Call to Order/Pledge of Allegiance: Chair Freeman called the meeting to order @ 6:00 p.m. Present: Commissioners Van Denburgh, VanDyke and White; City Administrator Johnson, and City Planner Richards. Absent: City Councilmember Liaison Representative Liljegren. II. Approval of Agenda: Commissioner Van Denburgh, seconded by Commissioner White, moved to approve the Agenda as presented. Carried 4-0. III. Approval of September 10, 2020 Meeting Minutes: Commissioner White, seconded by Commissioner VanDyke, moved to approve the Minutes as presented. Carried 4-0. IV. Department/Commission Liaison/Other Reports: City Administrator Johnson reported on the Allen S. King Advisory Committee meeting recently held, noting that another was scheduled for later in the month. Chair Freeman noted that it would be good if those meetings were available for public viewing. V. Visitors/Public Comment: None. VI. Public Hearings: None. VII. New Business: A. Planning Commission Applicant Interview(s): The Commission adjourned to a closed work session to interview the applicant for Planning Appointment consideration. The regular meeting was reconvened upon completion of that interview. B. Planning Commission Vacancy—Appointment Recommendation to City Council: Brief discussion was had as to the challenges of recruiting applicants to the Commission and some of the challenges faced by the Commission in making well informed decisions for the City. Chair Freeman noted that City staff does significant ground work to applications that come through so that the Commission is provided with good information at the Planning Commission meetings for their review and consideration in forwarding recommendations to the City Council. Planning Commission Minutes October 8, 2020 Page 2 of 2 Commissioner White, seconded by Commissioner Van Denburgh, moved to recommend City Council appoint Tyler Husby to the Planning Commission. Carried 4-0. City Administrator Johnson clarified that the recommendation would be sent to the City Council at their October 13th meeting and that they would determine the term of appointment and that staff would likely recommend a term that will fulfill completion of the vacant term and a regular full 3-year term, so as to keep the staggering of term appointments in line. VIII. Old Business: None. IX. Informational: A. Upcoming Meetings: B. A PUD is required in that it is a change from the site plan originally approved for Lowe's. The property is zoned B-4 Limited Business District with a PUD overlay that was approved to allow joint access and parking for a coordinated development plan for the CSM Development. The CSM Development that contained the Lowe's Home Center was approved by the City Council in November of 2005. A Conditional Use Permit (CUP) was approved for open and outdoor storage in June 2007. EXHIBITS The review is based upon the following submittals: Exhibit 1: Site Plan (C400) Exhibit 2: Title Sheet (T-1.0) Exhibit 3: Enlarged Floor Plan and Demolition Plan (A-1.0) Exhibit 4: Garden Center and Rear Gate Details (A-1.01) Exhibit 5: Exterior Elevations and Specifications (A-2.0) Exhibit 6: Garden Center Pilaster Plan, Details and General Notes (S-1.0) Exhibit 7: Electrical Schedules, Notes and Details (E1) Exhibit 8: Electrical Schedules, Notes and Details (E2) Exhibit 9: Garden Center Extension Photometric Plan (E3) Exhibit 10: Plumbing Plans and Notes (P1) Exhibit 11: Site Photos PROJECT DESCRIPTION The Applicant has indicated that "the project involves the expansion of the garden center and the addition of a gate on the rear drive aisle." The garden center is on the west side of the Lowe's building. The 5,530 square foot expansion of the garden center area will assure that all of the materials for sale are stored within the screened area. The gate, which faces to the east and to a residential area, will also provide additional screening of the storage area. The expansion area will include a new fence, screening and lighting that will match what is already existing. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The continued use of the site for retail commercial use is consistent with the Comprehensive Plan. Zoning. The property is zoned B-4 Limited Business District. The CSM development, which includes the Lowe's, was approved as a PUD in 2005 to allow multiple commercial buildings within the development with shared access and parking. The PUD is an overlay of the B-4 District. A CUP was required in 2007 to allow open and outdoor storage of truck trailers and allow three delivery trucks to be parked within the storage area at the south side of the Lowe's store. A PUD is required for the expansion of the garden center and the gate in that the site plan of the development is being altered. Setbacks. The B-4 District requires a front yard setback of 40 feet, side yard setback of 10 feet and rear yard of 20 feet. The front is considered Nova Scotia Avenue North and the rear is adjacent to Walmart. The expanded garden center will be approximately 40 feet from the rear property line. None of the other required setbacks are impacted. Traffic Circulation. Traffic circulation within the site will not be impacted with this site change and building expansion. Parking. No changes to the parking area are required with the garden expansion. Lighting. Lighting of the garden center is being altered such that fixtures are being installed adjacent to the new fence. The lighting specifications indicate that the fixtures are to be pole mounted and are full cut off. The Zoning Ordinance states that no light source or combination thereof which cast light on a public street shall exceed one (1) foot candle meter reading as measured from the centerline of said street nor shall any light source or combination thereof which cast light on adjacent property exceed four- tenths (0.4) foot candles as measured at the property line. A photometric plan has been 2 submitted and indicates that this will be complied with. Additionally, the Ordinance states that the maximum height above the ground grade permitted for light sources mounted on a pole is twenty-five (25) feet. The specifications indicate that the pole height is 20 feet but that the fixture will be above that. The Applicant shall check to make sure that requirement is addressed. The conditions of approval will state that all lighting shall be full cut off and shall be consistent with Section 401.15.6.7 of the Zoning Ordinance as it relates to lighting requirements. Signage. Other than required exiting signage, no other signs are proposed. Fencing/Screening. The proposed new fencing at the west edge of the garden center will be identical what is existing now and consist of corner pilasters with relocated tube steel fence and gates. The gate detail plans indicated that the egress gate (6 on Sheet A-1 .01) may be chain link fence or tube steel. The City will require the gate to be tube steel in that it provides better screening and is consistent with the rest of the fencing. Grading, Drainage, Erosion Control and Utilities. No grading, drainage and utility plans were required for this project. Design Guidelines. No Design Guideline review is required. CONCLUSION / RECOMMENDATION Subject to the preceding review, City staff recommends approval of a Planned Unit Development (PUD) Amendment to allow the expansion of the garden center and the addition of a gate on the rear drive aisle of the Lowe's Home Center at 5888 Nova Scotia Avenue North subject to the conditions that follow: 1. All light fixtures shall be full cut off and be consistent with Section 401 .15.B.7 of the Zoning Ordinance as it relates to lighting requirements. No light source or combination thereof which cast light on adjacent property exceed four-tenths (0.4) foot candles as measured at the property line. The maximum height above the ground grade allowed for light sources mounted on a pole shall not exceed twenty-five (25) feet. 2. All gates and fencing shall be constructed with tubular steel. No chain link fence shall be allowed. 3. No merchandise or storage of items shall be stored above the garden level fence on the west side of the building. 4.
