No new applications have been received. 2. The owners of the former Bus Garage site is currently without an active or valid Conditional Use permit for use as a trucking-type facility.This was vacated by the owners when they sought to have this be the bus garage for the District.There have been some semis and another activity at the site and we have reminded the Owner that this is not-permitted until a new CUP is approved.Accordingly,we anticipate an application soon. 3. As there has not been successful code compliance achieved by the owner of the former McCormick's site-Staff has asked that the Clty Attorney provide a final warning communication. Please see the enclosed. COVID-19 Matters: • This is the Governor's- PORTAL https://mn.gov/covidl9- Many documents/ Exec. Orders can be found. We write regarding the condition of your property at 13435 60th Street N., the vacant former site of the McCormick's Furniture store. City staff has sent you prior written requests in June and July 2021 to remediate the condition of your property. Multiple items remain unacceptable, including the following: 1. Badly leaning light poles in the parking lot need to be fixed or removed; 2. Sign is falling apart and needs to be repaired; 3. Remnants of signage wording "McCormick" on the building need to be removed or painted over to make them not visible. Your property was previously declared noncompliant with City Code and a public nuisance under Ordinance 1109.01(D) and 1109.03. Your refusal to remedy the condition has necessitated my office's involvement in the matter. If you do not remedy these conditions within the next 30 days, on or before March 11,2022, then we will proceed with a civil code enforcement lawsuit against you, seeking an order of the Court holding you in violation, commanding your compliance, and/or permitting the City to retain contractors to enter upon the property to conduct the necessary remediation, and billing all such costs back to you and assessing them against the property, including additions for administrative oversight costs by the City and all court costs and attorneys' fees incurred by the City. We would note that the billing appears to be in conflict the Fire Services Agreement and previous invoicing from the BASE YEAR(S)and past practices, We noted similar concerns in past years.As stated previously-Bayport may not simply delete or edit Fire Aids from the Budget at its sole discretion and/or shift these costs to the other parties.The formula worked as designed in 2015, 2016,2017 and 2018 and the Budget included these credits and years of invoicing denotes this practice and understandings when this was undertaken in 2015. At this time, the City has calculated a 3% increase over 2021 to the correct Base Amount & Percentage and has supplied that amount herewith (1st Qtr.) based upon a budget of $525,818.67 which then calculates to a quarterly payment of $69,607,89. That said, i would offer that the City is willing to discuss options on how to address this continuing discrepancy, but we would ask that all parties also revisit the historical practice and perhaps Bayport outlines how this could be discussed in an impartial setting--such as with a mediator of some form—although perhaps not that formal... but as a place to begin Thank you, 441— PLEASE NOTE: Eric Johnson As in previous years, the City has paid the Fair Share City Administrator Bond Amount of$92,821.48.
