Professional Fee Responsibility;
It is the understanding of the undersigned that all City incurred professional fees and expenses associated
with the processing of this request(s)will be promptly paid upon receipt. If payment is not received from
the applicant,the property owner acknowledges and agrees to be responsible for the unpaid fee balance
either by direct payment or a special assessment against the property.
Applicants will be billed on a monthly basis for Planning,Engineering,Legal and Community Development
fees as they are accrued. It is understood that Interest will be charged on the account at the maximum
rate allowed by the Fair Credit Act if it becomes thirty(30)days past due. Failure to pay administrative
and processing fees in a timely manner may result in denial of the application. All fees must be paid at

Covenant RE Management,Inc.("Covenant")is pleased to present the development plans for its project at
the former Ruby Tuesday's site on 60th Street North in the city of Oak Park Heights.We are proposing to sub divide
the existing vacant restaurant into two tenant spaces.We propose two small additions with a drive thru lane to
accommodate this change."Addition 1"is a second entrance tower for the second tenant space we are proposing to
create and"Addition 2"is bumping out the wall along the north side for a drive thru pick up window.Our proposed
drive thru lane is 180 feet of stacking and wraps the east and north of the building.The rest of the parking lot is
existing to remain.In order to modernize,update and modify the project so we no longer look like a ruby Tuesday,
we are proposing to remove the existing stone from the existing entrance tower and replace with EIFS system;
leaving the other three building façades with brick intact.We will keep the black awnings,and provide new paint for
the metal awning,cornice features and light fixtures as needed.
We will rework the existing utilities for the new multi-tenant user requirements.The current restaurant
building is 5,105 s.f.,our additions add approx.97 s.f for a total of 5,202s.f. There is an existing trash enclosure to
the south that will remain to shield the trash bins.The new uses will be a quick serve drive thru tenant and a dental
office use.We feel the proposed uses are appropriate for the surrounding area and will be beneficial to the city and
its residents
We are Lot 4 of the Shoppes of Oak Park Heights which has ingress/egress and parking easements from lot
to lot. Site is located south of 60th Street North.We are proposing the drive thru entrance to be from the southeast to
wrap the building along the east and exit at the north west side to the existing parking lot.We will keep most of the
landscape vegetation along these two sides to screen the proposed drive thru.We propose to rework the ADA
parking stalls and curb ramps to meet current code compliance.Existing utilities are to remain and will be protected
throughout this process.
The dental office will be managed by an affiliate of Covenant,Pacific Dental Services,Inc.("PDS"),which
has been developing and managing successful dental practices since 1989,and today is an industry leader in
developing new dental practices and is the provider of choice in the markets we serve. Strategic success at PDS can
be attributed to foundational beliefs and a mission that focuses on the customer in an effort to provide the perfect
patient experience. PDS provides shopping centers with a long term professional tenant that generates significant
traffic in the center,and the length of patient visits generates additional shopping activity by those accompanying
patients being seen.
Our success in developing new dental practice locations is a result of our ability to identify excellent sites
and construct our facilities in a timely manner. Our professional development team and in-house construction team

Re: Traffic Queue Study,Oak Park Heights, MN
Per your request, S2 Traffic Solutions, LLC has conducted a vehicle traffic queue assessment for the
proposed Donut/Coffee Shop restaurant in Oak Park Heights, MN. The proposed development would
repurpose a portion of an existing building to include 2,500 square foot restaurant with a drive-thru
lane, see attached site plan. The site is located within the Shops at Oak Park Heights shopping center,to
the south of 60th Avenue N and to the west of Norell Avenue N. To determine the vehicle queuing for
the proposed development,the trip generation potential has been estimated, and empirical queuing
data collected at 18 existing sites across the country has been reviewed. This memo summarizes the
findings.
To determine the trip generation potential for the restaurant development,S2 Traffic Solutions assumed
the Donut/Coffee Shop with Drive-Thru WWindow category, Land Use Code 937, as described by the
Institute of Transportation Engineers (ITE) in Trip Generation, 10th Edition. Table 1 summarizes the
findings.

As shown in Table 1,when fully operational the restaurant development is forecast to generate 222 trips
AM Peak hour trips distributed as 113 entering and 109 exiting trips; is forecast to generate 108 PM
Peak hour trips distributed as 54 entering and 54 exiting trips.
The Donut/Coffee Shop proponent has conducted a significant amount of research on the operations of
their facilities and has published the following drive-thru characteristics regarding their stores:
• The drive-thru beverage and food pick-up window will be located on the north side of the
building and will stacking for 12 vehicles prior to reaching the pick-up window (see attached
Figure 2).
• The targeted transaction time from when the Donut/Coffee Shop customer orders to when they
pick up their beverage and/or food is 90 seconds (assuming the drive-thru lane is backed to the

order board).This quick timeframe is accomplished, because the Donut/Coffee Shop proponent
has a more limited menu and there are fewer special-order options available than other coffee
shops and drive-thru restaurants.
• About 65%of their business is completed by 10 AM. In other words their peak business is
completed before other uses within the Shops at Oak Park Heights are open.
• 65% or more of their customers use the drive-thru.
• At least 65%of their business comes from vehicles already traveling the adjacent roads, known
as "pass-by trips", perhaps as a stop for coffee on their way to work.
As mentioned above,the proposed restaurant will generate 113 entering trips in during the morning
peak, of which 73 will use the drive-thru. 18 sites with similar square footage and trip generation were
reviewed by others in Illinois and Massachusetts, revealing the maximum recorded vehicle queue was
10 vehicles. Figure 2 illustrates there is space for at least 12 vehicles to queue without impacting the
operations on site or neighboring properties. (It is noted,there are reciprocal cross easement
agreements in place with the neighboring parcels within the Shops at Oak Park Heights, and the
customers demand associated with the proposed restaurant will peak prior to opening of the other site
shopping center uses.) It is our opinion,the site as designed will accommodate the anticipated traffic
without impacting its neighbors.
