Introduction. At the February 2021 City Council Goal Setting, the Council desired to have staff prepare a rough cost estimate that would enable the City to bring snowplowing services "in-house". Recall, the general beginning of this question stems from the City's ability to have more long-term control of the overall snowplowing capacity versus being under the services of a contractor who may not be available in the long-term. And, the notion of frequently switching contractors can also present challenges to providing stable services or billings. Current Costs and Arrangement. The City at this time has a Snow Plowing Service Agreement with Raleigh Trucking for all City Street snow maintenance services,with the latest three-year version signed in 2018 that expired in April 2021.The City and Raleigh did enter into an agreement for one-year extension to this (2022) and which also granted the City an option to extend through April 2024 with notice to Raleigh prior to December 21,2021.This Agreement has an automatic price inflator of 2%annually. The City's annual amounts paid to Raleigh are noted in the Figure 1 below and includes both services and salt/sand. Raleigh's costs include all elements of staff, equipment, maintenance, etc. On average the City's annual cost is $158,442.07, but of course can fluctuate based on annual conditions. This is the unadjusted rate and would be a baseline of comparable costs. Applying a 3% inflator over the next 10 years to this average would total $1,870,850.00 or about$187,000 annually. If the City desired (or was compelled) to bring this service "in-house" it would need to consider several cost factors. These costs are broken down into three sections—all in 2021 COSTS: 4 of 40 June 22nd 2021 Meeting 5 of 40 June 22nd 2021 Meeting Part 1 - Base Equipment Needs- Initial Cost$718,000 110-year Cost$893,288 (32%of Debt). This would be the base investment in trucks,graders,loaders to undertake the task.The City would need to acquire this equipment in a single up-front acquisition so that it is prepared for the task. Public Works Director Andy Kegley did provide a summary of that equipment and would have an upfront purchase cost of$718,000 (see Attachment on such equipment). Part 2-Building Needs-Initial Cost:$1,500,000/10-year Cost:$1,866,200(68%of Debt). A building for vehicle storage/operations and salt/sand storage would be necessary. The City's facilities do not have the storage capacity for these vehicles or equipment. Further, City Hall paved surfaces would also need some adjustments to accommodate these single-axle vehicles. Figure z In addition, sand/salt would need to be accessed in an I` CONC SIDEWALK timely manner and thus suggest it too would need to be - stored on-site and in a covered facility. The City would need to supply: Fuel, salt/sand, repairs, depreciation, operational personnel (est. 525 Hours at$75 per hour)to undertake the additional tasks of the snowplowing.These generally outlined below. In year 11 , much of the bond costs drop off and would be replaced with some increases in depreciation and building repairs, but should be considerably less than the initial investment, with years 11 to 20 would perhaps be one-half of this difference between the two. Itwould be difficult to estimate if the application of current City staff would result in the reduction of services if these hours are shifted away from their current roles. It is likely that other winter- time actions would be delayed — include the plowing of trails, rinks and other winter maintenance. Certainly, trail plowing would be impacted and could not be a priority. If the Council directed staff to start plowing city streets in house, the operation would need to be researched, planned in detail and prepared for which would require an appropriate amount of time, likely over the course of an entire year or more. Often, a truck chassis is purchased separately from the plow equipment (International HV507 chassis is in the range of$84,000). 1 did price plow equipment independently and the cost estimate is $127,000 to outfit a stripped chassis. At $170,000 per vehicle package vs $211,000 to purchase the equipment and chassis separately, the plow package estimate is a far better price than I expected. To effectively plow the City, we would need at least three (3) plow trucks on city streets during and after a snow event. All three would have the capability of spreading salt. CAT 926M Loader The City would need to purchase a loader capable of effectively and efficiently loading salt into the back of the plow trucks. The City could opt t purchase plow equipment for the loader for $36,000 but if the loader is out plowing, it would not be loading salt and vice versa. The sales rep at Caterpillar noted that the CAT 926M and 930 M loaders are the most frequently purchased loaders by municipalities for snow removal and salt loading functions. OPH would fill its needs with the smaller 926M unit. Full time Staff As you already know, no department in OPH is overstaffed, including the public works department. In my opinion, the public works department does not have much room to expand services without some real opportunity costs with the current staffing resources. If the City were to plow streets in house, there would need to be ample personal to cover plowing operations as well as maintaining system utilities and parks -especially when water or sewer systems fail and need immediate maintenance. I believe no less than one full time staff person, but maybe two would be required to fill the gap. Should the City lean toward in house plowing in earnest, this would be researched and chewed on a bit, but expect the added expense. PW Building w/covered salt storage bin to House and Maintain plow Equipment I could throw a guestimate of$3-4 Million dollars to build a public works garage large enough to store the diesel equipment, but I haven't made any connections that could provide closer cost estimates. Although the building structure could be simple, it would have to have equipment such as hoists and cranes to install/remove the heavy plow equipment on/off of the trucks. Further, the building would need interior storage space for plow equipment if trucks would be used during the other three seasons. The City would need to build a salt storage shed as well, ideally one that could hold enough salt to fill trucks several times through the course of a snow event. 9 of 40 June 22nd 2021 Meeting 10 of 40 June 22nd 2021 Meeting Other items for consideration (would need to flush this out) • Fixed costs for building, insurance, fuel etc. • Vehicle replacement costs and schedule • Vehicle maintenance costs • Vehicle maintenance service provider (do we hire a mechanic as 1 of 2 hires)? • Added PW duties for other 3 seasons and additional equipment needs for added staff (PW day to day vehicles, Lawn care, etc.) • New operational procedure/hierarchy for PW department • Need and licensure for CB Radios • PW staff training to operate plow trucks. • Need for onsite fuel storage/cooperation w/ County for fuel (70 gallon tanks of diesel per vehicle x4) • Could/should salt storage be within wellhead protection zone, or would it have to be off site? Vickey Holmes was driving MN lie southbound on Neal Ave N,waiting to turn eastbound into the Kpwalskrr,entrance. Holmes advised that there wasa driver nortour on Neal Ave N in the middle turn lane to turn west into the Starbucks lot.Holmes stated that this driver waved her through the intersection while he waited. Holmes did no[see Jessica Quiroga,who was driving MN lie northbound on Neal Ave N.Holmes failed to yield to Quiroga.Aa Holnws made the tum eastbound into the lot.Quiroga's vehicle impaclRd the rear passarger side quarter panel and tire,dlsablirlq the vehicle.Quiroga had heavy front end damage to her vehicle which was also disabled.Holmes'passenger side airbags deployed as well as Quiroga'-front cr ver's side alrhag-Quiroga's three children were in the vehicle wlth her ono were not injured.Quiroga did have scrapes and bruising to her forearms From the accident. WHEREAS, The Parties (Saint Paul & Oak Park Heights) desire to be prepared to adequately address fire,flood,natural disaster,civil disturbance,or any other Emergency that may occur within the jurisdictions of the Parties; and WHEREAS,In order to protect the public peace and safety, and to preserve the lives and property of people in each jurisdiction,the Parties(Saint Paul&Oak Park Heights)agree to furnish Assistance to one another in the event of said emergencies. Assistance A participating political subdivision may request Assistance(a"Requesting Party")from the other participating subdivision(a"Providing Party")to respond to an Emergency or as a participant in drills or exercises authorized under legislation or this Mutual Aid Agreement. A request for Emergency Assistance shall be made by a Requesting Party to a Providing Party by contacting the Providing Official or his/her designee. Requests may either be verbal or in writing. Any verbal requests will be followed by a written request made by the Requesting Party to the Providing Official or his/her designee as soon as practical or within such period of time as provided by law. Requests and responses to requests under this Agreement are limited to law enforcement personnel assistance services, equipment, supplies, and related resources. In the case of an Emergency for which a Requesting Party will seek reimbursement of costs from the Federal Emergency Management Agency(FEMA)or the State of Minnesota, the Requesting Party shall make the request for Assistance to each Providing Party and the Incident Commander shall monitor and oversee the documentation of the performance of Emergency work and the documentation of reasonable and reimbursable costs of a Providing Party in accordance with the FEMA Disaster Assistance Policy and will disburse the federal share of funds owed to a Providing Party. In response to a request for Assistance under this Agreement,a Providing Party may authorize and direct personnel to go to the aid of a Requesting Party.The Providing Party shall provide personnel who possess the required qualifications along with the equipment and supplies of the Providing Party to the Requesting Party at the discretion of the Providing Party within the scope of the aid deemed necessary by the Requesting Party and the Incident Commander. IV. Limitations A Party's decision to provide Assistance in response to, or recovery from, an Emergency, or in authorized drills or exercise is subject to the following conditions: A.)Party may withhold resources to the extent necessary to provide reasonable protection and services within its own jurisdiction. B.)Party may recall Assistance at any time in the best interests of that Party. C.)Emergency response personnel of a Providing Party shall follow the policies and procedures of the Providing Party and will be under the Providing Party's command and control but will follow the operational direction of the Incident Commander and be subject to the incident management system of the Requesting Party. 29 of 40 June 22nd 2021 Meeting 30 of 40 June 22nd 2021 Meeting D.)Assets and equipment of a Providing Party shall remain under the control of the Providing Parry but shall be under the operational control of the Incident Commander within the incident management system of the Requesting Party. V. Compensation The Requesting Party and any Providing Party will each be responsible for its own costs and compensation for any Assistance arising from any Emergency that may occur during the Term of the Agreement. Unless the Emergency is eligible for reimbursement by FEMA, a Providing Party shall be responsible for the costs and compensation of its personnel, equipment and supplies. For an Emergency that is eligible for reimbursement of costs by FEMA,the labor force expenses of the Providing Party will be treated as contract labor, with regular time, overtime wages and certain benefits eligible for reimbursement. Notwithstanding the above paragraphs in this Section, a Requesting Party may reimburse a Providing Party that has provided Assistance pursuant to this Mutual Aid Agreement. The Providing Party seeking reimbursement from the Requesting Party for Assistance rendered under the terms of this Mutual Aid Agreement, may do so by submitting to the Requesting Party an itemized bill for the actual cost of any Assistance provided. The charges for Assistance provided pursuant to this Agreement will be based upon the actual costs incurred by the Providing Party, including salaries or wages, overtime, materials, supplies and other necessary expenses, except that the Parties agree that the Federal Emergency Management Agency equipment rates will be used as the basis for equipment charges whenever possible. If a local, State, or federal Emergency is declared, and applicable funds become available, a Providing Party may charge a Requesting Party for Assistance rendered under the terms of this Agreement. The Providing Parties will submit to the Requesting Party an itemized bill for the actual cost of any Assistance provided as described above. The Requesting Party is responsible to take all steps it deems necessary to seek reimbursement from the United States of America, the State of Minnesota or other sources, to the extent that such reimbursement is available, for expenses it incurs for services provided pursuant to this Agreement. Should funding become available,the Requesting Party may reimburse the Providing Party to the extent possible under the terms of this Agreement. Any claims for reimbursement by the Providing Party must be made to the Requesting Party within 90 days after the expense is sustained or incurred. No Party will be responsible for the reimbursement of Self-Deployment costs. VI. Workers' Compensation Each Party will be responsible for injuries or death of its own personnel.Each Party will maintain workers' compensation insurance or a program of self-insurance covering its own personnel while they are providing Assistance pursuant to this Agreement. Each Party waives the right to sue any other Party for any workers' compensation benefits paid to its own employee or volunteer or their dependents, even if the injuries were caused wholly or partially by the negligence of any other Party or its officers,employees,or volunteers. VII. 1)amaLe to Equipment Each Party shall be responsible for damages to or loss of its own equipment used to respond to an Emergency under this Agreement. Term of A Bement This Agreement shall be in full force and effect from January 1,2021 through December 31,2026, subject to Section XVI Withdrawal of Party/Termination of Agreement. IX. Liability, and lndenrnification For purposes of the Minnesota Municipal Tort Liability Act (Minnesota Statues, §466), the employees and officers of a Providing Party are deemed to be employees(as defined in Minnesota Statues, §466.01, Subdivision 6)of the Requesting Party. The Requesting Party agrees to defend and indemnify the Providing Party against any claims brought or actions filed against the Providing Party or any officer, employee, or volunteer of the Providing Party for injury to, death of, or damage to the property of any third person or persons, arising from the performance and provision of Assistance in responding to a request for Assistance by the Requesting Party pursuant to this Agreement. Under no circumstances,however,shall a Party be required to pay on behalf of itself and the other Party, any amounts in excess of the limits on liability established in Minnesota Statutes Chapter 466 applicable to any one Party. The limits of liability for one or both of the Parties may not be added together to determine the maximum amount of liability for any Party. The intent of this subdivision is to impose on each Requesting Party a limited duty to defend and indemnify the Providing Party for claims arising within the Requesting Party's jurisdiction subject to the limits of liability under Minnesota Statutes§466.The purpose of creating this duty to defend and indemnify is to simplify the defense of claims by eliminating conflicts among defendants,and to permit liability claims against multiple defendants from a single occurrence to be defended by a single attorney. Neither Party to this Agreement or any officer of any Party shall be liable to the other Party or to any other person for failure of any Party to furnish Assistance to the other Party, or for recalling Assistance,both as described in this Agreement. Nothing in this Agreement is intended to prevent or hinder the pursuit of applicable State or federal benefits to personnel who respond or render Assistance pursuant to an Emergency request and sustain injury or death in the course of, and arising out of, their employment and response or Assistance under this Agreement. Providing Party shall not be responsible for any injuries, damages or losses arising from the acts or omissions of personnel of the Requesting Party and its officers, employees,agents and assigns. X. General Compliance Both Parties agree to comply with all applicable federal, State and local laws and regulations governing any services provided under this Agreement. XI. Accounting;Standards and Retention of Records A.) Each Party must immediately report to other Party any requests from third parties for information relating to activities performed pursuant to this Agreement. Each Party agrees to promptly respond to inquiries from the other Party concerning data requests.Each Party agrees to hold the other Party, their officers and employees harmless from any claims resulting from unlawful disclosure or use of data protected under state and federal laws by the disclosing Party. XIIL Applicable Law The laws of the State of Minnesota shall govern all interpretations of this Agreement and any litigation which may arise under this Agreement. XIV. Non-Discrimination All Parties agree to comply with the provisions of all applicable federal and State statutes and regulations pertaining to civil rights and nondiscrimination including, without limitation, Minnesota Statutes§181.59 and§363A. XV. Withdrawal of Party/Termination U AtYreement A.) Wi(houl Cause - Either Party may withdraw from this Agreement without cause upon thirty(3 0)days written notice to the designated recipients for the other Party.If withdrawal is without cause, the Party shall pay the withdrawing Party all reimbursements and payments to which it is entitled under this Agreement, to the date of withdrawal. Any withdrawing Party must also pay all obligations owed to any other Party under this Agreement,to the date of withdrawal. B.) Poor Cause - A Party may terminate this Agreement if another Party fails to perform in accordance with the provisions of this the Agreement in a proper and timely manner, or otherwise violates the terms of this Agreement. Currently,while one bus stop is near a sidewalk and both have a sign and bench,the bus stops on both sides of the street are not paved,potentially presenting a concern for individuals with limited mobility. (SEE: https://www.metrotransit.org/imal)/294 -- STOPS: 7253& 7261 —IMAGES ATTCHED) The City understands that these may not be high traffic bus stops or even stops that are regularly utilized but we would like to ensure equitable accessibility of all the bus stops in our City so that all our residents can benefit. So that you may further understand our perspective,please note that approximately 19.8%of Oak Park Heights residents have some form of disability,which is higher than the national average,of which, 13.9% have ambulatory difficulty.' We can understand these may be older stops that may be coming due for some updates however Metro Transit must ensure that its bus stops have a firm, stable surface to allow passengers to board the bus and to be in compliance with the Americans with Disabilities Act and related updates. Currently,the bus stops at 58t1 Street and Stillwater Blvd do not appear to meet these standards, since they do not have pavement(or other firm surface) at the stops and as a result lack an accessible connection to the off-street/street route. We ask that Metro Transit consider paving the stops and make other necessary improvements to better ensure they are accessible to our community members.And,please let us know the timeline for any such improvements. Metro Transit staff will begin exploring design options for adding accessible boarding pads.This will include coordination with Washington County Public Works and City of Oak Park Heights Public Works staff. At the northbound bus stop, it appears a pad can be added between the curb and trail to make the accessibility improvement, but site measurements are needed to verify. At the southbound bus stop, the site conditions and absence of a pedestrian network are challenges to making the stop accessible. We would like to consider moving the southbound bus stop to the pedestrian crossing preceding the traffic signal, nearside of the intersection. We noted similar concerns in 2020.The City noted in 2020 that Bayport may not simply delete or edit Fire Aids from the Budget at its sole discretion and/or shift these costs to the other parties.The formula worked as designed in 2015,2016,2017 and 2018 and the Budget included these credits and years of invoicing denotes this practice and understandings when this was undertaken in 2015. At this time, the City has calculated a 3% increase over 2020 to the correct Base Amount (and #of calls adjustments with OPH being of 53.40% of total) and has supplied that amount herewith (1s' Qtr.) based upon a budget of $510,522.98; which then calculates to a total payment of$272,619.27. Enclosed is a supplemental check in the amount of$917.83 which adds to our payment submitted earlier this month for the 1s'quarter 2021.The City will be need to make subsequent payments for the remaining quarters of$68,154.81. That said, I would offer that the City is willing to discuss options on how to address this continuing discrepancy, but we would ask that all parties also revisit the historical practice and perhaps Bayport outlines how this could be discussed in an impartial setting— such as with a mediator of some form—although perhaps not that formal...
