I. CUP PERMIT AND SITE PLAN APPROVAL: The property is located in the B-3
Highway Business and Warehouse District. TCO Real Estate- Fund 2, LLC is the
intended owner of the property, and the business on this site is to be operated by
Infmite Health Collaborative, P.A. /Twin Cities Orthopedics, P.A Applicant proposes
to use the Site for a medical office facility at 5715 Memorial Avenue, which is a
permitted use in the zoning district. Applicant proposes to install signage including
two wall signs on one fagade, which requires a Conditional Use Permit. The
Applicant submitted a detailed development design and site plan, and the proposed
use satisfies all required conditions of the zoning code and is in general conformance
with the neighborhood. The Planning Commission held a public hearing on March 12,
2020 and recommended approval, and the matter came before the City Council on
March 24, 2020.
All permits and uses applied for a medical office facility are granted, including the
conditional use of two wall signs on one fagade, but shall be subject to the following
conditions imposed by the March 24, 2020 Resolution of the City Council of the City
of Oak Park Heights, as follows:
1. Applicant shall complete and record the vacation of the prior drainage and utility easement
and establishment of the new drainage and utility easement, subject to review and approval
of the City Engineer and the City Attorney.
2. The site plan shall be reviewed and approved by the Fire Marshal.
The Applicant shall provide a snow removal plan for review and approval by City.
4. The landscape plan shall be reviewed and approved by the City Arborist. The City Arborist
shall work with the Applicant related to the parking lot islands and final landscape plan.
5. The Applicant is encouraged to revise some of the parking to proof of parking spaces,
possibly the row of parking at the south side of the building.
6. All grading, drainage, erosion control, and utility plans shall be reviewed and approved by
the City Engineer. Storm water plans shall be reviewed and approved by the Browns Creek
Watershed District.
7. All light fixtures shall be full cut off, compliant with the height requirements, and be
consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting
requirements. Outdoor lighting for the parking areas and building lighting shall be turned
off one hour after closing, except for approved security lighting.
The proposed accent lighting shall be full cut off and used as architectural building
wash subject to review and approval by the City.
9. All mechanical equipment on the roof or on the site shall be fully screened in
accordance with the provisions of the Zoning Ordinance.
10. The second wall sign reading Orthopedic Urgent Care on the north elevation shall be
removed if that service is discontinued at this location.
11. All signs shall comply with the Zoning Ordinance requirements for fixture cut off and
illumination.
12. The building design, site layout, and building materials shall be constructed as submitted
and approved by the City Council.
13. The City encourages placement of an appropriately placed bike rack on the site.
H. Reference Attachment: The City Planner report dated March 6, 2020 and all
exhibits therein are annexed hereto by reference as "Exhibit B."
M. Abandonment: This Conditional Use Permit requires continuous use in order to
preserve the Conditional Use granted by the City under the terms hereof. Any
discontinuation or abandonment of the uses permitted hereunder upon the site for a
period of twelve (12) continuous months shall constitute abandonment and void the
Conditional Use Permit.
IV. Annual Review: Annual review is not imposed as a condition of this Conditional Use
Permit.

BACKGROUND
Keith Helmer of Twin Cities Orthopedics has made application to construct a medical
office building on Memorial Avenue North. The application is for Design Guidelines/Site
Plan review, a signage Conditional Use Permit and vacation of an easement for
development on a portion of Lot 2, Block 1, Oak Park Station on Memorial Avenue
North. The building will house Orthopedic Clinic service, Physical Therapy Service,
Athletic Training, Imaging, and an Orthopedic Urgent Care Clinic. There will also be
conference/patient education rooms located in the building.
The site is zoned B-3, Highway Business and Warehouse in which medical clinics are a
permitted use.

PROJECT DESCRIPTION
The project narrative provides the following description:

Twin Cities Orthopedics (TCO) is planning to develop a new medical office building that
is located on a site between Memorial Avenue North and Stillwater Boulevard North in
Oak Park Heights. The medical office building will house Orthopedic Clinic services,
Physical Therapy Service, Athletic Training, Imaging, and an Orthopedic Urgent Care
Clinic. There are also conference/patient education rooms located in the building.
The medical othce building will be a 2 -story building with an attached single story indoor
athletic training space. The total building area is 59,900 square feet. The building will
have mechanical roof top units to service the building that will be located in a screened
area on the roof. The building roof will be drained internally with overflow drains that
daylight above grade. There is an exterior enclosure for trash to be collected with easy
access for trucks to traverse the site.
The site has previously been graded to prepare for building development and there are
no significant trees on site. A new landscape plan has been developed and included in
the documentation.
The site allows for patient and staff parking with a total of 285 parking stalls including 15
accessible parking stalls. The traffic volumes coming to the site on a daily basis is
estimated around 60-80 staff daily. The estimated patient volume will be around 500 -
700 patients per day with 85 percent of the patient volume coming to the site between
the hours of 7:30 am - 5:30 pm Monday through Friday. The medical office building will
be open from 8:00 am to 8 pm seven days a week for Orthopedic Urgent Carne.

It is the intent to submit a building signage package and permit application after this
submittal. The intent for the wall signs has been shown on the exterior elevations for
area and location. The intent of the monument sign has been shown on the site plan for
the location. Once the signage package has been developed it will be submitted for
review and approval.
Additional information has been provided related to the Orthopedic Urgent Care Clinic:
For non-traumatic injuries, your first stop should be an orthopedic specialist. If you think
you have a fracture or an acute (sudden onset) injury and need immediate care, walk in
services are conveniently available at our TCO Orthopedic Urgent Care — no
appointment necessary.
An Orthopedics Urgent Care Clinic has been open at our Stillwater location for 5 plus
years. It's a walk-in clinic with no appointment needed and is staffed by an orthopedic
provider.
ISSUES ANALYSIS
Comprehensive Plan. The property is designated as Highway Business/Warehouse
on the Proposed Land Use Map. The proposed use is consistent with this land use
designation.
Zoning. The property is zoned B-3 Highway Business and Warehouse District. The
use of the site for a medical clinic is a permitted use in this district.
Easement Vacation. The Applicant has proposed a vacation of the existing drainage
and utility easement through the property and replacement with a revised easement at
the south east side of the property. A public hearing was advertised for the vacation
and the City Engineer has provided comments. The easement vacation is subject to
review and approval of the City Engineer and the City Attorney.
Site Plan. The front of the building is orientated to Memorial Avenue North with parking
adjacent to the front entrance. The parking area wraps around the building on the south
side to a parking lot adjacent to County Road 15. There is green area around the
parking lots and building on the south, east and north sides.
Setbacks. The building and parking areas are compliant with all setback requirements.
Traffic Circulation/Curb Cuts. The site plan indicates that there will be two curb cuts
from Memorial Avenue North. There are numerous landscape islands within the parking
lot. The plan has been reviewed and approved by the Fire Marshal for emergency
vehicle access.
Snow Storage. The plans do not indicate an area for snow storage. The applicant
shall indicate where the snow is to be stored.

Per ordinance, the site would require 273 parking spaces. The proposed site plan
indicates a total of 285 spaces. The Applicant has been encouraged to show some of
the parking as proof of parking spaces, possibly the row of parking at the south side of
the building. The plans indicate 15 disability stalls which is appropriate for a medical
Clinic.
Landscaping. The submitted landscape plan is subject to City Arborist review and
approval. Note the comments that have been made by the City Arborist related to the
landscape islands in the parking lot. The Planning Commission should make comment
on whether the Applicant increase the size of some of the islands to accommodate the
plantings. There is a surplus of parking onsite. City Arborist comments are found as an
exhibit to this report.
Lighting. The lighting plan indicates the locations of the parking lot and site fixtures as
well as the building wall fixtures. The lighting specifications indicate that most of the
fixtures to be used in the parking lot and on the walls, will be full cut off and LED. The
lighting regulations limit the height from ground level to the top of the fixture at 25 feet.
All light fixtures shall be required to be full cut off, compliant with the height
requirements, and be consistent with Section 401.15.13.7 of the Zoning Ordinance as it
relates to lighting requirements. A photometric plan has been provided that complies
with the Ordinance.
The plans indicate the use of LED strip lighting on the building facades. The use of strip
lighting is not allowed in the Design Guidelines.
Trash Storage. The plans indicate a trash enclosure at the north west comer of the
building. The enclosure would be constructed from a corrugated metal panel that is
also used on the building.
Mechanical Screening. Any exterior mechanical equipment, either on the roof or
ground mounted will need to be screened in accordance with Section 401.15.E.10.e. of
the Zoning Ordinance. The plans indicate that the roof mounted mechanical equipment
will be screened.
Grading, Drainage, Erosion Control and Utilities. Grading, drainage, erosion
control, and utility plans are subject to review and approval by the City Engineer. The
City Engineer has provided comments in a separate report that is found as an exhibit.

Storm water issues are also subject to review and approval by the Browns Creek
Watershed District,
Signage.
Freestanding Sign. The Applicant has proposed one freestanding sign, placed
adjacent to Memorial Avenue. The location of the Memorial Avenue sign is shown on
the site plan. The base of the sign will need to be landscaped.
Wall Signage. The Applicant has proposed four wall signs on three facades. The north
elevation is proposed with two signs which requires a Conditional Use Permit. The
Applicant has indicated that the proposed total square footage of 270 feet but has not
provided the individual sign sizes. Staff would recommend the second wall sign on the
north elevation with the condition that the urgent care sign be removed if that service is
discontinued at this location.
The Zoning Ordinance would allow for one wall sign, each on separate building facades
and two freestanding signs. The total allowable sign area is 300 square feet.
Sin Illumination. The proposed plans do not indicate how the signs will be lit.
Additional detail is required to review how the signs will be illuminated. The signs will be
required to comply with the Zoning Ordinance lighting requirements. Staff will approve
the lighting specifications for the signs at the time of permitting.
Design Guidelines
Architectural Guidelines.
Facade Treatments
The building will be required to have a definite base, middle and top at its front,
side and rear facades. The facades have significant visual interest with a mix of
building materials and roof lines.
Ground Level Expression
This is a two-story building with a front entrance and pedestrian canopy. The
main entrance is well defined by the canopy and glass. The height of the
building is less than the 35 -foot maximum requirement.
Transparency
The building uses glass on each facade. The transparency requirements are met
with this building design.
Entries
The building features a prominent entry with a canopy and glass.

Roof Design
The building has a flat roof and curved roof. The rooftop mechanical equipment
will be completely screened.
Building Materials and Colors
The applicant has provided color perspectives for review. The building will be a
combination of brick, precast concrete, metal panels, steel, and glass. Building
material samples will be provided for the Planning Commission meeting.
Franchise Architecture
The building is not a franchise design.
Site Design Guidelines
Building Placement
The proposed building has a well-defined entrance and attractive front which is
visible from Memorial Avenue North.
Parking Areas
The parking area includes landscaped areas.
Storm water
Storm water will be addressed by the City Engineer.
Pedestrian and Common Space
The plans show a trail along Memorial Avenue that will be constructed at eight
feet in width to match the trail adjacent to the Kwik Trip development.
Landscaping
The overall landscaping plan is a very positive feature of the site. The landscape
plan is subject to review and approval of the City Arborist.
Trees/Shrubs
The trees and shrubs used in the landscape plan shall be subject to the review
and approval of the City Arborist.

The Development Application submitted by Keith Heimer on behalf of TCO Real Estate -Fund 2,
LLC, is hereby supplemented by adding the following additional requests:
Applicant requests that the Property be released from any previous development
agreements with the City, including but not limited to the Developer's Agreement dated
February 7, 2002, filed March 14, 2002 as Document Number 3220302.
2. A portion of the existing drainage and utility easement on the Property needs to be
relocated in order to facilitate the proposed development. Attached as Exhibit A is a
proposed legal description and site show plan showing the portion of the easement to be
vacated. Attached as Exhibit B is a proposed legal description and site show plan
showing the proposed new drainage and utility easement.
3. The Property is subject to Resolution No. 07-08-55 by City of Oak Park Heights dated

As requested, we have reviewed the information submitted regarding the proposed Twin Cities Orthopedics
Project. The information reviewed includes preliminary, not for construction engineering drawings, and
stormwater related documents received 2112!2020 with updates on 212512020. Further review will be
forthcoming when construction plans are submitted. Following are our preliminary comments and/or
recommendations:
Sheet C100.200 — Existing Conditions and Removals Plan, Site Plan
1. The legal descriptions for the new and vacated drainage and utility easements have been reviewed.
Our review with one comment is enclosed with this letter.
2. The pavement patch for the utility installation shall, at a minimum, match the existing pavement
section. The section to be used will be confirmed at the time of construction; wear course to be a
minimum of 1 -1/2 -inches. The patch joints will be butt joints.
3. The plan calls for raising a sanitary manhole and casting. The City requires a minimum of 2 -inches
of rings and maximum of 8 -inches of rings. Clarify the details of adjusting this structure.
4. Include ADA compliant pedestrian ramps where the trail crosses the driveways.
5. Provide details for the flumes (note 32).
6. Provide details for the modular block retaining wall (note 40).
7. Include all applicable City Detail Plates.
8. Refer to the Fire Department review of fire lanes and circulation.

Sheet C300 - Grading Plan
1. Refer to the stormwater comments below. The Owner will need to comply with all related
requirements of the NPDES Construction Stormwater Permit and the Brown's Creek Watershed
District.
2. Further detail and review of the area north and northwest of the building is needed. There is
potential for poor drainage and standing water if that area is not graded correctly, and the drainage
pattem in relation to the adjacent property and building needs to be confirmed.
3. Indicate a depth of excavation for the pond expansion at the southeast comer of the site.
4. The stormwater facilities proposed for the site including facilities that encroach into the drainage
and utility easements and the City right-of-way, shall be considered private and shall be owned and
maintained by the Owner.
5. Include all applicable City Detail Plates.
Sheet 400 — Erosion Control Pian
1. Show soil stabilization along the northern side of the site.
2. The legend shows turf reinforcement mat, clarify where this is being used.
3. Include applicable City Detail Plates.
4. The City reserves the right to require additional erosion control measures as determined/necessary
during the construction of the project.
Sheet C500 - Utility Pian
1. Connections to the City's sewer and water systems shall be per City standards and detail plates.
2. The City or its designee will be present for water and sewer service connections to the City's
systems.
3. The proposed wet tap in Memorial Drive will need to be coordinated with the City's Public Works
Department.
4. The watermain, hydrants and sanitary sewer that serve the site will be private and maintained by
the owner.

Storm Sewer /Storm Water Management
1. This property is part of the Kern Center pond drainage area. As part of the agreement with Browns
Creek Watershed District, all stormwater management requirements are provided within the
drainage area to the Kem Center pond.
2. Please provide storm sewer calculations that show the conveyance, at a minimum, of a 10 -year
storm event in the parking lot storm sewer system.
3. A sump manhole with skimming structure should be placed at the last catch basin manhole of the
storm sewer system prior to entering the Kam Center pond to provide pretreatment.
4. The proposed new storm sewer facilities on site shall be considered private and shall be
maintained by the Owner, except for the ditch within the relocated drainage and utility easement.
5. The project is subject to review by the Brown's Creek Watershed District. The City shall be
provided a copy of the permit approval letter from the BCWD and any required maintenance
agreements.
General Comments
1. The City reserves the right to inspect the construction of the project. The City or its designee shall
be present for water and sanitary sewer service connections.
2. The Owner will need to comply with all requirements of the NPDES Construction Stormwater
Permit and the Brown's Creek Watershed District. The City reserves the right to require additional
erosion control measures as determined/necessary during the construction of the project.
3. Review of issues related to parking, lighting, landscaping or the buildings is by others.
4. The Owner shall be responsible for obtaining all required permits.
5. Utility construction and improvements in the right-of-way need to conform to the City's Standard
Detail Plates. Include all applicable City detail plates on the plans. The City's details can be
provided upon request.

The Development Application submitted by Keith Heimer on behalf of TCO Real Estate -Fund 2,
LLC, is hereby supplemented by adding the following additional roqucsU:
1. Applicant requests that the Property be released from any previous development
agreements with the City, including but not limited to the Developees Agreement dated
February 7, 2002, filed March 14, 2002 as Document Number 3220302.
2. A portion of the existing drainage and utility easement on the Property needs to be

Ree Twin Cities Orthopedics Landscape Plan Review
I have reviewed the landscape plans submitted by Keith Helmer for the Twin Cities
Orthopedics plans dated 212512020. The following includes my comments and/or
recommendations:
Landscape Plan (Sheet Number L100)
The overall design of the plan is attractive and will complement the building well. The plan
includes an acceptable species selection of deciduous trees, coniferous trees, omamental
trees, shrubs and perennial plants to be installed ((924) total plantings). All plantings must be
on private property not the City boulevard right-of-way. Most plants included in the plan are
handy under local growing conditions, tolerant or resistant to major insect and disease
problems and fairly low maintenance. All plant sizes, root and container classes included in
the plans conform to the City of Oak Park Heights zoning ordinance requirements.
Plant Schedule
The final plans must include the following items:
1. Quantities for each variety of tree/shrub/perennial in addition to the total quantity in the
Plant Schedule.
2. Include the symbols used in the Landscape Legend also in the Plant Schedule.
3. Include the spacing for Coniferous Shrubs, Deciduous Shrubs and Perennials in the
Plant Schedule (revise X' -X° O.C. and X° O.C.).
4. 1 recommend replacing Malus 'Red Splendor' with a disease resistant variety such as
Malus 'Pra ldfire' or another species such as Syringa reticulate 'Ivory Silk'.

k@a4scage Requirements
The locations chosen for most plants are appropriate. The only exception would be the
placement of the trees in the parking lot islands. The trees included in the plans for the islands
can grow to be very large at maturity (25' spread x 25' tall) even though they are ornamental
trees. The parking lot medians typically will not allow enough rooting space for these trees to
grow to a healthy maturity and will create traffic visibility conflicts in the future. I recommend
replacing the ornamental trees that will be larger at maturity with ornamental grasses or
ninebark shrubs (both are low maintenance).
Landscape Details (Sheet Number L101)

The landscape notes and planting detail submitted is acceptable. Please include the following
items on the final plans:
1. All trees must be landscape grade trees of good form and structure not Park Grade
trees. Trees with poor form will be more prone to storm damage and failure in the
future. Please include this in the planting notes.
2. Burlap, wire and all rope must be removed from the top 12" of the root ball on all trees.
3. All trees must be straight and not need staking after planting. Contractor shall stake
trees only if the tree(s) begin to lean within the guarantee period, please include this in
the final planting notes.
4. The landscape contractor is required to plant trees and shrubs according to the
approved planting detail diagrams and landscape notes submitted with the final
approved landscape plan. This will be checked after planting and any deviations from
the plans must be corrected before the landscaping will be approved by the City, this
needs to be noted in the final pians.
5. Contractors doing any type of tree work must secure a City of Oak Park Heights Tree
Worker's License for 2020 from the City of Oak Park Heights Building Department. All
required documents must be submitted with the application.
6. The City Arborist will conduct an Initial Landscape Inspection after all plants/trees,
mulch, act. have been installed.
7. The City Arborist will conduct a Final Landscape Inspection typically (1) year after
installation, at the end of the plant guarantee period. For Final Acceptance of
Installation and Landscape Plants the specified planting procedures must have been
followed and all plants must be alive and in good condition at the end of the plant
guarantee period.
