending the
entire day in St. Paul.We will begin with a short,mid-late morning"overview"meeting at the
Capitol,to cover logistics and talking points for your legislative meetings.Following our
Legislative Meetings,the MN Small Cities Board of Directors will meet in mid-late afternoon, in
the St.Croix Room at the League of MN Cities offices(about 2 blocks NW of the Capitol).As
always, MAOSC Members are welcome and encouraged to attend the Board Meeting.
• Later that afternoon we will host our Annual Legislative Reception at the Best Western Capitol
Ridge Event Center(fka the Kelly Inn),about one block west of the Minnesota Capitol.We hope
you will stick around for this.We will be inviting Minnesota law makers and other VIP's to join us
as well.And,it will be GOOD networking time with your fellow small city leaders from across the

Governor Walz on Thursday released his recommendation for affordable housing funding including
funding to support affordable housing construction,preservation and rehabilitation.The Governor our Tweets

$200 million would be used to fund Housing Infrastructure Bonds(HIB),appropriation bonds that fund
privately built and owned residential buildings and houses.HIB funds support new construction and
renovation of existing affordable homes across the state as well as shelter for people experiencing
homelessness.The funds are awarded through a competitive process administered by Minnesota
Housing.
$60 million would be borrowed through general obligation bonds to support publicly owned housing
units and buildings.Funds would be awarded on a competitive basis to local public housing authorities
across the state.A focus on veterans'affordable housing would be funded by$15 million under the
Governor's recommendation.These funds would support renovations and security upgrades to state
veterans'homes administered by the Minnesota Department of Veterans Affairs.

Governor Walz Releases Water Infrastructure Proposal
Governor Walz on Friday announced the second component of his bonding recommendations,for water
infrastructure,with a focus on water quality and updating state water infrastructure.The proposal
includes a total of$300 million to replace aging infrastructure and upgrade watertreatment facilities.
$293 million would be funded with general obligation bonds.
The Governor's proposal includes$5 million to the Metropolitan Council for grants to cities for inflow
and infiltration(I and 1)improvements on local and regional wastewater systems.Metro Cities supports
funding for Ill and has initiated a$9.5 million legislative request.

Governor Wali proposal also includes$25 million to match an estimated$125 million in federal water
infrastructure grants and to increase lending capacity in Clean Water and Drinking Water Revolving
Funds.The Water Infrastructure Funding Program,which provides grants to communities to build clean
water and drinking water projects,would receive$100 million under this proposal.The Point Source
Implementation Grants Program would receive$75 million.The MPCA would receive$15 million for
grants to municipalities to build sustainable and resilient stormwater infrastructure and$$2 million for
support to communities,including cities,for removal of sediment from stormwater ponds contaminated
by polyaromatic hydrocarbon(PAH).

Metropolitan Council Reviews Status of Comp Plan Updates and Trends
Metropolitan Council staff provided an update on 2040 comprehensive plan submittals at the January 6
Community Development Committee(CDC)meeting.
Of the 168 expected plans from local government units from across the seven-county metropolitan
region,151 updates have been submitted and 76 plan updates have been authorized by the
Metropolitan Council,with remaining plans still in process.
Staff highlighted several specific plan components.68 plans included economic development or
economic competitiveness elements in their updates.This was an optional component for cities and
counties to Include,and the Metropolitan Council provided resources and tools for governments that
wished to include them.Climate and energy and resiliency components were included in dozens of
plans according to Council staff.141 updates included some sort of resilience component.75 plan
updates Included equity terms,goals,principles and/or policies.
Council staff will continue to review trends in the content of comp plan updates as final reviews are
completed.Metro Cities will continue to monitor these trends and provide updates in future newsletters.

Housing Goals for Livable Communities Programs
Recently,Metro Cities,along with staff from several metropolitan cities and housing stakeholders,
participated in two advisory committee meetings convened by Metropolitan Council Livable
Communities Act Program(LCA)staff to discuss affordable and lifecycle housing goals for cities
seeking to participate in the LCA programs.By state law,cities and the Council must negotiate such
goals in order for cities to be eligible to qualify for LCA funding.The discussion in the two meetings
covered the existing method for determining housing goals,as well as factors that should influence the
determination of housing goals.The meetings did not produce a formal recommendation and Metro
Cities'understanding is that Council staff will seek additional feedback,including feedback from city
officials.
The existing method for determining housing goals for LCA programs uses as a starting point the
affordable housing'need'numbers allocated decennially to cities and is adjusted to reflect available
resources for housing,determined in 2010 to be 65%in available resources to meet the need.The
method uses a range rather than a single goal number.In the meetings,Council staff provided
estimates showing resources are projected to be at 44%of need.
Metro Cities supported the existing method in that it allows for consistency between identified housing
needs while considering the limitations of existing resources.The LCA programs provide modest but
critical funding for cities in the region to meet affordable housing as well as other goals such as
redevelopment,blight removal and soil remediation.
There was discussion on having the housing'need'numbers serve as housing goals with no adjustment
to reflect resource availability.These numbers differ in their purpose and definition,and Metro Cities is
concerned that equating them could reduce flexibility for cities to qualify for LCA participation.
Metro Cities'policies support the LCA programs,with policies emphasizing the importance of sufficient
flexibility in program criteria and requirements to ensure that all participating cities can reasonably
qualify for participation in the LCA programs.

EVENT:Regional Solicitation Workshops
The Metropolitan Council will host two workshop meetings(see below)to introduce prospective
applicants to the 2020 Regional Solicitation for transportation projects.Approximately$180 million in
federal transportation funds are expected to be available for allocation in 2024-2025.
The application period for the Regional Solicitation is expected to be open in February,with all
applications required to be submitted no later than April 16,2020.After projects are scored and ranked,
the schedule calls for the Transportation Advisory Board(TAB)to select projects for funding late in

Metro Cities is excited to announce that Michael Lund will join Metro Cities on January 21 as the
organization's 2020 Legislative Intern.Mike is completing his Master's in Public Policy at the Humphrey
School of Public Affairs at the University of Minnesota and has a Bachelor of Arts in Political Science
and Government from the University of Minnesota.Mike has a strong research background as he has
recently worked as a Library Assistant in Access and Information Services at the University library
system.
Mike will assist Metro Cities staff with its 2020 legislative work,taking on roles such as monitoring bills,
