CERTIFIED MAIL RETURN RECEIPT REQUESTED March 20, 1990 Mr. Steve Chaves Chaves Property 5845 Stage Coach Trail North Oak Park Heights, Minnesota 55082 Dear Mr. Chaves: RE: Petroleum Storage Tank Release Investigation and Corrective Action Site: Chaves Property, 5845 Stage Coach Trail North, Oak Park Heights Site ID#: LEAK00002325 The Minnesota Pollution Control Agency (MPCA) has received your notification that a release of petroleum has occurred from storage tank facilities which you own and/or operate. The first report of the release was made to MPCA staff on March 2, 1990. Federal and state laws require that persons legally responsible for storage tank releases notify the MPCA of the release, investigate the extent of the release and take actions needed to ensure that the release is cleaned up. A person is generally considered legally responsible for a tank release if the person owned or operated the tank either during or after the release. We are aware that during an environmental site assessment by City Corporation soil contamination was encountered. The MPCA staff is therefore requesting you to take the necessary steps to investigate and clean up the release in accordance with the enclosed "Outline for the Petroleum Tank Release Investigation Report." To do this it is recommended that a qualified consulting firm be hired who has experience in conducting petroleum release site investigations and corrective actions. If you do perform the requested work, the state may reimburse you for a major portion of your costs. The Petroleum Tank Release Cleanup Act establishes a fund which in certain circumstances provides partial reimbursement for petroleum tank release cleanup costs. This fund is administered by the Petroleum Tank Release Compensation Board (Petro Board). More specific eligibility rules are available from the Petro Board (612/297-4017). Please respond to this letter either in writing or by telephone within 30 days after receipt of this letter. Your response should indicate whether or not you intend to proceed with the necessary corrective action, whom you have chosen to do the work and a schedule for implementation. In this event, the MPCA Commissioner may order you to take corrective action. If not complied with, the Commissioner's order could be enforced in court or, alternatively, the MPCA could spend its own money cleaning up the release and then seek to recover its costs from responsible persons through legal action. Failure to cooperate with the MPCA in a timely manner may also result in reduced reimbursement from the Petro Board. If you conclude that the release in question is not from any tank which you have owned or operated, please notify the MPCA immediately and explain the bazis of your conclusion. In addition, please notify me within 24 hours of discovery of free floating petroleum product on the surface of the ground water, and notify me three days before removing any tanks. This Article of the code contains stipulations which must be followed, as well as, several conditions enforced by Minnesota Pollution Control regarding soil around and under tanks which must be dealt with accord- ing to rules and regulations. With this in mind, please be advised that you are requested to remove tank or tanks at the Stagecoach Trail North building within 90 day- upon receipt of this letter. Failure to do so will result in the City of Oak Park Heights doing necessary work and adding cost to tax roll. If you have any questions in this matter, please contact me. It is for this reason that our office suggests that both fencing of the maximum allowable height and planting strips emphasizing tall evergreen shrubs/trees be utilized to diminish this expanded public visibility. MEMORANDUM TO: Frank Leier FROM: Robert Kirmis/Curtis Gutoske DATE: 13 December 1988 RE: Oak Park Heights - Chaves Outdoor Storage FILE NO: 798 . 02 - 88 . 29 This memorandum responds to your request to investigate the specific screening requirements of the Chaves property in which 6 to 8 tank trailers are being stored on an ( I-1) industrially zoned property. According to Section 401 . 03 . B. 7 . of the Oak Park Heights Zoning Ordinance, all required fencing and screening of outdoor storage areas from public right-of-way lying within industrial zones shall consist of either a fence or a green belt planting strip as provided for below: ( 1) A green belt planting strip shall consist of evergreen trees and/or deciduous trees and large shrubs and shall be of sufficient width and density to provide an effective visual screen.
