As a follow up to the 14 April 1998 meetin in which the Cit Council approved the re
for a SuperAmerica and Valvoline Instant Oil Chan at 58th Street between Hi 5
and Neal Avenue, please find as follows the revised list of conditions a to b the
Council for this pro
RECOMMENDATION
The Cit Council recommended approval of the re for a rezonin from 0 to B-2; a
PUD/CUP to address access and internal setback issues a conditional use permit for the
automotive fuel station, oil chan facilit and car wash; a variance from si
re and the subdivision to create separate lots for the SuperAmerica and
Valvoline facilities, sub to the followin conditions.-
1. The Cit Council finds that the proposed pro is consistent with the CUP criteria
found in Section 401.30.E and the variance criteria found in Section 401.04 of the
Zonin Ordinance.
2. The final plat be recorded to include all utilit draina and other easements as
re b the Cit En
3. The PUD/CUP development a shall address all cross access easements
to allow street access to the Valvoline facilit No public road access will be
allowed from Lot 2 to 58th Street or Neal Avenue.

4. A setback for parkin stalls will not be re alon internal propert lines as
allowed b the PUD/CUP.
5. All proposed curb cut widths are approved b the Cit En

7. Under g as tank fillin operations should be done in such a wa as to
minimize disruption of site circulation and so as not to have an adverse impact upon
adjacent nei or traffic movements in the immediate area. The Cit
Council ma review this condition at an time and impose additional limitations on
fillin operations as necessar to minimize an adverse effects.
8. Ten feet of additional g reen space shall be provided between the two entrance curb
cuts on Neal Avenue. This area shall be appropriatel landscaped. A dia
showin the detailed g reen space is found as Exhibit P, attached.

development as found in Exhibit P, A the areas should accommodato

site.

especiall around the buildin and in the existin and proposed curb barrier
areas.
B. The plan should avoid the use of Pin Oak in this urban settin The shouLi
be replaced with White, Bur or Swamp White Oak.
C. Each of the g roupin g s of plant materials uses the same species. -Fhe
specifies could be diversified to g ive more interest to the plantin areas b
var the size, hei and t of material.
D. The row of shrubs near the Valvoline parkin area should be moved awa
from the curb at least two to three feet to avoid dama
E. The materials selection be subject to review and approval b the Cit
Arborist.
