RE: Oak Park Heights - Kennedy Site Plan Review

Please be advised that the Planning Commission at their May 10, 1999 meeting voted 3-0
to approve the site plan for an office/warehouse building at 5650 Memorial Avenue North
in the Kern Center. The Planning Commission approved the site plan review with the nine
conditions listed in the planning report, but revised number 3 to indicate that curb and
gutter will be required around all paved surfaces on the site. The Planning Commission
took this action in that curb and gutter is an ordinance requirement and a variance had not
been requested by the property owner.
After discussion on the Kennedy site plan, the Planning Commission approved a motion
requesting that the City Council evaluate the policy regarding full curb and gutter around
all paved areas in the Kern Center. It has been suggested that curb and gutter be required
for those areas in front of the buildings where parking for employees and customers is
provided. The areas in back for driveways and storage would be allowed without curb and
gutter. This should be considered only for the Kern Center and would require an
amendment to the Zoning Ordinance.
The Planning Commission also suggested that the Zoning Ordinance and Design
Guidelines be revised so that development requests that meet all ordinance and design
guideline criteria be approved through staff approval and not require Planning Commission
and City Council attention. The City Council should consider this suggestion for a possible
ordinance/guideline amendment.
