smoke detector(s).

Present: Mayor McComber, Councilmembers Dougherty, Johnson, Liljegren and Runk; City
Administrator Johnson, City Attorney Sandstrom, City Planner Richards. City Engineer Mann,and City

1. Call to Order: Mayor McComber called the meeting to order at 5:00 p.m.
2. Legislative Consulting Goals: Mayor McComber suggested financial assistance for the City due
to the King Plant decommissioning be an item to include for the bonding bill. City Administrator
Johnson gave a presentation on the King Plant tax revenue and what would be needed for makeup
of lost revenue. Ann Lenczewski reported that the first step would be to get support to write the
legislation. She said she already spoke with Representative Christensen who expressed support,
and she had plans to speak with Senator Housley. She said the next step would be to conduct
research and then write the legislation. City Administrator Johnson reported that the City received
grant funding for Stantec to do a utility study. City Engineer Mann said he hoped to start the
utility study in June for the King Plant site to determine how to service water, sewer, and
storm water, with actual start date depending on the grant paperwork,and finish the study by the
end of the year.He said included in the scope would be service needs for a lesser developed site
and for more intensive use on the site.
No action taken.
3. Memorial Avenue Reconstruction Project: City Engineer Mann reviewed proposed
improvements to the area. Councilmember Runk asked why the City should spend money to look
at the area now since the road was stable,there are no safety concerns,there was no funding
available for the project at the current time, and it was in the plans to reconstruct the area in the
future. Councilmember Dougherty said he did not want to spend money to update the study now,
especially since the City did not know what the County planned to do. Mayor McComber said she
wanted to have Stantee update the Feasibility Study in case grant opportunities came up.
Administrator Johnson said the estimated cost to update the Feasibility Study was$6,500,and if
the City was not going to do something in that area in the next couple of years, updating the
Study may not be necessary today since another update would need to be done again in a few
years once the project was ready to begin. Councilmember Runk asked how long it would take to
complete an update. City Engineer Mann responded that it would take about a month to complete.
Administrator Johnson said that grant opportunities usually provided enough lead time that a
study could be done if an opportunity to apply came up. He did say that an assessment study may
take two to three months, and it may be needed to determine if the City could assess to afford a
grant match. Councilmember Dougherty suggested keeping the project on the goal list, but to not
spend money on an update today.
No action taken.

I. Call to Order/Approval of Agenda: Mayor McComber called the meeting to
order at 6:00 p.m. Present: Councilmembers Dougherty, Johnson, Liljegren, and
Runk. Staff present. City Administrator Johnson, City Clerk Pinski, City
Attorney Kevin Sandstrom, City Planner Richards, and City Engineer Mann.
Absent: None.
Councilmember Dougherty, seconded by Councilmember Johnson, moved to
approve the Agenda. Roll call vote taken. Carried 5-0.
II. Council/Staff Reports:
A. Mayor McComber: She reported she testified before the House
Transportation Committee regarding small cities assistance; she has been
attending sessions in the Minnesota Advanced Leadership Conference; she
has been participating in continuing meetings with the Midwest Governors
Association; and she also attended a meeting with the tax chair Senator
Nelson and Representative Marquart. She reported she would be attending
the JAZB meeting, the Coalition of Utility Cities meeting regarding the
Integrated Resource Plan, two additional sessions in the Minnesota
Advanced Leadership Conference, and the NLC Small Cities Committee
meeting.
B. Councilmember Dougherty: He reported he would be attending the
Coalition of Utility Cities meeting on February 10 via Zoom..
C. Councilmember Johnson: She reported she would be attending the NLC
Energy, Environment, and Natural Resources policy meeting later in the
week.
D. Councilmember Lillegren: He reported he would be attending the JAZB
meeting on February 10 via conference call and the Planning Commission
meeting on February 11.
E. Councilmember Runk: He reported he would be attending the Middle St.
Croix Watershed Management Organization meeting.
F. Staff: City Clerk Pinsk] reported that Mike and Shannon Sullivan of 5495
Oakgreen Place North were chosen as the recycling award winners.
III. Visitors/Public Comment: Jenifer Doherty of 6320 Lookout Trail expressed
concern about safety issues with the bike/parking Iane proposed as part of the

Lookout Trail reconstruction project. She said she was also concerned about the
trail taking out a portion of residents' driveways. And, she asked the City to
reconsider widening the roadway for historical preservation.

V1. Old Business:
A. City Stormwater Update South of 55'1' Street/River Hills Develo meat:
City Engineer Mann reported that he and City Administrator Johnson
walked the site and provided an analysis of drainage issues to the property
owner. City Administrator Johnson said he felt the City wanted to help
and be a partner, but not be a leader on any project as the flow from the
City was at most ten percent of the water volume. Mann said it made sense
to talk over options with the homeowner and come back to the City after
that discussion. Councilmember Dougherty said that part of the City's
contribution was telling the homeowner how to fix the drainage problem.
Councilmember Liljegren thought the homeowner should have looked into
the site drainage before he built his home there and developed the
property. The City Council directed the City Administrator to let the
homeowner know that the City was committed to spending ten percent and
they have already spent some of that. Councilmember Dougherty wanted
to know if the homeowner planned to do anything to correct the problem.
He said he did not want staff to continue working on it if the homeowner
wasn't planning to do anything. No motion was made.
VII. New Business:
A. 2022-2024 Snow Plowing Agreement: City Administrator Johnson
reported he had a proposed contract extension for Raleigh Trucking for
snow removal services through at least April 2022, and the City would
need to discuss options for beyond that date.
Councilmember Runk, seconded by Councilmember Dougherty, moved to
approve the contract extension. Roll call vote taken. Carried 5-0.

B. Norell Ave—Backage Road Clarifying Resolution: Councilmember

VIII. Other Council Items or Announcements: Councilmember Johnson asked if a
date had been set for the City Council teambuilding meeting. Mayor McComber
responded that she was waiting for the League of Minnesota Cities to set a date
when it was safe to meet in person.

application has been thoroughly completed, the fee has been paid, and the background check was

1) During 2021 budget process the Police Uniform Budget was established at $11,500.
8 Officers at $1150, 1 Chief $1150 and 2 sgts $1050 as per Union Contracts.
2) Per the Chief's memo, he would like to
a) replace 3 bullet proof vests(funding from state and federal grants- BPV)
b) establish funds for new hire startup costs $3,000
c) training uniforms for the officers $1,500
d) secretary/dispatch uniform (polo/pants) $500.
e) Mobile Field Force officer uniform $400.
3) Due to the delay in hiring the new officer, excess funding of approximately $6,000/month is
included in the salary budget.
4) To adjust the budget based on the requests would not increase the department budget, just
reallocate funds from the salary budget to uniforms and record the expected revenue from the
BPV grants.

Subject: Amendment to increase the uniform(41.510-312) expenditure for 2021
1 am requesting the uniform expenditure line item to be funded an additional $9,000.00 this
year 2021 for the following reasons below:
$3,600.00 —Three officers will be needing to get their bullet proof vest replaced this year. This
was not included into the budget and also these funds would be reimbursed through the
federal and state grant BPV program as in years past.
$3,000.00- We will have new full-time hire this year and the startup costs were not part of the
original budget due to the unexpected resignation of Tennessen. The hiring process also
dragged into 2021.
$1,500.00- Requesting funds to get all officers their initial training uniforms Class C which
will consist of a black polo shirt embroidered with city logo and name, khaki cargo training
pants. The dept would purchase the initial set and the officers would be responsible in the
future years. This training uniform would be used also for events (party in park, night to
unite).
$500.00- Class C uniform style for dispatcher/secretary position, (Sandy). This position used
to be full police uniform minus duty belt. Requesting this position now wear polo shirt
embroidered with khaki pants. This staff member is part of the police team, thus should be
able to represent as such too. This Class C is similar to the police training uniform and can
also be worn at events for the city too. This would be a one time start up costs that would
allow for three pairs of pants, one sweater, combination of shirts long/short.
$400.00-Mobile Field Force position apparel/uniform transition. We have assigned a new
officer to the MFF team and will be able to use most of the existing uniforms from the
previous officer Tennessen. However, there is a few modifications of embroidery of name
changes, tailoring of old uniforms to fit.

A RESOLUTION APPROVING ADJUSTMENTS TO THE 2021 BUDGET
WHEREAS, The City Council adopted the 2021 budget for calendar year on
December 8, 2020; and,
WHEREAS, the City Council for the City of Oak Park Heights during the 2021 City
Operations wishes to facilitate the Police Chief's request for funding the uniform budget;
and
WHEREAS, the City Council for the City of Oak Park Heights recognizing grant
revenue and shifting funds from police department salaries would result in a net adjustment
to the total budget of$0.00.

Subject: St. Paul Mutual Aid Agreement
Administrator Johnson,
On the date of November 51, 2020, St. Paul Police Department reached out to the Oak Park Heights
Police Department to formalize a Mutual Aid Agreement between both parties. St. Paul has
concerns about possible civil unrest in the upcoming year of 2021 during the criminal trials of the
former MPLS Officers scheduled for March 81 and in August.
The East Metro Emergency Response Group has been formed with St. Paul running as the lead
agency. This group consists of Sheriffs Departments from(Ramsey,Washington, Dakota) and
numerous other City Agencies. This is very large-scale operation for pre-planning as you can
imagine and currently the MFF (mobile field force)teams will be the primary response units
assisting if needed. This Mutual Aid Agreement would also allow for additional officers to be sent to
St. Paul for assistance upon request beyond the MFF teams.
I've had several conversations (5)with St. Paul Police about what kind of assistance or roles they
might need from us in the future under emergency circumstances with this mutual aid agreement.
They advised assistance would most likely be needed in the form of security details at their law
enforcement government buildings, fire department facilities, escorting of EMS/Fire services to calls
or police patrol related calls for service in St. Paul. Some Officers might also be needed to
supplement MFF, but that would be under extreme circumstances.
There are numerous discussions at the State Level about funding assistance to the municipalities
which appears likely for reimbursement. However, each agency is responsible for their own officer
salary cost, equipment/squads if damaged and workers compensation for any officer injured. This
Mutual Aid Agreement would be effective until December 31, 2026.
Please note the following: The City is NOT unilaterally obligated to provide personnel under all
circumstances; rather the final decision to send personnel remains within our own discretion. The
contract states the following:
"In response to a request for Assistance under this Agreement, a Providing Party may authorize and
direct personnel to go to the aid of a Requesting Party."
Further, the LIMITATIONS section very clearly outlines that:

"16,41 Party may withhold resources to the extent necessary to provide reasonable protection and services
within its own jurisdiction. AND... "(A)Party may recall Assistance at any time in the best interests of
that Party.
Considering these conditions and how it may benefit the City should we need assistance in the
future which is the underlying intention of Mutual aid, my recommendation is to move forward and
accept this agreement. Both the LMC Attorney Chris Smith and City Attorney Kevin Sandstrom
have reviewed this too. I believe this will benefit both cities now and, in the future, if needed.
Realistically, the most we could send would be 1-2 officers and that would be at the discretion of the
Police Chief.

MUTUAL AID AGREEMENT
THIS MUTUAL AID AGREEMENT ("Agreement") is made effective as of Janaury 1,
2021,by and among the City of Saint Paul and the City of Oak Park Heights,political subdivisions
of the State of Minnesota, pursuant to the provisions of Minnesota Statutes §471.59, the Joint
Powers Act("Agreement").
WHEREAS, The Parties (Saint Paul & Oak Park Heights) desire to be prepared to
adequately address fire, flood,natural disaster, civil disturbance, or any other Emergency that may
occur within the jurisdictions of the Parties; and
WHEREAS, In order to protect the public peace and safety, and to preserve the lives and
property of people in each jurisdiction,the Parties(Saint Paul&Oak Park Heights)agree to furnish
Assistance to one another in the event of said emergencies.
NOW, THEREFORE, The Parties (Saint Paul & Oak Park Heights) hereby agree to
furnish Assistance to each other upon the terms and conditions set forth in this Agreement.
I. Purpose
The general purpose of this Agreement is to enable the Parties (Saint Paul and Oak Park Heights)
and their respective law enforcement personnel to come to the aid of each party to this Agreement
as permitted in Minnesota Statutes §471.59 and Minnesota Statutes §12.331. This Agreement is
limited to the named Parties.
II. Definitions
The capitalized terms in this Agreement shall have the following meanings:
Assistance means the provision of law enforcement personnel, services, equipment, supplies and
related resources.
Emergency means any disaster including,but not limited to, a multi-alarm fire; casualty involving
the damage, collapse or destruction of private or public infrastructure; accident or occurrence
involving one or more modes of transportation including, but not limited to air, rail, vehicular or
watercraft; civil disorder or disturbance; release of contaminates or pollutants, hazardous
substances or hazardous waste that necessitates the evacuation of occupants from structures or
some defined geographic area; any quarantine or limitation on the movement of persons due to
disease or threat to health and safety of the general population; any threat to national security;
"Disaster" and "Emergency" as defined in Minnesota Statutes §12.03; and "Emergency" and
"Major disaster" as defined in 44 CFR Sections 206.2(a)(9) and(17).
Incident Commander means the ranking peace officer designated by the Requesting Party to be
responsible for overseeing the management of Emergency Responders and for the planning,
logistics and finances at the field level during an Emergency.
Partv means a governmental unit as defined by Minnesota Statues, §471.59, Subdivision 1.
"Parties" shall collectively mean more than one Parry.
Providing Party means the entity that provides mutual aid Assistance to the Requesting Party.

Providing Official means the person designated by the Parry who is responsible to determine
whether and to what extent that Party should provide assistance to the Requesting Party.
Reguestin-Party means the entity that requests mutual aid Assistance under this Agreement.
Self-Deployment means deploying resources without a request for mutual aid Assistance from a
Requesting Party.
State means the State of Minnesota.
III. Assistance
A participating political subdivision may request Assistance(a"Requesting Parry")from the other
participating subdivision (a "Providing Parry") to respond to an Emergency or as a participant in
drills or exercises authorized under legislation or this Mutual Aid Agreement. A request for
Emergency Assistance shall be made by a Requesting Parry to a Providing Parry by contacting the
Providing Official or his/her designee. Requests may either be verbal or in writing. Any verbal
requests will be followed by a written request made by the Requesting Parry to the Providing
Official or his/her designee as soon as practical or within such period of time as provided by law.
Requests and responses to requests under this Agreement are limited to law enforcement personnel
assistance services, equipment, supplies, and related resources.
In the case of an Emergency for which a Requesting Party will seek reimbursement of costs from
the Federal Emergency Management Agency (FEMA) or the State of Minnesota, the Requesting
Parry shall make the request for Assistance to each Providing Party and the Incident Commander
shall monitor and oversee the documentation of the performance of Emergency work and the
documentation of reasonable and reimbursable costs of a Providing Party in accordance with the
FEMA Disaster Assistance Policy and will disburse the federal share of funds owed to a Providing
Party.
In response to a request for Assistance under this Agreement, a Providing Party may authorize and
direct personnel to go to the aid of a Requesting Parry. The Providing Parry shall provide personnel
who possess the required qualifications along with the equipment and supplies of the Providing
Parry to the Requesting Parry at the discretion of the Providing Parry within the scope of the aid
deemed necessary by the Requesting Parry and the Incident Commander.
IV. Limitations
A Party's decision to provide Assistance in response to, or recovery from, an Emergency, or in
authorized drills or exercise is subject to the following conditions:
A.)Parry may withhold resources to the extent necessary to provide reasonable protection and
services within its own jurisdiction.
B.)Parry may recall Assistance at any time in the best interests of that Party.
C.) Emergency response personnel of a Providing Party shall follow the policies and
procedures of the Providing Party and will be under the Providing Parry's command and
control but will follow the operational direction of the Incident Commander and be subject
to the incident management system of the Requesting Parry.

D.)Assets and equipment of a Providing Parry shall remain under the control of the Providing
Parry but shall be under the operational control of the Incident Commander within the
incident management system of the Requesting Party.
V. Compensation
The Requesting Parry and any Providing Party will each be responsible for its own costs and
compensation for any Assistance arising from any Emergency that may occur during the Term of
the Agreement.
Unless the Emergency is eligible for reimbursement by FEMA, a Providing Party shall be
responsible for the costs and compensation of its personnel, equipment and supplies. For an
Emergency that is eligible for reimbursement of costs by FEMA, the labor force expenses of the
Providing Party will be treated as contract labor, with regular time, overtime wages and certain
benefits eligible for reimbursement.
Notwithstanding the above paragraphs in this Section, a Requesting Parry may reimburse a
Providing Party that has provided Assistance pursuant to this Mutual Aid Agreement. The
Providing Party seeking reimbursement from the Requesting Party for Assistance rendered under
the terms of this Mutual Aid Agreement, may do so by submitting to the Requesting Party an
itemized bill for the actual cost of any Assistance provided. The charges for Assistance provided
pursuant to this Agreement will be based upon the actual costs incurred by the Providing Parry,
including salaries or wages, overtime, materials, supplies and other necessary expenses, except
that the Parties agree that the Federal Emergency Management Agency equipment rates will be
used as the basis for equipment charges whenever possible.
If a local, State, or federal Emergency is declared, and applicable funds become available, a
Providing Parry may charge a Requesting Parry for Assistance rendered under the terms of this
Agreement. The Providing Parties will submit to the Requesting Party an itemized bill for the
actual cost of any Assistance provided as described above. The Requesting Parry is responsible to
take all steps it deems necessary to seek reimbursement from the United States of America, the
State of Minnesota or other sources, to the extent that such reimbursement is available, for
expenses it incurs for services provided pursuant to this Agreement. Should funding become
available,the Requesting Party may reimburse the Providing Party to the extent possible under the
terms of this Agreement. Any claims for reimbursement by the Providing Parry must be made to
the Requesting Party within 90 days after the expense is sustained or incurred.
No Party will be responsible for the reimbursement of Self-Deployment costs.
VL Workers' Compensation
Each Party will be responsible for injuries or death of its own personnel. Each Party will maintain
workers' compensation insurance or a program of self-insurance covering its own personnel while
they are providing Assistance pursuant to this Agreement. Each Party waives the right to sue any
other Party for any workers' compensation benefits paid to its own employee or volunteer or their
dependents, even if the injuries were caused wholly or partially by the negligence of any other
Party or its officers, employees, or volunteers.
VII. Damage to Equipment
Each Parry shall be responsible for damages to or loss of its own equipment used to respond to an
Emergency under this Agreement. Each Party waives the right to sue any other Party for any
damages to or loss of its equipment, even if the damages or losses were caused wholly or partially
by the negligence of any other Party or its officers, employees, or volunteers.

VIII. Term of Agreement
This Agreement shall be in full force and effect from January 1, 2021 through December 31, 2026,
subject to Section XVI Withdrawal of Party/Termination of Agreement.
IX. Liability and Indemnification
For purposes of the Minnesota Municipal Tort Liability Act (Minnesota Statues, §466), the
employees and officers of a Providing Parry are deemed to be employees (as defined in Minnesota
Statues, §466.01, Subdivision 6) of the Requesting Parry.
The Requesting Parry agrees to defend and indemnify the Providing Parry against any claims
brought or actions filed against the Providing Parry or any officer, employee, or volunteer of the
Providing Party for injury to, death of, or damage to the property of any third person or persons,
arising from the performance and provision of Assistance in responding to a request for Assistance
by the Requesting Parry pursuant to this Agreement.
Under no circumstances,however, shall a Parry be required to pay on behalf of itself and the other
Parry, any amounts in excess of the limits on liability established in Minnesota Statutes Chapter
466 applicable to any one Parry. The limits of liability for one or both of the Parties may not be
added together to determine the maximum amount of liability for any Parry.
The intent of this subdivision is to impose on each Requesting Party a limited duty to defend and
indemnify the Providing Party for claims arising within the Requesting Party's jurisdiction subject
to the limits of liability under Minnesota Statutes §466. The purpose of creating this duty to defend
and indemnify is to simplify the defense of claims by eliminating conflicts among defendants, and
to permit liability claims against multiple defendants from a single occurrence to be defended by
a single attorney.
Neither Parry to this Agreement or any officer of any Parry shall be liable to the other Party or to
any other person for failure of any Parry to furnish Assistance to the other Party, or for recalling
Assistance, both as described in this Agreement.
Nothing in this Agreement is intended to prevent or hinder the pursuit of applicable State or federal
benefits to personnel who respond or render Assistance pursuant to an Emergency request and
sustain injury or death in the course of, and arising out of, their employment and response or
Assistance under this Agreement.
Providing Party shall not be responsible for any injuries, damages or losses arising from the acts
or omissions of personnel of the Requesting Parry and its officers, employees, agents and assigns.
X. General Compliance
Both Parties agree to comply with all applicable federal, State and local laws and regulations
governing any services provided under this Agreement.
XI. Accounting Standards and Retention of Records
A.) Accounting — Both Parties agree to maintain the necessary source documentation and
enforce sufficient internal controls as dictated by generally accepted accounting practices
and as required by FEMA to properly account for expenses incurred under this Agreement.

B.) Retention of Records - Both Parties will retain all records pertinent to expenditures
incurred under this Agreement as required by the applicable records retention schedule.
XII. Data Practices
Both Parties agree to comply with the Minnesota Government Data Practices Act and all other
applicable State and federal laws relating to data privacy or confidentiality. Each Parry must
immediately report to other Parry any requests from third parties for information relating to
activities performed pursuant to this Agreement. Each Party agrees to promptly respond to
inquiries from the other Parry concerning data requests. Each Party agrees to hold the other Parry,
their officers and employees harmless from any claims resulting from unlawful disclosure or use
of data protected under state and federal laws by the disclosing Party.
XIII. Applicable Law
The laws of the State of Minnesota shall govern all interpretations of this Agreement and any
litigation which may arise under this Agreement.
XIV. Non-Discrimination
All Parties agree to comply with the provisions of all applicable federal and State statutes and
regulations pertaining to civil rights and nondiscrimination including, without limitation,
Minnesota Statutes §181.59 and §363A.
XV. Withdrawal of Party/Termination of Agreement
A.) Without Cause - Either Party may withdraw from this Agreement without cause upon
thirty (30)days written notice to the designated recipients for the other Party.If withdrawal
is without cause, the Parry shall pay the withdrawing Parry all reimbursements and
payments to which it is entitled under this Agreement, to the date of withdrawal. Any
withdrawing Parry must also pay all obligations owed to any other Parry under this
Agreement, to the date of withdrawal.
B.) For Cause - A Party may terminate this Agreement if another Party fails to perform in
accordance with the provisions of this the Agreement in a proper and timely manner, or
otherwise violates the terms of this Agreement. The non-defaulting Party shall have the
right to terminate this Agreement, if the default has not been cured after ten (10) days
written notice has been provided.
C.) This Agreement shall terminate upon expiration of the Term or by mutual written
agreement of both Parties in the form of a resolution by the Parry's governing body.
XVI. Severability
Should a court of competent jurisdiction rule any portion, section or subsection of this Agreement
invalid or nullified, that fact shall not affect or invalidate any other portion, section or subsection;
and all remaining portions, sections or subsections shall remain in full force and effect.

BACKGROUND
Tyler Edwards of Menards has made application for Design Guidelines/Site Plan review
and Conditional Use Permits for setback and parking for the existing Menards at 5800
Krueger Lane North. The application consists of requests to add an automated express
lane requiring an addition to the existing gate at the east side of the site. Five parking
spaces are to be removed which places the total parking for the site below the minimum
allowed parking when the site was first approved.
The approvals for the Menards were granted in March of 1995 including a parking
Variance. At the time, 465 spaces were required, and the Variance allowed for the site
to be constricted with 405 spaces. Currently, there are 402 spaces on the site. Five
spaces are removed with the proposed gate building addition resulting in a total of 397
parking spaces on site. The Zoning Ordinance now allows a reduction in required
parking spaces by Conditional Use Permit.
The City Council approved the same project on April 23, 2019. Menard's allowed the
approval to expire one year later and did not request to have it renewed. The plans and
the project are the same as what was previously approved.

PROJECT DESCRIPTION
The Applicant's narrative for the project is found as Exhibit 1.
Menard, Inc. is submitting an application to reapprove the gate expansion project that
was first reviewed in 2099. The project has not changed since the last approval. The
addition to the gate will allow for an online order pickup lane to be added to the store.
This is an automated gate for guests to scan a barcode from their order and pick up
their material without waiting for the gate guard to let them in. There will continue to be
an entrance and exit lane operated by the gate guard. The materials used on the gate
addition will be an exact match to the existing gate.
1 have attached the copies for the materials submitted in 2099 as a reference and
include the copies of the plans from the application checklist.
ISSUES ANALYSIS
Comprehensive Plan. The property is designated as Commercial on the Proposed
Land Use Map. The continued use of the site for retail commercial use is consistent
with the Comprehensive Plan.
Zoning. The property is zoned 13-2 General Business District. The retail use is a
permitted use in the B-2 General Business District. Changes to the exterior of the
building and the site changes require Design Guidelines and Site Plan review. A
Conditional Use Permit is required for the front yard setback and to allow the number of
parking spaces to be reduced.
Setbacks. The front yard setback requirement in the B-2 District is 40 feet. The
current gate building is setback 40 feet from the right of way line of Krueger Lane, but
the gate building expansion will encroach into the setback. The proposed setback will
be 22 feet. The proposed gate building will extend slightly to the east from the location
of the current fence.
The fence line is being adjusted to the south of the proposed gate building, but fence
setback requirements are not being impacted.
In evaluation of the requested Conditional Use Permit for a setback reduction, Section
401.04.A.7 of the Zoning Ordinance directs the Planning Commission and City Council

to consider the possible effects of the proposed use, with that judgment based upon
(but not limited to) the following factors:
a. Relationship to the speck policies and provisions of the municipal comprehensive plan.
b. The conformity with present and future land uses in the area.
C. The environmental issues and geographic area involved.
d. Whether the use will tend to or actually depreciate the area in which it is proposed.
e. The impact on character of the surrounding area.
f. The demonstrated need for such use.
g. Trak generation by the use in relation to capabilities of streets serving the property.
h. The impact upon existing public services and facilities including parks, schools, streets,
and utilities, and the City's service capacity.
i. The proposed use's conformity with all performance standards contained herein (i.e.,
parking, loading, noise, etc.).
Comment: The use is consistent with the Comprehensive Plan and in conformity with
present and future land uses. There should be no environmental issues or impact to
surrounding tenants or property owners resulting from the setback reduction. There is
no impact upon public services and facilities and site lines on Krueger Lane will not be
impacted. City Staff sees no issues with the expansion of the gate building.
The Planning Commission and City Council should determine if the reduction in the
front yard setback is appropriate for this site.
Traffic Circulation. Traffic circulation within the site will not be impacted with this site
change and building expansion.
Parking. In March of 1995, the Menards was granted a parking Variance for a
reduction in the required number of spaces. At the time, 465 spaces were required, and
the Variance allowed for the site to be constricted with 405 spaces. Currently, there are
402 spaces on the site. Five spaces will be removed with the proposed gate building
addition resulting in a total of 397 parking spaces on site. The Zoning Ordinance now
allows a reduction in required parking spaces by Conditional Use Permit.

i. The proposed use's conformity with all performance standards contained herein (i.e.,
parking, loading, noise, etc.)
With the current number of spaces, there have been no parking issues noted at the
Menards. With the addition of online ordering, there will be even less demand for
parking in the lot at the front of the building. The Planning Commission and City Council
should determine if the five-stall parking reduction is appropriate for this business. Staff
does not see the reduction of parking as significant and recommends the request.
Lighting. The plans do not include any changes to exterior lights installed on gate
building or as part of the improvements to the site. Any new light fixtures shall be full
cut off and shall be consistent with Section 401.15.13.7 of the Zoning Ordinance as it
relates to lighting requirements.
Signage. The plans indicate that the lighted signs above the entrance and exits of the
gate building are to be removed and relocated on the expanded building. It appears the
signs do not comply with current back lighting for signage. The sign lighting should be
designed such that only the text and logo portions of the signs are to be lit at night. The
sign background will need to be dark. All the relocated or any new signs will be
required to comply with the Zoning Ordinance lighting requirements. Staff will approve
the lighting specifications for the signs at the time of permitting.
Landscaping/Fencing. As part of the gate building expansion and change to the
driveway area at the entrance, three evergreen trees are to be moved east. The City
Arborist shall determine if the three trees can be moved or if they should be replaced.
Additionally, the City Arborist is recommending the removal and replacement of four
spruce trees on the east side of the fence adjacent to Krueger Lane. A crabapple tree
along Krueger Lane near the entrance is recommended to be removed and not
replaced. The trees would need to be guaranteed for one year after replacement or if
they are moved.
Mechanical Screening. No changes to mechanical equipment locations have been
indicated on the plans.
Grading, Drainage, Erosion Control and Utilities. Grading, drainage and utility plans
have been provided by the Applicant. The grading, drainage and utility plans shall be
subject to review and approval of the City Engineer. The Applicant has confirmed with
Brown's Creek Watershed District that their review is not required.

The gate building is to be expanded using the same materials and colors to
match the existing facade.

Ground Level Expression
The fence will be removed and replaced with the facade of the building. The
change in ground level expression is not significant.

The entry into the gate building will be widened, but this portion of the site is
screened by mature evergreen trees.
Roof Design
The gate building expansion is an extension of the existing roof structure.
Building Height
The current building is approximately 21 feet to the ridge line and well within the
maximum building height of 35 feet. The gate building expansion will be 17 feet
at the east elevation.
Building Materials and Colors
The applicant has provided color elevations for review. All the new building
materials are what is currently being used on the structure.
Franchise Architecture
The building is a franchise design.
Site Design Guidelines
Building Placement
The gate building expansion will result in the need for a setback Conditional Use
Permit as discussed in this report.
Parking Areas
Five spaces will be removed resulting in a parking Conditional Use Permit as
discussed in this report.
Storm water
The drainage plans are subject to review and approval of the City Engineer.
Pedestrian and Common Space
Not Applicable.
Landscaping
There are minor changes to the landscape plan which include transplanting three
trees. The City Arborist recommends removal and replacement of four spruce
trees. The plans are subject to the review and approval of the City Arborist.

CONCLUSION / RECOMMENDATION
Subject to the preceding review, City start recommends approval of the Design
Guidelines/Site Plan review and Conditional Use Permits for setback and parking for the
existing Menards at 5800 Krueger Lane North subject to the conditions that follow:
1. All light fixtures shall be full cut off and be consistent with Section 401.15.6.7
of the Zoning Ordinance as it relates to lighting requirements.
2. All signs shall be designed to comply with the Zoning Ordinance requirements for
size, number, placement, and internal illumination. Staff will approve the lighting
specifications for the signs at the time of permitting. The sign lighting should be
designed such that only the text and logo portions of the signs are to be lit at
night. The sign background will need to be dark.
3. The Planning Commission shall comment on the building design and building
materials.
4. The grading, drainage and utility plans shall be subject to review and approval of
the City Engineer.
5. The landscape plan shall be subject to the review and approval of the City
Arborist. Menards shall remove and replace the trees along Krueger Lane as
recommended by the City Arborist. The trees would need to be guaranteed for
one year after replacement or if they are moved.

CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from Menards for
Conditional Use Permits for setback and parking and Design GuidelineslSite Plan review
for an addition to the gate building and site changes at 5800 Krueger Lane North; and
after having conducted a public hearing relative thereto, the Planning Commission of Oak
Park Heights recommended that the request be approved with conditions. -The City
Council of the City of Oak Park Heights makes the following findings of fact and
resolution:
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting documentation
to the Community Development Department consisting of the following items:

3. The property is zoned B-2 General Business District in which retail uses
are a permitted use; and
4. A Conditional Use Permit is required to reduce the front yard setback to
Krueger Lane; and
5. The front yard setback requirement in the B-2 District is 40 feet. The
current gate building is setback 40 feet from the right of way line of Krueger Lane,but
the expansion of the gate building will result in a setback of 22 feet; and

6. A Conditional Use Permit is required to allow a reduction in parking from
the approved parking requirements for the site; and
7. In March of 1995, Menards was granted a parking Variance for a
reduction in the required number of spaces. At the time, 465 spaces were required, and
the Variance allowed for the site to be constructed with 405 spaces. Currently there are
402 spaces on the site. Five spaces will be removed with the proposed gate building
addition resulting in a total of 395 parking spaces on site. The Zoning Ordinance now
allows a reduction in required parking spaces by Conditional Use Permit; and
8. Change to the exterior of the building and site changes require Design
Guidelines/Site Plan review; and
9. The request includes a request for the addition of an automated express
lane to the gate building. The new lane will be covered by an extension of the existing
canopy and the new building materials will match the green steel front and white steel
roof materials of the existing canopy. Parking spaces will be removed,the fence will be
replaced, and landscaping will be removed and replaced; and
10. City staff prepared a planning report dated March 28, 2019 reviewing the
request; and
11. Said report recommended approval of the Conditional Use Permits and
Design Guidelines/Site Plan review in that the project is in conformance with the criteria
for Conditional Use Permit and Design GuideIines/Site Plan approval. Said
recommendation was subject to the fulfillment of conditions; and
12. The Planning Commission held a public hearing at their April 11,2019
meeting, took comments from the applicants and public, closed the public hearing, and
recommended that the application be approved with conditions.
NOW, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES
THE FOLLOWING:

size, number, placement and internal illumination. Staff will approve the lighting
specifications for the signs at the time of permitting. The sign lighting should be
designed such that only the text and logo portions of the signs are to be lit at

3. The City Council approves the building design and building materials.
4. The grading, drainage and utility plans shall be subject to review and approval of
the City Engineer and the Browns Creek Watershed District.
5. The landscape plan shall be subject to the review and approval of the City
Arborist. Menards shall remove and replace the trees along Krueger Lane as
recommended by the City Arborist. The trees would need to be guaranteed for
one year after replacement or if they are moved.

I am requesting the approval to purchase 5 police vehicles to replace the current aging fleet listed below:

These vehicles have surpassed their life expectancy for service and appearance. It is also estimated the
vehicles will sell at auction for approx. $25,000 --- altogether.
Moving forward, I would like to move the entire fleet on a shorter and more optimal rotation plan. This
would include rotating patrol vehicles every 4 years and admin vehicles every 5 years. This rotation
benefits the City in maintenance costs and improved resale value.
The following is a list of the new police vehicles that I am requesting to order under the state bid pricing
along with the squad equipment and funds have already been budgeted for these replacement vehicles in
the Budgeted Proiect Fund—$402,203 - current balance (not inc. sale values):

Over years,the City has offered internships to students who are pursuing careers in public administration. I
would believe that this offering has been a `win-win' as the City takes advantage of inexpensive but dedicated
labor to accomplish projects that may have otherwise not been completed while the student gains valuable work
experience. While the City has had good interns,there have been occasions when applicant pools were slim or
applicants were not well qualified or did not have a skill set that match City needs.An intern must be capable
and motivated of independent work and such position is not meant to put a material burden on current City
staff. So,when quality applicant becomes available,we have tried to take advantage of the opportunity.
With this in mind,the City was contacted by Ms. Katie Danielzuk seeking opportunity of a City Internship and
upon review of her resume,City Clerk Jenni Pinski and I as well as Council Member Johnson did meet with her
to find out her goals and interests to see if it made sense to continue any discussions. I have enclosed her
correspondence and data and she is also highly recommended by State Representative Kelly Morrison and Dr.
David Shultz of Hamline University and regular contributor to local news networks and presenter at LMC/
MNAPA events.
The 2021 budget does NOT allocate resources for such role,but since this person would be working across
departments,these costs might be shared throughout the City however for the sake of clarity I would request a
budget adjustment of$6,000 to City Administration from expected cost savings from costs not expected to be
incurred due to delay in hiring police officer and other health care savings—this
total savings is estimated to be $25,000 to the City—SEE INSET: AC#101-40690-415--$364,700 was
budgeted for ALL employee health,
If approved,the City would offer a wage of$11.00 per hour/20 hours per week, dental and life insurance;

This is an entry-level level,temporary position responsible for assisting in the support needs of

A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS
OUTLINING FURTHER POLICIES AND REQUESTS RELATED TO ASSISTING IN
ECONOMIC RECOVERY FOLLOWING THE COVID-19 OUTBREAK.
Whereas, the State of Minnesota and numerous communities have been impacted by the outbreak of
COVID-19 virus forcing the slow down and, in some cases, shuttering of businesses creating significant
unemployment; and,
Whereas, many individuals have also been impacted by the COVID-19 outbreak with the loss of
employment and critical income; and,
Whereas,the State and Federal Governments have begun to implement various tools to aid in the recovery
of businesses and employment; the City of Oak Park Heights may also consider responsible actions to aid
effected businesses and their staff as well as its general population; and,
Whereas, the City has previously approved a resolution outlining certain City responses, it has continued
to evaluate its options related to any continued assistance it may be able to offer as well as explore other
public-private partnerships to advance solutions to address these matters stemming from COVID-19
matter.
NOW, THEREFORE, BE IT RESOLVED that the City Council for the City of Oak Park Heights
enacts a partial refund of ON-SALE liquoribeer licenses (prorated daily)for those dates such firms were
duly closed as a result of the Governor's Executive Orders from approximately November 20th, 2020
through January 11th,2021.
Be It Further Resolved, that City Staff shall actively implement these goals to the extent authorized
under Minnesota law and provide the necessary communications to related offices and entities.
The Resolution has been duly considered and adopted by the City Council this day of ,

Re: Sanitary Sewer Cleaning Contract Extension 2021-2025
Oak Park Heights,through contracted services, maintains approximately 135,000 LF of
sanitary sewer pipe.The City contracts sewer main cleaning and televising activity to
eliminate the expensive overhead of owning and operating a sewer jet/vac truck and a
televising van with expensive equipment. Pipe Services has satisfactorily cleaned and
televised the City's sanitary sewer mains for the past approximately ten (10)years.The
contractor maintains the same crew year after year(including an owner),so the crew has
learned the OPH system. Having the same crew return each year is valuable to OPH as it
reduces the amount of time City staff must spend accompanying the contractor.
Pipe Services proposed cleaning,televising and compiling extensive reports of approximately
135,000 LF of sanitary sewer for approximately$25,650 per year, NOT including root cutting.
Root cutting quantities are determined when problem areas are found during cleaning or
televising.Sewers in OPH are cleaned on a rotation of approximately every five (5)years,and
in approximate accordance with the attached Sewer cleaning and TV overview map. If
necessary, we error on the side of cleaning sewers more frequently.
I recommend the council authorize staff to contract with Pipe Services for sanitary sewer
main cleaning and televising for an extended five (5)year period at the proposed rates. Upo
approval,the City will reach out to Pipe Services to execute a contract similar to the 016-
2020 contract.

AGREEMENT TO PERFORM SANITARY SEWER CLEANING AND CCTV IN OPH.
THIS DOCUMENT SERVES AS A FINAL AGREEMENT BETWEEN THE CITY OF OAK PARK HEIGHTS AND PIPE
SERVICES CORPORATI (TH6 CONTRACTOR).
The Contractor shall provide all services as delineated in the 2016 Request for Quotes and
as retumed to the City in an amount not to exceed$0.45 per linear feet for cleaning,$0.45
per linear feet for televising an estimated 27,000 linear feet per year,$210 per hour for
additional root cutting,$210 per hour for additional cleaning and$210 per hour for
additional televising from 2016 to 2020.The contractor's quote and related information is
attached and incorporated into this Agreement as"Exhibit A".
This Agreement once fully executed shall serve as a notice of acceptance by the City of
the Contractor's quote and also acts as a notice to proceed by the City for the submitted
price quote.
The Contractor shall complete all work as outlined in the submitted Contractor's quote
and shall provide all final reporting and closing documents to the City not later than
December IM of each contract year.Failure to complete by this date will entitle the City to
withhold 5%of the contracted amount for each day thereafter.The City shall provide
timely access to infrastructure.
The City may terminate this Agreement at anytime and for any reason.
Except for intentional or willful acts by the City,the Contractor does hereby release the
City from any loss or liability incurred by the Contractor related to the disposition of the
work at the site or on this project.The Contractor shall implement best management
practices to complete this project and will utilize appropriate caution to complete the
work in a safe and efficient manner.

2016 Request for Quotes—Sanitary Sewer Cleaning/CCTV
Summary: The City of Oak Park Heights is seeking quotes from qualified contractors to
perform sewer cleaning and certified PACP CCTV work over a five year contract period on the
sanitary sewer system. Oak Park Heights owns roughly 135,000 linear feet of sewer pipe
ranging in diameter from four inches to thirty-six inches,most of which are between six inches
and eight inches in diameter.

SCOPE OF WORK:
CLEANING SPECIFICATIONS
Intent of Jet Cleaning: The intent of line cleaning is to remove foreign materials from the lines
and restore the pipe segment to a minimum of 95%of the original carrying capacity. It is
recognized that there are some conditions such as a broken pipe section and/or other major
blockage that prevents cleaning from being accomplished or where additional damage would
result if cleaning were attempted. Such instances will be reviewed on a case by case basis.
Cleaning Equipment: High-Velocity Jet Equipment shall be used as the primary cleaning
method on this project. All high-velocity pipe cleaning equipment shall be constructed for ease
and safety of operation, The equipment shall have a multiple selection of two or more
high-velocity nozzles. The nozzles shall be capable of producing a scouring action from 15 to 45
degrees in all pipe sizes to be cleaned. Jet washing equipment will not exceed a maximum
pressure of 1800 psi.The equipment shall carry its own water tank. Water for re-filling the tank
will be made accessible through existing City owned fire hydrants.

Cleaning Operation:The equipment shall be capable of removing dirt,grease,rocks, sand,and
other materials and obstructions from the sanitary sewer lines and manholes. If cleaning of an
entire section cannot be successfully performed from one manhole,the equipment shall he set up
on the other manhole and cleaning again attempted. If, again, successful cleaning cannot be
performed or the equipment fails to traverse the entire manhole section,it will be assumed that a
major blockage exists and the cleaning effort shall be abandoned.
Root Removal:Roots shall be removed in the designated sections where root intrusion is a
problem at the discretion of the public works director. Any work done to remove roots in a
section shall be documented in the report. Discing and rodding equipment maybe used for root
removal.Documentation shall include the locations in the pipe segment where roots were
removed and the procedure that was used.

Nfaterial Removal:All sludge,dirt,sand,rock, grease,and other solid or semisolid material
I
resulting from the cleaning operation shall be removed at the downstream manhole of the section
being cleaned.Passing material from manhole section to manhole section,which could cause
line stoppages, accumulations of sand in wet wells,or damage pumping equipment, shall not be
permitted.

Disposal of Materials: All solids or semi-solids,debris resulting from the cleaning operations
shall be removed from the work area and disposed of properly and is the sole responsibility of
the contractor. All materials shall be removed from the work area no less often than at the end of
each workday. Under No circumstances will the Contractor be allowed to accumulate debris,
etc.,on the site of work beyond the stated time,except in totally enclosed containers and as
approved by the Owner.
Water Use: If the Contractor requires water for cleaning operations from hydrants,the
Contractor shall make arrangements with the City of Oak Park Heights Public Works
Department and shall use only fire hydrants designated by the City.The City shall provide a
reasonable amount of water free of charge to the contractor.
Final Acceptance: Acceptance of sanitary sewer cleaning shall be made upon the successful
completion of the television inspection and shall be to the satisfaction of the Owner. If TV
inspection shows the cleaning to be unsatisfactory,the Contractor shall be required to re-clean
and re-inspect the sanitary sewer line until the cleaning is shown to be satisfactory.

TELEVISING SPECIFICATIONS
Intent: All designated pipe sections shall be visually inspected by means of closed-circuit color
television(CCTV).All CCTV work shall be conducted in accordance with NASSCO Pipeline
Assessment. All inspections shall be done in certified PACP format.
Equipment: The television camera used for the inspection shall be one specifically designed and
constructed for such inspection. The camera shall be capable of radial view for inspection of the
top,bottom, and sides of pipe and for looking up Iateral connections. The camera shall be
mounted on adjustable skids,or self-propelled,to keep it in the center of the pie. Lighting of the
camera shall be supplied by a lamp on the camera, capable of being dimmed or brightened
remotely from the control panel.The lighting system shall be capable of lighting the entire
periphery of the pipe. The camera, television monitor,and other components of the video system
shall be capable of producing a picture quality satisfactory to the City; and if unsatisfactory,the
equipment shall be removed and no payment will be made for an unsatisfactory inspection.
Televising:The television camera shall be moved through the line in either direction at a
uniform rate,stopping when necessary to insure proper documentation of the sanitary sewer pipe
condition but in no case will the television camera be pulled at a speed greater than 30 feet per
minute. Manual winches,power winches,TV cable, and powered rewinds(or other devices that
do not obstruct the camera view or interfere with proper documentation of the sanitary sewer
conditions)shall be used to move the camera through the sanitary sewer. If, during the
inspection operation the television camera will not pass through the entire sanitary sewer section,

the Contractor shall re-setup his equipment in a manner so that the inspection can be performed
from the opposite manhole. If, again, the camera fails to pass through the entire sanitary sewer
section,the inspection shall be considered complete and no additional inspection work will be
required. All costs for re-setup due to an obstruction in the sanitary sewer that will not allow the
camera to pass shall be considered incidental. If the camera becomes submerged due to a sag in
the pipe, a high velocity jet will be utilized to pull water away from the camera lens.
Measuring:The location meter,for accurately recording the location of the television camera
with respect to the reference manhole,shall be a direct reading,above ground,friction clamp
device or other suitable equipment. Marking on the cable,or the like,which would require
interpolation for depth of manhole,will not be allowed. The meter shall be capable of reducing
readings for reverse movement of the camera and shall be capable of being manually re-zeroed
for each new setup. Footage shall be shown on the video data.
Television Inspection Logs: The logs shall be typed or computer printed and acceptable to the
Owner. Printed location records shall be kept by the contractor and will clearly show the
location,in relation to adjacent manholes,of each infiltration point discovered by the television
camera. An estimate of the flow rate of observed infiltration points shall be made and recorded.
In addition,other points of significance such as locations of building sanitary sewer laterals,
joints,unusual conditions,roots, sanitary sewer connections, collapsed sections,presence of
scale and corrosion, and other discernible features will be recorded and no less than two(2)
copies of such records shall be supplied to the Owner. A summary report of all significant
findings shall be attached to the typed or computer printed log report.

Video Recordings: The purpose of recording shall be to supply a visual and audio record of the
condition of the lines that may be replayed both daily and at future presentations. DVD
recording playback shall be at the same speed that it was recorded. Upon completion of the
work,all DVDs recorded during the television inspection shall become the property of the
owner. Cost of DVDs shall be included in the unit price bid. A complete recording shall be
made of each line televised. A voice recording on DVD shall make brief and informative
comments on the sanitary sewer conditions.
DVDs shall include the following information:
A. Visual(on screen in corner):
1. Report number.
2. Date of television inspection
3. Sanitary sewer section and number.
4. Current distance along reach(tape counter footage).
5. Printed labels on DVD and case with location information, date,format information, and
other descriptive information.

1. Audio date and time of television inspection,operator name,name of overlying or
adjacent street, and manhole numbers.
2. Confirmation of pipe section and television direction in relation to flow.
3. Description of pipe size, type, and pipe joint length.
4. Description and location of each service connection and defect.
5. Type of weather during inspection.

Television inspection logs shall include,but are not limited to,the following:
• Date,time,city,street,basin, sanitary sewer section, reference manhole number,name of
operator,inspector, and weather conditions.
t. Pipe diameter,pipe material,section length,depth of pipe, length between joints,and
corresponding DVD identification.
• Location of each point of leakage.
• Location of each service connection.
• Location of any damaged sections,nature of damage, and location with respect to pipe
axis.
• Deflection in alignment of grade of pipe.
• GIS integration with the City's sanitary sewer shopefile/geodatabase data.
Should the DVD's show the inspection to be unsatisfactory; the Contractor shall be required to
re-inspect/re-televise the sanitary sewer line at no additional charge.
Traffic Control: Contractor is responsible for all traffic control devices, signage and warning
lights. In all cases the work shall be conduct so as to minimize,as best as practical,all types of
traffic disruption.

Bidder Qualifications:No bids will be accepted other than those submitted by experienced
Sewer Televising,Inspection and Cleaning Contractors. Contractors must demonstrate that they,
and/or their employees,have been in the business of televising, inspecting and cleaning of
sanitary sewers for at least 5 years. Bidder qualifications must accompany bid submittal and will
be used to evaluate the bidder's ability to perform the work as required.
Laws and Regulations: The contractor shalt comply with all Federal, State,County and City
laws,ordinances,and regulations affecting the work under this specification. Unless otherwise
instructed it shall be the responsibility of the contractor to obtain and preserve all the necessary
permits,licenses,or outside agency approvals throughout the duration of the job.
Indemnification: The contractor shall defend,indemnify and hold harmless the City of Oak
Park Heights,its officers and employees from all suits, actions and claims of any character
brought because of injuries or damages received or sustained by any person,persons or property
as a result of the operations of the contractor; or on account of or in consequence of any neglect
in performing the work; or through the use of unacceptable materials in constructing the work; or
because of any act or omission,neglect,or misconduct of the contractor or its subcontractor; or
because of any claims arising or amounts recovered from infringements of patents,trademarks,
copyrights,or because of any claims arising or amounts recovered under the Workers'
Compensation Act, or under any other law,ordinance,order or decree.

Pians and Specifications: Before submitting its bid,the bidder shall carefully examine the entire
contents of the specifications so as to be thoroughly familiar with all the requirements. Bidders
are instructed to acquaint themselves with all the conditions affecting the work, such as
obstacles,right-of-way encroachments and of surface and subsurface geological formations. The
successful bidder shall not be allowed any extra compensation by reason of any unforeseen
difficulties,of which the bidder could have discovered,by reasonable anticipation prior to the
bidding. Before submitting a bid, all bidders must examine existing field conditions, and/or
specifications to judge for themselves the difficulties with which may arise in the execution of
the work.
Inspections: All workmanship and materials are subject to the inspection and approval of the
City of Oak bark Heights. If,in the opinion of the City,it is not expedient to correct inadequate
workmanship not in compliance with the specifications,the City shalt have the right to deduct
the difference in value between the workmanship or materials supplied and that called for under
the specifications. The value shall be determined in accordance with competent cost estimates.
Any deductions shall not be construed as a waiver, release or compromise of any other losses,
costs,damages or causes of action of the City arising out of such non-complying workmanship.

Payment: Payment for the work is dependent upon the approval of the Public Works Director.
Payments shall be based on the bid unit price per linear foot for the corresponding linear foot of
work performed. Measurement of the actual number of feet cleaned and/or televised shall be
made from the center of the manhole. Payment will be made upon final completion of yearly
work.
Quantity: The estimated quantities are given below; however bidders are to note that this may
vary to meet actual department demands throughout the contract. For bidding purposes the
following estimates are given for a five(5)year period.
Sanitary Sewer Cleaning 25,000 linear feet
Sanitary Sewer Televising 25,000 linear feet

Bid submittal: Bids will be accepted for finnishing all necessary equipment,materials and labor
to perform the televising and cleaning work specified, for a period of five(5)years. Bids shall
include:
• Linear foot price for performing the sanitary sewer televising work,including GIS
integration of reports.
Linear foot price for performing root cutting work
• Per hour rate for a complete televising crew,materials and equipment to perform extra
assigned work as needed.
• Per hour rate for a complete sewer cleaning crew,materials and equipment to perform
extra assigned work as needed.

Insurance: Prior to any work performed by the contractor or its subcontractors,the contractor
shall furnish to the City a certificate of insurance for not less than$1,000,000.00 naming the City
as an additional insured party. The City may also direct that copies of the actual insurance
policies, or renewals or replacements thereof,be submitted. All premiums for the insurance as
specified above to be obtained by the contractor or its subcontractors shall be paid for by the
contractor or its subcontractors. Except for intentional or willful acts by the City, the contractor
does hereby release the City from any loss or liability incurred by the contractor related to the
disposition of the work in the field.

This Program does not have a dedicated funding source and such amounts must be allocated by the
Legislature. It is generally intended to provide funds to cities that do not receive-MSA—Road Funds.
See attached fact sheet.
Through this Program our City has received funding in the past of $31,721.00 in 2018 from a total
Statewide allocation of$8,000,000.
I would like the Council to consider authorizing "letters of support" for funding such program
for the Mayor to sign, to be sent to the Chairs of the House and Senate Transportation
Committees as well as other related legislative bodies.

Small Cities Assistance Program
Program Overview
The Small Cities Assistance Program was created in
2D15 to provide funding for construction and
maintenance of roadways in cities with a population
less than 5,D00. Minnesota Statute 162.145p rovides
details on the program. The program is administered — a
by WDOT's State Aid for Local Transportation Division "
with the funding distributed by the Minnesota
Department of Revenue.
Program Guidance and Criteria
Guidance
Eligible local agencies include cities that do not receive municipal state aid under Statutes 162.D9 to
162.14. This primarily includes all cities that have a population of 5,000 or less.
The Commissioner of Revenue distributes the funds to cities in the same manner as local government
aid under chapter 477A. Generally, cities will receive 50`}'a of the payment in July and 5D%of the
payment in December.
Criteria
The preliminary aid to each city is calculated as follows:
• 5%equally allocated to all cities
• 35%allocated based on each city's share of lane miles of municipal streets compared to the
total municipal lane miles of all eligible cities
• 35%allocated based on each city's share of population compared to the total population of all
eligible cities
+ 259E allocated based on each city's share of the state aid adjustment factor compared to the
sum of the state aid adjustment factor for all eligible cities
c The state aid adjustment factor is the greater of zero or:

■ The number of lane miles of county state aid highway Ina city compared to the

The final aid to each city is the lesser of:
• The preliminary aid or
• The maximum aid,which equals 3.5 multiplied by the unweighted average amount of
assistance to a city in a year.
Use of Funds
The funding is for the construction and maintenance of roads located within the city and can include
land acquisition,environmental analysis,design,engineering,construction, reconstruction and
maintenance.
Timeline for Use of Funds
There is no specified timeline by when the cities need to use these funds. However,it is recommended
that they be used within two years of receiving the initial payment.
Accounting of Funds
The cities are not required to submit a report on how the funds were expended. Each city is required
to follow appropriate accounting practices to clearly show that the funds they received have been used
on the eligible items listed above and in the statute. one recommendation is to establish a separate
account for these funds and then reduce that account as eligible expenditures are incurred.
