A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST BY LOWE'S HOME CENTERS, LLC FOR A PLANNED
UNIT DEVELOPMENT AMENDMENT TO ALLOW EXPANSION
OF THE GARDEN CENTER AND THE ADDITION C 11 A GATE AT
THE REAR DRIVE AISLE AT 5888 NOVA >' _s 'i;',e`_: AVENUE

WHEREAS, the City of Oak Park Heights has received a request from Lowe's Home
Centers_. LLC for a Planned Unit Development Amendment to allow expansion of the
garden center and the addition of a gate at the rear drive aisle at 5888 Nova Scotia
Avenue North: and atter- having conducted a public hearing relative thereto,the Planning
Commission of Oak Park Heights recommended that the application be approved with
conditions. The City Council of the City of oak Park lei<ghts makes the following
faidings of fact and resolution:
I. The real property affected by said ahplicdo on is legally described as
follows, to wit:

and
2. The applicant has submitted an application and supporting documentation
to the Community Development Department consisting of the following items:

and
3. The property is zoned B-4 Limited Business District in which retail uses
are a permitted use; and
4. The CSM development which includes the Lowe's Home Center was
approved as a Planned Unit Development by the City Council on November 22, 2005;
and
5. A Planned Unit Development Amendment is required for the expansion of
the garden center and addition of the gate in that the improvements alter the original site
plan for the site: and
6. The 5,530 square foot expansion of the garden center will assure that all of
the materials for sale are stored within the screened area and the gate will provide
additional screening to the residential properties to the east; and
7. City staff prepared a planning report dated November 5, 2020 reviewing
the request; and
8. Said report recon-imended approval of the application in that the project is
in conformance with the criteria for Planned Unit Development approval. Said
recommendation was subject to the fulfillment of conditions; and
9. The Planning Commission held a public hearing at their November 12,
2020 meeting, took comments from the applicants and public, closed the public hearing,
and recommended that the application be approved with conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL i.r;
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPRO`'LE-E'
THE FOLLOWING:
A. The application subimtted by Lowe's Honk Centers, LLC for a Planned Unit
Development Amendment to allow expansion of the -ardcn center and the addition of a
gate at the rear drive aisle at 5888 Nova Scotia Avenue North and affecting the real
property as follow s:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights
with the followin conditic���s:
1. All light fixtures shall be full cut off and be consistent with Section 401.15.B.7
of the Zoning Ordinance as it relates to lighting requirements. No light source or
combination thereof which cast light on adjacent property exceed four-tenths
(0.4) foot candles as measured at the property line. The maximum h61111L above
the ground grade allowed for light sources mounted on a pole shall not exceed
twenty-five (25) feet.
2. All gates and fencins shall be constructed with tubular steel. No chain link fence
shall be allowed.
3. No merchandise or storage of items shall be stored above the garden level fence
on the west side of the building.
4. All conditions of the PUD approvals granted on November 22. 2005 and the CUP
granted on .lune 19, 2007 shall remain in effect and will be enforced.

RESOLUTION 20-1248
A RESOLUTION APPROVING PROPOSED ANNUAL
LIQUOR, TOBACCO, AND AMUSEMENT LICENSES
WHEREAS. the City Council for the City of Oak Park Heights has received applications
for the year 2021 liquor, tobacco, and amusement licenses from businesses located within the
City limits.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Oak
Park Heights that the licenses outlined in Exhibit A are hereby approved.
NOW, THEREFORE, BE IT FURTHER RESOLVED,by the City Council of the
City of Oak Park Heights that the liquor licenses for Fiesta Cancun Stillwater are hereby
approved with the condition that the license holder, Edgar Alexis Gomez Alcocer, must come
into compliance with legal matters resulting from a liquor license violation in 2020 by February
1, 2021.

A RESOLUTION DESIGNATING THE POLLING LOCATION FOR 2021
ELECTIONS IN THE CITY OF OAK PARK HEIGHTS
WHEREAS,there was a change made during the 2017 legislative session to State
Statute 204B.16 which discusses polling place designations; and
WHEREAS, state law now requires municipalities to designate precinct polling
places for all elections for the year by December 31 of the prior year; and,
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Oak Park Heights hereby designates one precinct polling location for 2021 elections in
the City of Oak Park Heights at the following location:

A RESOLUTION APPROVING CERTIFICATION OF DELINQUENT UTILITY
CHARGES TO THE COUNTY AUDITOR FOR COLLECTION WITH THE 2021 TAX
BILLS
WHEREAS, the following properties have delinquent utility bills as of December 8,
2020 and require collection;
SEE ATTACHED LIST
WHEREAS, the City Staff for the City of Oak Park Heights has complied with the
collection procedures for the utility billing and the above accounts remain delinquent as of
December 18, 2020; and,
WHEREAS, the City is allowed by statute to use certification to the County for inclusion
on the real estate tax collection system as the collection mechanism.
NOW,THEREFORE,BE IT RESOLVED, by the City Council of the City of Oak
Park Heights that delinquent utility charges included on the list supplied by the Finance Director
and as reduced for payments between December 8, 2020 and December 18, 2020,be certified to
the County Auditor for Collection with the 2021 Tax Bill.

A RESOLUTION APPROVING THE 2021 BUDGET
WHEREAS, the City Staff has prepared and submitted to the City Council the
proposed budget for calendar year 2021; and,
WHEREAS, the City Council for the City of Oak Park Heights has determined that
the proposed budget as submitted by the City Staff is in the best interests of the citizens of
the City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Oak
Park Heights:
That the 2020 budget is hereby approved as presented by the City Finance Director
in the total General Fund amount of 6,107,322

A RESOLUTION APPROVING THE 2021 GENERAL FUND LEVY, AND THE
CANCELATION OF THE BONDED INDEBTEDNESS LEVY FOR GENERAL
OBLIGATION CAPITAL IMPROVEMENT BONDS OF 2012 AND GENERAL
OBLIGATION CAPTIAL IMPROVEMENT BONDS OF 2014
WHEREAS, the City Staff has prepared and submitted to the City Council the
proposed general fund levy for calendar year 2021; and,
WHEREAS, the City Council for the City of Oak Park Heights has determined that
the proposed general fund levy as submitted by the City Staff is in the best interests of the
citizens of the City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council forthe City of Oak Park
Heights:
1.That the City Administrator is hereby authorized and directed to certify to the
Washington County Tax Accounting and Research Department the General Fund
levy for the City of Oak Park Heights for calendar year 2021 in the amount of
$5,691,012.
2.That the City Administrator is also authorized and directed to cancel the scheduled
tax levy of$460,000 for the General Obligation Capital Improvement Bonds of 2012;
and $41,000 of the General Obligation Bonds of 2014.

RESOLUTION 20-12-54
A RESOLUTION AUTHOPRIZING AN APPLICATION TO THE DEPARTMENT OF
EMPLOYMENT AND ECONOMIC DEVELOPMENT, COMMUNITY ENERGY
TRANSITION GRANT PROGRAM.
WHEREAS, the City of Oak Park Heights, (the City) is a Corrnmtsnity under Minnesota Statute
§116J.55;
NOW THEREFORE BE IT RESOLVED that the City act as the legal sponsor for project(s)
contained in the Community Energy Transition Grant Program to be submitted on(or prior to)
January 4`", 2021 and that the City Administrator is hereby authorized to apply to the Department
of Employment and Economic Development for funding of this project on behalf of the City.
BE IT FURTHER RESOLVED that the City has the legal authority to apply for financial
assistance, and the institutional, managerial, and financial capability to ensure adequate project
administration.
BE IT FURTHER RESOLVED that the City has not violated Federal, State or local Iaws
pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or
corrupt practice.
BE IT FURTHER RESOLVED that upon approval of its application by the state, the City may
enter into an agreement with the State of Minnesota for the above referenced project(s), and that
the City certifies that it will comply with all applicable laws and regulation as stated in all grant
contract agreements.
BE IT FURTHER RESOLOVED that the City shall allocate a 20%match of the estimated project
costs as outlined in the Application.
NOW, THEREFORE BE IT FINALLY RESOLVED that the Mayor and City Administrator are
hereby authorized to execute such agreements as are necessary to implement the project on behalf
of the applicant.

RESOLUTION 20-12-55
CITY OF OAK PARK N E I G H TS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION OF THE CITY COUNCIL OF OAK PARK HEIGHTS
THANKING BRIAN DEROSIER FOR HIS YEARS OF SERVICE WITH
THE OAK PARK HEIGHTS POLICE DEPARTMENT
WHEREAS, Brian. DeRosier was hired to the Oak Park Heights Police
Department as a part-time officer on October 1, 1994 and a full-time officer on
January 1, 1997; and,
WHEREAS, Brian DeRosier was appointed as Deputy Chief on August 1,
2007 and took over as Police Chief in 2008; and
WHEREAS, prior to joining the Oak Park Heights Police Department,
Chief DeRosier served as a Patrol Officer with the City of Bayport and a Military
Police Officer at Camp Ripley; and
WHEREAS, Chief DeRosier expanded his educational horizons by earning
an AAS Degree in Law Enforcement, and completing several POST courses and
hours of training; and,
WHEREAS, Chief DeRosier was committed to strengthening the
communication between the City's Police Department and its citizens; was
especially known for his efforts to preserve and protect the neighborhoods that
make up the City of Oak Park Heights; will be remembered for his efforts at
outreach to the community and his strong support for and personal connection with
all members of the Department; and,
WHEREAS, throughout his career, Chief DeRosier demonstrated the
utmost professionalism, ability, and integrity, winning the unbridled respect and
admiration of his colleagues, fellow officers, and a grateful public; and
WHEREAS, Chief DeRosier is retiring from the Oak Park Heights Police
Department effective December 31, 2020.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of
Oak Park Heights, Minnesota, on behalf of its citizens, expresses its profound
appreciation to Brian DeRosier for 26 years of diligent service to the community.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the City
Council wishes Brian DeRosier a happy, healthy and enjoyable retirement.
