CITY OF OAK PARK HEIGHTS PLANNING COMMISSION MEETING MINUTES Thursday, March 11, 2021 Held Via Video Conference Per MN Statute 13D.021 Call to Order: Chair Freeman called the meeting to order @ 6:00 p.m. Present: Commissioners Husby, Van Denburgh, VanDyke and White; City Administrator Johnson, City Planner Richards, and City Councilmember Liaison Representative Liljegren. II. Approval of Agenda: Commissioner White, seconded by Commissioner Van Denburgh, moved to approve the Agenda as presented. Carried 5-0. III. Approval of February 11, 2020 Meeting Minutes: Commissioner White, seconded by Commissioner VanDyke,moved to approve the Minutes as presented. Carried 5-0. IV. Crist C.U.P: Review and consider Conditional Use Permit Requests for a rear yard setback reduction of 8-feet and to construct a 1,395 s.f garage at 6188 Beach Rd. N. City Planner Richards reviewed the March 4, 2021 Planning Memorandum to the requests to allow a reduced rear yard setback and garage size square footage increase for construction of a new garage and addition to the existing home. Richards provided an issue analysis and discussed the same, noting that staff recommended approval, subject to the conditions reviewed. Discussion was had as to the requirement of exterior materials for the new addition and garage to be compatible with those upon the house and as to issues related to property lines and setbacks to the lot. Planning Commission Minutes March 11,2021 Page 2 of 3 Chair Freeman opened the public hearing at 6: 15 p.m. and invited public comment. There being none, Commissioner White, seconded by Commissioner Van Denburgh, moved to close the public hearing. Carried 5-0. Brief discussion commenced. City Planner Richards will comment on existing property line encroachment at west side of existing home in the resolution. Commissioner Van Denburgh noted that the turnaround area space at the driveway was a smart move with the busy road. Commissioner Van Denburgh, seconded by Commissioner VanDyke,moved to recommend City Council approval of the request, subject to the conditions of the March 4, 2021 Planning Memorandum, specifically, that: 1. Any exterior mechanical equipment associated with the garage addition shall be screened. 2. The exterior of the proposed garage addition shall be finished with siding to match the current house. 3. The Applicant shall apply for and receive a building permit for the structure. 4. The concrete pad proposed outside of the mud room door shall be required to be five-feet from the property line. 5. The Applicant shall provide a plan for any removal of trees. 6. Any other conditions of the Planning Commission, City Council and City Staff. Carried 5- 0. B. Palmer Station P.U.D. Amendment: Review and consider a Planned Unit Development Amendment request to allow a reduction to the front yard setback from 30-feet to 25- feet at Lot 10, Palmer Station, located at 5613 Oak Cove,N. City Planner Richards reviewed the March 4, 2021 Planning Report to the request, providing a brief history of similar requests within the development and noting that the change would allow a greater separation from the wetland buffer at the rear yard and that the City Engineer has reviewed the proposal. Richards provided an issue analysis and discussed the same, noting that staff recommended approval. Discussion ensued. It was noted that four houses that have had their front yard setback altered and that they blend well with the other homes in the neighborhood. Olivia Gavic—Creative Homes, applicant to the request, discussed the setback changes made to date within the development, noting that in this request, there was some confusion as to the setback requirements at the wetland buffer area. TPC FILE: 236.02 — 21.04 BACKGROUND Olivia Gavic, representing Creative Homes Inc. has made an application for a Planned Unit Development Amendment to allow for changes to a boulder rock retaining wall for Lot 8, Palmer Station located at 5573 Oak Cove North. The Planned Unit Development Amendment is required to vary from the changes to the original grading plans and locations of the retaining wall. The City Council approved the request for the rezoning, Planned Unit Development, and Preliminary and Final Plat for the thirteen-lot subdivision of the Palmer property at their July 22, 2014 meeting. On July 28, 2020, the City Council approved a Planned Unit Development Amendment for reduction in the front yard setback from 30 feet to 20 feet for Lots 7, 8 and 9 of Palmer Station or 5606, 5573, and 5607 Oak Cove North, respectively. The current proposal is to place the new dwelling 20.5 feet from the property line for Lot 8 and to make changes to the retaining wall. The property is zoned R-1 Single Family Residential District. The review is based upon the following submittals: Exhibit 1: Certificate of Survey for Lot 8 Exhibit 2: Elevation Diagram of Boulder Wall Exhibit 3: Site Pictures Exhibit 4: Report of the City Engineer PROJECT DESCRIPTION Ms. Gavic has indicated that the reason for the request is to allow the expansion of the existing retaining wall to allow construction of a three-car garage and to keep proper drainage through the lot. The house will be pulled forward to 20 feet from the property line which will keep it aligned with the adjacent existing house. The site plan indicates a portion of the retaining wall to be removed and the line marked in red on the survey shows the proposed retaining wall location. The elevation diagram shows the wall to be constructed from fieldstone boulders with a wrought iron fence at the top of grade. The highest part of the wall is 12 feet tapering to one foot. The fence is needed for any part of the wall over a four-foot elevation. ISSUES ANALYSIS Comprehensive Plan. The Comprehensive Plan 2018 designates this area as Low Density Residential. The Palmer Station development is in conformance with the Comprehensive Plan. Zoning. The property is currently zoned R-1 Single Family Residential District. The R- 1 District requires a front yard setback of 30 feet, side yard setbacks of 10 feet and rear yard setback of 30 feet. The Planned Unit Development Amendment approved in July 2020 reduced the front yard setback by 10 feet to 20 feet. Exhibit 1 shows the proposed building footprint at the 20.5-foot setback. The change to the retaining wall was considered enough of a variation to the grading plan that it required a Planned Unit Development. The retaining wall and grading shall be subject to approval of the City Engineer. Planned Unit Development Amendment Review. The Planning Commission and City Council should review the criteria for a Conditional Use Permit in considering the Planned Unit Development: The conditional use permit criteria, found in Section 401.03.A.7 of the Zoning Ordinance, are found as follows: 1. Relationship to the specific policies and provisions of the municipal comprehensive plan. 2. The conformity with present and future land uses in the area. 3. The environmental issues and geographic area involved. 4. Whether the use will tend to or actually depreciate the area in which it is proposed. 5. The impact on character of the surrounding area. 6. The demonstrated need for such use. 7. Traffic generation by the use in relation to capabilities of streets serving the property. 8. The impact upon existing public services and facilities including parks, schools, streets, and utilities, and the City's service capacity. 9. The proposed use's conformity with all performance standards contained herein (i.e., parking, loading, noise, etc.). 2 Comment: The Planning Commission should comment if any of these criteria will be at odds with the Planned Unit Development Amendment proposed for the site. The changes to the retaining wall and grading will not negatively impact any of the above criteria. City Staff does not see any issues with the request. Grading and Drainage. A grading plan has been provided as part of the submittals. The City Engineer shall review and approve all of the grading and drainage plans including the boulder rock retaining wall. The City Engineer has provided a letter that is found as Exhibit 4 and includes a condition that the City shall be notified when the final grading of the lot is complete, prior to placement of sod, so that the grades and drainage can be confirmed. Easements. No existing easements will be impacted, nor new easements are required with this request. CONCLUSION / RECOMMENDATION Upon review of the request for a Planned Unit Development Amendment to allow for changes to a boulder rock retaining wall and grading for Lot 8, Palmer Station located at 5573 Oak Cove North, City Staff recommends the application with the following conditions: 1. The final grading and drainage and plan for the boulder rock retaining wall for Lot 8 shall be subject to approval of the City Engineer. 2. The boulder rock wall shall be constructed as per the certificate of survey dated March 4, 2021 and the wall elevation dated March 24, 2021 including the addition of the wrought iron fence as indicated. 3. The City shall be notified when the final grading of the lot is complete, prior to placement of sod, so that the grades and drainage can be confirmed, subject to approval of the City Engineer. 4.
