Thursday, August 13 2009
Call to Order: Chair Wasescha called the meeting to order at 7:00 p.m. Present:
Commissioners Bye, Liljegren and Powell; City Administrator Johnson, City Planner Richards
and Commission Liaison Runk. Absent: Commissioner LeRoux.

Commissioner Powell, seconded by Commissioner Liljegren, moved to approve the Agenda as
presented. Carried 4 — 0.
Approve Minutes of June 11, 2009: Commissioner Liljegren, seconded by Vice Chair Bye,
moved to approve the Minutes as presented. Carried 4 — 0.

New Business:
A. Desien Guidelines:
City Planner Richards noted the work session held with the City Council just prior to the
Planning Commission meeting and provided a brief review of the discussion held primarily
related to the commercial design standards. He reminded the Commission to let him know of
any cities they felt had particularly good design guidelines that they would like him to include
in his research and to also provide staff with any photos they may have of what they consider
to be good commercial designs or ideas.
Richards will work on an update of the Design Guidelines based on the discussion shared by the
City Council and Planning Commission at the work session and noted that anyone with
comments for consideration to the Design Guidelines should contact City Hall.
B. Sign Regulations /Special Events and Destination Retail Highway District
City Planner Richards noted that the City Council had requested that the Commission review
options for allowing additional or different types of signage within the Destination Retail
Highway District. He noted that the City Council received a specific request from Stillwater
Motors in that area, for consideration of allowing an electronic reader board /animated sign
that could be visible off of Hwy. 36 or Hwy.5.

Richards discussed possibilities for the Destination Retail Highway District as well as others city
wide that could be considered for increased flexibility to the existing special event ordinance
language within Ordinance section 401.15.G.8.
General discussion ensued as to the options discussed by City Planner Richards. The
Commission inquired as to what businesses had run up against in conflict of what the
ordinance allows and what specific allowances were being requested by Stillwater Motors.
Commission consensus was that they didn't want to make any changes to the ordinance
without having more specific information from Stillwater Motors as a request for their
consideration.
Richards inquired as to the Commission's thoughts on animated signs. Chair Wasescha noted
earlier discussion on these types of signs and expressed his concern as to them, citing an
example he has observed on Hwy. 94 at near the City of Landfall. Discussion ensued as to the
types of these signs, potential limitations upon them and the anticipated demand increase to
allow them at commercial locations.
Commissioner Powell, seconded by Vice -Chair Bye, moved to make no changes to the
ordinance with no recommendation for change and to have Stillwater Motors present a formal
proposal for a change request to be considered. Carried 4 — 0.

On Memorial Avenue North

As you are aware, the City Council is contemplating the purchase of property on
Memorial Avenue North for a potential well and water tower site. The property is just
east of the cul -de -sac on Memorial Avenue and north of the Xcel power line easement.
Currently, the property is owned by Stillwater Motors and is part of a larger parcel. If
purchased by the City, a subdivision of approximately three acres of the lot would need
to be completed.
Minnesota Statutes 462.356, Subd. 2 requires the following:
Compliance with plan. After a comprehensive municipal plan or section
thereof has been recommended by the planning agency and a copy filed with
the governing body, no publicly owned interest in real property within the
municipality shall be acquired or disposed of, nor shall any capital
improvement be authorized by the municipality or special district or agency
thereof or any other political subdivision having jurisdiction within the
municipality until after the planning agency has reviewed the proposed
acquisition, disposal, or capital improvement and reported in writing to the
governing body or other special district or agency or political subdivision
concerned, its findings as to compliance of the proposed acquisition, disposal
or improvement with the comprehensive municipal plan.
The Comprehensive Plan Proposed Land Use Map designates this area as highway
business /warehouse. Utility structures and facilities are regarded as allowable and as
reasonable land uses within this planned area. Further, the property is zoned B -3,
Highway Business and Warehouse which allows government and public utility buildings
and structures as a permitted use.
The Planning Commission should review this issue and make a motion in support of a
potential City purchase of this property for utility purposes in that it is in compliance with
the Comprehensive Plan.

For the September 10, 2009 meeting, the Planning Commission will adjourn the regular
meeting and go into a work session to discuss the Design Guidelines. Once the
workshop is completed, the meeting will be reconvened and the Planning Commission
can take any formal action resulting from the workshop. Staff has planned a workshop
on this item in that the Planning Commission will be asked to review and discuss a
number of photographs to determine direction for the Design Guidelines. It will be
easier for us to do that at a large conference table rather than the Council Chambers.
In preparation for that workshop and meeting, please find the following:
A. A draft format for the Design Guidelines.
B. Photos of various buildings, streetscapes, landscaping, lighting, signage, trash
enclosures, and other decorative elements. The Planning Commission should
review these carefully and select the best examples from each of the categories.

The Planning Commission should also consider whether the Design Guidelines should
remain as they exist in the Zoning Ordinance as just a statement of guidelines or if they
should become part of the ordinance and enforced as an actual performance standard.
If the latter is preferred, then any deviation from the standards would require a variance
or conditional use permit, depending upon how the ordinance is drafted.
If the Planning Commission members have any additional photos or ideas of where
additional examples should be taken, please do not hesitate to contact me.

RE: Stillwater Motors - T
Last week, I had met with DJ Raduenz of Stillwater Motors as a follow -up to the City's letter
requesting specific information on what the City should consider as potential temporary signage
amendments. Basically, I was provided the enclosed document and which indicates a
distinction between SALES EVENTS AND SPECIAL EVENTS.
Per Mr. Raduenz, Stillwater Motors is generally bound to participate in specific corporate "sales
events" and which includes some promotional activities, such as a TENT SALE. These being
different from an in -house promotional event or community event such as a car show, which the
site does host four times per year.
While it would appear workable to suggest that a firm must comply with its corporate hierarchy
and establish an extra signage criteria making the above distinction, this unfortunately is not
workable from an "across the board" standpoint as it would convey special privileges to one
type of firm as opposed to another; nor could the City document what such corporate structure
is requiring. Basically, the City does not regulate why someone desires, or must have signage,
rather that there IS signage. Cities my generally not regulate content of signage.
I appreciate that there is a distinction in type of signage desired and /or required considering this
Stillwater Motors is located in the B -3 district and the City may consider additional signage for the
entire district, but it would be applicable to all firms in such district.
I also informed Stillwater Motors that since they did remove large permanent signage from the
north side of their building they may have room for additional permanent signage per their CUP
form 2007.

DEFINITION.
(S les ev s) are separate from (Special events) as they are events put
on by their Franchise Or Corporation. They are Nationally or Locally
advertised Events. (Special events) are events put on by in- house or
by the Business itself.
SALES EVENTS.
a. Sign Permit Required. No sales event shall be held without first obtaining
a sign permit.
b. Number of Events. The business or applicant in all business and industrial
zoning districts, as well as each public and institutional use in residential districts,
shall be allowed twelve (12) sales events per calendar year. Proof of these sales
events must be submitted with sales event permits and updates sent to Planning
and Code Enforcement Officer as they change. These sales events must be events
that are part of their Franchise or Corporate Local or National advertised event
that the business participates in. Each sales event shall not exceed fifteen (15)
days and can be extended for a total of three (3) consecutive time periods for each
business. Once the time period has expired for the sales event the applicant shall
wait ten (10) days before they can start a new sales event.
C. Permitted Advertising Devices. Advertising devices for sales events must be
directly related to the activity being conducted as a sales event. The advertising
devices described below are permitted for sales events in addition to the
maximum allowable sign area, provided they are professionally done and the
following standards are met and complied with:
1) Small Balloons.
a) The size of small balloons or a group of connected balloons shall not
exceed two (2) feet as the largest dimension, except that balloon
arches not exceeding eight (8) feet in height shall be allowed..
b) Small balloons may be multi colored and incorporate logos and
messages.
c) Helium balloons shall be refilled daily.
2) Tents.
a) Tents, including all ties, ropes, stakes, etc., shall be located entirely
upon the permitee's property and shall comply with the City's
setback requirements for accessory buildings.
1) Bannerettes.
a) Bannerettes may be used on light standards or flag poles.
b) No more than one (1) bannerette shall be allowed per standard or
pole.
c) Bannerettes shall be smaller than any United States flag on the
property, and shall not be flown at the height greater than any United
States flag allowed on the property.
4) Banners.
a) Banners may be attached to poles, tents, and buildings, provided that
are well secured and are prevented from being blown around
uncontrollably by the wind.
b) No more than two ( -�) banners shall be allowed.
c) Banners shall not be larger than on hundred (100) square feet not
higher than the wall of the principal building on the lot.
5) Search lights.
a) Search lights as regulated in Section 401.15.B.7.g.(1) of this
Ordinance.
d. Prohibited Advertising Devices for Events. The advertising devices or
activities described below are prohibited for ,J events:
1) Animated signs, light bulb strings, pennants, portable signs, ribbons,
and streamers.
2) Displays or special features on any landscaped areas or on roofs.
3) Aerial rides.
4) Large balloons or collections of small balloons exceeding two (2) feet in
diameter, except for balloon arches not exceeding eight (8) feet in
height.
5) Additional lighting that does not meet this Ordinance.
6) Any advertising device in the public right -of -way.

f. Violations.
1) It is violation for any person, company, or organization to provide, erect
or display any beacons, balloons or other advertising device which is
not in conformity with the provisions of this Section.
2) Sales event signs and decorations not removed by the last day of the
sales event.
