A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST BY TWIN CITIES ORTHOPEDICS FOR DESIGN
GUIDELINES/SITE PLAN REVIEW, A SIGNAGE CONDITIONAL USE
PERMIT AND VACATION OF AN EASEMENT FOR DEVELOPMENT OF
A MEDICAL OFFICE BUILDING ON A PORTION OF LOT 2, BLOCK 19
OAK PARK STATION AT 5715 MEMORIAL AVENUE NORTH BE
APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request by Twin Cities
Orthopedics for Design Guidelines/Site Plan review, a signage Conditional Use Permit and
vacation of an easement for development of a medical office building on a portion of Lot 2,
Block 1, Oak Park Station at 5715 Memorial Avenue North, and after having conducted a public
hearing relative thereto, the Planning Commission of Oak Park Heights recommended the
application with conditions. The City Council of the City of Oak Park Heights makes the
following findings of fact and resolution:
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting documentation to the
Community Development Department consisting of the following items:

3. The property is zoned B-3 Highway Business and Warehouse District in which
medical clinics and office buildings are a permitted use; and
4. Design Guideline/Site Plan approval is required for the building design and site
improvements; and
5. A signage Conditional Use Permit is required to allow two wall signs on one
fagade; and
6. Vacation of an existing drainage and utility easement with replacement of a new
easement at the south east side of the property. A public hearing for the vacation of the easement
was held at the March 12, 2020 Oak Park Heights Planning Commission meeting. The vacation
was recommended by the Planning Commission. The legal description of the easement to be
vacated is as follows:
That part of the Drainage and Utility Easement as dedicated on Lot 2, Block 1, OAK
PARK STATION, according to the recorded plat thereof, Washington County,
Minnesota, described as follows:
Commencing at the southeasterly comer of said Lot 2; thence North 37 degrees 21
minutes 18 seconds East, assumed bearing long the southeasterly line of said Lot 2, a
distance of 10.78 feet to a northeasterly line of a Drainage and Utility Easement as
dedicate on said OAK PARK STATION; thence North 30 degrees 45 minutes 50 seconds
West along said northeasterly line, a distance of 137.55 feet; thence North 54 degrees 53
minutes 35 seconds West, continuing along said northeasterly line, a distance of 5.13 feet
to the point of beginning of the easement to be vacated; thence North 54 degrees 53
minutes 52 seconds West, continuing along said northeasterly line, a distance of 30.00
feet; thence North 35 degrees 06 minutes 24 seconds East, a distance of 319.52 feet to
the northeasterly line of the said southwesterly 386.52 feet of Lot 2; thence South 54
degrees 53 minutes 35 seconds East along said northeasterly line of the said
Southwesterly 386.52 feet, a distance of 30.00 feet; thence South 35 degrees 06 minutes
24 seconds West, a distance of 319.52 feet to the point of beginning.
7. City staff prepared a planning report dated March 6, 2020 reviewing the request;
and
8. Said report recommended approval of the Design Guidelines/Site Plan review, a
signage Conditional Use Permit and vacation of an easement for development of a medical office
building subject to the fulfillment of conditions; and
9. The Planning Commission held a public hearing for the Conditional Use Permit
and the vacation of the drainage and utility easement at their March 12, 2020 meeting, took
comments from the applicants and public, closed the public hearing, and recommended the
application with conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE
FOLLOWING:
A. The application submitted for Design Guidelines/Site Plan review, a signage Conditional
Use Permit and vacation of an easement for development of a medical office building on a
portion of Lot 2, Block 1, Oak Park Station at 5715 Memorial Avenue North, affecting the real
property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights for
Design Guidelines/Site Plan review, a signage Conditional Use Permit and vacation of an
easement for development of a medical office building subject to the following conditions:
1. The drainage and utility easement vacation and establishment of the new easement is
subject to review and approval of the City Engineer and the City Attorney.
2. The site plan shall be subject to review and approval of the Fire Marshal.
3. The Applicant shall provide a snow removal plan or indicate if the snow will be hauled
off site.
4. The landscape plan shall be subject to the review and approval of the City Arborist. The
City Arborist shall work with the Applicant related to the parking lot islands and final
landscape plan.
5. The Applicant has been encouraged to show some of the parking as proof of
parking spaces, possibly the row of parking at the south side of the building. The
Planning Comment should comment.
6. All grading, drainage, erosion control, and utility plans are subject to review and
approval of the City Engineer. Storm water plans are also subject to review and
approval of the Browns Creek Watershed District.
7. All light fixtures shall be full cut off, compliant with the height requirements, and be
consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting
requirements. Outdoor lighting for the parking areas and building lighting shall be turned
off one hour after closing, except for approved security lighting.
8. The proposed accent lighting shall be full cut off and used as architectural building
wash subject to approval of the City Council.
9. All mechanical equipment on the roof or on the site shall be fully screened in
accordance with the provisions of the Zoning Ordinance.
10. The second wall sign reading Orthopedic Urgent Care on the north elevation shall be
removed if that service is discontinued at this location.
11. All signs shall be designed to comply with the Zoning Ordinance requirements for
fixture cut off and illumination.
12. The Planning Commission was favorable, and the City Council approves the building
design and building materials.
13. The City shall encourage the placement of an appropriately placed bike rack.

Planning Commission Review & Recommendation: March 12, 2020
Conditional Use Permit - Lapse of Approval:
Unless the City Council specifically approves a different time when action is officially taken on
the request, the conditional use permit shall become null and void twelve (12) months after the
date of approval, unless the property owner or applicant has substantially started the construction
of any building, structure, addition or alteration, or use requested as part of the conditional use.
An application to extend the approval of a conditional use permit shall be submitted to the
Zoning Administrator not less than thirty (30) days before the expiration of said approval.
