recycle and to increase fire prevention awareness, the City rewards two residents
each month with their choice of an award of $25.00 or a fire extinguisher and/or
smoke detector(s).

1. Call to Order/Approval of Agenda: Mayor McComber called the meeting to
order at 6:00 pan. Present: Councilmembers Dougherty, Johnson, Liljegren, and
Runk. Staff present: City Administrator Johnson, City Clerk Pinski, Police Chief
Hansen, City Attorney Kevin Sandstrom, and City Engineer Mann. Absent: City
Planner Richards.
Councilmember Runk, seconded by Councilmember Johnson, moved to approve
the Agenda. Carried 5-0.

III. Council/Staff Reports:
A. Mayor McComber: She reported she would be attending the Midwest
Governor's Association meeting the following day and a meeting with the
Washington County Mayors. She also said early registration was open for
the League of Minnesota Cities Advanced Leadership Conference.
B. Councilmember DoughertX: No report.
C. Councilmember Johnson: She reported she attended the Parks and Trails
Commission meeting in December.
D. Councilmember Liljegren: No report.
E. Councilmember Runk: He reported he would be attending the Convention
and Visitors Bureau meeting on January 13 and the Middle St. Croix
Watershed Management Organization meeting on January 14.
F. Staff. City Clerk Pinski reported that Mayor McComber and
Councilmembers Dougherty and Runk were sworn in with the Oath of
Office prior to the meeting.

VII. Old Business:
A. Lookout Trail—Update and Requested Actions: Councilmember
Dougherty, seconded by Councilmember Runk, moved to approve Option
3 for the design of Lookout Trail, to approve the scope and fee addition
amendment in the amount of$36,400, and to authorize plans and
specifications and solicitation of bids. Roll call vote taken. Carried 5-0.
City Engineer Mann said he would be looking into the online bidding
process.
VIII. New Business:
A. Appointment of Full-Time New Hire Police Officer: Police Chief Hansen
recommended the hire of Ben Badowich pending;passage of the psych
evaluation and fitness test with an expected start date of February 1, 2021.
Councilmember Liljegren, seconded by Councilmember Runk, moved to
authorize the hire. Roll call vote taken. Carried 5-0.
B. 2021 Legislative Consulting: Ann Lenczewski and Angie Huss of
Lockridge Grindal Nauen P.L.L.P. provided a presentation.
Councilmember Runk suggested the City Council hold a worksession
prior to the next meeting to discuss.
Councilmember Runk, seconded by Councilmember Dougherty, moved to
set a worksession for January 26 at 5:00 p.m. Roll call vote taken. Carried
5-0.
C. Tax Abatement Requests—Washington County: Councilmember Runk
reported that based on recent City of Stillwater Council meetings, it
appeared a developer for the Highway 36 and Manning Avenue area may
be approaching Washington County about providing tax abatement for the
development.

Councilmember Runk, seconded by Councilmember Dougherty, moved to
authorize staff to monitor if or when an application for tax abatement was
made with Washington County if the City wanted to make comments at
the Public Hearing. Roll call vote taken. Carried 5-0.
IX. Other, Council Items or Announcements: Mayor McComber reported she spoke
with Pam Whitmore regarding Council teambuilding, and Pam thought it was best
to do that in person when it was safe to do so. She said she would work with Pam
to set up a teambuilding session for a Friday in February or March.
Councilmember Johnson, seconded by Councilmember Liljegren, moved to set a
goal setting worksession for January 21 at 5:00 p.m. Roll call vote taken. Carried
5-0.
Councilmember Liljegren reported he would like to add a discussion with the new
Police Chief during the goal setting worksession on the survey results that came
out as part of the Police Chief hiring process.
X. Adiourn: Councilmember Runk, seconded by Councilmember Johnson, moved to
adjourn at 6:57 p.m. Roll call vote taken. Carried 5-0.

RESOLUTION GRANTING THE APPLICATION OF
STILLWATER AREA FASTPITCH ASSOCIATION
TO CONDUCT A ONE-DAY RAFFLE AT
STILLWATER AREA HIGH SCHOOL ON MAY 20, 2021
WHEREAS, Emily Dollerschell, on behalf of Stillwater Area Fastpitch
Association, has submitted a request to conduct a one-day raffle on May 20, 2021 at the
site of the Stillwater Area High School softball field, 5701 Stillwater Boulevard North;
and
WHEREAS, Ms. Dollerschell has reported that the State of Minnesota Gambling
Control Board has confirmed that the Stillwater Area Fastpitch Association is a 501(c)3
organization and is authorized to conduct a raffle without a permit as an excluded
organization under Minnesota Statute; and
WHEREAS, the City of Oak Park Heights has reviewed the request and finds
that its purposes meet the necessary community standards; and
WHEREAS, the City of Oak Park Heights has solicited the input of the public
and there have been no objections to the granting of the request for the raffle as applied
for by Stillwater Area Fastpitch Association.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:.
That the request by Stillwater Area Fastpitch Association to conduct a one-day
raffle on May 20, 2021 at the site of Stillwater Area High School softball field, 5701
Stillwater Boulevard North, within the City of Oak Park Heights is hereby approved.

Stillwater Area Fastpitch Association is looking to hold a raffle this winter/spring. Stillwater
Area Fastpitch Association("SAFA") is a 501(c)3 organization with its Federal Tax ID of41-
1690310. We contacted the Minnesota Gambling Board and was approved as an"excluded"
organization under Minn. Stat. § 349.166, subd. 1(c). An"excluded" organization may conduct
one(1)raffle per year provided the prizes total less than$5000.00.
This letter details the location and timing of the 2021 SAFA Raffle. Please provide a copy of
this letter to the Oak Park Heights City Council for their review, and hopefully, their approval.
The raffle will be held at the Stillwater Area High School Varsity Softball field on Wednesday,
May 20, 2021.
Raffles sales will begin April 15, 2021. Raffle sales will end May 6, 2021. This gives
organizers two full weeks to collect all sold and unsold raffle tickets.
SAFA intends to sell 1500 $10.00 raffle tickets. The raffle will provide three(3) cash prizes:
$500, $250, and $100. Other prizes will go to players that sell a certain amount of tickets.
Those prizes will be as follows:
Sell 20 tickets - $10 gift card
Sell 40 tickets - $20 gift card
Sell 50 tickets - $25 gift card.
Prizes to top sellers will also occur on May 20, 2021.
Therefore,prizes for the raffle will total $850 and prizes for gift cards cannot be higher than
$750. We have approximately 100 families participating in the raffle and are asking each player
to sell 10 raffle tickets. Parents or players are not required to sell raffle tickets to play or
participate in the SAFA.
SAFA fully intends to abide by all statutory requirements for conducting a lawful raffle in the
state of Minnesota along with any other requirements set forth by the City of Oak Park Heights.

Re: 2021 City of Oak Park Heights Native Prairie Maintenance
Attached are copies of quotes submitted by Minnesota Native Landscapes, Inc. to continue
with maintenance of the restoration areas of the native prairies located within Swager Park
and Valley View Park.
I recommend the City continue with weed control maintenance and have a spring prescribed
burn conducted in place of the spring mowing for 2021 at both sites. In keeping with the DNR
recommended standards, the prairies should be burned every 3-5 years to maintain plant and
animal diversity. The weed control visits are timed on growing conditions throughout the year
which is key for proper maintenance as well. The last time a prescribed burn was conducted
at both sites was in 2017. The quotes provided include very similar management services to
those provided in past years.
Minnesota Native Landscapes, Inc. has been managing these areas for the City of Oak Park
Heights since 2012. 1 recommend the City of Oak Park Heights continue vegetation
management services with Minnesota Native Landscapes, Inc. for 2021 which includes three
(3) weed control visits at each site and a prescribed burn at each site. The cost for this service
is $4,510. The project is funded using the Parks Contractual Services budget, which has an
ample balance to cover the $4,510.

conditions. Observations of native and invasive species growth as well as determination of which weed control activity will benefit
the restoration area will be made during these visits.These visits may be made separately or coincide with routine weed control
visits.
Prescribed Burn: Minnesota Native Landscapes/Red Rock Fire will obtain the necessary burn permit, provide a DNR burn plan,
coordinate with local fire departments and other involved parties,and conduct the burn itself.The attached maps outlines the burn
area. Burn breaks will be mowed around the burn unit perimeter(where natural burn breaks, roads, or trails do not exist)and
around heat sensitive objects(trees, bird houses, utility boxes, etc.) prior to burning by the homeowner.
Spring Cutting:(only to occur if a spring prescribed burn is decided against or cannot occur because of weather or other factors)The
spring cutting consists of knocking down and mulching up dormant stocks and vegetation with a tractor mounted flail or rotary
mower and weed whips. This cutting will help the overall appeal of the site, knock back early season weeds, and provide an
advantage for new growth. In addition to the cutting, any litter or debris in the planting area will be picked up and removed from the
site.
Weed Control Visits: During the growing season comprehensive weed control visits will occur to control weedy and undesirable
vegetation. MNL estimates that three weed control visits will be sufficient for controlling weedy species.A variety of management
techniques will be used, including but not limited to;spot weed whipping,full site cutting,hand weeding,and herbicide applications.

Good Evening Madam Mayor and members of the Council,
We are here tonight to address our request for rate increases on select line items based on the
disposal fee increase we received from the R & E Board where we are required to dispose of all
Washington County trash. We have included three supporting documents for review.
Attachment 1 is an overview of the line items with the approved rate increase, amount, and the
year it was approved. It also includes the disposal fees per ton from the R& E Board and the
percentage of the rate increase each year. Please note, the construction debris rate has not
been increased since the beginning of the contract in 2015 and the additional bag fee was been
increased once in 2020, even though the disposal fee has increased every year excluding 2017
to dispose of these items. Attachment 2 displays the total amount of appliances, mattresses,
box springs and the estimated tonnage of all other bulk items picked up from the residents of
Oak Park Heights. Mattresses and box springs have an additional fee for disposal on top of the
disposal fee charge. The totals on attachment 2 do not include the 9.75% Solid Waste
Management tax or the 35% Washington County Environmental Charge. Attachment 3 is a
copy of page 25 of the contract between the City of Oak Park Heights and Tennis Sanitation; in
section E it states that Tennis the Contractor can ask for increases on additional services, such
as the bagged trash and construction debris. The line item increases we are requesting are to
cover the disposal fee increases Tennis has received over the last 6 years we have serviced the
City of Oak Park Heights.

The base dwelling unit prices will be established in Attachment A of this
Contract.
E. Additional collection services.
Charges for pickup of additional items and for additional service shall be made directly to
the resident owner by the Contractor at a rate approved by the City. The additional
collection service price will be established in Attachment C of this Contract. Said rates
may only be increased if approved by the City.
I. The Contractor shall be responsible for the billing of additional collection services
to the dwelling unit_
2. The Contractor may request the City to charge all accounts delinquent for ninety
(90)days on the customer's utility bill pursuant to a process approved by the City.
Said collection shall be limited to rates approved by the City and shall be subject
to a City approved appeal process.
3. Separate roll-off containers are not managed under this Contract.

The City will not bill nor collect any other government's or ag=ies imposed taxes,
surcharges, charges or fees for the Contractor that are not specifically incorporated into
this Contract,this includes the Washington County Environmental Charge,the CEC.The
City will have no involvement in the application,collection, interpretation or payment of
the CEC.
G. Unless agreed to in a separate written agreement,no additional fees,charges, surcharges,
fuel charges,taxes, stipends,etc.may be applied to the City by the Contractor,its agents
or its disposal sites.
H. Unless expressly approved in this Contract,the Contractor may not separately charge any
resident, occupant or property owner any additional service fee, surdmirge, tax or any
other fee for services provided for under this Contract.
I, Implementation of any fuel surcharges or any other `temporary" additional fees are not
permitted without the prior written consent of the City and will not be paid

City Council should discuss including the 58ffi Street and Memorial Avenue
Reconstruction/Rehabilitation Project in the bonding bill. City Engineer Mann will discuss an
update to the Feasibility Study for 58t1i Street and Memorial Avenue, and staff is seeking an
update on fees from Lockridge Grindal Nauan.
Additionally, the City Council should consider the King Plant closure for the bonding bill
discussion.
