Re: Variance Permit
Dear Mr. Phillips,
On June 22, 2004, the City of Oak Park Heights approved a variance from Section
401.A.7 of the Zoning ordinance to permit the construction of a single-family structure at
5272 Stagecoach Trail, subject to conditions being imposed thereon. Condition 2.e. reads
that a building permit shall be issued for a single-family structure on the subject site no
later than July 1, 2005 and the structure shall be completed with a certificate of
occupancy issued by July 1, 2006.
Building Permit#2005-00061 was issued to you on March 25, 2005, for the construction
of a single-family residential structure. The last recorded inspection to this permit is a
framing inspection completed on 8/17/05. The time line for completion of this project is
well over due. This letter is to inform you that I shall void this permit in 60 days from the
date of this letter if the following conditions are not completed and complying with the
Zoning and Building Codes adopted by the City of Oak Park Heights.
The following conditions must be met:
1) A new site plan, drawn to scale,must be submitted to the Building Inspection
Department for approval. Please note that the south driveway shown on the site
plan submitted in March of 2005 is not permitted. Zoning Code Section401.15.6.d
states that a driveway must lead directly into a garage and shall be constructed of
concrete, asphalt cobblestone, or paving block. Please note that Class 5 rock is
not acceptable.
2) The landscaping of your yard must be completed. This includes the necessary
block retaining walls to be constructed in the front and rear yards. Again, a site
plan must be submitted for approval. The landscaping shall include sod in the
front and side yards to the edge of the curb on Stagecoach Trail and ornamental
grass, or other acceptable vegetation may be used in the rear yard.

3) The siding and soffits of the structure shall be completed.
4) The deck on the Southwest corner of the structure must be completed. The
columns and beam shall be sided, deck boards installed and a guard rail installed
at a minimum height of 36"with the maximum clear opening of the spindles no
more than 4 inches.
5)' The door(s) going to the other deck must be secured so that the maximum clear
opening is not greater than 4 inches.
Prior to occupying this structure the following must be completed,inspected and
approved by.the Building Official. The structure shall have the following:
1) One completed bathroom with a toilet, lavatory, shower or tub, and a finished
floor.
2) A kitchen sink and hot and cold water supplied to all plumbing fixtures.
3) A heat source in the structure.
4) A final electrical inspection of the structure.
5) Final electrical,plumbing, heating, and building final inspections must be
requested by you,completed and approval granted prior to occupancy of this
dwelling.
Please be advised that if these directions are not completed and complying to the City
Codes, legal remedies may be pursued to correct these violations. Contact me if you
