SIGN IN RIGHT OF WAY OF WASHINGTON COUNTY STATE AID HIGHWAY 24 (OSGOOD
AVENUE NORTH; CSAH 24), OAK PARK HEIGHTS
Dear Mr. Lemon:
I have discussed the matter of your sign in County right of way with Oak Park Heights City
Councilman Mark Swenson and with County Engineer Don Theisen. Mr. Swenson asked if the
relocation of your sign could wait until it is determined if the planned reconstruction of Highway
36 would affect your business.
We do not know exactly when a final decision will be made on the "Concept F, Buttonhook"
design option that was recommended to and given preliminary approval by Oak Park Heights,
Stillwater, and the County, but that decision must be made by early 2005.
If the "Buttonhook" design is rejected, impact to your property will not be an issue and the sign
must be removed by September 30, 2005.
If the "Buttonhook" concept is approved, we will review the impact to the property and make a
decision based on that impact and its timing. In any case, we must resolve this issue and plan
for removing the sign. It is a traffic hazard and cannot legally be allowed to remain in the public
right of way
I have enclosed copies of my previous letters regarding the sign. Please call me at 651-430-
4312 if you have any questions.
Sincerely,
Joseph Lux

SIGN IN RIGHT OF WAY OF WASHINGTON COUNTY STATE AID HIGHWAY 24 (OSGOOD
AVENUE NORTH; CSAH 24) IN OAK PARK HEIGHTS, MINNESOTA
Dear Mr. Secord:
Thank you for meeting with me last week at your Oak Park Heights location. Our survey crew
staked the limits of the County right of way yesterday (5/29/03) to assist you in determining
where to relocate the sign.
When we met, you asked for some time to arrange the relocation of the sign. We would like to
see it moved as soon as possible, but no later than October 31, 2003.
Since we met I have received two more complaints from motorists about the difficulty this sign
creates in seeing to the south. We would appreciate it if the block planter around the sign base
were removed prior to the sign relocation, and as soon as possible.
Thank you for your cooperation on this matter. Please call me at 651-430-4312 if you have any
questions.
Sincerely,
seph Lux

SIGN IN RIGHT OF WAY OF WASHINGTON COUNTY STATE AID HIGHWAY 24 (OSGOOD
AVENUE NORTH; CSAH 24), OAK PARK HEIGHTS
Dear Mr. Lemon:
I have discussed with the County Engineer the difficulties that you are having in moving your sign.
You have improved visibility for drivers by removing the planter that had been built around the sign
base. Nevertheless, the sign base still restricts visibility to the south and is, in our opinion, a traffic
hazard. Also, we are prohibited by statute from allowing advertising signs in County right of way.
We ask that you continue to work with the City of Oak Park Heights to find a solution that conforms
to City ordinances or that is an acceptable variance. We will extend our deadline for moving the
sign by one year to October 31, 2004.
Please call me at 651-430-4312 if you have any questions or if I can be of any help.
Sincerely,
oseph Lux
