PLANNING COMMISSION MEETING MINUTES
Thursday, September 9,2021
I. Call to Order/Pledge of Allegiance:
Chair Freeman called the meeting to order @ 6:00 p.m.
Present: Commissioners Freeman, Husby, Van Denburgh, VanDyke and White; City
Administrator Johnson, and City Planner Richards. Absent: City Councilmember Liaison
Representative Liljegren.
II. Approval of Agenda:
Commissioner Van Denburgh, seconded by Commissioner VanDyke, moved to approve the
Agenda as presented. Carried 5-0.
III. Approval of July 8,2021 Meeting Minutes:
Commissioner VanDyke, seconded by Commissioner Husby, moved to approve the Minutes
as presented. Carried 5-0.
IV. Department/Commission Liaison/Other Reports: None.
V. Visitors/Public Comment: None.
VI. Public Hearings:
A. W.A.T.E. Enterprises PUD Amendment & CUP: Review and consider request for a
Planned Unit Development Amendment and Conditional Use Permit to allow an
enclosed, outdoor storage area, North of 5520Memorial Ave., N. at Lot 3, Block 2,
Kern Center Addition on Memorial Ave.N.
City Planner Richards reviewed the August 31, 2021 Planning Report to the request
to allow an enclosed, outdoor storage area at 5570 Memorial Ave.N., for the storage
of construction equipment, building materials and finished exterior panels. Richards
provided an issue analysis and discussed the same, noting that staff recommended
approval, subject to conditions and reviewed those.
Chair Freeman invited the applicant to address the Commission.
Will Zintl— 5570 Memorial Ave. N. discussed the plan proposed for the site, timing
for its development and its use.

Brief discussion was had as to residential properties in the area of the proposed
project and the range of public hearing notice notification being 500-feet radius of
the proposal site and how those addresses are generated through Washington County
GIS.
Chair Freeman opened the public hearing at 6:13 p.m. There being no visitors to the
public hearing, Commissioner Van Denburgh, seconded by Commissioner Husby,
moved to close the public hearing. Carried 5-0.
Discussion ensued as to the temporary use of class 5 gravel surface versus requiring
curbing and pavement and with regard to the access to the site.
Commissioner White, seconded by Commissioner Van Denburgh, moved to
recommend City Council approval of the request subject to the amended conditions
of the August 31, 2021 Planning Report, specifically,that:
1. All light fixtures shall be full cut off and be consistent with Section
401.15.B.7 of the Zoning Ordinance as it relates to lighting requirements.
2. The Planning Commission approved the plan with the storage area allowed
as a Class 5 gravel surface and no curb and gutter to be required at this time.
3. The Applicant shall provide written notification of the screening fence to the
adjoining property owner to the south concurrent with the application for a
fence permit.
4. The site plan and any stockpiling of fill material shall be subject to the
review and approval of the city Engineer and Brown's Creek Watershed
District if required.
5. All tree removal shall be subject to the review of the City Arborist. If a tree
replacement plan is required, it shall be subject to City Arborist approval.
6. All conditions of the PUD Approvals granted for the subject site shall remain
in effect and shall be enforced.
Carried 5- 0.
