CITY COUNCIL MEETING MINUTES
L Call to Order/Approval of Agenda: Mayor McComber called the meeting to
order at 6:00 p.m. Present: Councilmembers Dougherty, Johnson, Liljegren and
Runk. Staff present: City Administrator Johnson, City Clerk Pinski, City
Attorney Kevin Sandstrom, City Engineer Mann, and City Planner Richards.
Absent: None.
Mayor McComber added"2020 Bonding Bill and Norell Ave Project Timing" as
New Business Item F.
Councilmember Dougherty, seconded by Councilmember Liljegren, moved to
approve the Agenda as amended. Carried 5-0.
II. Council/Staff Reports:
A. Mayor McComber: She reported she attended various meetings with the
following groups: Coalition of Utility Cities, Center for Energy and
Environment, Transportation Steering Committee, Minnesota Association
of Small Cities, and a joint meeting with LMC staff and the Minnesota
Association of Small Cities Board. She said she would be attending the
Minnesota Association of Small Cities Board Retreat, a Transportation
Steering Committee meeting on October 16, and a conference call with
NLC regarding COVID on October 14.
B. Councilmember Dougherty: No report.
C. Councilmember Johnson: No report.
D. Councilmember Liljegren: He reported he attended the Joint Airport
Zoning Board meeting on September 23 via Zoom where they went over
the draft Zoning Ordinance. He said the next step was to send it to
MNDOT for review. He said he did not attend the October 8 Planning
Commission meeting.
E. Councilmember Runk: He reported he attended the Middle St. Croix
Watershed Management Organization meeting via Zoom and would be
attending the CVB meeting on October 14 via Zoom.
F. Staff: City Clerk Pinski reported that Rita and William Fornell of 5652
Oak Cove North were chosen as the recycling award winners.

A. Consider Request from Central Automotive—Deferment of Connection &
Park Dedication Fees: Councilmember Dougherty, seconded by
Councilmember Runk, moved to approve the deferment of$109,215.38
for up to 36 months and to direct staff to formalize a written agreement.
Carried 5-0.
B. Discussion on Cost Sharing Policies —Washington Coun . 9tom:
Councilmember Runk reported that there were flaws in Washington
County's Cost Sharing Policy, and he was requesting the City Council
pass a Resolution requesting the County suspend their current policy and
review it. The City Council discussed the language in the Resolution
which outlined several concerns with the policy.
Councilmember Runk, seconded by Councilmember Liljegren, moved to
adopt the Resolution with an added clause that the policy should ensure
compliance with various statutes related to communication with local
jurisdictions. Roll call vote taken. Carried 5-0.
C. COVID-19— CRF Spending Plan - REVISION: Councilmember
Liljegren, seconded by Councilmember Johnson, moved to approve the
Resolution. Roll call vote taken. Carried 5-0.
D. Consider Appointment to Planning Commission: Councilmember
Dougherty, seconded by Councilmember Johnson, moved to appoint Tyler
Husby to the Planning Commission as recommended. Carried 5-0.

E. City Council Teambuilding & Goal Setting: Councilmember Dougherty
suggested the City Council set a half or full day session sometime after the
first of the next year to discuss more long-term planning. Mayor
McComber said she would check with Pam Whitmore from the League of
Minnesota Cities for a date in January and bring it back to the next
meeting.
Councilmember Dougherty, seconded by Councilmember Liljegren,
moved to table the agenda item to the next meeting. Carried 5-0.
F. 2020 Bonding Bill and Norell Ave Project Timing: Mayor McComber
suggested the City Council give authorization for staff to proceed with
pre-planning and prep should the bonding bill pass that week. City
Engineer Mann reported that the City should look at the project as a 2022
project due to timing.
Councilmember Johnson, seconded by Councilmember Dougherty, moved
to authorize staff to start on anything they could should the bill pass.
Carried 5-0.
VIII. Other Council Items or Announcements: City Administrator Johnson reported
that the Lookout Trail neighborhood meeting was set for October 24 at 10:00am
at the Scenic Overlook.
IX. Adiourn: Councilmember Liljegren, seconded by Councilmember Johnson,
moved to adjourn at 6:38 p.m. Carried 5-0.

RESOLUTION APPROVING A GAMBLING PREMISES PERMIT
APPLICATION MADE BY STILLWATER ELKS #179 FOR GAMBLING
ACTIVITY AT STILLWATER VFW
WHEREAS, David R. Carlson., on behalf of Stillwater Elks #179 has applied
with the State of Minnesota Gambling Control Board for a permit to conduct lawful
gambling activity at the site of Stillwater VFW, 5880 Omaha Avenue North in Oak Park
Heights; and.
WHEREAS, the City of Oak Park Heights has reviewed the application and finds
that its purposes meet the necessary community standards; and
WHEREAS, the City of Oak Park Heights has solicited the input of the public
and there have been no objections to the granting of the application for the permit as
applied for by Stillwater Elks #179 with the State of Minnesota Gambling Control Board.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
That the application of Stillwater Elks #179 with the State of Minnesota
Gambling Control Board for a permit to conduct lawful gambling activity at the site of
Stillwater VFW, 5880 Omaha Avenue North, within the City of Oak Park Heights is
hereby approved.

Background/Justification (Please indicate any previous action, financial implications including budget
information and recommendations).
The recent approval of the 2020 State Bonding Bill included funding for the City's proposed
improvements for the street and intersection on Norell and Hwy 36. This funding allows the city to
move forward with the project. In order to account for this capital improvement with an estimated cost
of$2,230,000, I recommend that the City establishes a Capital Improvement Fund titled Norell and
Hwy 36 Interchange Improvements.
The funding for this project is expected to be as follows:
State Bonding Bill $790,000
MnDot Participation $644,000
City Funding $796,000
The use of Unallocated General Fund Balance has been referenced as a possible funding source for the
City's portion of the project. Closing of the Revolving Capital Fund to the General Fund in 2018
transferred $292,000 of unused Capital Project Funds to the General Fund. This amount with
$504,000 of Unallocated General Fund Balance would provide the City's portion of funding.
A schedule of expected fund balance for 2020 is attached.
RECOMMENDED:
Establish a Capital Project Fund for Norell Interchange Improvement and transfer from the General
Fund $796,000 for City's estimated portion of funding.

With the funding established for the Norell Ave. Backage Road project; the City will be commencing in
earnest the process towards its ultimate construction—again slated for 2022. This will of course involve
significant surveying, coordination with property owners, MNDOT offices for design review/vetting,
trails and stormwater permitting.
The general design and bidding process outlined in the attached proposal from STANTEC and is
comprehensive to those design and bidding elements. Project implementation, construction and
inspection would be in a separate proposal in 2021.
The City will be generally expected to advance fund much of this design work, with reimbursements
expected from the State as it proceeds. Interim funding will be in Project Account established by the City
Council — See Council Action Sheet - Establish Capital Project Fund - from Finance Director Betty
Caruso for 10/27/20 Council Meeting.

Reference: Proposal for Engineering Services—Thi 36 at Norell Ave. Backage Road and
Roundabout Project
Dear Eric,
This letter outlines the Scope of Services and estimated costs for providing design and bid letting services
for the construction of a new TH 36 backage road from Krueger Lane to Norwich Ave. and a roundabout on
Norell Ave. The improvements will include modifications to the existing TH 36 frontage road access to
Norell Ave., construction of the new Backage road which will serve as the new east west connection and a
roundabout at Norell Ave. Modifications to the existing TH 36 and Norell Ave. intersection will also be
required.
The design services and project schedule are outlined in detail in Attachment A to this letter.
The Design Phase will be performed on an hourly not-to-exceed basis plus expenses. The fee estimate,
itemized by task, is included in Attachment A.
Estimated Engineering Costs
- Design Services, $227,803
Services to be provided by others
- Geotechnical investigation and pavement section determination, $8,000
(this is an approximate estimate. It is assumed that the City will contract directjy with the
geotechnical consultant.)
Stantec will coordinate the required soils borings with the geotechnical consultant.
This letter and scope of services represent the understanding between the City and Stantec in respect to
the Project and may only be modified in writing signed by both parties and is subject to the current Master
Services Agreement between the City and Stantec.

PROJECT OVERVIEW
The City of Oak Part. 11ci-Isis is in need ol'professional. teclini:t11 assistance to provide detail design
for the construction of ei ricw TH 36 backage road and roundabout on 'Norell .Ave. The project begins at
Krueger- Lane on the west cnd and ends at Norwich Ave. on the east end. The project is a MnDOT
Cooperative Agreement project which will require the de�elopinent of a plan that meets the
requirements of a Mn.D0T final design plan set. The services being 1.)i-m ided by Stantec (Contractor)
include, but are not limited to, field surveys, utility coordination, geometric la\'out, construction limits,
road plans, permits, and bidding assistance.
lA PROJECT MANAGEMENT
Project management will include work necessary for communication and completion of the
project tasks on tune and within budget. [Iie Contractor's stal'I'will have the training and expertise
necessary for the work tasks to which they are assigned.
1.1 Project Management& Administration
1.1.1 Monthly Budget & Billing (Invoice and Status Report): Invoices will be
accompanied by a progress report and schedule update.
1.2 Schedule
The Contractor will submit a refined project schedule based on discussions with the City and
MnDOT. The project schedule will be developed and maintained by the Contractor.

presented and addressed. The Contractor- will prepare the agenda and facilitate the Design
Team meetings. The Contractor will also prepare and distribute draft and final meeting
minutes.

1.5 Neighborhood Meetings (up to two meetings)
Neighborhood meetings will be held at the project development stages determined by the
City. These meetings may be virtual if public meetings are restricted. The meetings may be
in an open house format if the COViD — 19 meeting restrictions are lifted.
The Contractor will prepare for and attend two (2) Neighborhood meetings for the City. The
purpose oftlnc meetings will be to present ocneral project details to the public, including the
roadway design concept, construction staging plan, construction schedule and trat'fic
impacts. The two public open houses will be 17eld at milestones in the project as determined
by the City. A summary of content and feedback from each meeting will be prepared. The
Contractor will rely on information from the City on advcrtising, strategies and then the
Contractor will conduct the advertising.
1.6 Quality Control Management
A Contractor team member will be assigned the title of quality control manager and have the
task of reviewing key submittals. Key submittals include draft plan set submittals. The
basic format for quality certification will be checking, back checking, and verifying format
as according to MnDOT's Design-Bid-Build Quality Management Process. Refer to

1.7 Electronic File Submittal
One electronic copy of the detail design files will be provided to the City and MnDOT.
1.8 Deliverables

3. Gopher State One Call - Design Locate, or field locate utilities as necessary.
3.0 HYDRAULIC ANALYSIS AND DESIGN
The Contractor will cover all activities necessary to analyze and design the hydraulic system within
the project area. The plan will also show the appropriate labels, direction of surface flow, and
direction of water flow into the drainage structures. The Contractor will provide the following
deliverables:
3.1 Storm Sewer (Catch Basin) Replacement Design
The storm sewer or catch basin replacement design will follow the procedures in
MnDOT's "Drainage Manual" and the "Standard Specifications for Highway
C011St1-UCtlnn". The Contractor will be required to use MnDOT's spreadsheet format for

areas will be modeled with consideration of future development and increased runoff
associated with dc%elopment. The Contractor will develop drainage area maps for each
storm drain inlet with pertinent data such as boundaries of the drainage area, runoff
coefficients, time of concentration, and land use with design curve number. The draina�ITe
plan sheets will document the roadway cross slope and super elcv�itions in accordance
with MnDOT's standard plan. Water Resource Engineering (WRI;) related notes,
tabulations. and specifications will be prepared according to MnDOT's latest sample plan

3.2 Wetland Delineations (if necessary)
Wetlands will be identified using standard dciirication methodology described in the 1987
Army Corps of Engineers Wetland Delineation Manual as required by Section =104 of the
Clean Water Act. To verify a site is a wetland, tluree technical criteria will be examined and
documented. A combination of the livdric ;oil. In-dropIlytic vegctation. and liydroloo�y
criteria defines ��ctlands as described in the National Food Security Act Manual (Soil
Conservation Seri cc, 1994) and the Corps of Engineers %Vctlands Delineation Manual
(Environmental Laboratory, 1987). Therefore, an area t1wt meets the hydric soil criteria must
also meet the hydrophytic vegetation and wctland IYvdrology criteria in order for it to be
classified as a jurisdictional wetland. The extent of waterways and creeks will also be
determined using a sub meter GPS unit.
Collect E_visting Data, Complete Field Work
The Contractor will collect soil, aerial, and National Wetland Inventory for the project site
prior to completing the site visit. The field work will consist of examining and documenting
soils. v cucwtion. anal Hydrology to determiiie i f a wetland is present. if a wetland is found, a
transect n ill be completed along the wetland edge. As required b} the Corps of Engineers, a
plot wiII 'be placed in an area that meets the criteria to he �i jurisdictional wetland.

Meeting with the Wetland Conservation Act(WCA) Loral Governmental Unit(LGU)

Government Unit(LGU) and U.S. Army Corp of Engineers (if available) to review the
boundaries in the field.

A wetland delineation report will be prepared for the wetland determination/delineation that
includes all of the necessary- documentation and figures to comply with Federal, State, and
local Agencies to document if a site is a jurisdictional wetland. These reports will include:

incorporated into the Finial Geometric Layout.
6.2 Materials Design Recommendation
The Contractor Zvi I1 work with the Geotechnical finn hired by the City to utilize the soil boring
data to analyze the existing materials and prepare recommendations for the subgrade, base and
surfacing of the roadways. The pavement determination will be provided by the Geotechnical
firm.

The City does have a stormwater drainage system that extends south of the City's limits onto the abutting
property owner lying in Baytown Township. This was established in the late 1990's with the development
of the River Hills subdivision and acts as an overflow and storm control from such area homes,properties
and roadways. See the attached maps and images.
It would appear that some of these downstream structures are in need of some clean-up and repairs or
expanded capacity. What those agreements were at the time between the area developers and property
owners is unknown as there appears to not be any "of-record" easements or other written finding.
Certainly, it might be offered that the City's right to drain such water and in its current capacity is
established with the current landowner having the responsibility to fully address these issues.
That stated, it would seem however reasonable for the City to endeavor to make some improvements.
And, the owner— at least to date —has also made some meaningful efforts to enhance the stormwater
capacity. In order to being to evaluate what may be necessary,please see the proposals from STANTEC
that will better evaluate the situation, volumes and concepts.
As this relates to repairs and renewals of a current City STORM SYSTEM, these estimated study and
design costs of $11,700 (and future Project costs) may be funded from the City's STORMWATER
RENEWAL / REPLACMENT FUND which has a balance of $1.9 million. Of course, these funds are
necessary for long-term maintenance of the entirety of the City's systems —which is extensive but this
project will also be needed to ensure long-term down-stream capacity.
Staff is seeking approval from the City Council to move forward with the Proposal as outlined by
STANTEC—as attached.

Reference: Proposal for Engineering Services—Anderson Property Drainage Improvements
Dear Eric:
This letter outlines the Scope of Services and estimated costs for providing a topographic survey, existing
and alternative analysis, and concept/preliminary layout and cost estimate for the drainage improvements
along the Anderson property south of 55th Street in Baytown Township. The improvements will generally
include an analysis to protect the property from future erosion and scour that is currently occurring due to
the City's runoff from —20 acres north of the property.
The total estimated hourly not-to-exceed (without prior authorization)fee for the work is $11,700, including
expenses. A proposal for design and construction services will be forwarded for the City's review at the end
of this preliminary analysis when a solution is agreed upon by the City.
The work would consist of the following tasks:
Task 1 —Topographic Survey
• Topographic Survey—Collect existing topographic information needed for the concept and final design.
Coordinate Gopher State One Call process. Includes initial survey(1-day)and one follow up visit if
needed.
Task 2— Existing and Alternative Site Analysis
• Stantec will use the City's local surface water management plan (LSWMP) HydroCAD model as the
basis for the existing conditions site analysis. The Anderson property currently receives —20 acres of
runoff from drainage area BT-3 according to the LSWMP. The model will be broken out to determine
the conveyance capacity, as well as the flows and velocities crossing the Anderson property for the
2, 10, 25, 50, and 100-year, 24-hour storm events. All modeling will use NOAA Atlas 14 rainfall data
and MSE Type III rainfall distribution curves.
• Two alternative analysis will be performed for the Anderson property after the existing conditions
model has been completed.
o Alternative one will consist of making alterations to drainage path along the Anderson. As
part of this analysis, we will evaluate the culvert crossings within the property and making
necessary grade changes to provide a drainage path that will reduce the velocities and
potential erosion that is currently happening within the Anderson property.

o Alternative two will consist of creating a stormwater detention feature at the outlet of the
City pipe and modifications to the drainage path along the Anderson property. A
stormwater detention basin will be designed to retain water and slowly release it
downstream, along the Anderson property. The goal of this analysis will be to determine
the sizing of the detention basin needed to release the stormwater to a velocity that will
reduce the risk of further erosion along the drainage path. In this alternative, drainage path
modifications will ideally on be made where erosion has occurred to reestablish the
pathway.
• A technical memorandum summarizing the existing conditions and two alternative analysis will be
completed as part of this Task 2. It will include the necessary information to help advise the City to
a recommended solution. One virtual meeting will be included for this drainage analysis to review
the results with the City prior to finalizing the memo.
• Geotechnical exploration is not a part of this contract. Soil borings should be considered prior to
final design to determine soil characteristics. This will allow for a better understanding of infiltration
capacities and allow designs to help prevent potential erosion and scour from occurring.
Task 3—Conceptual Design Layout and Cost Estimates
• Stantec will complete a conceptual layout for the two alternative layouts described in Task 2. This
will include showing the preliminary drainage alignment and footprint, culvert recommendations,
project limits, and other information that will help allow the City to understand the proposed project.
For the second alternative, the approximate footprint and storage volume of the detention basin will
be shown. Under this scenario, Stantec will also identify the locations of where the drainage path
will be repaired to fix current erosion and scouring locations.
• Preliminary opinion of probably costs associated for each alternative will be provided as part of this
Task.
The fees for the tasks outlined above are as follows:

PROCLAMATION OF THE MAYOR OF THE CITY OF OAK PARK HEIGHTS
SUPPORTING SCHOOL CHOICE WEEK
January 24—30,2021
WHEREAS all children in OAK PARK HEIGHTS should have access to the highest-quality education possible;
and,
WHEREAS OAK PARK HEIGHTS recognizes the important role that an effective education plays in preparing
all students in OAK PARK HEIGHTS to be successful adults; and,
WHEREAS quality education is critically important to the economic vitality of OAK PARK HEIGHTS; and,
WHEREAS OAK PARK HEIGHTS is home to a multitude of high-quality public and nonpublic schools from
which parents can choose for their children,in addition to families who educate their children in the home; and
WHEREAS,educational variety not only helps to diversify our economy,but also enhances the vibrancy of our
community; and,
WHEREAS OAK PARK HEIGHTS has many high-quality teaching professionals in all types of school settings
who are committed to educating our children; and,
WHEREAS, School Choice Week is celebrated across the country by millions of students,parents,educators,
schools and organizations to raise awareness of the need for effective educational options;
NOW,THEREFORE,I,Mary McComber do hereby recognize January 24—30,2021 as OAK PARK HEIGHTS
School Choice Week,and I call this observance to the attention of all of our citizens.
