St. Paul, MN 55075 Ref: 6174 Beach Road N. Dear Mr. Gabraway: This letter is in regards to your installation of two garage doors for Mr. Bouchie at his home located at 6174 Beach Rd. N. in the City of Oak Park Heights. Mr. Bouchie contacted me to do a site investigation of the installation of these doors. It is my understanding that Mr. Bouchie has contacted you to inform you that one door will not open, and I can confirm that it does not. This letter to inform you a building permit is required when making any structural change to a building and that the work you did destroyed the structural integrity of five 2 X 4 roof rafters and the structural integrity of a ceiling /rafter tie in two different locations. In addition, beginning January 1, 1993, by state statue, all residential automatic garage door opening system must include an edge sensor, safety beam, or similar device, and you did not install this safety device. I am directing you to make an application for a building permit no later than June 30, 2009, with the corrections to this structure completed no later than July 15, 2009. With the application, you are to submit a repair plan from a Minnesota State Licensed Structural Engineer. If I do not receive the requested information by June 30, I will assume that you have no intention to comply, and I will be left with no alternative but to commence enforcement through legal remedy as prescribed by City Ordinance for misdemeanor violations. For your convenience, I have enclosed a building permit application. Please fill out the high-lighted sections. The 2007 Minnesota State Building Code Automatic garage door opening systems 325F.82—325F.83 325F.82 Definitions. Subdivision 1. Scope. For the purposes of section 325F.83,the terms defined in this section have the meanings given them. Subd.2. Automatic garage door opening system. "Automatic garage door opening system"means a system of devices and equipment that,when connected to a garage door, automatically opens and closes a garage door. Subd. 3. Garage. "Garage"means a building, or a portion of a building, designed or used for the storage, repair, or keeping of a motor vehicle. Subd.4. Residential building. "Residential building"means a building such as a home or apartment for one or more families or persons that includes an attached or unattached garage. Subd. 5. Automatic reversing requirement. "Automatic reversing requirement"means the requirements specified in paragraphs 30.1 and 30.2 of Underwriters Laboratories, Inc., Standards for Safety-UL 325,third edition, as revised May 4, 1988, for a residential automatic garage door opening system or the requirements specified in paragraph 29.1 of Underwriters Laboratories, Inc., Standards for Safety-UL 325, third edition, as revised May 4, 1988, for a commercial vehicular door operator.
