Call to Order/Pledge of Allegiance/Approval of Agenda: Mayor McComber called the meeting to order at 5:04 p.m. Present: Councilmembers Johnson, Liljegren and Runk. Staff present: City Administrator Johnson, City Clerk Pinski, City Attorney Kevin Sandstrom, City Planner Richards and City Engineer Mann. Absent: Councilmember Dougherty. Mayor McComber added Consent Agenda Item O: "Approve Resolution Granting the Application of MDHA St. Croix Valley Chapter to Conduct a One-Day Raffle at Heights Hall and Club on April 4, 2020" and New Business Item F: "Lookout Trail—Turnback Agreement— MNDOT/OPH" to the agenda. Councilmember Runk, seconded by Councilmember Liljegren, moved to approve the Agenda. Carried 4-0. II. Council/Staff Reports: A. Mayor McComber: She reported she attended the League of Minnesota Cities advocacy media training; a meeting on Build It Right; a breakfast meeting with City Administrator Johnson and Xcel Energy; a meeting with Representative Lippert the previous week at the state house; the City Administrators, Mayors, and Chamber breakfast meeting that morning; and a meeting with Department of Corrections on their new strategic plan. She said she would be attending the Minnesota Association of Small Cities Legislative day, a board meeting and a reception; a meeting with Representative Doudt and Representative Gazelka; and a meeting with Governor Walz; and she would be testifying before the Energy Finance Policy Committee on the energy renewable grants. She also said there was a social medial webinar scheduled the following week. B. Councilmember Dougherty: Absent, C. Councilmember Johnson: She reported that the Parks and Trails Commission meeting for February was cancelled. She said she received calls on snowplowing which the City Administrator addressed. D. Councilmember Liljegren: He reported the Planning Commission met on February 13 and the next Joint Airport Zoning Board meeting was set for March 25 at 3:30 p.m. E. Councilmember Runk: He reported he attended the CVB meeting, and that the February Middle St. Croix Watershed Organization's meeting was cancelled. Visitors/Public Comment: Jim Kremer of 5475 Oakgreen Place North said he was extremely disappointed how the City Council was treated by the Mayor of Bayport at the last City Council meeting. Old Business: A. 2020 Street Improvements—Award Bid: City Administrator Johnson reported that the City received bids, and that the funding would be derived from two sources: the Mill and Overlay Fund and the Street Reconstruction Fund. He said that the City would seek reimbursements Page 7 of 164 City Council Meeting Minutes February 25, 2020 Page 3 of 5 from Baytown Township in the amount of$63,983.58 plus related soft costs. City Engineer Mann reported that the City received eight bids, and the low bid was $866,791.00 made by OMG Midwest, Inc. dba Minnesota Paving and Materials. Councilmember Runk, seconded by Councilmember Liljegren, moved to move forward with the project and award the bid to OMG Midwest, Inc. dba as Minnesota Paving and Materials. Carried 4-0. VII. New Business: A. Fury Jeep—Interim Use Permit Automotive Storage and Sales 14702 60`" Street N: City Planner Richards reviewed his planning report. Councilmember Liljegren, seconded by Councilmember Runk, moved to approve the Resolution. Roll call vote taken. Carried 4-0. B. Chief of Police—Possible Retirement and Hiring Process: City Administrator Johnson stated that the City should start the process for identifying a replacement for the Chief of Police after his retirement. A timeline was included in the City Council packet, and he proposed a committee of two members of the City Council, the City Administrator, the City Attorney, the City Clerk or other senior staff member, and a possible consultant or former Chief from a Minnesota City. Councilmember Liljegren and Mayor McComber said they would like to be a part of the process. Mayor McComber suggested having a worksession to go over the job description before the next City Council meeting and suggested each councilmember provide input on what they were looking for in the next Chief Councilmember Runk suggested the City seek out a former Chief from a City in Washington County for the committee. McComber suggested having a list of potential Chiefs ready for the worksession. Councilmember Johnson, seconded by Councilmember Liljegren,moved to set a worksession for 5:00 p.m. on March 24, 2020. Carried 4-0. City Administrator Johnson recommended the City Council start a list of 2020 goals for that worksession as well. C. Comprehensive Plan—2018 U date/Ado tion: Councilmember Runk seconded by Councilmember Li1jegren, moved to approve the Resolution. Roll call vote taken. Carried 4-0. D. Allen. S. King Plant Decommissioning and Reuse Adviso Panel: City Administrator Johnson said the invitation for the various agencies identified in the policy was set up to be signed by the Mayor and all Councihnen-ibers. He recommended an edit to the policy to provide joint Page 8 of 164 City Council Meeting Minutes February 25, 2020 Page 4 of 5 powers associations, such as the watershed, to appoint an elected official if they were unable to send a staff member or other volunteer to be on the panel. Councilmember LiIjegren, seconded by Councilmember Johnson,moved to approve the panel participation invitation and policy revision. Carried 4-0. E. Waste Receptacles Curbside After Pickup Dav: Mayor McComber suggested sending letters to residents to remind them not to leave waste containers in the street as it impeded snow plows, emergency vehicles, and street sweepers. City Administrator Johnson suggested that sending a letter would be costly. Mayor McComber requested an article be placed in the next City newsletter. F. Lookout Trail—Turnback Agreement—MNDOT/OPH: City Engineer Mann reviewed and addressed the items that were brought up to the City Council by resident David Beaudet at their meeting in January. City Administrator Johnson reported that the land swaps had been completed. He said that the stormwater facilities that cross Lookout Trail or are along the West side of Lookout Trial remain the City's facilities to manage and maintain regardless of this project or turnback, but the City would want language in the agreement that would assure the City unambiguous continuation of the facilities and their drainage, and that MNDOT would not be asking the City to divert the water to a different pond. City Administrator Johnson also said there were ponds that were part of the St. Croix River Crossing project that had significant capacity, and the City needed language in the agreement that the City could use the capacity for new or current impervious surfaces. City Engineer Mann said that while Lookout Trail would not drain directly to those ponds, the overall net of the drainage in the area going to the receiving water would be covered. He said the watershed indicated they were willing to agree to the that. Councilmember Runk, seconded by Councilmember Johnson, moved to approve the agreement subject to any final language required by City Engineer or the City Attorney. Carried 4-0. VIII. During Arbor Month the benefits of tree care and the importance of tree plantings are expressed. Arbor Day and Arbor Month are a great way to get the community active outdoors and make a difference in the appearance of their property and city parks. The City of Oak Park Heights has been named a Tree City USA for 37 years strong and the award is valued greatly by the community. Therefore recommend the Council to proclaim Friday April 24th 2020 Arbor Day in the City of Oak Park Heights and the month of May to be Arbor Month in the City of Oak Park Heights. Consumption and Display Permits are issued by the State of Minnesota but require local approval (MN Stat 304A.414, Subd. 5). This permit allows for a business to allow consumption but not sell alcohol. Staff has reviewed the permit application and is requesting approval by the City Council. Page 15 of 164 I MINNESOTA STATUTES 2019 340A.414 340A.414 CONSUMPTION AND DISPLAY PERMITS. Subdivision 1. Permit required. No business establishment or club which does not hold an on-sale intoxicating liquor license may directly or indirectly allow the consumption and display of alcoholic beverages or knowingly serve any liquid for the purpose of mixing with intoxicating liquor without first having obtained a permit from the commissioner. Dental of a public facility does not make a subdivision or the facility a "business establishment" for the purposes of this chapter. Subd, la. Additional authorization.A holder of a consumption and display permit under this section who wishes to allow the consumption and display of intoxicating liquor between the hours of 1:00 a.m. and 2:00 a.m.must obtain authorization to do so from the commissioner. The authorization may be provided in a document issued to the permit holder by the commissioner,or by a notation on the permit holder's permit. Authorizations are valid for one year from the date of issuance. The annual fee for obtaining afflhoriz.Lttion is $200. The commissioner shall deposit all fees received under this subdivision in the alcohol enforcement account in the special revenue fund. A person who holds a consumption and display permit and who also holds a license to sell alcoholic beverages at on-sale at the same location is not required to obtain an authorization under this subdivision. Subd. 2. Eligibility for permit. (a)The commissioner may issue a permit under this section only to: (1)an applicant who has not,within five years prior to the application,been convicted of a felony or of violating any provision of this chapter or rule adopted under this chapter; (2) a restaurant; (3)a hotel; (4)an establishment licensed for the sale of 3.2 percent malt liquor; (5)a resort as defined in section 157.15; (6) a club as defined in section 340A.101, subdivision 7,or an unincorporated club otherwise meeting that definition; and (7) a bed and breakfast facility as defined in section 340A.4011, subdivision 1. (b)The commissioner may not issue a permit to a club holding an on-sale intoxicating liquor license. Subd. 3. Only authorized to permit the consumption and display. A permit issued under this section authorizes the establishment to permit the consumption and display of intoxicating liquor on the premises. The permit does not authorize the sale of intoxicating liquor. Subd.4. Permit expiration. All permits issued under this section expire on March 31 of each year. Subd. 5. Local consent required.A permit issued under this section is not effective until approved by the governing body of the city or county where the establishment is located. Subd. 6. Permit fees. The annual fee for issuance of a pen-nit under this section is$250.The governing body of a city or county where the establishment is located may impose an additional fee of not more than $300. Subd. 7. Inspection. Subd. 8. Lockers. A club issued a permit under this section may allow members to bring and keep a personal supply of intoxicating liquor in lockers on the club's premises. All bottles kept on the premises must have attached to it a label signed by the member. No person under 21 years of age may keep a supply of intoxicating liquor on club premises. Subd. 9. One-day city permits. A city may issue a one-day permit for the consumption and display of intoxicating liquor under this section to a nonprofit organization in conjunction with a social activity in the city sponsored by the organization. The permit must be approved by the commissioner and is valid only for the day indicated on the permit. The fee for the permit may not exceed$25. A city may not issue more than ten permits under this section in any one year. PURPOSE/INTENT 1.1. Street Sweeping The purpose of this agreement provides the City of Oak Park Heights (hereinafter City) and St. Croix Sweeping (hereinafter called Contractor) with a mutually acceptable agreement to provide planned and emergency scheduled street sweeping operations on local city streets,roadways,and parking lots within the City of Oak Park Heights, Minnesota. 1.2. Administration This agreement shall be entered into with the City of Oak Park Heights, administered by the Public Works Director and under the direct operational supervision of the Public Works Director and or his designee. 1.3. Routes The Public Works Director and/or his designee will determine which streets are to be swept and shall schedule all sweeping operations with the Contractor. 1.4. Street Sweeping Policy This City sweeping policy requires three sweepings of the City streets per year. It is the intention of the City to retain the services of the Contractor for each sweeping operation. In addition,the City may request additional sweepings of single streets or sections of the city as required.These additional sweepings include cleanup days or are generally due to construction activities, storms or other unplanned activities that require street sweeping. Scope of Operations The City requires that the Contractor provide a minimum of one (1) piece of equipment to perform the entire sweeping operation with a dump truck for hauling sweeping waste material. 2. LENGTH OF AGREEMENT 2.1. This agreement shall be an initial agreement for the sweeping season commencing April 2019. This agreement may be renewed by written mutual consent of both the City and the Contractor. 2.2. This agreement may be terminated by the City at any time during the agreement, without penalty,by written notice delivered by certified mail sent to the Contractor at the address referenced on the proposal form. 2.3. The City cannot and will not guarantee a minimum number of work hours for any sweeping operation or duration of the agreement. 3. EQUIPMENT 3.1. Street Sweeper Only contractors using commercial grade equipment such as an"Elgin Pelican" or"TYMCO"or equivalent will be considered as qualified contractors.All sweeping equipment must use a water spray system to suppressed dust. 3.2. Dump Truck The Contractor shall provide a minimum of one(1)truck equipped with a dump bed for transport of sweeping waste material. 3.3. Skid Loader At certain locations within the City sand used for snow and ice control may accumulate to a point where a Street sweeper cannot effectively remove the material. In these areas the contractor shall provide a skid loader or manual labor Page 25 of 164 for removal of the bulk of the material prior to sweeping. Skid loader or other equipment work may be required for other work in the City of Oak Park Heights. 3.4. Accessories& Safety Equipment The Contractor and his employees shall follow all federal, state, county or other laws that may be in effect related to the performance of this project. All vehicles shall be properly equipped and outfitted to meet all local, county, state and or federal laws required for on the road emergency sweeping operations. Such vehicles shall provide the operator with full visibility in 360-degree direction and shall have a backup warning system. The operator's cab shall be fully enclosed and properly equipped with all equipment necessary to allow the efficient and safe operation of that vehicle. The City reserves the right to reject at any time,without notice to the contractor, any vehicle that does not comply with all rules or regulations required for on the road sweeping operations. Rejection of a vehicle's acceptability will also take into consideration the condition and limitations of operation the vehicle or its accessory equipment. 3.5. Vehicle Designation/Replacements The Contractor shall provide to the City a copy of the certificate of title including the vehicle identification number(if available)and license plate number within 10 days of execution of this contract. After inspection by the City,the City will verify those vehicles acceptable for performance under this contract. Except for emergencies, any planned substitution or replacement of previously approved equipment shall require prior written approval by the City. 3.6. Identification of Disposal Site and Indemnification The disposal site and any temporary storage sites for the street sweeping waste material must be identified by the contractor prior to the beginning of sweeping. The contractor agrees to indemnify and hold harmless the City with regard to any liability resulting from the storage and or disposal of the sweeping material. The storage and disposal site shall meet all applicable county, state and or federal Page 26 of 164 rules and regulations for storage and disposal of Municipal Street sweeping waste material. 4. OPERATOION& MAINTENANCE 4.1. Operator The Contractor shall ensure that the operator provided with each piece of equipment is fully trained and properly licensed with the state of Minnesota to operate the vehicle and or anticipated replacement. The Contractor shall make every effort possible to assure that the same operator performs the sweeping operation throughout the duration of this agreement. The Contractor shall certify that the operators have completed all necessary safety training. 4.2. Parts and Fuel The hourly rates contained herein shall cover all operation and maintenance expenses including but not limited to fuel, lubricants, supplies and support services. It shall include all labor,tools and equipment necessary for making any and all repairs or replacements which may be necessary to keep and maintain the machine and all parts thereof in proper and safe working order. 4.3. Storage The Contractor shall assume all responsibility and costs associated with maintaining proper and necessary protection/shelter/storage for all vehicles and equipment. Equipment storage is not allowed on City property unless specific use is in the City's best interest during the sweeping event and then it is limited to temporary storage only with prior approval from the Public Works Director or his designee. 5. HOURLY RATES 5.1. EgMigment and Operators All hourly rates quoted and attached hereto shall include full operation of the equipment by a qualified operator. 5.2. Quantities All rates quoted shall be on an hourly basis and shall be rounded to the nearest one 0.1 (tenth) of an hour. Page 27 of 164 5.3. Premium/Overtime No premium calculation or additional adjustment shall be given to the rates quoted for any hours worked regardless of the day, date,time of day or consecutive hours worked in any giving sweeping operation or calendar week unless specifically provided for in the agreement under section 7.1. 5.4. Nonproductive/Downtime The hourly rate shall be paid for the actual number of hours the machine is operated under the direction of the City. The City shall not be responsible for payment for any time taken for rest or meal breaks. However,the City will recognize payment for onsite routine maintenance and repairs or adjustments necessary to keep the machine properly operating. This allowance shall be provided for only those pieces of equipment previously approved by the City for required sweeping operations under this agreement. 6. PERFORMANCE REQUIREMENTS 6.1. Personnel The Contractor shall provide the City with the name,address and telephone number(s)for at least two designated contact personnel responsible for assuring response to the City's request for service. The Contractor shall ensure that at least one of the contact people is available and assessable 24 hours per day seven days per week. 6.2. Response Time The Contractor shall respond and begin sweeping operations within two(2)days and no later than four(4)days from the start time requested by the City for any given sweeping request, weather permitting. The Contractor shall ensure that the equipment and operator are ready and able to continuously provide sweeping services through the completion of the sweeping operations designated by add to the satisfaction of the City. The Contractor shall not allow any given operator to work more than sixteen(16) consecutive hours without an eight(8)hour break. The Contractor will be responsible for providing replacement personnel if sweeping operations require more than sixty(60)consecutive hours of operation. Page 28 of 164 6.3. Down Time The Contractor shall assure that all equipment provided is maintained in a proper manner to minimize required maintenance or emergency repairs during the performance of sweeping operations. If,when commencing a sweeping operation,a piece of equipment becomes disabled and nonfunctional for a period of three (3)consecutive days,the contractor shall provide a satisfactory replacement vehicle and operator if necessary at no additional cost to the City. 6.4. Communications The Contractor will maintain communication with the City throughout the duration of any given sweeping operation. The Contractor shall ensure that the operator maintains full availability for communication at times during sweeping operations. The Contractor will maintain continuous communication with their operators such that directions from the City can be relayed to the operator in a timely manner. 6.5. Authority/Direction The Contractor and his designated operator shall respond to all directions given by the City in a positive,courteous and timely matter during sweeping operations. The City reserves the right to reject any piece of equipment or operator from continued or further engagement of services due to incompetence, insubordination or inability to function properly for requested services. The contractor shall begin sweeping operations at a designated point and follow a specific progression as directed by the City. 6.6. Law Obedience The Contractor and his designated operator shall be responsible for their actions and compliance with all regulatory laws and ordinances governing the operation of the machine while performing sweeping operations for the City. 6.7. Non Performance The Contractor shall waive any and all objections,rights to objections and claims for additional compensation, damages or loss of revenue resulting from work performed by the City or its designee either prior to, during or after any scheduled or emergency sweeping operation in Lieu of these contractual services Page 29 of 164 as may be necessary due to nonperformance or excessive delays of the Contractor. 6.8. Property Damage The Contractor shall be responsible for any and all damages to private and public property(including public utilities) due to his own or his employee's negligence in performing sweeping operations. 7. COMPENSATION 7.1. Payment Schedule All pay requests must be prepared and submitted by the contractor as verified and approved by the Public Works Director.All pay requests received and approved by the Public Works Director shall be processed and payment made by the City not more than thirty(30) days after receipt. 7.2. Down Time No payment shall be made for any nonproductive or downtime of any singular sweeping operation. Compensable time shall include all time spent performing the sweeping operation subject to the exclusions identified herein and shall include all time spent performing the sweeping operations subject to the exclusions and identified herein and shall include travel time to and from the contractors base of operations or City limits,whichever is the shorter distance. 7.3. Liquidated Damages for Untimely Performance If the Contractor consistently is not able to respond and begin sweeping operations within four(4)days after the time requested by the City,penalties will be assessed as follows: 5%of the rate quote herein will be deducted for each day or portion thereof beyond four(4)days to when operations begin, Starting with the second untimely response and every time thereafter. If the Contractor does not respond within seven(7)days of the City's requested time of initiation,the City shall,at its discretion hire a different contractor for that sweeping event. Page 30 of 164 8. INSURANCE/LUBILITY CLAIMS 8.1. Indemnification The Contractor indemnifies and holds harmless the City and all of its agents and employees of and from any and all claims, demands, actions or causes of action of whatsoever nature or character arising out of or by reason of the Contractor's performance under this agreement. It is hereby understood and agreed that any and all employees of the contractor and all other persons employed by the Contractor in the performance of services under this agreement,required or provided four here under by the contractor shall not be considered employees of the City and that any and all claims that may or might arise under the workers compensation act of the state of Minnesota on behalf of set employees while so engaged in any and all claims made by any third parties as a consequence of any act or omission on the part of said contractors employees while so engaged in the performance of the services,to be rendered herein by the Contractor shall, in no way,be the obligation or responsibility of the City. 8.2. Insurance The Contractor shall,at his sole expense, carry and maintain liability insurance coverage in an amount not less than$1,000,000 protecting the Contractor, his employees and the City against any and all claims of any kind or character whatsoever arising from the damage,injury including bodily injury or death caused by or arising from the operation and use of the machine at the request of the City. Such insurance shall be in full force and effect during the time that the machine is operated and at the request of the City. Such an insurance policy shall provide or a minimum of 30 days written notice to the City of cancellation, nonrenewal or material change of the required insurance coverage. The requirement and approval of this insurance by the City shall not in any way relieve or decrease the liability of the contractor. It is expressly understood that the City does not in any way represent that the specific limits of liability or coverage or policy forms are sufficient or adequate to protect the interest or liabilities of the contractor. Copies of the insurance certificates shall be filed with the city upon execution of this agreement. Page 31 of 164 8.3. Legal Compliance The Contractor agrees to comply with Allstate and or federal laws and local ordinances governing the employment of personnel including,but not limited to, Minnesota statute section 181.59 relating to discrimination in employment,and section 290.07 requiring the certification of income tax withholding. 8.4. Claims The Contractor agrees to process and resolve all claims submitted by affected property owners of the City of Oak Park Heights in a timely manner. 9. AGREEMENT APPROVAL CONSIDERATIONS 9.1. Selection This City reserves the right to retain the services of the Contractor who,in the opinion of the city, can best provide the services requested under this agreement. Consideration shall be given to hourly rates, and availability, condition of equipment, competency of operators,previous experience,response time and specific pieces of equipment so quoted. 9.2. Combination of Quotes This City reserves the right to select any combination of equipment quoted for service as requested in entering into this agreement. Only one hourly rate will be considered for each machine,but consideration will be given to any other rate or combination of rates not called for in this proposal if it is in the best interest of the City. 10.PROPOSALS A quotation is to be entered in the schedule of prices for each machine the Contractor proposes to furnish and such quotations shall be an hourly rate. All proposals must be typed written or printed in ink and properly signed by an officer of the company. If the submitted proposal is accepted by the City and properly countersigned, it shall constitute a formal agreement between the City and the contractor with no further revisions addenda or exceptions acknowledge and less previously noted in writing on the quote proposal form. All require performance bonds, insurance certificates and Page 32 of 164 additional requested information shall be submitted in a form acceptable to the City upon execution of the agreement and request by the city. 11. ADOPTED BY REFERENCE OF PROPOSAL The attached proposal, schedule of prices and description are adopted as reference as this part of the agreement. 12. RECORD DISCLOSURE/MONITORING PROCEDURES Pursuant to Minnesota statute the books,records, documents and accounting procedures and practices of the Contractor relevant to this contract are subject to examination by the contracting agency and either the legislative auditor or the state auditor as appropriate. The Contractor agrees to maintain these records for a period of three(3)years from the date of termination of this agreement. 13. EQUAL EMPLOYMENT OPPORTUNITY—CIVIL RIGHTS During the performance of this agreement,the Contractor agrees to the following: no person shall,on the grounds of race, color,religion, age, sex, disability,marital status, public assistance status, creed coronation of origin be excluded from full employment rights in,participation in,be denied the benefits of or otherwise subjected to discrimination under any and all applicable federal and state laws against discrimination including but not limited to the Civil Rights Act of 1964. The contractor will furnish the City with all reports required by the secretary of labor and or the Minnesota Department of human services for the purposes of investigation to ascertain compliance with such rules,regulations and orders. The provisions of Minnesota statute 181.59 regarding nondiscrimination and violations related therefrom are incorporated in this paragraph by reference as an obligation of the Contractor. If during the term of this contract or any extension thereof, it is discovered that the Contractor is not in compliance with the applicable status and regulations or if the Contractor engages in any discriminatory practices the City may cancel this agreement as provided by the cancellation clause. HEIGHTS LANUI11 MAINTENANCE SCOPE OF SERVICES This scope of work applies to the requirements of maintaining grass and landscaped areas at various locations in the City of Oak Park Heights. The overall responsibility of the Contractor is to coordinate,plan, manage, and perform lawn maintenance activities described in this RFP to maintain an acceptable appearance in all areas included in the RFP. The Contractor shall furnish all labor, materials and supplies necessary to perform the mowing and maintenance tasks in the RFP. The Contractor shall complete all the tasks listed below and will comply with all the requirements and specifications. It is the Contractor's responsibility to verify the areas,sizes and quantities of the surfaces and Items to be maintained in this RFP. Failure of the Contractor to verify the listed amounts does not relieve the Contractor of the responsibility to provide all services required to the standards included herein,for the prices submitted in Contractors proposal. 1.1 HOURS WHEN WORK 1S TO BE PERFORMED Work is to be performed only from Monday through Friday from lam to 7 pm.No work shall be done on Saturday or Sunday without prior written permission from the City.Work should be limited to no more than two consecutive days per week. 1.2 SCHEDULING OF WORK-BEGINNING OF CONTRACT TERM A. At least five(5)business days prior to the commencement of the contract,the Contractor shall submit in writing to the City the name of the On-site Supervisor authorized to act for the Contractor in every detail for the lawn mowing and landscape services. B. At least five(5)business days prior to the commencement of the contract,the City or his/her appointee will confer with the Contractor and review the total specification requirements,total workload and the lawn mowing and landscaping services proposed by the Contractor. 1.3 SPECIFICATIONS The lawn and landscaped areas must be maintained and serviced at the frequency and to the standards as detailed in these specifications.The City will determine whether the tasks have been performed satisfactorily,and that the performance is in accordance with the standards set forth in these specifications. Failure to perform a task or to perform a task to the specified standard will result in reductions in the Contractor's monthly invoice. Page 40 of 164 Landscape Maintenance Standards and Specifications Overview: The following standard outlines the scope of services and responsibilities required of the Contractor,but may not be inclusive of the entire scope of services. The specifications outline the quantity and category of work required. Other parts of the contract(not included here) provide requirements such as insurance and licensing standards, hours of work,work authorizations,etc. A. GENERAL STANDARDS 1.GUARANTEE AND REPLACEMENT a. The Contractor will replace,at no additional cost to City,any turf,plant materials or any other City property damaged as a result of improper maintenance attention or procedures. Replacement material will be of the same size and variety as the dead or damaged material. Property damage must be done within two weeks of identification of damage. Alternatives to size,variety and scheduling of replacement must have written permission of City. b. The Contractor is not responsible for losses, repair or replacement of damaged work or plant material resulting from theft, extreme weather conditions,vandalism,vehicular incidents(other than Contractor's vehicles)or the acts of others over whom they have no reasonable control. 2.CONTRACTOR RESPONSIBILITIES a. The Contractor will provide staff able to perform work at the highest standards of horticultural excellence. Key staff shall have current knowledge of best management practices(BMP's)regarding: safety, hazardous materials spill response,lawn care,and integrated turf management. The City reserves the right to demand the replacement of the Contractor's staff who do not meet the City's standards for safety and or professionalism. b. Provide an emergency contact list identifying the names,positions held, and phone numbers of key maintenance personnel. Provide mobile numbers for the landscape maintenance manager and site supervisor. C. Attend meetings and site Inspections of the grounds as requested. d. The Contractor must maintain a computerized log of activities performed and provide a written copy with the monthly invoice. e. Establish a schedule/chart for regular maintenance activities by area and submit to Public Works for review.The Contractor to review proposed Page 41 of 164 schedules with Public Works at the regularly scheduled meetings and adjust as necessary to avoid conflicts. There are several events hosted in City Parks that require the property to be in compliance with the specifications of the RFP at the time of the event(City wide party in the park is an example which occurs between Junes-August). f. Provide to the City proof of insurance,naming the City as an additionally insured party in an amount not less than$1,000,000 general liability Insurance.The Contract shall maintain worker's compensation coverages as required by the State of MN. B.SCOPE OF WORK 1. GENERAL PRACTICE GUIDELINES FOR MATERIALS AND EXECUTION a. This document is intended as a benchmark of the City's minimum standards for maintenance, repair and improvements. However,the City respects the Contractor as a professional and as such,will take under consideration,any and all recommendations made by the Contractor. b. The contractor shall furnish all labor,equipment,and materials necessary to complete the maintenance of turf, as specified herein. It is the intent of the City that this site be maintained In a resource-efficient, sustainable,and cost-effective manner. C. Maintenance shall consist of a spring integrated Pest Management(IPM), weed/insect/disease control,litter control and any other procedures consistent with good horticultural practice necessary to ensure normal, vigorous,and healthy growth of turf. d. All turf shall be mowed with professional quality mulch-mowing equipment. Prior to the award of a contract,the Contractor must provide to the City the make and model of the mower(s)that will be used. e. The contractor is encouraged to use non-polluting devices like rakes and brooms when feasible. The City prefers that blowers and other power equipment are low-decibel, low-fossil fuel consumption,and low- emissions models. f. Contractor is encouraged to develop cultural practices which incorporate on-site recycling of organic materials,such as leaves and grass clippings, and the use of recycled materials In its maintenance operations. Page 42 of 164 C. MATERIALS AND EXECUTION TURF MAINTENANCE TURF MOWING All turf will be mowed with professional quality mulching mower equipment. Pricing assumes that bagging and removing clippings will occur only under the direction of the City and only when excessive leaf debris is present,turf is too long to mulch,or when moisture conditions are too high to allow effective mulching without substantial clumping of turf debris. b. Prior to each mowing,remove all litter and debris from lawn areas. Formal turf areas shall be mowed per the schedule below and maintained at a height of no less than 2% inches and no more than 3% inches. Coordinate mowing schedules with the City. C. Alternate mowing direction where feasible every mowing. Maintain a uniform lawn height free from scalping. d. The City and the Contractor will evaluate and determine any areas that require bagging and removal of clippings on a regular year-around basis. e. Contractor is responsible for any damage incurred as a result of mower damage to trees and shrubs and must repair or replace any such damage at no cost to the City. Properly maintained tree wells are encouraged to minimize such damage. f. Clippings must be swept or blown from hardscapes after each mowing. 2.APROXIMATE TURF MOWING SCHEDULE—SUBJECT TO CHANGE ATTHE DISCRETION OF THE CITY NO MINIMUMS ARE GURANTEED. Mechanically trim all landscape turf edges once a month. Edges include all formal lawn perimeters and tree wells in lawn areas. In April,June,and August,redefine all formal lawn edges with a mechanical blade-type edger or hand spade. Clean debris from hardscapes and non-turf landscape areas. Remove larger debris. b. Trim all formal lawn areas that cannot be reached by a mower after each mowing.Areas to be trimmed include any lawn adjacent to poles,signs, bollards,trees,walls and all other obstacles. Perform trimming to the same height as mowing. Clean debris from hardscapes and non-turf landscape areas, remove larger debris. C. Contractor must trim around City maintained guardrails every other mowing. d. Contractor is responsible for any damage incurred as a result of trimmer or edger damage to trees and shrubs and must repair or replace any such damage at no cost to the City. D. MATERIALS AND EXECUTION-GENERAL AREA MAINTENANCE 1. DEBRIS AND LEAF REMOVAL a. Keep walks, patios,planting beds,roadway gutters and lawn areas free of grass clippings and leaves on a weekly basis throughout the year. b. For sites that have densely planted trees and/or large mature trees,leaf removal is required for maintaining a clean,orderly appearance.Once leaves begin to fall, mowing crews must cut the leaves into small fine pieces during routine mowing visits.When leaves start falling in heavy concentrations,they must be gathered by means of commercial blowers, power rakes, and either carried off into a wooded area(to be used as natural mulch)or collected by means of a vacuum and removed from the site.A final leaf removal touch up may be performed in the late fall or early spring. Page 44 of 164 2. LANDSCAPE DEBRIS REMOVAL a. When necessary,remove biodegradable landscape debris(turf clippings (limited to only those times when mulch mowing is not possible),leaves, to yard refuse recycling sites. No biodegradable material should be disposed of as garbage,except noxious weed debris. 1.4 LOCATIONS OF WORK TO BE PERFORMED UNDER RFP A. Properties and locations included in base bid. Personnel employed by the Contractor shall be capable employees qualified in this type of work.A fully qualified work force shall be maintained throughout the period of this contract.All personnel shall receive close and continuing first-line supervision as necessary. B. The Contractor's supervisors shall be fully and adequately trained and have the requisite experience in lawn and landscaping supervision sufficient in scope to meet the requirement of the contract. C. The Contractor shall employ the quantity and quality of supervision necessary for both effective and efficient management of lawn and landscaping operations at all times. D. The Contractor is liable for any and all damages caused directly or indirectly by its employees. Page 45 of 164 1.6 REDUCTIONS IN PAY A. Reductions for below standard work will be made if,after the second documented notification,the Contractor has not corrected the deficiency and City worker(s)are assigned to perform the task(s)or was not completed at all by the contractor. 8. Reductions for non-performance will be made if the task(s)was not done and City worker(s)have to be assigned immediately to perform the task(s). C. Reductions for A.and B.above will be based on the hourly billing rate of the City employee(s) plus benefits assigned to perform the task(s)times the hour(s)required for City worker(s)to perform the task(s). If the work was not performed by the contractor and was just omitted,a deduction based on percentage of the overall monthly bill minus the work not completed will be calculated and the bill adjusted accordingly. 1.7 PAYMENT TO CONTRACTOR A. At the end of each month,the Contractor will provide a detailed invoice for the services provided during the preceding month. B. Additional alternate tasks that were preapproved by the City and performed during that month shall be itemized separately. C. The City will review the invoice and any necessary reductions which must be made in accordance with the conditions of the Contract.Should the Contractor's invoice not include all necessary reductions,the invoice shall be reduced by the amount of the non- included reductions and processed for payment.The Contractor shall be notified of the reductions made and supplied with copies of documentation supporting those reductions. 1.8 CHANGES TO THE SCOPE OF WORK AND TERMINATION OF CONTRACT A. The City at any time may have to change the scope of the contract by written contract modification.On the designated effective date,the Contractor shall make the required changes in his/her operation. B. Upon receiving notice of the change,the Contractor's monthly invoice shall be adjusted if necessary to reflect the value of the change in the services under this contract. C. The City may cancel the contract at any time for any reason upon giving 14 calendar day written notice to the Contractor. Page 46 of 164 D. The City shall have the right to cancel this Agreement immediately without prior notice for any breach of any provision of the contract if not cured within three(3)days from written notice from the City. 1.9 INSPECTIONS AND APPROVAL OF WORK A. The City demands strict conformance to the standards and frequency specified and agreed upon.The City will inspect all completed work and will ascertain that the tasks have been satisfactorily accomplished. B. The City will enforce the standards of this RFP and contract. 1.10 ON-SITE SUPERVISION AND TRAINING A. The successful Contractor will provide an On-site Supervisor who speaks and writes fluent English and will represent the Contractor.This On-site Supervisor will make routine communications with the appropriate City staff to receive instructions or other input regarding lawn mowing and landscaping services needs and activities. B. The On-site Supervisor is responsible for directing the Contractor's work force and accountable for all activities and behavior of all personnel assigned by the Contractor to perform work under this Contract. C. The Contractor shall be responsible for training and safety precautions for Contractor employees performing work under these specifications.At no time shall the Contractor or their staff be considered employees of the City. The medical office building will house Orthopedic Clinic services, Physical Therapy Service, Athletic Training, Imaging, and an Orthopedic Urgent Care Clinic. There are also conference/patient education rooms located in the building. The medical office building will be a 2-story building with an attached single story indoor athletic training space. The total building area is 59,900 square feet. The building will have mechanical roof top units to service the building that will be located in a screened area on the roof. The building roof will be drained internally with overflow drains that daylight above grade. There is an exterior enclosure for trash to be collected with easy access for trucks to traverse the site. The site has previously been graded to prepare for building development and there are no significant trees on site. A new landscape plan has been developed and included in the documentation. The site allows for patient and staff parking with a total of 285 parking stalls including 15 accessible parking stalls. The traffic volumes coming to the site on a daily basis is estimated around 60-80 staff daily. The estimated patient volume will be around 500 - 700 patients per day with 85 percent of the patient volume coming to the site between the hours of 7:30 am- 5:30 pm Monday through Friday. The medical office building will be open from 8:00 am to 8 pm seven days a week for Orthopedic Urgent Care. 2 Page 73 of 164 It is the intent to submit a building signage package and permit application after this submittal. The intent for the wall signs has been shown on the exterior elevations for area and location. The intent of the monument sign has been shown on the site plan for the location. Once the signage package has been developed it will be submitted for review and approvaL Additional information has been provided related to the Orthopedic Urgent Care Clinic: For non-traumatic injuries, your first stop should be an orthopedic specialist. If you think you have a fracture or an acute (sudden onset) injury and need immediate care, walk in services are conveniently available at our TCO Orthopedic Urgent Care no appointment necessary. An Orthopedics Urgent Care Clinic has been open at our Stillwater location for 5 plus years. It's a walk-in clinic with no appointment needed and is staffed by an orthopedic provider. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Highway Business/Warehouse on the Proposed !_and Use Map. The proposed use is consistent with this land use designation. Zoning. The property is zoned B-3 Highway Business and Warehouse District. The use of the site for a medical clinic is a permitted use in this district. Easement Vacation. The Applicant has proposed a vacation of the existing drainage and utility easement through the property and replacement with a revised easement at the south east side of the property. A public hearing was advertised for the vacation and the City Engineer has provided comments. The easement vacation is subject to review and approval of the City Engineer and the City Attorney. Site Plan. The front of the building is orientated to Memorial Avenue North with parking adjacent to the front entrance. The parking area wraps around the building on the south side to a parking lot adjacent to County Road 15. There is green area around the parking lots and building on the south, east and north sides. Setbacks. The building and parking areas are compliant with all setback requirements. Traffic Circulation/Curb Cuts. The site plan indicates that there will be two curb cuts from Memorial Avenue North. There are numerous landscape islands within the parking lot. The plan has been reviewed and approved by the Fire Marshal for emergency vehicle access. Snow Storage. The plans do not indicate an area for snow storage. The applicant shall indicate where the snow is to be stored. 3 Page 74 of 164 Parking. The following table provides an analysis of proposed and required parking spaces: Parking Area Required Requirements Spaces 1 per 200 SF. + 3 59,880 SF x .9 = 53,892 SF 1200 + 3 273 Per ordinance, the site would require 273 parking spaces. The proposed site plan indicates a total of 285 spaces. The Applicant has been encouraged to show some of the parking as proof of parking spaces, possibly the row of parking at the south side of the building. The plans indicate 15 disability stalls which is appropriate for a medical clinic. Landscaping. The submitted landscape plan is subject to City Arborist review and approval. Note the comments that have been made by the City Arborist related to the landscape islands in the parking lot. The Planning Commission should make comment on whether the Applicant increase the size of some of the islands to accommodate the plantings. There is a surplus of parking onsite. City Arborist comments are found as an exhibit to this report. Lighting. The lighting plan indicates the locations of the parking lot and site fixtures as well as the building wall fixtures. The lighting specifications indicate that most of the fixtures to be used in the parking lot and on the walls, will be full cut off and LED. The lighting regulations limit the height from ground level to the top of the fixture at 25 feet. All light fixtures shall be required to be full cut off, compliant with the height requirements, and be consistent with Section 401.15.13.7 of the Zoning Ordinance as it relates to lighting requirements. A photometric plan has been provided that complies with the Ordinance. The plans indicate the use of LED strip lighting on the building facades. The use of strip lighting is not allowed in the Design Guidelines. Trash Storage. The plans indicate a trash enclosure at the north west corner of the building. The enclosure would be constructed from a corrugated metal panel that is also used on the building. Mechanical Screening. Any exterior mechanical equipment, either on the roof or ground mounted will need to be screened in accordance with Section 401.15.E.10.e. of the Zoning Ordinance. The plans indicate that the roof mounted mechanical equipment will be screened. Grading, Drainage, Erosion Control and Utilities. Grading, drainage, erosion control, and utility plans are subject to review and approval by the City Engineer. The City Engineer has provided comments in a separate report that is found as an exhibit. 4 Page 75 of 164 Storm water issues are also subject to review and approval by the Browns Creek Watershed District. Signage. Freestandina Sign. The Applicant has proposed one freestanding sign, placed adjacent to Memorial Avenue. The location of the Memorial Avenue sign is shown on the site plan. The base of the sign will need to be landscaped. Wall Signage. The Applicant has proposed four wall signs on three facades. The north elevation is proposed with two signs which requires a Conditional Use Permit. The Applicant has indicated that the proposed total square footage of 270 feet but has not provided the individual sign sizes. Staff would recommend the second wall sign on the north elevation with the condition that the urgent care sign be removed if that service is discontinued at this location. The Zoning Ordinance would allow for one wall sign, each on separate building facades and two freestanding signs. The total allowable sign area is 300 square feet. Sin Illumination. The proposed plans do not indicate how the signs will be lit. Additional detail is required to review how the signs will be illuminated. The signs will be required to comply with the Zoning Ordinance lighting requirements. Staff will approve the lighting specifications for the signs at the time of permitting. Design Guidelines Architectural Guidelines. Fa ade Treatments The building will be required to have a definite base, middle and top at its front, side and rear facades. The facades have significant visual interest with a mix of building materials and roof lines. Ground Level Expression This is a two-story building with a front entrance and pedestrian canopy. The main entrance is well defined by the canopy and glass. The height of the building is less than the 35-foot maximum requirement. Transparency The building uses glass on each facade. The transparency requirements are met with this building design. Entries The building features a prominent entry with a canopy and glass. 5 Page 76 of 164 Roof Design The building has a flat roof and curved roof. The rooftop mechanical equipment will be completely screened. Building Materials and Colors The applicant has provided color perspectives for review. The building will be a combination of brick, precast concrete, metal panels, steel, and glass. Building material samples will be provided for the Planning Commission meeting. Franchise Architecture The building is not a franchise design. Site Design Guidelines Building Placement The proposed building has a well-defined entrance and attractive front which is visible from Memorial Avenue North. _Parking Areas The parking area includes landscaped areas. Storm water Storm water will be addressed by the City Engineer. Pedestrian and Common Space The plans show a trail along Memorial Avenue that will be constructed at eight feet in width to match the trail adjacent to the Kwik Trip development. Landscaping The overall landscaping plan is a very positive feature of the site. The landscape plan is subject to review and approval of the City Arborist. Trees/Shrubs The trees and shrubs used in the landscape plan shall be subject to the review and approval of the City Arborist. Utilites/Service/Loading/Storage Areas Addressed elsewhere in the planning report. Lighting Addressed elsewhere in the planning report. The request would allow replacement of a sign at the northwest comer of the property at 5991 Norwich Avenue North that will be taller and include more square feet of signage area. The sign will include 63 square feet of signage and would be up to 15 feet tall. The site is zoned B-4 Limited Business District in which the shopping center is a permitted use. Y he development was originally approved as a Planned Unit Development (PUD). The PUD amendment process may be used to allow sign alterations and to increase the amount of signage. The cun'ent monument sign does not provide adequate visibility and signage for our tenants. The new monument sign would replace the current monument sign and would be in the same location. 1 have engaged the service of Signs Now to provide a mockup of a new monument sign (Exhibit C) with a design that will reflect the same high-quality materials of the current monument sign and property. 1 have also attached an example of another monument sign (Exhibit D) that we could work from. We are proud to be a part of the Oak Park Heights community and ownership will spare no expense in the design/construction of the new monument. If approved, we will work closely with the City of Oak Park Heights on the final design/construction of the new monument sign. ISSUES ANALYSIS Comprehensive Plan. The Comprehensive Plan designates this area as Commercial on the Proposed Land Use Map. The use of the property for a retail, services and restaurants is consistent with the Comprehensive Plan. Zoning Ordinance. The property is zoned B-4, Limited Business District in which the shopping center has been approved by a PUD. An amendment to the PUD is required to make sign changes to the freestanding signage. Signage. The existing freestanding sign was constructed at the northwest comer of the property at 60th Street and Norwich Avenue North. It is eight feet tall and includes 48 square feet of signage. The Zoning regulations allow a freestanding monument sign of up to 20 feet in height with 100 square feet of signage. The existing Lowes freestanding sign was constructed with the original development. Additional freestanding signs may be constructed in a shopping center development. The sign regulations for multiple occupancy business buildings are as follows: 4) In any multiple occupancy building qualifying as a shopping center, signs shall be permitted for each common public entrance. Each sign area shall not exceed a total of fifty (50) square feet and shall be located within fifty (50) feet of the common public entrance being served. Attention shall be given to the possible number of tenants or occupant bays which may be served by the common public entrance for which the sign is intended. The proposed sign is designed as a monument sign up to 16 feet tall with 63 square feet of signage. The PUD is required to make sign alterations and to allow the proposed sign to exceed the allowed 50 square foot allowance. 2 Page 141 of 164 A review of the Conditional Use Permit criteria within the Zoning Ordinance should be considered as part of a PUD request. Any signage allowed for the development shall also require a sign permit. Conditional Use Permit. The Planning Commission should consider the following issues and impacts of the proposed project in making its recommendation. The conditional use permit criteria, found in Section 401.03.A.7 of the Zoning Ordinance, are found as follows: 9. Relationship to the specific policies and provisions of the municipal comprehensive plan. 2. The conformity with present and future land uses in the area. 3. The environmental issues and geographic area involved. 4. Whether the use will tend to or actually depreciate the area in which it is proposed. 5. The impact on character of the surrounding area. 6. The demonstrated need for such use. 7. Traffic generation by the use in relation to capabilities of streets serving the property. 8. The impact upon existing public services and facilities including parks, schools, streets, and utilities, and the City's service capacity. 9. The proposed use's conformity with all performance standards contained herein (i.e., parking, loading, noise, etc.). Comment: The expansion of the freestanding sign size and height should not create an issue for neighboring properties and will be beneficial to the shopping center tenants. The additional signage should not create any visibility issues at the intersection in that it is adequately set back from the roadway. There should be no environmental issues with this request. The request is minor and not out of nature with other requests that have been granted to vary from the sign regulations within the Highway 36 corridor. City Staff sees no issues with the request as proposed. CONCLUSION 1 RECOMMENDATION Upon review of the request for a Planned Unit Development Amendment for replacement of a sign at the northwest comer of the Oak Park Commons property at 5991 Norwich Avenue North, staff would recommend the project with the conditions as follows: 1. The proposed sign shall not exceed 16 feet in height and 70 square feet of signage per sign face. 2. Page 160 of 164 DECLARATION: 20-03-01 RESOLUTION: (TBD) CITY OF OAK PARK HEIGHTS-DECLARATION OF CITY EMERGENCY DUE TO COVID 19 WHEREAS, the virus named "SARS-CoV-2," is a new strain of coronavirus that has not previously been identified in humans and can easily spread from person to person and which causes a disease named "coronavirus disease 2019," commonly known as "COVID-19," which is a respiratory disease that can result in serious injury or death; and WHEREAS, on January 21, 2020 the first case of COVID-19 was detected in the United States; on March 6, 2020 the first case of COVID-19 was detected in the State of Minnesota; and as of March 16, 2020, there are thirty-five known cases of COVID-19 in Minnesota, including cases in Dakota County; and WHEREAS, on January 31, 2020, the United States Department of Health and Human Services Secretary Alex Azar declared a public health emergency for COVID-19, beginning on January 27,2020;. and WHEREAS, on March 13, 2020, President Donald Trump declared that the COVID-19 outbreak in the United States constitutes a National Emergency; and WHEREAS, on March 13, 2020, Governor Tim Walz declared a Peacetime State of Emergency to authorize all necessary resources to be used in support of the COVID-19 response; and WHEREAS, as of March 15, 2020 the World Health Organization Situation Report confirmed a total of 153,517 cases of COVID-19 in over 135 countries, including 5,735 deaths; and as of March 15, 2020,a total of 35 cases of COVID-19 have been reported in Minnesota including two in Dakota County and one in Washington County; and WHEREAS, COVID-19 has been identified by the World Health Organization as a pandemic, and the United States Centers for Disease Control has provided guidance for individuals, healthcare professionals, and businesses to slow the spread of COVID-19, which include cancelling or postponing in-person events that involve more than fifty people for eight weeks; and WHEREAS, the City has been preparing for weeks, working diligently with local, state, and federal partners to maintain situational awareness and respond to COVID-19; and WHEREAS, additional local cases will trigger a more aggressive public health response and are predicted to impact residents of the City of Oak Park Heights and those who work in or travel through the City, including City employees; and the need for social distancing, school closings, and quarantine methods to slow the spread of COVID-19 is expected to cause significant challenges;and WHEREAS, the City Administrator and Emergency Management Director find that this situation threatens the health, safety, and welfare of the citizens of the community and will cause a significant impact on the ability of public safety personnel to address any immediate dangers to the public as a result of COVID-19; and WHEREAS, the City Administrator and Emergency Management Director find that traditional sources of financial aid, assistance and relief will not be able to compensate for the potential impact of COVID-19, and have determined that the necessary resources to respond to and recover from this pandemic will exceed those resources available within the City of Oak Park Heights , and additional resources will be needed from Washington County and state and federal sources.
