Super America has requested a conditional use permit and a rezoning to construct an
Super America fuel facility to be located on 00th Street North West of Highway 5. This
memo serves as a summary of the issues pertaining to the request.

Rezonio The applicant is requesting a rezoning of the site from 0 -open Space
Conservation to B -, General Business. This rezoning is consistent With the
Comprehensive Plan.
Off-Street - - Par As stated Within the oak Park Heights Zoning ordinance,
Section 401.03.E.8 the following parking spaces are required for motor fuel
stations:

Handicap....Parking. Per State law, at least one (1) in every twenty -five (25) off-
street parking stalls must be devoted to use by disabled people. The applicant is
providing one (1) handicap parking space, therefore, must increase the number of
spaces to two in order to meet the minimum state requirement as shown on the
following page.

Curb Cuts. The two access entr points to the site are proposed to be thirt
(32) feet wide and thirt (35) feet wide. Section 401.03.E.4.h.(7) of the Zonin
Ordinance states that "no curb cut access shall exceed twent (24) feet in
width, or thirt (32) feet when accessin a State hi except b conditional
use permit ". The Cit En shall review the proposed access, and comment
on its acceptabilit
Additionall there is a separation distance of 200 from the southern entrance and
the 58th Street/60th Street intersection. This spacin shall also be subject to
approval of the Cit En
Internal Turnina Radius. Per the Ramse and Sleeper Architectural Graphic
Standards, the internal turnin radius of the drive throu access is ade for
automobiles, and access to the parkin lot is ade for access b emer
vehicles. The site plan should be sub to review b the Police and Fire Chiefs.

Subdivis'lon. Subdivision of the southerl portion of the Bracke West Addition to
create two buildable lots creates an issue of access and viabilit for the future use
of the southerl lot proposed as Outlot B. Limited access ma be provided off of
Kern Avenue, no access will be allowed to 58th Street.
