In April of 2004, we set a deadline of September 30, 2005 for removal of the sign if the "Buttonhook" design concept for Highway 36 reconstruction was rejected. That design was rejected but we failed to remind you to remove the sign by September 30th This letter is your notification that the sign must be moved out of County right of way. Since relocating the sign in the winter months would be costly and difficult, we will extend that deadline to June 1, 2006. I have enclosed copies of our previous letters regarding the sign, dating back to November 14, 2002. Because the sign base blocks visibility to the south, it must be removed. Oak Park Heights, MN 55082 _"MISTER CAR WASH" SIGN IN RIGHT OF WAY OF WASHINGTON COUNTY STATE AID • HIGHWAY 24 (OSGOOD AVENUE NORTH; CSAH 24) We recently received a complaint that your sign, located in the southwest quadrant of Osgood Avenue and 59th Street North, blocks drivers'visibility to the south. When we checked it,we found that the sign, and especially the retaining wall around it, does block the sight lines of eastbound • drivers on 59th Street. We then checked to determine if it is located on your property or in the public right of way and found that it is almost entirely located in the County's right of way for CSAH 24. Minnesota Statute 160.27, Subdivisions 8 and 9, specifically prohibit advertising signs in public rights of way. More importantly, this installation is a definite traffic hazard. It must be removed and relocated outside of the right of way. . We recognize that it is difficult, if not impossible to do this work during the winter, so you may wait until spring to relocate the sign. If it is not moved by June 1, 2003, we will take steps to ensure that it is removed. We apologize for the inconvenience and expense that moving the sign will cause you, but we regard it as serious traffic hazard that must be removed. It has the potential to cause a serious accident and could create significant liabilities for you and the County. We cannot allow the sign and retaining wall to remain in the right of way. I have enclosed some photos of the sign and retaining wall, the "RW B" sign sticking up between the sign base and shrub is a right of way corner marker. I have also enclosed an air photo showing right of way limits and a copy of Minnesota Statute 160.27. Please call me at 651-430-4312 if you have questions or comments. Our survey crew staked the limits of the County right of way yesterday(5/29/03) to assist you in determining where to relocate the sign. When we met, you asked for some time to arrange the relocation of the sign. We would like to see it moved as soon as possible, but no later than October 31, 2003. Since we met I have received two more complaints from motorists about the difficulty this sign creates in seeing to the south. We would appreciate it if the block planter around the sign base were removed prior to the sign relocation, and as soon as possible. Thank you for your cooperation on this matter. You have improved visibility for drivers by removing the planter that had been built around the sign base. Nevertheless, the sign base still restricts visibility to the south and is, in our opinion, a traffic hazard. Also, we are prohibited by statute from allowing advertising signs in County right of way. We ask that you continue to work with the City of Oak Park Heights to find a solution that conforms to City ordinances or that is an acceptable variance.
