Oak Park Heights, MN 55082 Re: Residence Construction and Variance Dear Mr. Phillips: On June 22, 2004 you were granted a Variance that allowed you to reconstruct your residence at 5727 Stagecoach Trail,N. due to the hardship of the original structure being lost to a fire. Condition 2 (e) of the Variance required that the construction permit be issued no later than July 1, 2005 and that construction be completed and Certificate of Occupancy be issued no later than July 1, 2006. General construction permit 2005-00061 was issued on March 25, 2005 and a plumbing permit issued on October 5, 2005. The last inspection requested and performed at your home was on October 5, 2005, when Building Official Butler inspected the construction framing and the plumbing underground work. To date, a mechanical permit has not been applied for and remains a requirement to the dwelling construction. If a fireplace is being installed a permit is also required for its installation. Records indicate that your home has had no work beyond framing and that the home is currently not insulated or that its inspection has not yet been requested, that you have no operable plumbing and no HVAC work of any kind done to the home, leaving the home without heat. We have also not received any recorded from the State Electrical Inspector indicating that any electrical inspections have been performed at the home. In short, the home by virtue of permits issued and inspections recorded is not considered habitable and shall not be occupied in any manner. At this point in time, the deadline for construction as per your Variance has passed and is subject to review and revocation. Additionally, because there has been no inspection of work performed in over one-year, the permits issued to the project are also subject to review and revocation. Tree City U.S.A. With this letter you are requested to: 1. Complete the exterior siding of the structure within 90 days of the date of this letter; and 2. Immediately contact City Administrator, Eric Johnson to discuss the status and completion timeline of the construction. Call or email me with any questions you may have regarding this communication. Cordially, JulA. Hultman Planning & Code Enforcement Officer pc: Eric Johnson, City Administrator Jim Butler, Building Official Mark Vierling, City Attorney
