No new applications have been received. Staff did meet with Lakeview Ambulance about the short-term use of the FURY MOTOS building for an ambulance/ready station. They are in need of relocating for about 24 months as Lakeview Hospital is in need of an on-site expansion and their other plans for a new building—to be located on CURVE CREST would not be ready until late 2022. This may require CUP review. 2. The City did send a follow-up to STARBUCKS commenting on their proposed plan to hire ON-SITE Flaggers and use more mobile pay app.I suppose we are obligated to let them try it-,please see the enclosed communication requiring that their plan is implemented by July 16'. Similarly,the City did provide a letter to ONEIL ELECTRIC for non-compliant outside storage—see enclosed. 3. The Owners of the WHITE CASTLE building did petition MNDOT to allow a Rt-in / Rt-out from STATE NIGNWAY ss the frontage road-,MNDOT did deny this in April; MN DOT RW PLAT NO. 82-95 however,after some further input from the City it _ would appear that MNDOT has changed course TNlZu IvHt:K with some conditions—namely that it would need _ 314' TURN LANE the curb-line would dates. to be art of a bigger PUD Amendment and that ud need some other a P 4 Therefore, the CI may see a PUD Amendment { t3 y OPTION 1 application from this Owner — hopefully this summer. Chief Hansen has supplied the June 2021 Police Activity Report. 2. Enclosed is a summary Capital Improvement Plan for 2021-2026.This will be discussed in full detail on 7/21 budget discussion and the full plans will be emailed next week. However,enclosed is the summary document for starters. 3. The City has discovered that the County did make an error on a Tax classification for one Mr.Nolde's properties an which impacts TIF District#4. The County will need to take steps to abate these costs and refund the TIF account. See the enclosed letter from the County. This is not at all similar to a traditional TAX ABATEMENT proposal,rather just a tool for the County address their error. Staff does still have some questions to be sure the city is not paying for these costs and we are working on these. 4. The Lookout Trail project has begun with tree removals this week and mailbox removals.STANTEC's Brandon Johnson has supplied a weekly update and is enclosed. 5. Council Member Runk asked for some documents for his 7/9/21 meeting with a School Board Member(s) related to the County's proposed South Frontage Road and the possible City acquisition of property from the School District for a possible WELL. These same docs are attached-,nothing new-except one MAP (7/12/21 Update)with some new Traffic Modeling at 58'street and STW Blvd, showing improvements with some amendments of turn lanes in a NO-Build Scenario—I will ask Lee Mann to discuss this new map with the Council at the next opportunity,possibly on 7/21/21.I did also attend the meeting with Mr.Runk and provided a summary of these documents. You propose the placement of"on-site"traffic management staff—flaggers—to direct traffic through the property so that stacking onto the public right-of way would not occur. 2. You propose the installation of an additional four(4) Mobile Order Pay/Parking spots. Unfortunately,the response includes no details as to a timeline for implementation, no details on how these would be monitored and no details on how the SHORT-TERM use of flaggers would be supplanted in the future. In addition, as requested by the City there was not a submission of a bone-fide traffic management plan that eliminates this stacking issue from an objective or measurable standpoint. Despite these shortcomings in the response,the City however is willing give these a try but shall be implemented in full not later than July 16th,2021 (continuing in perpetuity until the City approves the removal)and shall include PROFESSIONAL FLAGGERS(not STARBUCKS STAFF)on both Saturday and Sunday as well as Monday thru Friday-7:00 AM to 11:00 am. In addition,these flaggers shall remain wholly out of the City right of way(street)and have no authority to direct traffic in the public realm. These flaggers shall be clearly visible at all times,wearing appropriate safety vests and be entirely on private property so when the City performs a site visit,we can identify them as being in place. They are to stay out of the roadway. The City Police Dept and Admin Staff will visit the site on July 16th to check for compliance with these parameters. Failure to implement any of these actions you outline and with the provisions we note,will again result in the City initiating the revocation of the Conditional Use Permit.The City will review this matter moving forward and will consider further action if we determine this is an ineffective effort. Sincerely, PLANNING & CODE ENFORCEMENT Cit dministrator v CITY OF OAK PARK HEIGHTS POLICE DEPARTMENT 14168 Oak Park Blvd. N., Oak Park Heights, MN 55082 July 7, 2021 To: Mayor and Council From: Chief of Police, Steve Hansen Subject: Police Activity Report June 2021 This overview report is the activity of the Oak Park Heights Police Department during the month of June 2021. Officers responded to and generated 465 calls for service in the City of Oak Park Heights during this month. Quick breakdown for some of those calls for service include: 80 medicals, 5 fire related, 9 thefts from businesses, 17 vehicle accidents, 13 alarms, 7 disturbances, 67 traffic violations, 18 suspicious persons/vehicles. This past month the investigations unit worked on purging several firearms and weapons from the long-term property room. These involve incidents from the past twenty years which have now been resolved in court or were abandoned property. These items were picked up for destruction by a company to be later shredded/pulverized. This was done free of charge. Crime prevention officers started to plan Night to Unite events and registration information. Handouts and community outreach items were ordered as well. On June 24th, I was able to meet with several residents at an on-site construction meeting for the Lookout Trail project attended by OPH admin staff. A handful of residents discussed traffic concerns and suspicious vehicles in the park recently. Community Outreach: Officers assisted with the PONY parade event on June 5th for all the graduating seniors. We provided traffic control on Stillwater Blvd and SRO Paradise was able to assist with escorting the parade through OPH and SW. Officers also assisted with escorting the SW Girls High School Softball Team out of town as they headed to the MN State Tourney in Mankato on their team bus. Sgt. Vierling assisted with escorting the 34th Red Bull Military Police Unit back home through Bayport, OPH, SW and ending at the Stillwater Armory. Approximately 10 police agencies assisted with the reception home. Boutwells Landing invited me to assist with their employee appreciation ceremony on June 30' as a presenter of badge to their campus administrator Wendy Kingbay. Officer Paradise also attended the High School Prom and all-night grad party for the school season wrap up. Covid 19: All Public Safety officials were notified from Washington County that Covid testing sites will close at the Armory on June 3rd and Bluestone contract on June 30th. New hire update: Officer Fahrendorff is approximately half way through field training and is doing well. Officers attending training this month: All of the officers completed the annual AWAIR safety training through Patrol Online which is required annually by OSHA. Officer Fahrendorff attended a 3-day training over in the west metro for drug and alcohol testing related to traffic stops for DWI enforcement. Calls for service highlights: This is a sample of some of the cases we responded to and investigated 1. Total of 3 catalytic converters stolen within two days over by Tire Proz and residential area. 2. OPH officer located suspect male involved in a gun pointing incident on hwy 36/Hilton. Suspect located at Applebee's, suspect also stated he came out to Stillwater to kill his wife and kids, suspect had a loaded .45 handgun and extra ammo in his side storage compartment area of his motorcycle. 3. Traffic stop on vehicle with occupants in possession of 50 grams of Marijuana and 100 ecstasy tablets. 4. Phone scam complaint. Officer spoke with a resident advising he was told that his son was in jail and needed to bring$9,500.00 to a kiosk in Woodbury to pay for the attorney to get him out of jail. Complainant was just leaving his house to pay when his son arrived home and he quickly determined it was a scam. No loss of funds. 5. Bear sighting hwy 36/ beach rd 6. Officers responded to two bicycle accidents on the 12th , first one was on hwy 95/hwy 36, with severe injuries to the bicyclists back area. Second accident was a single bicyclist losing control on hwy 95 after coming down the hill from Perkins/56thst. 7. Stolen vehicle located at Walmart and suspect arrested. 8. Officer located a suspicious vehicle at the scenic overlook occupied by 4 juv males using marijuana. Parents contacted and juv citations issued. 9. Officer took several reports of theft from the underground garage at the Green Twig Villas, items included a$2,300 bike, $1000 worth of tools and misc stuff. 10. Burglary report, of a male that entered into a home through an unlocked service door on 55' st/Novak and stole a large amount of cash. 11. Officers arrested a male at Walmart pharmacy for prescription fraud. 12. Officers responded to animal stuck in the sewer at 57th/Peller. Officers discovered it was a black bear. Bayport Fire assisted with removing storm grates and the bear eventually flushed out heading w/b. 13. Officer responded to the Walmart for a reported male with a gun and possible shots heard. Officer advised it was unfounded and later discovered to be a distraction call from a suspect that just ran from Deputies in Lake Elmo. 14. County has received an abatement request for taxes payable in 2021 for the property indicated above. The property qualified for the 4d low income rental classification starting with taxes payable in 2021. Due to a clerical error in processing the 4d classification, the property was instead classified as market rate apartment for taxes payable in 2021. Correcting this error results in a reduction in the tax capacity and property tax because the class rate for properties that qualify for the 4d classification is significantly lower than the class rate for other apartments. The old concrete and asphalt road surface will be removed. New storm sewer will be installed along Lookout Trail. After the pipe Construction has been installed, a new road will be built along with concrete curb and gutter and bituminous pavement. Zones Dresel Contracting and its subcontractors will be performing the work. • Please slow down for construction On Tuesday (July 13th) asphalt removals will begin. There may be some additional tree and shrub removals if it is necessary for construction of the project. Please contact Brandon Johnson if you have any questions or concerns regarding tree removals. Email Updates — Our main form of communication regarding this project will be via email updates. Updates will be emailed every Friday, with additional updates being sent as needed. If you know someone who would like to receive these email updates about the project, please email bra ndon.johnson2(abstantec.com to be added to our email list. 1 Garbage and Recycling - At different stages of the project, garbage trucks may not be able to reach your trash receptacle. Please label your bins with your house number using tape and permanent marker. Place your trash/recycling receptacles curbside by 7:00 am on collection day and the contractor will move it as needed to be picked up and return it by the end of the day. We do not anticipate any issues with regular curb-side pick-up next week. Driveway Access — Driveway access will remain open at most times during the project, but residents should expect that during working hours (7am-7pm) their driveway may be temporarily blocked by excavation and equipment. Driveway access will be restored by the end of each working day. If anyone has any special access needs or concerns, please contact Brandon Johnson. Driveway Replacement- Portions of driveways that are disturbed as part of the project will be replaced in-kind. The proposal covers various tasks to analyze the proposed well site(s), assuming that up to two different well sites may be reviewed as part of this proposal. The work plan includes the following: Task 1: Well and Aquifer Hydraulic Analysis An analysis of estimated aquifer yield will be conducted, looking at local aquifer test data to determine the potential well yield and water level drawdown. The computer groundwater model utilized for the City's Wellhead Protection Plan will be updated to include the proposed new well. The model will simulate the influence of the new well on the groundwater flow field, estimating potential interference with other existing wells in the area. Concerns for potential well conflicts will be identified. Additionally, a calculated capture zone for the well will be mapped, showing areas where water will be captured to supply the new well. Any overlaps with existing wellhead protection areas will be identified where they exist. Task 2: Potential Contamination Sources Analysis Using the results of the capture zone analysis, nearby known and potential sources of contamination will be identified. An assessment will be made to determine the level of threat these sources of contamination pose towards the new well. Where available, existing water quality data will also be reviewed to determine water quality at-or-near the proposed well site. Task 3: State Permitting Review Two permits from State agencies will be needed to drill and pump a new water supply well. A permit from the Minnesota Department of Health will be needed once the well is designed and ready to bid. Ahead of that permitting, an analysis of the site is proposed to be conducted to ensure that the site is suitable for new well construction. This analysis will include a review of required isolation distances to ensure that the well can be suitably placed on the site to meet these requirements. A second permit from the Minnesota Department of Natural Resources (DNR) is needed to pump the well once it has been constructed. Before applying for this permit, the City should submit a request for a pre-construction assessment from the DNR. The pre-construction assessment identifies DNR concerns for potential water use conflicts and/or potential impacts on nearby groundwater-fed natural resources. This assessment will help identify whether the site is likely to meet the DNR standards for a water appropriations permit. Stantec will assist the City in requesting and reviewing the pre-construction assessment. 3 of 15 June 29,2021 Eric Johnson Page 2 of 3 Reference: Oak Park Heights Well 3 Site Analysis Proposal Task 4: Water System Operations Analysis Construction of a new well may impact water system operations. Stantec proposes to update the water distribution system model to simulate the operation of the new well. Results of the model will be used to identify the suitability of the new site and identify potential concerns that may arise from operation of the new well. Report A summary report will be provided outlining the results of the above four work plan tasks. The report will outline both pros and cons of the proposed well site(s), offering conclusions as to the suitability of the site(s). Recommendations will also be provided regarding any additional steps that may be needed before the final site selection can be finalized. Cost Proposal The following costs are proposed to conduct the well site analysis. Task Proposed Cost Task 1: Well and Aquifer Hydraulics Analysis $2,260.00 Task 2: Potential Contamination Sources Analysis $1,270.00 Task 3: State Permitting Review $660.00 Task 4: Water System Operations Analysis $1,872.00 Report $2,374.00 Total $8,436.00 The tasks are proposed to be carried out on a time and materials basis. Any changes or additions to the work plan may result to modifications of the project costs and therefore will be conducted only after approval from the City. Schedule We are ready to begin work on this project immediately. Stantec proposes to complete the outlined tasks and deliver the summary report within 45 days of receiving a notice-to-proceed on this effort. Additional time may be needed to conclude the project if additions or changes are made to the work plan or additional well sites are requested to be reviewed. If additional time is need, Stantec will provide a revised timeline for completion of this work. This letter and scope of services represent the understanding between the City and Stantec in respect to the Project and may only be modified in writing signed by both of us and is subject to the current Master Services Agreement between the City and Stantec.
