BACKGROUND
Andrew Polonus, representing Lowe's Home Centers has made application for a
Planned Unit Development (PUD) Amendment to allow the expansion of the garden
center and the addition of a gate on the rear drive aisle. A PUD is required in that it is a
change from the site plan originally approved for Lowe's. The property is zoned B-4
Limited Business District with a PUD overlay that was approved to allow joint access
and parking for a coordinated development plan for the CSM Development.
The CSM Development that contained the Lowe's Home Center was approved by the
City Council in November of 2005. A Conditional Use Permit (CUP) was approved for
open and outdoor storage in June 2007

PROJECT DESCRIPTION
The Applicant has indicated that "the project involves the expansion of the garden
center and the addition of a gate on the rear drive aisle."
The garden center is on the west side of the Lowe's building. The 5,530 square foot
expansion of the garden center area will assure that all of the materials for sale are
stored within the screened area. The gate, which faces to the east and to a residential
area, will also provide additional screening of the storage area.
The expansion area will include a new fence, screening and lighting that will match what
is already existing.
ISSUES ANALYSIS
Comprehensive Plan. The property is designated as Commercial on the Proposed
Land Use Map. The continued use of the site for retail commercial use is consistent
with the Comprehensive Plan.
Zoning. The property is zoned B-4 Limited Business District. The CSM development,
which includes the Lowe's, was approved as a PUD in 2005 to allow multiple
commercial buildings within the development with shared access and parking. The
PUD is an overlay of the B-4 District. A CUP was required in 2007 to allow open and
outdoor storage of truck trailers and allow three delivery trucks to be parked within the
storage area at the south side of the Lowe's store.
A PUD is required for the expansion of the garden center and the gate in that the site
plan of the development is being altered.
Setbacks. The B-4 District requires a front yard setback of 40 feet, side yard setback
of 10 feet and rear yard of 20 feet. The front is considered Nova Scotia Avenue North
and the rear is adjacent to Walmart. The expanded garden center will be approximately
40 feet from the rear property line. None of the other required setbacks are impacted.
Traffic Circulation. Traffic circulation within the site will not be impacted with this site
change and building expansion.
Parking. No changes to the parking area are required with the garden expansion.
Lighting. Lighting of the garden center is being altered such that fixtures are being
installed adjacent to the new fence. The lighting specifications indicate that the fixtures
are to be pole mounted and are full cut off. The Zoning Ordinance states that no light
source or combination thereof which cast light on a public street shall exceed one (1)
foot candle meter reading as measured from the centerline of said street nor shall any
light source or combination thereof which cast light on adjacent property exceed four-
tenths (0.4) foot candles as measured at the property line. A photometric plan has been

submitted and indicates that this will be complied with. Additionally, the Ordinance
states that the maximum height above the ground grade permitted for light sources
mounted on a pole is twenty-five (25) feet. The specifications indicate that the pole
height is 20 feet but that the fixture will be above that. The Applicant shall check to
make sure that requirement is addressed. The conditions of approval will state that all
lighting shall be full cut off and shall be consistent with Section 401.15.B.7 of the Zoning
Ordinance as it relates to lighting requirements.
Signage. Other than required exiting signage, no other signs are proposed.
Fencing/Screening. The proposed new fencing at the west edge of the garden center
will be identical what is existing now and consist of corner pilasters with relocated tube
steel fence and gates. The gate detail plans indicated that the egress gate (6 on Sheet
A-1.01) may be chain link fence or tube steel. The City will require the gate to be tube
steel in that it provides better screening and is consistent with the rest of the fencing.
Grading, Drainage, Erosion Control and Utilities. No grading, drainage and utility
plans were required for this project.
Design Guidelines. No Design Guideline review is required.
CONCLUSION / RECOMMENDATION
Subject to the preceding review, City staff recommends approval of a Planned Unit
Development (PUD) Amendment to allow the expansion of the garden center and the
addition of a gate on the rear drive aisle of the Lowe's Home Center at 5888 Nova
Scotia Avenue North subject to the conditions that follow:
1. All light fixtures shall be fuii cut oft and be consistent with Section 401.15.6.7
of the Zoning Ordinance as it relates to lighting requirements. No light source or
combination thereof which cast light on adjacent property exceed four-tenths
(0.4) foot candles as measured at the property line. The maximum height above
the ground grade allowed for light sources mounted on a pole shall not exceed
twenty-five (25)feet.
2. All gates and fencing shall be constructed with tubular steel. No chain link fence
shall be allowed.
3. No merchandise or storage of items shall be stored above the garden level fence
on the west side of the building.
4. All conditions of the PUD approvals granted on November 22, 2005 and the CUP
granted on June 19, 2007 shall remain in effect and will be enforced.

WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RECOMMENDING TO THE CITY COUNCIL THAT THE

OF THE GARDEN CENTER AND THE ADDITION OF A GATE AT
THE REAR DRIVE AISLE AT 5888 NOVA SCOTIA AVENUE
NORTH SHOULD BE APPROVED WITH CONDITIONS
WHEREAS,the City of Oak Park Heights has received a request from Lowe's Home
Centers, LLC for a Planned Unit Development Amendment to allow expansion of the
garden center and the addition of a gate at the rear drive aisle at 5888 Nova Scotia
Avenue North; and after having conducted a public hearing relative thereto,the Planning
Commission of Oak Park Heights makes the following findings of fact:
1. The real property affected by said application is legally described as
follows, to wit:
SEE ATTACHMENT A
and
2. The applicant has submitted an application and supporting documentation
to the Community Development Department consisting of the following items:
SEE ATTACHMENT B
and
3. The property is zoned B-4 Limited Business District in which retail uses
are a permitted use; and
4. The CSM development which includes the Lowe's Home Center was
approved as a Planned Unit Development by the City Council on November 22, 2005;
and
5. A Planned Unit Development Amendment is required for the expansion of
the garden center and addition of the gate in that the improvements alter the original site
plan for the site; and

6. The 5,530 square foot expansion of the garden center will assure that all of
the materials for sale are stored within the screened area and the gate will provide
additional screening to the residential properties to the east; and
7. City staff prepared a planning report dated November 5, 2020 reviewing
the request; and
8. Said report recommended approval of the application in that the project is
in conformance with the criteria for Planned Unit Development approval. Said
recommendation was subject to the fulfillment of conditions; and
9. The Planning Commission held a public hearing at their November 12,
2020 meeting, took comments from the applicants and public, closed the public hearing,
and made the following recommendation:
NOW,THEREFORE,BE IT RESOLVED BY THE PLANNING
COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE
PLANNING COMMISSION RECOMMENDS THE FOLLOWING:
A. The application submitted by Lowe's Home Centers, LLC for a Planned Unit
Development Amendment to allow expansion of the garden center and the addition of a
gate at the rear drive aisle at 5888 Nova Scotia Avenue North and affecting the real
property as follows:
SEE ATTACHMENT A
Be and the same as hereby recommended to the City Council of the City of Oak Park
Heights for approval with the following conditions:
1. All light fixtures shall be full cut off and be consistent with Section 401.15.B.7
of the Zoning Ordinance as it relates to lighting requirements. No light source or
combination thereof which cast light on adjacent property exceed four-tenths
(0.4) foot candles as measured at the property line. The maximum height above
the ground grade allowed for light sources mounted on a pole shall not exceed
twenty-five(25) feet.
2. All gates and fencing shall be constructed with tubular steel. No chain link fence
shall be allowed.
3. No merchandise or storage of items shall be stored above the garden level fence
on the west side of the building.
4. All conditions of the PUD approvals granted on November 22, 2005 and the CUP
granted on June 19, 2007 shall remain in effect and will be enforced.

in conformance with the criteria for Planned Unit Development approval. Said
recommendation was subject to the fulfillment of conditions; and
9. The Planning Commission held a public hearing at their November 12,
2020 meeting,took comments from the applicants and public, closed the public hearing,
and recommended that the application be approved with conditions.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES
THE FOLLOWING:
A. The application submitted by Lowe's Home Centers, LLC for a Planned Unit
Development Amendment to allow expansion of the garden center and the addition of a
gate at the rear drive aisle at 5888 Nova Scotia Avenue North and affecting the real
property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights
with the following conditions:
1. All light fixtures shall be full cut off and be consistent with Section 401.15.B.7
of the Zoning Ordinance as it relates to lighting requirements. No light source or
combination thereof which cast light on adjacent property exceed four-tenths
(0.4) foot candles as measured at the property line. The maximum height above
the ground grade allowed for light sources mounted on a pole shall not exceed
twenty-five(25) feet.
2. All gates and fencing shall be constructed with tubular steel. No chain link fence
shall be allowed.
3. No merchandise or storage of items shall be stored above the garden level fence
on the west side of the building.
4. All conditions of the PUD approvals granted on November 22,2005 and the CUP
granted on June 19, 2007 shall remain in effect and will be enforced.
