Call to Order/Approval of Agenda: Mayor McComber called the meeting to order at 6:00 p.m. Present: C.ouncilmembers Dou�.,herty, Johnson, Liljegren, and Runk. Mayor McComber: She reported she would be attending the Midwest Governor's meetings through September, she would be attending the Minnesota Association of Small Cities Board meeting, she attended the Xcel Energy breakfast meeting on February 23, she attended the Coalition of Utility Cities meeting and two NLC committee meetings, she attended the Joint Airport Zoning Board meeting the previous week, and she also attended a web meeting with the tax chairs Senator Nelson and Representative Marquart. She reported the League of Minnesota Cities annual conference would be virtual in 2 02 1. B. Councilmember Dougherty: He reported he was appointed Treasurer of the Cable Commission at their February 22 meeting, he attended the Coalition of Utility Cities meeting on February 10, and he attended the breakfast meeting with Xcel Energy on February 23. C. Councilmember Johnson: She reported she attended the NLC Energy, Environment, and Natural Resources policy committee meeting; and she would be attending the NLC virtual conference in March. She announced that the Parks and Trails Commission meeting in February was cancelled and that there was a vacancy on that Commission. D. Councilmember Liljegren: He reported he attended the JAZB meeting on February 10 via conference call and the Planning Commission meeting on February 11. E. Old Business: A. Approve Joint Powcrs Agreement—Mutual Aid w/St. Paul: Police Chief Hansen reported that the City of St. Paul was looking for extra officers in the form of a mobile field force officer and a SWAT officer for upcoming events. He said he would evaluate any requests for assistance and keep the City Council informed. He said the agreement would go both ways in that the City of Oak Park Heights could ask for help from the City of St. Paul if needed. Chief Hansen recommended approval of the agreement. Mayor McComber questioned insurance and liability. Chief Hansen responded that the City of St. Paul would be responsible in that any officer sent from the City of Oak Park Heights would be considered an employee of the City of St. Paul for liability and insurance purposes. Resident Jim Kremer of 5475 Oakgreen Place North was present at the meeting and said he was concerned that the City of St. Paul reduced their force and budget, and he did not feel there was a benefit to this agreement for the City of Oak Park Heights' taxpayers. City Attorney Sandstrom said he could look into why the agreement would be necessary and what the benefit to the City would be if directed to do so by the City Council. Chief Hansen said that under the agreement, there was no obligation to send anyone and that he had discretion on the number of officers to send or to send none at all. Kremer Page 7 of 38 City Council Meeting Minutes February 23, 2021 Page 3 of 4 was concerned that the Chief would have to explain his decision to not send any officers, and Chief Hansen responded that staffing was a valid issue, and also if there was any intel that anything would be happening in Washington County where the City's officers would be needed. Councilmember Dougherty asked if there were other neighboring communities entering into a similar agreement, and Chief Hansen responded that most had, and he hasn't followed up with the couple that hadn't yet. Councilmember Dougherty, seconded by Councilmember Johnson, moved to approve the agreement. Roll call vote taken. Carried 5-0. VII. New Business: A. Menards Yard Entrance—Conditional Use Permit and Design Guidelines: City Planner Richards reported that Tyler Edwards made an application for Conditional Use Permits for setback and parking to add an automated express lane and Menards. He reviewed his planning report and reported the Planning Commission recommended approval. Councilmember Dougherty, seconded by Councilmember Runk, moved to approve the Resolution. Roll call vote taken. Carried 5-0. B. Approve Purchase of Five Police Vehicles: Chief Hansen reported that the current police vehicles were part of a retired fleet. He said he created a vehicle rotation of safe, presentable, and professional cars with higher resale value. He said he included an unmarked truck in the request. Councilmember Liljegren, seconded by Councilmember Dougherty, moved to approve the request. Roll call vote taken. Carried 5-0. C. Authorization to Offer Local Government Internship—,.Temp. Position: City Administrator Johnson reported that the City was contacted by a Hamlin University student, Katie Danielzuk, who was interested in working as an intern for the City. He said staff determined some projects that would be valuable for both an intern and the City, and that an interfund transfer from health care costs to administration would fund the position. He reported he contacted Ms. Danielzuk's references and received positive feedback. Councilmember Johnson, seconded by Councilmember Liljegren,moved to authorize the offer. Roll call vote taken. Carried 5-0. D. Consider Resolution Outlining Possible City COVID-19 Responses to Aid: Actions Related to Liquor Licensing: Round 2: City Administrator Johnson reported that Finance Director Caruso ran numbers to determine a prorated refund of license fees for those businesses affected by the Page 8 of 38 City Council Meeting Minutes February 23, 2021 Page 4 of 4 Governor's shutdown orders mid-November 2020 through early January 2021. He said it would be an estimated total of$4,400 refunded. Councilmember Runk, seconded by Councilmember Johnson,moved to approve the Resolution. Roll call vote taken. Carried 5-0. E. Sewer Cleaning Contract: Public Works Director Kegley reported that the City maintained approximately 135,000 linear feet of sanitary sewer pipe cleaned over a five-year period. He said Pipe Services proposed cleaning, televising, and compiling expensive reports of the sewer pipes for approximately $26,650 per year, and that he has been satisfied with their work in the past. He recommended approval of the contract. Councilmember Liljegren, seconded by Councilmember Dougherty, moved to authorize staff to contract with Pipe Services. Roll call vote taken. Carried 5-0. F. Support Legislation Relating to the Small Cities Assistance Program: Mayor McComber reported that two bills were presented after she testified before the House Transportation Committee. She requested the City send a letter supporting sustainable funding for a Small Cities Assistance Program. Councilmember Johnson, seconded by Councilmember Runk, moved to authorize sending the letter. Roll call vote taken. Carried 5-0. VIII. Other Council Items or Announcements: City Administrator Johnson reported that he received an email that the Metropolitan Airports Commission was looking to create a Lake Elmo local advisory committee and for appointment of representatives from the City. He said he would put it in Weekly Notes and Council could discuss it the following month. IX. Arbor Day is recognized in all 50 states as well as in many other countries. Many communities have special Arbor Day events and activities such as tree plantings. During Arbor Month the benefits of tree care and the importance of tree plantings are expressed. Arbor Day and Arbor Month are a great way to get the community active outdoors and make a difference in the appearance of their property and city parks. The City of Oak Park Heights has been named a Tree City USA for 38 years strong and the award is valued greatly by the community. Therefore I recommend the Council to proclaim Friday April 30' 2021 Arbor Day in the City of Oak Park Heights and the month of May to be Arbor Month in the City of Oak Park Heights. Background/Justification (Please indicate if any previous action has been taken or if other public bodies have advised): This Council Action Sheet seeks permission to update and replace various equipment that is in need of updating;there are three(3)items: ITEM 1: Portable Radios-$48,797 I am requesting the approval to replace 10 officer portable radios. The current radios are 12 yrs old and are no longer supported by the manufacturer and have not been for the past couple of years. Parts and accessories for these radios can no longer be purchased. These new requested radios are from Motorola under the APX series. These replacement APX public safety radios offer encryption capability,allowing staff to share sensitive information with dispatch or other responders that cannot be monitored by scanners. The APX line of radios also allows remote programming over Wi-Fi. Currently fielded radios need to be periodically updated by county radio staff in person via USB cable. 10-Portable radios Motorola APX6000,with batteries,chargers is$48,797.00 Vendor:Ancom Communications contract bid pricing Item 2: Squad Car Video and Body Cameras-$48,140 I am requesting approval to replace 4 squad video cameras,4 officer body cameras and adding 6 additional body cameras for a total of 10. Currently our squad video cameras are 10 years old and only 3 of them are working.Also,we only have 4 body cameras that are 1St generation devices. Each officer needs to have their own. If there is a large-scale event or multiple officers involved service call,we currently don't have enough cameras for everyone.It is an absolute must for each officer to have one available. We have researched other systems and spoke with other vendors for pricing and demonstrations.We recommend using the same company Watchguard that we currently use but with new updated equipment. The new equipment will allow squad car cameras to wirelessly upload the video to a server at the PD. This will reduce the size of hardware equipment currently in the squads as they currently load dvds into the device that are mounted on the ceiling near the rear-view mirror.Additionally,there will be three squad cameras now recording in each squad. Two cameras to the front of the squad which include a wide-angle fixed position and a second swivel camera that the officer can adjust further out to the left or right depending on the incident location. The third camera is in the backseat area. The new body cameras will now be able to record in conjunction with the squad cameras. This integrated system will allow both camera systems to download on one event together.If the officer activates their body camera it will also activate the squad camera too. Each of the new body cameras are more robust/ruggedize with improved camera angle along with two microphones which counter act the wind interference. The new body cameras have improved battery capabilities designed to last a 12-hour shift which is ideal for our current 11-hour patrol shift configuration. Page 13 of 38 These cameras will all download to a new server that will now have redaction capabilities. This is extremely important and necessary for fulfilling video requests. We can now block out or blur other persons or juveniles that might be intentional or not intentionally recorded during an incident.Following current data practice laws. 10-body cameras Vista V300 and 4 squad video cameras 4RE is$48,140.00 Vendor Watch Guard is under contract bid pricing plus there will be an annual software maintenance fee for 14 devices at approx. $2,730.00 Item 3: Squad Car Computers-$15,469.00 Third item request for approval is to replace all 4 squad car computers. The current laptops are 5-6 years old and need to be replaced with upgraded hardware consisting of internal GPS and Cell provider network cards. I have examined two of most popular or common laptops for law enforcement that are similar priced.I am choosing to stay with the Panasonic brand with the semi ruggedized package. These laptops can also be docked in the squad cars or removed for portable use too. 4-laptop computer Panasonic Toughbook FZ-55 with ex warranty is$14,669.00+Software (Microsoft Office version 2019)is an additional$800.00. Vendor Baycom is under contract bid pricing. At this process now moves towards application of such rules, the MAC is seeking a to create the Lake Elmo Local Advisory Commission to ensure there is a continuing conversation between their offices and the local community. According, they are seeking two members from the City of Oak Park Heights (and other members)to continue to serve on this Commission—One Member and One Alternate. If the City would like to continue in this, the MAC is seeking a resolution of appointment of two persons. Staff has drafted a resolution—attached—that appoints the two Council members that participated in the JAZB process—Mayor McComber and Council member Mike Liljegren for a TWO-YEAR term. By appointing representatives to this Commission, the appointing authorities do hereby endorse the purpose and goals as identified in these bylaws and authorize and support the Commission as an advisory body to the respective appointing bodies. ARTICLE II PURPOSE AND GOALS GOAL: This Commission is formed to further the general welfare of the community and the Lake Elmo Airport, a public airport in the City of Lake Elmo, County of Washington, state of Minnesota, through minimizing or resolving problems created by the aircraft operations at the airport. PURPOSE: 1. The Commission shall advise the community and the Metropolitan Airports Commission with regard to all matters affecting the Lake Elmo Airport, the classification, rules and regulations supplied to the operation of the Airport and the development of lands adjacent to the Airport. 2. The Commission shall cooperate with the Metropolitan Airports Commission staff in reviewing matters affecting the use and control of the Lake Elmo Airport. 3. The Commission shall make its recommendations to the Metropolitan Airports Commission regarding any proposal affecting the use or operations of Lake Elmo Airport. ARTICLE III MEMBERSHIP 1. Officially designated representatives and their alternate representatives shall be appointed to serve for two (2) year terms and until their successor is appointed. Vacancy shall be filled by the appointing authority for a new two (2) year term commencing with the date of appointment of such successor representative. 2. In addition to the designated USER and PUBLIC Representatives (or their appointed alternate), non-voting membership to the Commission may include TECHNICHAL ADVISORS. Page 34 of 38 TECHNICAL ADVISORS— Officially recognized organizations or agencies maybe called upon to advise the Commission that include: the Federal Aviation Administration (FAA), Minnesota Pollution Control Agency (MPCA), Metropolitan Airports Commission Board Members or staff, and any other organization or agency that can provide technical assistance to matters of interest to the Commission. 3. ARTICLE IV VOTING RIGHTS OF MEMBERSHIP 1. A quorum at all meetings of the Commission shall consist of attendance by three (3) USER REPRESENTATIVES and three (3) PUBLIC REPRESENTATIVES, or duly designated alternatives. 2. Each USER and PUBLIC REPRESENTATIVE, or a duly designated alternate, shall have one (1) vote. 3. The Bylaws may be amended by majority vote of membership provided that notice of such proposed amendments shall have been given ten (10) days prior to the Commission meeting. Voting may be conducted via email, or by members in attendance at a meeting in-person or through use of virtual collaboration tool. Page 35 of 38 ARTICLE V CO-CHAIRPERSONS The representatives shall elect by majority vote from membership present (in-person or through use of virtual collaboration tool) at the time of voting two (2) chairpersons; one (1) from the PUBLIC REPRESENTATIVE constituency and one (1) from the USER REPRESENTATIVE. The chairpersons will alternate conducting chairperson duties from one meeting to the next. The Chairpersons shall serve for a two (2) year term or until his/her representation on the Commission terminates, whichever occurs first; and until his/her successor is elected. The powers and duties of the Chairpersons are as follows: 1. To preside at all meetings of the Commission. 2. To call special meetings of the Commission as he/she deems necessary, or upon request by two (2) USER or two (2) PUBLIC REPRESENTATIVES. 3. To sign as Chairpersons of this Commission, with the approval of the membership, certifications and other papers and instruments in writing that may require such signature. 4. To perform such other duties and tasks as these Bylaws or as the membership shall from time to time prescribe. ARTICLE VI RULES OF ORDER 1. All administrative support will be provided by a staff member of the Metropolitan Airports Commission. 2. All record retention will be provided by the Metropolitan Airports Commission. 3. Meetings will be held on a semi-annual basis at a minimum. 4. Membership will establish the location of meetings. 5. Roberts Rules of Order will preside on issues of disagreement. 6. Financing of the Commission initiatives relative to the respective constituencies will be provided by that constituencies appointing authority, or as other sources of funding are established.
