No new applications have been received. 2. Enclosed is a copy of the City's letter to the School District relating to the potential well site—we are awaiting a response.We understand the School District has hired Brian Zeller to represent the District on their land sales —which may or may not include this site,but we are endeavoring to find out. 3. Many site issues have been addressed at the former KFC/A&W—please see the enclosed letter from the real estate representative—Jon Whitcomb. Also,the former Mr. Car Wash site has been mowed. 4. The City received a copy of the public meeting notice from Baytown related to a residential development—the former Cahanes land- as was discussed earlier this spring. See enclosed. Enclosed is the weekly update from STANTEC-Brandon Johnson • Mr.Paul Sinz—has been given the City's demand for payment related to his tree damages.This was also supplied to his insurance agent. We are awaiting response. • Only Friday afternoon-July 31St City Staff have endeavored to hold STAFF TEAMBUILDING EVENT—we are going to try our hand a kayaking event on the Kinnickinnic River that Jenny is familiar with. So... Stillwater,MN 55082 Also VIA EMAIL: drornmerhausenm@sfillwaterschools.org RE: Memorial Ave Property—City Offer to Purchase Dear Melinda and Mark: Thank you again for being willing to discuss the possible sale of the District's property(PIN#0602920210002—3.73 acres+!-} located on Memorial Ave in our City.As noted,the City is interested in the prompt acquisition for the purposes of a new well (0).At this time the City can provide the following proposal for our acquisition of the parcel: 1) PURCHASE PRICE. The City understands that the DISTRICT may have an independent appraisal performed by a licensed I certified appraiser for this property and the City very likely would be comfortable with such value if it can be supported in the appraisal documentation. Therefore,the City's purchase offer is$350,000 or the value stated in the District's current appraisal(dated prior to July I P,2021)whichever is higher,but not exceeding$447,100. 2) EARNEST FUNDS/CONTINGENT OFFER PURCHASE: If a price can be clarified subject to#1 above that is acceptable to all parties, the City would offer an immediate$10,000 earnest payment for the property in exchange for a 60-day due diligence period.Prior to the conclusion of the 60-day period the City must commit to the purchase of the property at the agreed-on purchase price and a closing must be scheduled promptly by both parties with no further contingencies. Should the City not ultimately close on the property at the established price,then the District may keep the$10,000 as a penalty.If if does close,one-half of the$10,000 would be applied to the purchase price and the District may keep the remainder. 3) DUE DILLIGENCE PERIOD: During the 60-day period the City would complete its due diligence on the parcel including an evaluation regarding the possible well location,this information was outlined in the STANTEC memo provided earlier. 4) SURFACE USE/LEASE BACK. The City's expected footprint on the parcel is expected to be small and keeping the open-space around the well-head would be a best-practice;thus,the City would be interested in discussing a lease-back or other surface use permission to the District if it felt it desired to maintain some recreational or open-space type use of the property,such as for the current MTN Bike trails. This could be accomplished in a no-fee arrangement to the District. 5) BUY-BACK OPTION: After closing,should the City Council determine at some future date that the land is not necessary for City,the City would offer the District a no-cost first option to buy-back this property from the City at the same price the City pays for it from the District only adjusting or a rate of inflation using the CPI-established for the MSP region. This Buy-Back option would expire in 25 years. If these elements are of interest and timely,may we suggest that perhaps the City Attorney and the District's Counsel meet to discuss these elements and how it can be finalized.I would be happy to answer any questions you may have or if you would like to set up a meeting with our respective counsel,we can do that as well. The City at that time requested that a few items that were in violation of City ordinances be remedied. With the approval from City staff we completed the tasks within the 10 day extension of July 21, 2021 as shown by the pictures. As to Item 1 on the list, the panels in the pylon have been fully covered as required. As to item 2 on the list, the directional signs that were not properly covered have been removed and capped. As to item 3 on the list,the trash enclosure doors have been repaired and rehung per required ordinance. Based on this letter, and the photo's as evidence that the work has been completed, we will assume no further action will be taken toward the property owner related to these items. Due to the pandemic, the walk/run event was held virtually and was self-paced and self-timed. The routes, created by Councilmember Carly Johnson, took participants through the City's parks and on a portion of the City's extensive trail system. The event was announced in the City's Spring Newsletter, on the City's website, and through several postings on the City's Facebook page. The City Council authorized a random drawing, not based on time results, for gift card prizes. Participants submitted their results through either a Google Form or by email. Most people chose to walk rather than run. Here is a list of the participants and their comments about the event: 10K: Name What was your favorite part of the 5K or 1 OK? Since there were only two lOk participants, staff made the decision to automatically select the two IOk winners and to draw randomly four names from the 5k list of participants. The old concrete and asphalt road surface will be removed. New storm sewer will be installed along Lookout Trail. Email Updates — Our main form of communication regarding this project will be via email updates. Updates will be emailed every Friday, with additional updates being sent as needed. If you know someone who would like to receive these email updates about the project, please email bra ndon.johnsonNIstantec.com to be added to our email list. 1 8 of 23 Garbage and Recycling - At different stages of the project, garbage trucks may not be able to reach your trash receptacle. Please label your bins with your house number using tape and permanent marker. Place your trash/recycling receptacles curbside by 7:00 am on collection day and the contractor will move it as needed to be picked up and return it by the end of the day. We do not anticipate any issues with regular curb-side pick-up next week. Driveway Access — Driveway access will remain open at most times during the project, but residents should expect that during working hours (7am-7pm) their driveway may be temporarily blocked by excavation and equipment. Driveway access will be restored by the end of each working day. If anyone has any special access needs or concerns, please contact Brandon Johnson. We understand that errors occur, however this error results in a loss of tax revenue due to the City for 2021. In order to remedy this, the City needs to fund it with reserves or add the uncollected amount to the 2022 tax levy. Understanding that the taxpayers of Oak Park Heights will pay the bill whether it is in 2021 or 2022, the issue adds a unique complexity for the City to explain it and its impacts. The conveyed apology for the impact that the City has experienced is appreciated. We would hope that the County sees the willingness of the City to move forward and that the County in the future be would be receptive to accommodate us in our continuing efforts to resolve or address the valuation timing/ reporting issues we have with the Department of Revenue related to the utility properties.
