Mayor McComber: She reported she attended the Minnesota Mayors Association annual meeting via Zoom last week and then the NLC Transportation committee meeting. She said she had a call scheduled with the lobbyists on October 13 regarding the upcoming bonding tours. She said the House tour would be in November and the Senate tour would be in January. She did not have exact dates. She also reported the ribbon cutting for Twin Cities Orthopedics was held on October 9, and the Washington County Historical Society ribbon cutting was set for October 15. B. Councilmember Dou hey: No report. C. Councilmember Johnson: No report. D. Councilmember Liliggren: He reported the next Planning Commission meeting was set for October 14. E. Councilmember Runk: He reported the Middle St. Croix Watershed Management Organization meeting was cancelled, and the Convention and Visitor's Bureau met the previous week. F. Staff. This allows for more uniformity and accuracy for data created and used throughout the County. In Washington County currently all law enforcement agencies/departments are using the same records management system called central square or tri-tech software. This system replaced the aging software referred to as the AS-400/Alerts software a few years ago. This data sharing agreement is important for investigations, backgrounds, and police information networking. In the past we would have to get permission from the other agency for accessing their data or reports. Both entities are still governed to in force the MN Government Data Practices Act under chapter 13 and federal regulations on data privacy. Page 9 of 112 JOINT POWERS AGREEMENT BETWEEN THE WASHINGTON COUNTY SHERIFF'S OFFICE AND THE CITY OF OAK PARK HEIGHTS THIS AGREEMENT is made by and between political subdivisions organized and existing under the Constitution and laws of the State of Minnesota. Washington County a political subdivision by and through its Sheriff's Office (hereinafter"Washington County") and the City of Oak Park Heights, Minnesota, a municipal corporation, (hereinafter referred to as the "City") are the parties to this agreement. WHEREAS, Minnesota Statutes Section 471.59 provides that two or more governmental units may by Agreement jointly exercise any power common to the contracting parties. WHEREAS, Washington County and Participating Agencies (defined as all local municipalities, entities, or agencies, including City, that agree to enter into similar joint powers agreements with Washington County) create, store, and utilize law enforcement data as political subdivisions of the State of Minnesota; WHEREAS, Washington County has agreed to replace its current law enforcement records management system with an application known as Central Square (TriTech) Software Systems; WHEREAS, Participating Agencies and Washington County find it beneficial to share law enforcement data amongst themselves to enhance services to its residents, to arrange a data sharing opportunity to foster a stronger law enforcement relationship as well as to assure uniformity and accuracy of data created and used throughout the county of Washington; WHEREAS, Washington County and Participating Agencies can benefit from the Central Square (TriTech) Software Systems project and associated cost sharing and data sharing arrangements. NOW THEREFORE, pursuant to the authority contained in Minnesota Statute Section 471.59. commonly known as the Joint Powers Act which authorizes two or more governmental units to jointly exercise any power common to them and /or Minnesota Statutes Sections 626.76 and in consideration of the mutual covenant herein contain and the benefits that each party hereto shall derive hereby Washington County and City agree to the following terms and conditions: AGREEMENT CONDITIONS Washington County and Participating Agencies agree to share law enforcement data created, stored and utilized in the Central Square (TriTech) Software Systems records management system during the term of this Agreement unless otherwise subject to exclusion. Each party to this agreement will make available to each other and all Participating Agencies such law enforcement data created, stored and utilized by the parties hereto insofar to the extent distribution of such data is consistent with applicable Federal and State laws. No party shall use any data that is obtained under this Agreement for any commercial, for-profit activity or product or otherwise prohibited use. 1 Page 10 of 112 All parties to this agreement agree they will not knowingly or negligently allow its employees, agents or independent contractors to copy, sell, disclose or otherwise make the law enforcement data available to anyone who is not authorized to have access to such data. Each party agrees to immediately notify the other in writing if it becomes aware of any unauthorized data access by its employees, agents or independent contractors. The parties hereto further agree to guard against unauthorized disclosure by its own employees, agents or independent contractors by taking appropriate security measures including, but not limited to, providing physical security measures and taking all steps necessary to protect information, data or other tangible or intangible property of its own that the parties regard as confidential or nonpublic. All parties agree to comply with current U.S. Department of Justice CJIS Security Policies and the Minnesota Bureau of Criminal Apprehension CJDN Rules. All data entered into the system by the City shall remain City data; Washington County does not obtain any ownership interest in the City data except to the extent that Washington County is obligated to keep this data intact and the system secure and to regularly backup the data for redundancy and disaster recovery purposes. As between the City and Washington County the data is and shall remain the sole and exclusive property of the City. The City ensures the data submitted for addresses and parcels are accurately reflected and will amend any incorrect addresses by following appropriate process with Washington County. If this Agreement is terminated by either party, then Washington County shall maintain such data until it is ready to be securely returned to City, and thereafter shall promptly return all of City's data to City. The City shall be responsible for responding to any data practices requests related to any City Data that the City or its Permitted Users have entered into the System. The City agrees to maintain their technologies utilized to connect to Washington County at a minimum in accordance to the Washington County Technology and Security standards. TERM OF AGREEMENT The term of this Agreement shall commence upon signature by both parties or upon its execution by Washington County and all Participating Agencies, whichever occurs later. This Agreement shall remain effective until December 31, 2021. This agreement shall be renewable at the end of the current term for a successive annual term unless either party gives written notice of its intention not to renew annually before expiration of the current term. Parties shall notify in writing all parties hereto of any changes in the terms of the Agreement at least 60 days prior to the notice period for renewal or termination. PAYMENT Washington County shall calculate and invoice City for use of the system based upon a pro rata share of the County's actual costs to create, operate, and maintain the system, with said costs being calculated and invoiced on a per capita basis across all Participating Agencies based upon published population estimates each year from the U.S. Census Bureau. The City shall pay Washington County per estimated capita within 30 days of being invoiced. Washington County shall invoice the City annually or quarterly as determined by the City. Washington 2 Page 11 of 112 County shall notify City at least 45 days in advance regarding any anticipated modifications to the manner or method by which fees are calculated so that City may review and consent to the same. Washington County may increase costs each year by up to 5.0%. INDEPENDENT CONTRACTOR It will be agreed that nothing within the contract is intended or should be construed in any manner as creating or establishing the relationship of co-partners between the parties or as constituting the City as the agent, representative, or employee of Washington County for any purpose or in any manner whatsoever. ASSIGNMENT The City shall not assign any services contemplated under this agreement. INDEMNIFICATION The City agrees it will defend, indemnify and hold harmless Washington County, its officers and employees against any and all liability, loss, costs, damages, and expenses which Washington County, its officers, or employees may hereafter sustain, incur, or be required to pay arising out of the negligent or willful acts or omissions of the City in the performance of this agreement. Washington County agrees it will defend, indemnify and hold harmless the City, its officers and employees against any and all liability, loss, costs, damages, and expenses which the City, its officers, or employees may hereafter sustain, incur, or be required to pay arising out of the negligent or willful acts or omissions of Washington County in the performance of this agreement. INSURANCE REQUIREMENTS The parties agrees that in order to protect themselves, as well as the other party hereto, under the indemnity provisions set forth above, they each will at all times during the term of this Agreement, keep in force the following insurance protection in the limits specified: '1 Maintain their respective membership and participation in the League of Minnesota Cities Insurance Trust and the Minnesota Counties Intergovernmental Trust, or otherwise maintain Commercial General liability Insurance with contractual liability coverage in the amount of the City's and Washington County's tort liability limits set forth in Minnesota Statute Section 466.04 and as amended from time to time. 2. Automobile coverage in the amount of the City's and Provider's tort liability limits set forth in Minnesota Statute Section 466.04 and as amended from time to time. 3. Worker's Compensation in statutory amount. Prior to the effective date of this Agreement, the City will furnish Washington County, with certificates of insurance as proof of insurance. This provision shall be set as a condition subsequent; failure to abide by this provision shall be deemed a substantial breach of contract. 3 Page 12 of 112 Any policy obtained and maintained under this clause shall provide that it shall not be cancelled, materially changed, or not renewed without thirty days notice thereof to Washington County. DATA PRACTICES All data collected, created, received, maintained, or disseminated for any purposes by the activities of either party hereto, because of this agreement, is governed by the Minnesota Government Data Practices Act, Minnesota Statutes Chapter 13, as amended, the Minnesota Rules implementing such Act now in force or as adopted, as well as federal regulations on data privacy. TERMINATION Washington County or City may cancel this Agreement with or without cause at any time upon giving a 60 days written notice to the Washington County Sheriff or designee or the Oak Park Heights City Police Chief, City Administrator or designee. The proposed improvements to be studied generally include the removal of any existing walk/trail, and construction of a concrete walk or bituminous trail with pedestrian curb ramps at driveway and street crossings. Additionally, the City identified a possible annexation to the west of the business warehouse area known as Kern Center in the plan. This possible annexation area had also been identified in the 2008 Comprehensive Plan. Due to recent changes in area land ownership since the 2018 Plan adoption by the City, City Staff and the City Council have identified possible amendments for consideration outlined below. Generally, such amendments are necessary as more than one-half of these lands have now been annexed into Stillwater — formerly in Stillwater Township. And, that the Transportation Plan map shows a conceptual road extension based on a City annexation concept has been mis-interpreted by outside parties that the City supports a particular extension, such as found in Washington County's recent plans. The City does not support that particular extension. The City Council has asked the Planning Commission to hold a public hearing and review these minor changes to the Land Use Plan and Transportation Plan and to remove language and notations on maps regarding a possible extension. The City could certainly always consider these extensions or annexation in the future, however in the interim, such edits would better reflect known conditions and prevent further misinterpretation. PROPOSED AMENDMENTS Staff would propose the following amendments to the Comprehensive Plan. The text changes and revised map are attached. Page 24 of 112 In the Land Use Plan on page 60 remove the reference of extension of utility and street infrastructure to the west. The language discussing annexation would remain as well as the map on page 63 in that there is a small area to the west of the Oak Park Heights that could possibly be annexed. 2. In the Transportation Plan on page 102, the reference to Possible Extension of 58th Street would be removed. On page 108, the paragraph on System Improvements/Extensions would be removed. Staff has had a conversation with Jake Reilly, the Sector Representative of the Metropolitan Council regarding the amendments. He indicated that the proposed amendments would qualify for administrative review and would not need to be considered by the Metropolitan Council as a whole. Once the City Council approves a resolution authorizing the amendments, the Metropolitan Council staff will complete their review in approximately 15 days. Solar Access Protection and Alternative Energy Systems Ensuring that all properties have equal access to sunlight is a priority not only for potential solar energy systems, but for the protection of property and aesthetic values as well. Solar access protection is provided for by the uniform implementation of lot and building performance standards adopted as part of the Zoning Ordinance. Requirements such as maximum building height and yard setback standards have been implemented for creating separation between structures and allowing equal sunlight access between structures. Additionally, the City adopted alternative energy system regulations in 2010 to promote and encourage ground source heat pump, wind and solar energy systems. The map on the following page indicates the gross solar potential for Oak Park Heights. The 2040 Transportation Plan does not indicate any light rail corridors that would access Oak Park Heights or neighboring communities in the St. Croix Valley. AIRPORTS There is no impact to Oak Park Heights resulting from the Lake Elmo Airport and the City is not within the airport influence area. This matter has been discussed by many entities for decades and certainly was part of a conceptual annexation area over such timeline. Moreover, the City— like all entities bound by statute to submit a Plan, is obliged to make such note in its 2018 submission to the MET COUNCIL about its transportation systems—despite the realities that has been not much more than vague discussion. These points stated please note the following: • Unfortunately, this MAP is being mis-interpreted by outside parties that the City supports a particular extension—such as the County's recent concepts. Staff knows this to be a false conclusion by such entities and has expressed that. • Secondly, the City's 2018 Plan only contextualizes this "possible extension"from perspective that the City may consider this as part of a "future annexation" and not that it is driven by outside parties. See Figure 2 below. In discussing this matter with the City's MET COUNCIL staff rep... a simple or minor amendment with a public hearing by the Planning Commission and final City Council Resolution finding provided to the MET COUNCIL could be provided to deal with this issue. Please note the 2018 Plan generally predated the shifting of much of this land to Stillwater and so possible annexations would appear unlikely. Accordingly, in order to avoid any further confusion or misinterpretation by outside entities; Staff does recommend that this imagery representation and related discussion be deleted to prevent any other misunderstandings of what the City's expectations are to prevent outside parties from trying to define this for the City for their own purposes.This action would not bind the City to never embracing such concept, rather would prevent false narratives from continuing. The project narrative provides the following description: The applicant is requesting approval for a Site Plan/Design Guideline Review for a replacement building that will consist of phased demolition, new construction, and sitework. The applicant is also requesting approval for a Subdivision: Major to provide for a lot combination from the existing three (3) lots into one new lot. Subdivision: Maior The current property consists of three (3) parcels, PID 0502920110005, 0502920110006, and 0502920110004. The applicant is requesting to plat these three parcels into one (1) new parcel to cover the entire area in order to enable a more efficient and appealing overall development consistent with the area. Site Plan Review This 1.49-acre site and Phase 1 — 6,000 square foot building is being designed as a replacement medical office building to be used by Park Dental — St. Croix Valley to expand its services to the surrounding community. The uses within the building will include treatment rooms, lab, and ancillary support spaces. The Phase 11— 3,000 square foot expansion is being planned for a potential expansion for a symbiotic co-tenant which may include complementary medical, office or retail users. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The proposed use is consistent with this land use designation. 2 Page 49 of 112 Zoning. The property is zoned B-4 Limited Business District. The use of the site for a medical clinic, office space or retail use is permitted in this district. Design Guideline and Site Plan review for the application is in a following section of this report. Preliminary/Final Plat. The Applicant has provided a Preliminary and f=inal Plat for review. The Subdivision Ordinance does not allow lot combinations of more than two lots by administrative review. The lot combination as requested for Park Dental requires a public hearing and review by the Planning Commission and City Council. The Preliminary and Final Plat comply with all subdivision requirements but are subject to review by the City Engineer and City Attorney for easements and other requirements. Site Plan. The existing site contains three buildings, all will be removed for the construction of the one building for Park Dental. The existing dental building will remain open during construction and will be removed after the new building is open for business. The two access points to 60th Street North will be reduced to one at the east side of the site. Parking for the building will be at the rear, with primary customer and employee access into the south elevation of the building. Green space and landscaping will be provided at the front of the building adjacent to 60th Street North. Setbacks. The building and parking areas are compliant with all setback requirements. Traffic Circulation/Curb Cuts. As indicated there will be one access point from 60th Steet North. The access shall be subject to approval of MnDOT. The rear parking lot is constructed with landscape islands and landscaping. The plan has been reviewed by the Fire Chief for emergency vehicle access. He has expressed concern related to turning radius for the ladder truck and is working with the Applicant to resolve any issues. The final site plan shall be subject to the review and approval of the Fire Chief for emergency vehicle access. Snow Storage. The plans do not indicate an area for snow storage. The Applicant shall indicate where the snow is to be stored. Parking. The following table provides an analysis of proposed and required parking spaces: Parking Area Required Requirements Spaces 1 per 200 SF. + 3 9,000 SF x .9 = 8100 SF 1200 + 3 44 Per ordinance, the site would require 44 parking spaces. The proposed site plan indicates a total of 66 spaces of which three are ADA compliant stalls and are appropriate for this dental clinic. 3 Page 50 of 112 Landscaping. The submitted landscape plan is subject to City Arborist review and approval. Note the comments that have been made by the City Arborist in Exhibit 25. A tree inventory of existing significant trees and tree protection plan will be required. Lighting. The lighting plan indicates the locations of the parking lot light fixtures. The lighting specifications indicate that the fixtures to be used in the parking lot will be full cut off and LED. The plans do not indicate any wall mounted building fixtures. The lighting regulations limit the height from ground level to the top of the fixture at 25 feet. All light fixtures shall be required to be full cut off, compliant with the height requirements, and be consistent with Section 401.15.13.7 of the Zoning Ordinance as it relates to lighting requirements. A photometric plan has been provided that complies with the Ordinance. Trash Storage. The plans indicate a trash enclosure at the rear of the building in the parking lot. Plans for the enclosure indicate the use of brick with a corrugated metal panel gate. Mechanical Screening. Any exterior mechanical equipment, either on the roof or ground mounted will need to be screened in accordance with Section 401.15.E.10.e. of the Zoning Ordinance. The plans indicate that the roof mounted mechanical equipment will be screened with a corrugated metal screen wall. Grading, Drainage, Erosion Control and Utilities. Grading, drainage, erosion control, and utility plans are subject to review and approval by the City Engineer. The City Engineer has provided comments in a separate report that is found as Exhibit 24. Storm water issues are also subject to review and approval by the Middle St. Croix Watershed Management Organization. Signage. Freestanding Sign. The glans do not indicate a freestanding sign for the site. Wall Signage. For Phase I, the Applicant has proposed two wall signs, one on the north and the second on the south facade. The signs are 58 square feet each. Section 401.15.G.9 of the sign regulations specify the allowances for multiple occupancy buildings. The proposed sign sizes are consistent with the regulations. For Phase II, the Applicant has shown four signs, each 48 square feet for two potential tenants. The proposed signs are within the allowances for multiple occupancy buildings. Sign Illumination. The proposed plans do not indicate how the signs will be lit. Additional detail is required to review how the signs will be illuminated. The signs will be required to comply with the Zoning Ordinance lighting requirements. Staff will approve the lighting specifications for the signs at the time of permitting. 4 Page 51 of 112 Design Guidelines Architectural Guidelines. Facade Treatments The building will be required to have a definite base, middle and top at its front, side and rear facades. The facades have significant visual interest with a mix of brick colors, building materials, and roof lines. Ground Level Expression This is a one-story building with a prominent entrance from the rear parking lot. The front of the building that will be viewed from Highway 36 has the same materials and visual interest as the rear. The height of the building is less than the 35-foot maximum requirement. Transparency The building uses glass on each fagade. The transparency requirements are met with this building design. Entries The building features a prominent entry with a metal canopy and glass. Roof Design The building has a flat roof but with varying roof heights. The rooftop mechanical equipment will be completely screened with a corrugated metal screen wall. Building Materials and Colors The applicant has provided a building materials board for Planning Commission review. The building will be a combination of three colors of brick, metal panels, and glass. Franchise Architecture The building is not a franchise design. Site Design Guidelines Buildina Placement The proposed building has a well-defined entrance to the rear and attractive front which is visible from Highway 36. Plant Schedule The plant schedule (L1-1) shows a good choice of species diversity with some native or improved cultivars of native plants. Most of the trees and plants chosen are hardy under local growing conditions, relatively insect and disease free and fairly low maintenance. The recommendations and edits I have for this plan sheet are listed below: 1. 1 would like to recommend not planting the Gro-low fragrant sumac since it can be difficult to control as it is a plant that spreads. Please recall,the City initially committed to perform this from the pre-2012 roadway reclaim project undertaken by MNDOT of this area. This was extended again in about 2017 with the City— MNDOT settlement of Bridge costs. It is difficult to estimate the specific costs of this to the City,however in rough terms—based on the fact that it's a priority route,generally three lanes wide and consumes additional sand/salt, such roadway area adds perhaps $5,000 to $7,000 annually to the City costs.This however also better ensures that it is accomplished in a more-timely matter versus if it was MNDOT route—although that too is a bit of speculation. Lastly,MNDOT has indicated that they view this as a local-City contribution for MNDOT/COUNTY proposed re-alignment of the 60th Street frontage road behind the Carbone's building. If the City would like to consider this,MNDOT does ask the City to adopt the enclosed resolution and approve the Agreement. SStaff would expect some minor final ad ustments with MNDOT in the Agreement,but would not alter any scope or intention of this action. Page 103 of 112 STATE OF MINNESOTA DEPARTMENT OF TRANSPORTATION And CITY OF OAK PARK HEIGHTS MAINTENANCE AGREEMENT Control Section (C.S.): 8214 Trunk Highway Number(T.H.): 36 This Agreement is between the State of Minnesota, acting through its Commissioner of Transportation ("State") and the City of Oak Park Height acting through its City Council ("City"). Recitals 1. The City will perform snow and ice maintenance upon, along, and adjacent to Trunk Highway No. 36 on the south frontage road (60'Street) from 1200 feet east of Norell Avenue to Osgood Avenue; and 2. The State and City entered into Agreement No. 92834 ("Original Agreement"). The Original Agreement defines the party's respective obligations to maintain the South Frontage Road along Trunk Highway No. 36 within and adjacent to the Oak Park Heights city limits; and expired in 2018; and 3. The State and City entered into an agreement amendment identified as MnDOT Contract No. 92834-1 (Amendment#1), in which the parties agreed to an extension of the Original Agreement through May 21, 2021; and 4. Minnesota Statutes § 161.20, subdivision 2 authorizes the Commissioner of Transportation to make arrangements with and cooperate with any governmental authority for the purposes of constructing, maintaining, and improving the trunk highway system.
