CITY OF OAK PARK HEIGHTS—WEEKLY NOTES for: June l l", 2021 TO: City Council Members& Staff FROM: Eric Johnson,City Administrator Zoning&Development Items: 1. No new applications have been received. 2. The City Staff has sent several notices of code enforcement for continued site compliance issues—STARBUCKS,RUBY TUESDAY (former),KFC/A&W. These letters are enclosed and these property owners are now well informed of the City's next steps related to enforcement.There are other sites in such cue,including the former McCormick's site(which has not yet sold to TOP TEN Liquor) and STAFF has had to engage the shop owner at the NAPA site for working on cars in the street,derelict cars and other site concerns. 3. Apparently the ISD#834 School District is going to be selling its 3 acre +/- site on Memorial Ave and was a topic of the SchoolQ Board discussion on 6/10/21 — See the ENCLOSED.The City has in the past explored possible land acquisition in this area for WELL #3 (NOT A TOWER)as it is very close to the approximated the WATER CAPTURE ZONE; P not otherwise taxable; mostly under power lines; nearby to City water mains, and could w E 5 have some reasonable safety zone green space around such well-head. We will need to see what the School District does next, but apparently it will be publicly listed. Well # 3 will be necessary at some point as the City Paa Et generally is at its maximum FIRM CAPACITY. 4. Kevin Sandstrom and I worked with the City's realtor to refine a possible counter-offer related to the STAGECOACH property. Assuming the discussed concepts are workable with possible buyer—this matter may be on your Council Agenda for 6/22 for final approval to sign the PURCHASE AGREEMENT. It will contain certain deadlines and requirements of the buyer before any closing might actually occur—not vastly different than Holiday Inn Express process from a couple of years back. COVID-19 Matters: • This is the Governor's-PORTAL https://mn.gov/covidl9—Many documents/Exec.Orders can be found. Washington County has initiated a County Dashboard containing more localized COVID-19 Impacts and rates LINK-»HERE. • COVID-19 Testing sites can be found on this Link: https://mn.gov/covid19/get-tested/testing-locations/index.jssp Other Items: 1. Staff does have some concerns related to the use of E-Bikes on City Trails,we note that some can appear to be going very fast and functionally become more-or-less motorcycles or mopeds—just with electric power—and are not permitted on City Trails. We are compiling a memo for discussion,but these are quite popular and could be a contentious matter for some. No action is pending and we are searching for other State guidance and what other cities are doing about the matter—if any... 2. The STW Morning Rotary (Rotary International)group might be seeking to host a VALLEY BIKE RIDE moving through Oak Park Heights in mid-August. A local permit would be required as there could be 300+/- participants. Overall, these have been without issue and the City has waived fees for non-profit groups. More information is forthcoming. 3. The City does bill the School District a prorated fee for the School resource Offier-attached is the billing for the last part of the 2020-2021 year. Attached is a POLICE INCIDENT report from an accident occurring on 6/4/21 stemming from the stacking issues we note as well as various images–taken on May 29th - again showing the situation with cars in the wrong lane. Similar to my letter from Feb 2nd 2021 –you are to provide a new– professionally drafted - traffic management plan that eliminates this stacking and also provide a detailed timeline for implementation. In the interim, the City will be commencing its process towards possible revocation of the Conditional Use Permit that allows STARBUCKS to operate at the site and they will be closed without such Conditional Use Permit... but we would instead prefer to see your proposed plan. Located the two vehicles partially blocking the west entrance to Kowal5ki'5 off of Neal Ave N.located to the southeast of Starbucks, I spoke with both drivers and got the following information.. Vickey Holmes was driving MN lie southbound on Neal Ave N,waiting to turn eastbound into the Kpwalskrr,entrance. Holmes advised that there wasa driver nortoun on Neal Ave N in the middle turn lane to turn west into the Starbucks lot.Holmes stated that this driver waved her through the intersection while he waited. Holmes did no[see Jessica Quiroga,who was driving MN lie northbound on Neal Ave N.Holmes failed to yield to Quiroga.Aa Holnws made the tum eastbound into the lot.Quiroga's vehicle impar:tRd the rear passarger side quarter panel and tire,disablinq the vehicle.Quiroga had heavy frrol end damage to her vehicle which was also disabled.Holmes'passenger side airbags deployed as well as Quiroga'-front cr ver's side alrhag-Quiroga's three children were in the vehicle wlth her ono were not injured.Quiroga did have scrapes and bruising to her forearms From the accident. Holmes caused the crash due to her failure to yield the right of way to Quiroga. No citation issued as the intersection was hacked up at the time due.o the design and provided poor visual of oncoming traffic because of it. Pictures were taken of both vehicles that will bet uploaded to the Police drive.Driver and insurance information was gathered.Holmes 2nd Quiroga were both provided a business earl with the case number attached.Both vehicles were towed by Stillwater Towing State accident report to be compleled. Since closure, we have shared communication as to the condition of the site and the signage. The outstanding compliance and condition of the items noted below create a public nuisance pursuant to City Nuisance Ordinance i 109.03(f)&(F) and 1109.04 (C) & (L). 1�s cif today: I) The sign faces at the pylon structure have not been adequately addressed are in violation of City Ordinance 401.15.G.15.c with regard to Out of Business Signs. The blank panel that is white in color shall be replaced with a fully opaque panel set so that no light illuminates through it. 2) The sign structures at the entry, previously serving as directional signage for the site have been tn damaged and one of them currently without the sign face and its pole leaning over. The signs serve no directional purpose and are regularly creating a hazard and per City Ordinance shall be removed in their entirely and any electric to them properly terminated. Any disturbance of the grade shall be corrected upon the structure removals. 3) The trash enclosure is without its enclosure doors and trash is being placed to the interior. despite there being no trash container and is also a violation of City Nuisance Ordinance 1109. The doors shall be replaced to the enclosure, with materials similar to the building structure, as provided by City Ordinance 401.16— Design Guidelines. This letter serves at your 30-day notice to satisfactorily address the above issues and to remain in compliance. These issues have been ongoing since the KFC closure at the site in 2013, with no resolution. Failure to address items 1 — 3 above prior to Monday, July 12, 2021 will result in the matter being directed to the City Attorney for legal recourse by them, including possible criminal citations or civil sanctions to the Owner which will you need to address in the DISTRICT COURT. 6of18 Tree City U.S.A. In addition, the City may declare this entire site a"public nuisance"and will effectuate the repairs under its own forces as outlined in City Ordinance 1109.07, and will bill all such costs as a special assessment plus all related administrative an attorney's fees.
