EnQiI CITY OF OAK PARK HEIGHTS PLANNING COMMISSION MEETING MINUTES Thursday, February 13,2019—Oak Park Heights City Hall Call to Order/Pledge of Allegiance: Chair Freeman called the meeting to order @ 6:02 p.m. Present: Commissioners Giovinazzo, Kremer, VanDyke and White; City Administrator Johnson, City Planner Richards, and City Councilmember Liaison Representative Liljegren. II. Approval of Agenda: Commissioner Kremer, seconded by Commissioner Giovinazzo, moved to approve the Agenda as presented. Carried. 5-0. III. Approval of September 11, 2019 Meeting Minutes: Commissioner Giovinazzo, seconded by Commissioner VanDyke, moved to approve the Minutes with amendment to Commission Liaison Report for clarity. Carried 5- 0. IV. Department/Commission Liaison/ Other Reports: Commission Liaison Liljegren reported that the next meeting of the City Council would be February 25th. V. Visitors/Public Comment: None. VI. Public Hearings: A. Fury Motors Interim Use Permit: Review and consider a request from Leonard Investment LLC for an Interim Use Permit to allow automotive sales and outdoor storage at 14702 60th St. N. City Planner Richards reviewed the February 6, 2020 Planning Report to the interim use permit request for outdoor automotive storage, sales and service, noting that the intent is to seek such use for a period of two-years. Richards provided an issue analysis and discussed the same. Brief Commission discussion ensued as to interim use period, wherein it was clarified that the two-year period was that which the applicant requested, and conflicting language within the planning report recommended approval conditions. Chair Freeman invited comment from the applicant. David Phillips of Phillips Architects introduced himself and responded with regard to set hours within the proposed conditions, that they would prefer to not have them. Mr. Phillips provided a brief history of the site, discussed questions with regard to the frontage road and right-of-way, the condition of the building, and the proposed condition requiring repair. Planning Commission Minutes February 13, 2020 Page 2 of 5 Chair Freeman opened the public hearing at 6:30 p.m. There being no visitors to the public hearing, Commissioner Kremer, seconded by Commissioner Giovinazzo, moved to close the public hearing. Carried 5-0. Commission discussion ensued as to the conditions within the planning report, hours of operation, condition of vehicles placed at site and site lighting. Commissioner Kremer, seconded by Commissioner Giovinazzo, moved to recommend City Council approval of the request, subject to the amended conditions of the February 6, 2020 Planning Report, as amended; specifically, that: 1. The Interim Use of the site by Fury Motors shall be limited to two years from the date of City Council approval. the applicant may request an extension of the Interim Use Permit from the City Council prior to its expiration. 2. The building changes are not anticipated to be subject to Design Guidelines review,but the Applicant shall paint the building, make necessary repairs and provide transparency through the front windows. All paint and repairs shall be completed by June 1, 2020 and are subject to the review and approval of the Building Official. 3. The vehicles parked in the lot will be required to be secured and operable. No wrecked vehicles,body or vehicle parts shall be allowed to be stored outside of the building. Any other vehicles such as buses, campers, and box trucks will be allowed on site but must be parked in the northern one-third of parcel 33.030.20.43.0038. No boats,pontoons, semi-trucks and trailers, other equipment or storage of materials other than the items specifically listed herein shall be permitted in any exterior elevation. 4. The light fixtures existing on the building shall be replaced with full cut off fixtures with shields. Any new lighting of the site will need to be in compliance with the Zoning Ordinance and is subject to review and approval of City staff 5. The outdoor lighting shall be turned off one hour after closing, except for approved security lighting which shall be full cut off 6. Changes to the landscape or new plantings are subject to the review and approval of the City Arborist. The monument rocks at the southwest corner of the site shall be removed no later than June 1, 2020. 7. Jersey barriers stored on the site shall be removed no later than June 1, 2020. 8. Any changes to the grading, drainage or utilities shall be subject to the review and approval of the City Engineer. Planning Commission Minutes February 13, 2020 Page 3 of 5 9. Any new mechanical equipment that is located on the roof or ground level and are visible from street level or from neighborhood properties shall be screened with materials that blend harmoniously with the building façade materials. 10. The fencing for the trash/recycling enclosure shall be repaired. Repair of the enclosure fencing shall be subject to the review and approval of the Building Official. 11. A commercially produced sign shall be affixed to the face of the building that defines the site as operated by Fury Motors and such sign plan shall be provided to the City for review and approval of City staff. The sign shall be installed no later than June 1, 2020. 12. The use of an exterior announcement system shall not be allowed. 13. All storage of materials, parts and supplies shall be to the interior of the building. 14. All vehicle auctions and auto repair activities shall be conducted indoors and the overhead doors to the service bays shall be kept closed at all times except when moving vehicle in and out. 15. Automotive sales and service shall not be conducted between the hours of 8:00 p.m. and 7:00 a.m. unless otherwise allowed by formal action of the City Council. 16. No vehicles with on or off-site related advertising shall be allowed on the site at any time. This includes vehicles displaying painted advertisement or temporary banners. 17. The applicant shall receive and retain, if required, a Hazardous Waste Generators License for batteries, oil and tires from Washington County. Carried 5-0. VII. New Business: A. 2020 Planning Commission Meeting Dates & Commission Representative Schedule: The proposed schedule was reviewed. Commissioner Kremer noted that he could not act as the representative for the September City Council meeting as he would be completing his term in May and would no longer be on the Planning Commission. Chair Freeman shared his thoughts regarding having to lose the contribution and knowledge of a Commissioners due to a term limit and invited discussion on a proposal to amend the Bylaws with regard to term limits. Discussion ensued as to current term limits and possible changes to them, without any action taken to amend the Bylaws. Planning Commission Minutes February 13, 2020 Page 4 of 5 Chair Freemen stated that he would like to see an upcoming Agenda item with regard to generating ides on addressing term limits. The schedule was accepted with amendment, removing Commissioner Kremer as the September City Council meeting representative. B. Allen S. King Plan Decommissioning & Reuse Advisory Panel: City Administrator Johnson reviewed the current status of an advisory panel being formed with regard to the decommissioning of the A.S. King Plant, noting that conceptually, the panel would be charged with working through the decommissioning event and planning for the site in a broad sense. Johnson stated that the panel will be a diverse group, which will not include any Oak Park Heights elected officials, and will include a representative of the Planning Commission. Johnson did not ask for a commitment from the Commission, asking that they think about it and if they have interest in participating to let him know, and that the item would be placed on a future meeting agenda. C. Advertise Commission Vacancy& Term Limits: City Administrator Johnson and Planning and Code Enforcement Officer Hultman discussed the current terms of the Commission, nothing that Commissioner Kremer would be completing his one year special appointment to the Commission on May 31' and that per Planning Commission Bylaws could not seek reappointment and that staff would be advertising the vacancy. The Commission will hold its annual meeting in March, where Chair Freeman will be asked to declare his desire to seek reappointment or otherwise and where the Commissioners will elect a Chair and Vice Chair. VIII. Old Business: A. 2018 Comprehensive Plan—Final Draft Approval: City Planner Richards reviewed his February 6, 2020 Memorandum, noting that the City received Metropolitan Council notification, dated December 18, 2019, that its 2018 Comprehensive Plan had been reviewed and fount to meet all of the requirements of the Metropolitan Land Planning Act. Discussion ensued as to efforts put forth into preparing the plan, Commission desire to keep its elements fresh for the Commission through review and modification discussion during the course of the plan's life versus at the end of it, manner by which such conversation could be accomplished, and the need for a plan to put something in place so that staff could place it on the Commission Agenda for periodic review and/or conversation. Commissioner Kremer, seconded by Commissioner White, moved to forward to City Council with a recommendation to approve and adopt the 2018 Comprehensive Plan as approved by Metropolitan Council. The request would allow replacement of a sign at the northwest corner of the property at 5991 Norwich Avenue North that will be taller and include more square feet of signage area. The sign will include 63 square feet of signage and would be up to 15 feet tall. The site is zoned B-4 Limited Business District in which the shopping center is a permitted use. The development was originally approved as a Planned Unit Development (PUD). The PUD amendment process may be used to allow sign alterations and to increase the amount of signage. EXHIBITS The review is based upon the following submittals: Exhibit 1: Project Narrative Exhibit 2: Picture of Existing Monument Sign Exhibit 3: Aerial Photo Indicating Location of Existing Monument Sign Exhibit 4: Proposed Monument Sign Exhibit 5: Sign Example PROJECT DESCRIPTION Chad Anvary has provided the following narrative describing the request: I am writing you on behalf of OPC Properties to request a PUD Amendment for the current monument signage (Attached as Exhibit A and Exhibit B) to allow for 100 square feet of signage. The current monument sign does not provide adequate visibility and signage for our tenants. The new monument sign would replace the current monument sign and would be in the same location. I have engaged the service of Signs Now to provide a mockup of a new monument sign (Exhibit C) with a design that will reflect the same high-quality materials of the current monument sign and property. I have also attached an example of another monument sign (Exhibit D) that we could work from. We are proud to be a part of the Oak Park Heights community and ownership will spare no expense in the design/construction of the new monument. If approved, we will work closely with the City of Oak Park Heights on the final design/construction of the new monument sign. ISSUES ANALYSIS Comprehensive Plan. The Comprehensive Plan designates this area as Commercial on the Proposed Land Use Map. The use of the property for a retail, services and restaurants is consistent with the Comprehensive Plan. Zoning Ordinance. The property is zoned B-4, Limited Business District in which the shopping center has been approved by a PUD. An amendment to the PUD is required to make sign changes to the freestanding signage. Signage. The existing freestanding sign was constructed at the northwest corner of the property at 60th Street and Norwich Avenue North. It is eight feet tall and includes 48 square feet of signage. The Zoning regulations allow a freestanding monument sign of up to 20 feet in height with 100 square feet of signage. The existing Lowes freestanding sign was constructed with the original development. Additional freestanding signs may be constructed in a shopping center development. The sign regulations for multiple occupancy business buildings are as follows: 4) In any multiple occupancy building qualifying as a shopping center, signs shall be permitted for each common public entrance. Each sign area shall not exceed a total of fifty (50) square feet and shall be located within fifty (50) feet of the common public entrance being served. Attention shall be given to the possible number of tenants or occupant bays which may be served by the common public entrance for which the sign is intended. The proposed sign is designed as a monument sign up to 16 feet tall with 63 square feet of signage. The PUD is required to make sign alterations and to allow the proposed sign to exceed the allowed 50 square foot allowance. 2 A review of the Conditional Use Permit criteria within the Zoning Ordinance should be considered as part of a PUD request. Any signage allowed for the development shall also require a sign permit. Conditional Use Permit. The Planning Commission should consider the following issues and impacts of the proposed project in making its recommendation. The conditional use permit criteria, found in Section 401.03.A.7 of the Zoning Ordinance, are found as follows: 1. Relationship to the specific policies and provisions of the municipal comprehensive plan. 2. The conformity with present and future land uses in the area. 3. The environmental issues and geographic area involved. 4. Whether the use will tend to or actually depreciate the area in which it is proposed. 5. The impact on character of the surrounding area. 6. The demonstrated need for such use. 7. Traffic generation by the use in relation to capabilities of streets serving the property. 8. The impact upon existing public services and facilities including parks, schools, streets, and utilities, and the City's service capacity. 9. The proposed use's conformity with all performance standards contained herein (i.e., parking, loading, noise, etc.). Comment: The expansion of the freestanding sign size and height should not create an issue for neighboring properties and will be beneficial to the shopping center tenants. The additional signage should not create any visibility issues at the intersection in that it is adequately set back from the roadway. There should be no environmental issues with this request. The request is minor and not out of nature with other requests that have been granted to vary from the sign regulations within the Highway 36 corridor. City Staff sees no issues with the request as proposed. CONCLUSION / RECOMMENDATION Upon review of the request for a Planned Unit Development Amendment for replacement of a sign at the northwest corner of the Oak Park Commons property at 5991 Norwich Avenue North, staff would recommend the project with the conditions as follows: 1. The proposed sign shall not exceed 16 feet in height and 70 square feet of signage per sign face. 2. All proposed signage shall require a sign permit and shall be in compliance with Section 401.15.G of the Zoning Ordinance. 3 3. The medical office building will house Orthopedic Clinic services, Physical Therapy Service, Athletic Training, Imaging, and an Orthopedic Urgent Care Clinic. There are also conference/patient education rooms located in the building. The medical office building will be a 2-story building with an attached single story indoor athletic training space. The total building area is 59,900 square feet. The building will have mechanical roof top units to service the building that will be located in a screened area on the roof. The building roof will be drained internally with overflow drains that daylight above grade. There is an exterior enclosure for trash to be collected with easy access for trucks to traverse the site. The site has previously been graded to prepare for building development and there are no significant trees on site. A new landscape plan has been developed and included in the documentation. The site allows for patient and staff parking with a total of 285 parking stalls including 15 accessible parking stalls. The traffic volumes coming to the site on a daily basis is estimated around 60-80 staff daily. The estimated patient volume will be around 500 — 700 patients per day with 85 percent of the patient volume coming to the site between the hours of 7:30 am — 5:30 pm Monday through Friday. The medical office building will be open from 8:00 am to 8 pm seven days a week for Orthopedic Urgent Care. 2 It is the intent to submit a building signage package and permit application after this submittal. The intent for the wall signs has been shown on the exterior elevations for area and location. The intent of the monument sign has been shown on the site plan for the location. Once the signage package has been developed it will be submitted for review and approval. Additional information has been provided related to the Orthopedic Urgent Care Clinic: For non-traumatic injuries, your first stop should be an orthopedic specialist. If you think you have a fracture or an acute (sudden onset) injury and need immediate care, walk in services are conveniently available at our TCO Orthopedic Urgent Care — no appointment necessary. An Orthopedics Urgent Care Clinic has been open at our Stillwater location for 5 plus years. It's a walk-in clinic with no appointment needed and is staffed by an orthopedic provider. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Highway Business/Warehouse on the Proposed Land Use Map. The proposed use is consistent with this land use designation. Zoning. The property is zoned B-3 Highway Business and Warehouse District. The use of the site for a medical clinic is a permitted use in this district. Easement Vacation. The Applicant has proposed a vacation of the existing drainage and utility easement through the property and replacement with a revised easement at the south east side of the property. A public hearing was advertised for the vacation and the City Engineer has provided comments. The easement vacation is subject to review and approval of the City Engineer and the City Attorney. Site Plan. The front of the building is orientated to Memorial Avenue North with parking adjacent to the front entrance. The parking area wraps around the building on the south side to a parking lot adjacent to County Road 15. There is green area around the parking lots and building on the south, east and north sides. Setbacks. The building and parking areas are compliant with all setback requirements. Traffic Circulation/Curb Cuts. The site plan indicates that there will be two curb cuts from Memorial Avenue North. There are numerous landscape islands within the parking lot. The plan has been reviewed and approved by the Fire Marshal for emergency vehicle access. Snow Storage. The plans do not indicate an area for snow storage. The applicant shall indicate where the snow is to be stored. 3 Parking. The following table provides an analysis of proposed and required parking spaces: Parking Area Required Requirements Spaces 1 per 200 SF. + 3 59,880 SF x .9 = 53,892 SF /200 + 3 273 Per ordinance, the site would require 273 parking spaces. The proposed site plan indicates a total of 285 spaces. The Applicant has been encouraged to show some of the parking as proof of parking spaces, possibly the row of parking at the south side of the building. The plans indicate 15 disability stalls which is appropriate for a medical clinic. Landscaping. The submitted landscape plan is subject to City Arborist review and approval. Note the comments that have been made by the City Arborist related to the landscape islands in the parking lot. The Planning Commission should make comment on whether the Applicant increase the size of some of the islands to accommodate the plantings. There is a surplus of parking onsite. City Arborist comments are found as an exhibit to this report. Lighting. The lighting plan indicates the locations of the parking lot and site fixtures as well as the building wall fixtures. The lighting specifications indicate that most of the fixtures to be used in the parking lot and on the walls, will be full cut off and LED. The lighting regulations limit the height from ground level to the top of the fixture at 25 feet. All light fixtures shall be required to be full cut off, compliant with the height requirements, and be consistent with Section 401.15.6.7 of the Zoning Ordinance as it relates to lighting requirements. A photometric plan has been provided that complies with the Ordinance. The plans indicate the use of LED strip lighting on the building facades. The use of strip lighting is not allowed in the Design Guidelines. Trash Storage. The plans indicate a trash enclosure at the north west corner of the building. The enclosure would be constructed from a corrugated metal panel that is also used on the building. Mechanical Screening. Any exterior mechanical equipment, either on the roof or ground mounted will need to be screened in accordance with Section 401.15.E.10.e. of the Zoning Ordinance. The plans indicate that the roof mounted mechanical equipment will be screened. Grading, Drainage, Erosion Control and Utilities. Grading, drainage, erosion control, and utility plans are subject to review and approval by the City Engineer. The City Engineer has provided comments in a separate report that is found as an exhibit. 4 Storm water issues are also subject to review and approval by the Browns Creek Watershed District. Signage. Freestanding Sign. The Applicant has proposed one freestanding sign, placed adjacent to Memorial Avenue. The location of the Memorial Avenue sign is shown on the site plan. The base of the sign will need to be landscaped. Wall Signage. The Applicant has proposed four wall signs on three facades. The north elevation is proposed with two signs which requires a Conditional Use Permit. The Applicant has indicated that the proposed total square footage of 270 feet but has not provided the individual sign sizes. Staff would recommend the second wall sign on the north elevation with the condition that the urgent care sign be removed if that service is discontinued at this location. The Zoning Ordinance would allow for one wall sign, each on separate building facades and two freestanding signs. The total allowable sign area is 300 square feet. Sign Illumination. The proposed plans do not indicate how the signs will be lit. Additional detail is required to review how the signs will be illuminated. The signs will be required to comply with the Zoning Ordinance lighting requirements. Staff will approve the lighting specifications for the signs at the time of permitting. Design Guidelines Architectural Guidelines. Façade Treatments The building will be required to have a definite base, middle and top at its front, side and rear facades. The facades have significant visual interest with a mix of building materials and roof lines. Ground Level Expression This is a two-story building with a front entrance and pedestrian canopy. The main entrance is well defined by the canopy and glass. The height of the building is less than the 35-foot maximum requirement. Transparency The building uses glass on each façade. The transparency requirements are met with this building design. Entries The building features a prominent entry with a canopy and glass. 5 Roof Design The building has a flat roof and curved roof. The rooftop mechanical equipment will be completely screened. Building Materials and Colors The applicant has provided color perspectives for review. The building will be a combination of brick, precast concrete, metal panels, steel, and glass. Building material samples will be provided for the Planning Commission meeting. Franchise Architecture The building is not a franchise design. Site Design Guidelines Building Placement The proposed building has a well-defined entrance and attractive front which is visible from Memorial Avenue North. Parking Areas The parking area includes landscaped areas. Storm water Storm water will be addressed by the City Engineer. Pedestrian and Common Space The plans show a trail along Memorial Avenue that will be constructed at eight feet in width to match the trail adjacent to the Kwik Trip development. Landscaping The overall landscaping plan is a very positive feature of the site. The landscape plan is subject to review and approval of the City Arborist. Trees/Shrubs The trees and shrubs used in the landscape plan shall be subject to the review and approval of the City Arborist. The following includes my comments and/or recommendations: Landscape Plan (Sheet Number L100) The overall design of the plan is attractive and will complement the building well. The plan includes an acceptable species selection of deciduous trees, coniferous trees, ornamental trees, shrubs and perennial plants to be installed ((924) total plantings). All plantings must be on private property not the City boulevard right-of-way. Most plants included in the plan are hardy under local growing conditions, tolerant or resistant to major insect and disease problems and fairly low maintenance. All plant sizes, root and container classes included in the plans conform to the City of Oak Park Heights zoning ordinance requirements. Plant Schedule The final plans must include the following items: 1. Quantities for each variety of tree/shrub/perennial in addition to the total quantity in the Plant Schedule. 2. Include the symbols used in the Landscape Legend also in the Plant Schedule. 3. Include the spacing for Coniferous Shrubs, Deciduous Shrubs and Perennials in the Plant Schedule (revise X'-X" O.C. and X" O.C.). 4. I recommend replacing Malus 'Red Splendor' with a disease resistant variety such as Malus 'Prairifire' or another species such as Syringa reticulata 'Ivory Silk'. TREE CITY U.S.A. Landscape Requirements The locations chosen for most plants are appropriate. The only exception would be the placement of the trees in the parking lot islands. The trees included in the plans for the islands can grow to be very large at maturity (25' spread x 25' tall) even though they are ornamental trees. The parking lot medians typically will not allow enough rooting space for these trees to grow to a healthy maturity and will create traffic visibility conflicts in the future. I recommend replacing the ornamental trees that will be larger at maturity with ornamental grasses or ninebark shrubs (both are low maintenance). Landscape Details (Sheet Number L101) Plantinq Notes/Plantinq Detail The landscape notes and planting detail submitted is acceptable. Please include the following items on the final plans: 1. All trees must be landscape grade trees of good form and structure not Park Grade trees. Trees with poor form will be more prone to storm damage and failure in the future. Please include this in the planting notes. 2. Burlap, wire and all rope must be removed from the top 12" of the root ball on all trees. 3. All trees must be straight and not need staking after planting. Contractor shall stake trees only if the tree(s) begin to lean within the guarantee period, please include this in the final planting notes. 4. The landscape contractor is required to plant trees and shrubs according to the approved planting detail diagrams and landscape notes submitted with the final approved landscape plan. This will be checked after planting and any deviations from the plans must be corrected before the landscaping will be approved by the City, this needs to be noted in the final plans. 5. Contractors doing any type of tree work must secure a City of Oak Park Heights Tree Worker's License for 2020 from the City of Oak Park Heights Building Department. All required documents must be submitted with the application. 6. The City Arborist will conduct an Initial Landscape Inspection after all plants/trees, mulch, ect. have been installed. 7. The City Arborist will conduct a Final Landscape Inspection typically (1) year after installation, at the end of the plant guarantee period. For Final Acceptance of Installation and Landscape Plants the specified planting procedures must have been followed and all plants must be alive and in good condition at the end of the plant guarantee period. Election of Chair and Vice Chair: Planning Commission Bylaws Article 4 Officers, Duties and Election of Officers, section D, which states: "Terms. The Planning Commission officers shall be elected from among its appointed members for the term of two years. No member shall serve as Chairperson or Vice-Chairperson for more than two consecutive terms. The election shall occur at the Planning Commission's annual meeting." The Commission elected Commissioner Freeman as Chair and Commissioner Giovinazzo as Vice- Chair at their 2018 Annual Meeting for a two-year term, which will conclude at the 2020 Annual Meeting. They may both be re-elected to Chair or Vice Chair. Commissioners VanDyke and White may also be elected to either Chair or Vice Chair. The Planning Commission should elect a Chair and a Vice Chair to serve in their respective role for a period of 2 years, following the 2020 Annual Meeting and until the Annual Meeting in 2022. CITY OF OAK PARK HEIGHTS PLANNING COMMISSION BYLAWS ARTICLE 1 - ORIGIN AND POWERS A. Authorization. The City is authorized and empowered to establish a Planning Commission by the provisions of Minnesota State Statutes 462.354. B. Establishment. The Planning Commission was created in an advisory capacity by action of the Oak Park Heights City Council on April 14, 1998 by the adoption of Ordinance 210 and the amendment of Section 401, the Oak Park Heights Zoning Ordinance. ARTICLE 2 — DUTIES AND OBJECTIVES A. Advisory Capacity. The Planning Commission is designed to serve in an advisory capacity to the Oak Park Heights City Council. B. Objectives. The objectives of the Planning Commission are to make recommendations to the City Council which will guide the development of land, services and facilities within the City, so as to promote the public health, safety and general welfare. C. Public Hearings. The Planning Commission shall hold public hearings for variances, conditional use permits, subdivisions, PUD permits, and other applications to the City in accordance with the City Zoning Ordinance and shall make recommendations on said applications to the City Council. D. Special Public Hearings. The Planning Commission may hold such public information hearings as the City Council deems necessary and may make recommendations on applications for building permits or site plan review when requested by the City Council. ARTICLE 3 — MEMBERSHIP A. Voting Members. The Planning Commission shall consist of five citizen members who are eligible voters residing within the Oak Park Heights City limits and who are appointed by the City Council. B. Ex-Officio Members. There shall be a City Council person designated by the Mayor, with the consent of the City Council, to be a liaison to the Planning Commission. Such City Council person shall serve without voting power and in a capacity as ex-officio to the Planning Commission. The Mayor, with the consent of the City Council may also appoint non-voting, ex-officio members to represent other groups or organizations from the community. C. Terms. The five members of the Planning Commission shall be appointed by the City Council. All such appointments shall initiate and be established by resolution of the City Council. The term of each member shall be for three years with initial terms being staggered by the City Council resolution of appointment. Unless extended by special order of the City Council for a period of one year; no member shall serve more than two consecutive terms on the Planning Commission. D. Absenteeism. If any voting member fails to attend three consecutive meetings or a total of four meetings (or 25 percent) during the calendar year, the City Council shall be notified with a recommendation by the Planning Commission. Planning Commissioners shall notify the Chairperson or City staff when an absence is anticipated. E. Removal. Any member of the Planning Commission may be removed at any time by a four-fifths (4/5) vote of the City Council with or without cause. F. Compensation. Compensation of Planning Commission members as selected by the City Council shall serve without compensation except as otherwise established by resolution of the City Council. G. Training. The Chairperson and the City staff shall meet with each new Planning Commissioner to explain Planning Commission procedures. Within the first year of appointment, each new Planning Commissioner shall attend a Government Training Service, Planning Commission training session at City expense. H. Resignation. A member who wishes to resign shall submit a written resignation to the Chairperson, who shall in turn forward the same to the City Council. Vacancies. Vacancies occurring within the Planning Commission shall be filled for the balance of the appointment by the City Council. 2 ARTICLE 4 — OFFICERS, DUTIES AND ELECTION OF OFFICERS A. Officers. The officers of the Planning Commission shall be Chairperson and Vice-Chairperson. B. Duties of the Chairperson. The Chairperson shall preside at all meetings, appoint Planning Commission members to committees, appoint Planning Commission representatives, rule on procedural questions (subject to reversal by a two-thirds (2/3) vote of those members in attendance), meet with all newly appointed members, exercise the same voting rights as other Planning Commissioners and carry out such other duties as are assigned by the Planning Commission or by the City Council. C. Duties of the Vice-Chairperson. The Vice-Chairperson shall act in the absence or inability to act of the Chairperson, and in such instances, shall have the powers and functions of the Chairperson. D. Terms. The Planning Commission officers shall be elected from among its appointed members for the term of two years. No member shall serve as Chairperson or Vice-Chairperson for more than two consecutive terms. The election shall occur at the Planning Commission's annual meeting. E. Vote. Candidates for office receiving a majority vote of the entire membership (three-fifths (3/5)), shall be declared duly elected. F. Date of Office. Newly elected officers shall take office at the annual meeting in March. G. Vacancies. Vacancies occurring in the offices of the Planning Commission shall be filled immediately by the above election procedure. ARTICLE 5 — MEETINGS A. Annual Meeting. An annual organizational meeting shall be held the second1 Thursday in March of each year. Election of officers shall be conducted at that time. B. Regular Meetings. Regular meetings of the Planning Commission shall be held at 6:00 PM on the second Thursday of each month in the City Hall Council Chambers. The regular meeting date of the Planning Commission may be changed by resolution of the City Council. C. Special Meetings. Special meetings may be called at the discretion of the Chairperson, after consultation with City staff. 3 D. Notice of Meetings. Notice in writing of all regular and special Planning Commission meetings, setting forth the time, place and agenda of such meetings, shall be mailed by the City staff to all Planning Commission members at least five days in advance of each meeting. E. Site Investigation. Prior to each meeting, all Planning Commission members shall endeavor to visit any properties to be discussed at the meeting. F. Planning Commission Representative at City Council Meetings. Each Planning Commission member shall in turn represent the Planning Commission at regular City Council meetings. ARTICLE 6 — PRE-MEETING PROCEDURES A. Agenda. The agenda for each meeting of the Planning Commission shall be developed in writing by the City staff and shall be available at the City Hall prior to each meeting. B. Withdrawal. If a petitioner or applicant desires to withdraw a matter from an agenda, such request must be submitted to the City staff in writing, and if any public notice has been given, all persons appearing at the noticed hearing on said petition or application shall be entitled to be heard. ARTICLE 7 — PUBLIC HEARING PROCEDURE A. Time. The time of each public hearing shall be stated on the agenda, and no hearing may begin before this time. Each hearing shall begin as soon as possible after this time. B. Presentation. If a public hearing is required for a request by a petitioner, the petitioner or an appointed representative shall state the request, explain the proposal and answer questions of the Planning Commissioners. If no petitioner is involved, the Chairperson or the City staff member shall explain the purpose of the hearing. The Chairperson may impose reasonable restraint upon the number of times one individual may speak. C. Termination of Hearing. The Chairperson may close a public hearing after hearing those present who care to speak, or any member may move to continue the public hearing until a specified date. If a hearing on the petitioner's request is closed, the Planning Commission shall make a recommendation to the City Council within 30 days following the close of the hearing. If a hearing is continued, mailed notices of the continuation may be requested by any voting member. 4 ARTICLE 8 — MEETING PROCEDURES A. Rules of Order. Unless otherwise specifically designated, Roberts Rules of Order, as most recently revised, shall govern the meeting procedure. B. Quorum. A majority of the voting membership (three-fifths (3/5)) shall constitute a quorum for meeting purposes. C. Conflict of Interest. Whenever a Planning Commission member shall have a direct or indirect personal or financial interest in an application or petition before the Planning Commission, that member shall declare such interest and excuse himself/herself from the discussion and vote. D. Agenda. The order of business at regular meetings generally shall be as follows: 1. Call to order. 2. Roll call of members. 3. Approval of the minutes of the previous meeting. 4. Public hearings. 5. Informational hearings. 6. Old business. 7. New business. 8. Adjournment. E. Appearance of Petitioner. No application or petition shall be given final approval unless the applicant or petitioner appears personally or by representative at the hearing called thereon, or unless he/she makes satisfactory explanation or presentation in lieu thereof. F. Tabling. A tabling motion, if passed, has the effect of laying a matter over until the next regular meeting, unless otherwise specified. G. Reports. Any matter may be tabled for a technical report or study which the Planning Commission may make or request of the petitioner, the City staff, the City Attorney, the City Engineer or other sources. Such report shall be presented to the City staff for forwarding to the Planning Commission at least five days prior to the meeting at which said matter will be heard again. H. Non-Agenda Matters. No binding or final action may be taken on any matter not on the written agenda except by unanimous vote of the members in attendance or four-fifths (4/5) vote of the entire membership. 5 ARTICLE 9 — COMMITTEES A. Planning Commission Committees. The Planning Commission may establish committees of its own membership for a specific purpose and duration. B. Ad Hoc Committees. The Planning Commission may request that the City Council appoint other members of the community to Ad Hoc Commission committees, which may be created by the Planning Commission for a specific purpose and duration. At least one voting member of the Planning Commission also shall be appointed to each such committee. ARTICLE 10 — RECORDS A. Minutes. The City shall supply a secretary at all regular and special meetings of the Planning Commission who shall be responsible for taking full and complete minutes and record all such meetings. The City staff shall be responsible for keeping a record of all Planning Commission resolutions, transcriptions, minutes and findings. B. Open Meetings. All meetings shall be a matter of public record. Naturally, the entire Planning Commission cannot serve on that Panel and the Council would prefer one individual as outlined in the Policy. I believe I incorrectly stated more than one-member last month. That said, perhaps the Planning commission could select one of these two persons and appoint the other as an alternate and I would take that concept to Council. The first meeting is expected in late MAY and be monthly thereafter; STAFF would anticipate most meetings would be in the evenings. ADOPTED 2/25/20 CITY OF OAK PARK HEIGHTS POLICIES RELATING TO THE ALLEN S.KING PLANT DECOMMISSIONING AND REUSE ADVISORY PANEL—APPOINTMENTS AND ROLES PURPOSE: The City Council desires to appoint an Advisory Panel to inform and support the City Council's decision making regarding the future of the Allen S.King Plant.The following policy shall govern the formulation of this group, describes its role and relationship with the Council and what the expectations are from participating members. Invitation to Serve on the Advisory Panel: The City desires participation from a number of parties generally known in the community with an apparent stake or clear interest in such dialogue and which includes the organizations listed below. These entities will be sent a Letter of Invitation to participate in the City's process and such invitation shall be signed by the Mayor and every Council member.Each group,or organization if they desire to participate shall nominate a SINGLE representative, who is expected to be available to attend 10-12 monthly meetings. The City's desire is that such person would generally relay the views of the organization they represent where possible.All members so appointed shall be reviewed and approved by unanimous consent of the City Council. 1. Interested individuals shall submit a letter and application to the Council explaining their role in the community and interest in serving on the Advisory Panel.Depending on the level of interest,the Council may choose to decrease or increase the number of at-large members. Locally Elected Officials are precluded from serving on this Panel where they directly represent a given city, school district, county's interest. In the case of these public organizations the appointment of staff,volunteers, or other appointed officials to their respective bodies is requested. For example: The City of Stillwater may appoint their Planning Commission Chair who is a non-elected person but is appointed by the City Council. In circumstances where there is a"joint-powers"organization such as the MSCWMO or WCCDA,appointment of Staff or Non-elected officials is preferred. However, this may result on overtime expenses or budgetary constraints that may preclude participation.If such staff or other volunteer is not available and if such JPA board members are elected individuals and are available,the City Council may evaluate these on a case-by-case basis so as to ascertain their underlying entity and relationships.Any person so appointed would be expected to clearly represent the joint-powers entity,not their primary jurisdiction. Appointment of Co-Chairs: The City Council also desires the appointment of CO-CHAIRs positions so as to better ensure continuity of the process in the event one person cannot attend.The role of the"co-chair"is to ensure the meetings move forward and to facilitate the discussion and presentations and in allotted time. In all respects,the CO-CHAIR position acts only as manager to ensure the process remains vital and fluid and not to advocate for any given position. The Mayor or a Council Member may nominate and the Council shall appoint up to two co-chairs, any such appointment shall be by unanimous vote of the City Council.If no chair(s)can be determined,the Panel shall be managed by City Staff or City Consultant until such time as a CO CHAIR can be found.A CO-CHAIR may be removed from the Panel by simple majority of the Council. The appointed CO-Chair individuals may or may not be otherwise listed in the invited participation listing stated above, if not listed they shall become full members of the Panel once appointed. Further Expectations of the Advisory Panel: The meetings are generally anticipated to be a method by which Panel Member can avail themselves of the best available information regarding the many facets of regulations,challenges and opportunities related to this site. Fundamentally, few— if any, decisions are expected to be made by the Panel itself. As the discovery process unfolds,all members of the Advisory Panel are expected to follow a Code of Conduct that will be provided by the City and which will outline rules of discussion and how any collective recommendations might be made.All members serve at the pleasure of the City Council and the City Council may amend the number of participants or which participants at any time at its sole discretion. Guests&Public Visibility: The City would expect to invite elected or appointed officials to attend the meetings —not as a panelist, but instead offer them an opportunity to listen and gain more information as to what is being accomplished. These guests would include: Metropolitan Council Sector 12 - Board Member Local legislators, MPCA, and other governmental organization representatives. Guests will be welcomed at meetings and materials will be shared with them,as supplies permit.Otherwise copies will be available for download from the City Website. The general public is also welcome to view and listen to these meetings as space allows,but such meetings are not PUBLIC HEARINGS and data presented and dialogue held is for the primary benefit and consumption of the Panel Members. City Council Role: Oak Park Heights elected officials may not serve on the Advisory Panel as the work of the Advisory Panel is intended to support the Council in its decision making regarding the future of this property.The Council will be fully briefed by the Consultant,following every working meeting.The Council will have the opportunity to either accept and embrace Panel recommendations, or direct course corrections, as needed. As it relates to City Council general interface with City Consultants,these communications should be channeled through City Staff similar to current City protocols.
