RESOLUTION NO. 20-03-17

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY,MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST FROM OPC PROPERTIES, LLC, TO ALLOW
REPLACEMENT OF A SIGN AT THE NORTHWEST CORNER OF
THE OAK PARK COMMONS PROPERTY AT 5991 NORWICH
AVENUE NORTH BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from OPC Properties,
LLC, to allow replacement of a sign at the northwest corner of the Oak Park Commons
property at 5991 Norwich Avenue North; and after having conducted a public hearing
relative thereto, the Planning Commission of Oak Park Heights recommended the
application with conditions. The City Council of the City of Oak Park Heights makes the
following findings of fact and resolution.
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting documentation
to the Community Development Department consisting of the following items:

and
3. The property is zoned B-4 Limited Business District in which the
shopping center is a permitted use; and
4. The property was approved as a Planned Unit Development which would
require changes to be approved by the Planned Unit Development Amendment process;
and
5. The sign regulations, in Section 401.15.G.9.c.4 and 5) specify that:
4) In any multiple occupancy building qualifying as a shopping
center, signs shall be permitted for each common public entrance.
Each sign area shall not exceed a total of fifty(50) square feet and
shall be located within fifty(50) feet of the common public
entrance being served. Attention shall be given to the possible
number of tenants or occupant bays which may be served by the
common public entrance for which the sign is intended.
5) No permit shall be issued for a new or replacement sign for
individual use except upon a determination by the Zoning
Administrator that it is consistent with the approved
comprehensive sign plan; and
6. The proposed sign is taller, up to 15 feet in total height, than the existing
approved sign, and will be 63 square feet which is larger than allowed by the sign
regulations; and
7. A Planned Unit Development Amendment is required to allow the
proposed sign; and
8. City staff prepared a planning report dated March 5, 2020 reviewing the
request; and
9. Said report recommended approval of the request, based upon the
fulfillment of conditions; and
10. The Planning Commission held a public hearing at their March 12, 2020
meeting, took comments from the Applicants and public, closed the public hearing, and
recommended the application with conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES
THE FOLLOWING:
A. The application submitted by OPC Properties, LLC, to allow replacement of a
sign at the northwest corner of the Oak Park Commons property at 5991 Norwich Avenue
North, should be approved and affecting the real property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights
with the following conditions:
1. The proposed sign shall not exceed 16 feet in height and 70 square feet of signage
per sign face.

2. All proposed signage shall require a sign permit and shall be in compliance with
Section 401.15.G of the Zoning Ordinance.
3. The sign panels shall be illuminated in conformance with Section 401.15.G.4.K of
the Zoning Ordinance.

Planning Commission Review & Recommendation: March 12, 2020
PUD Amendment- Limitation on General Concept Plan Approval:
Unless a General Plan of Development covering the area designated as in the General Concept
Plan as the first stage of the PUD has been filed within twelve(12)months from the date Council
grants General Concept Plan approval, or in any case where the applicant fails to file General
Plan of Development Stage and Final Plans and to proceed with development in accordance with
the provisions of this Ordinance and of an approved General Concept Plan, the approval may be
revoked by Council action. (401.06.C.2.e)
