The provisions are contained in the 1989 Property Tax Bill recently passed by the State Legislature in Special Session and signed into law by the Governor. The 1989 Tax Bill contains basically the same procedures for Truth in Taxation for payable 1990 that were outlined in the Commissioner of Revenue's letters mailed on June 23, July 28, and August 25. The schedule of events for Truth in Taxation for payable 1990 had to be changed because the Departments of Education and Revenue are required to recertify state aids and levy limitations under the new state property tax relief plan. The revised schedule of events is listed below: 1. October 23 Last day for the Department of Revenue to recertify aids and levy limitations. 2. October 27 Last day for the Department of Education to recertify levy limitations. 3. November 15 Last day for a taxing authority to certify its proposed tax levy. 4. December 28 Last day for a taxing authority to certify its final tax levy. The counties will select meeting dates first. School districts will select meeting dates next and cities will select after the school districts. The county auditors will coordinate the scheduling to avoid conflicting meeting dates. The information previously sent to you regarding the format of the meeting notice and other procedures remains unchanged. Taxing authorities which have already certified a proposed levy and whose levy will change as a result of provisions in the new tax law are to recertify their proposed levy. If a public hearing has already been held, the taxing authority is required to certify a new tax levy, publish a new notice, and hold another public hearing. Tech Re: Proposed and Final Levies Enclosed you will find forms to be used in certifying your proposed and final property tax levies. Please note that the deadline for certifying proposed levies to the County Auditor is November 15. The deadline for certifying final levies to the County Auditor is December 28. If you have already submitted a proposed levy to this office and do not need to make changes in it due to provisions of the new tax bill, we will use that levy. If you do need to make changes, please mark "Amended" on the new levy. In regard to the reduction /elimination of state aids, the Depart- ment of Revenue will certify to this office the amount of aid lost by each city /town and that amount will be added to your certified levy. If you do not want the entire amount of lost aid added to your certified levy, you must notify us. The tax bill establishes new dates for certifying your budgets and holding public hearings. If you have already certified your proposed levy, then do not publish the notice of your public hearing. If the notice has been sent to the newspaper but not yet published, contact the newspaper and cancel the publication of notice. If the notice of your public hearing has already been published, then you must hold the public hearing. However, do not adopt your final levy at the public hearing. At this time, the 1989 Tax Bill changes for this year only the October 1 deadline for certifying proposed levies to mid - November. In addition, this changes the November 9 deadline for certifying final levies to December 28. The "compromise" tax bill, in effect, negates all of our previous actions required by the Department of Revenue Guidelines issued July 28, 1989. The process now being considered would require all public budget hearings to be conducted between November 15th and December 28th with December 28th being the date of final levy certification to the County Auditor. After we have final legislation, we will allow a reasonable length of time to secure Department of Revenue evaluation and interpretation of legislative intent and issue guidelines to County Auditors. Stafford, i.VN store County Auditor- Treasurer SUBJECT: FUTURE TAX LEGISLATION Many of us have to be just as concerned about h9A to implement Legislation as the lawmakers must be about why• e.g... 1. We have been working with House and Senate Staff in an effort to streamline many parts of our new tax laws. One suggestion that could benefit from your support is that we do away with this cumbersome exercise of coordinating Public Budget Hearings and designate certain weeks of a given month or months for each level of Government to conduct their meetings. 2. It would be very helpful to our advisory efforts in the next session of the Legislature if'we had data dealing with attendance at the 1989 Public Budget Meetings. If there is any way you can "count noses" and let me know, it would be appreciated very much. In closing, I would like to remind you of your invitation to participate in "Capitol for a Day" at Washington County on October 27th. The provisions are contained in the 1989 Property Tax Bill recently passed by the State Legislature in Special Session and signed into law by the Governor. The 1989 Tax Bill contains basically the same procedures for Truth in Taxation for payable 1990 that were outlined in the Commissioner of Revenue's letters mailed on June 23, July 28, and August 25. The schedule of events for Truth in Taxation for payable 1990 had to be changed because the Departments of Education and Revenue are required to recertify state aids and levy limitations under the new state property tax relief plan. The revised schedule of events is listed below: 1. October 23 Last day for the Department of Revenue to recertify aids and levy limitations. 2. October 27 Last day for the Department of Education to recertify levy limitations. 3. November 15 Last day for a taxing authority to certify its proposed tax levy. 4. December 28 Last day for a taxing authority to certify its final tax levy. The tax bill establishes new dates for certifying your budgets and holding public hearings. If you have already certified your proposed levy, then do not publish the notice of your public hearing. If the notice has been sent to the newspaper but not yet published, contact the newspaper and cancel the publication of the notice. If the notice of your public hearing has already been published, then you must hold the public hearing. However, do not adopt your final levy at the public hearing. At this time, the 1989 Tax Bill changes for this year only the October 1 deadline for certifying proposed levies to mid - November. The organization of the notice is calculated to bring attention to the issue of greatest impor- tance to property owners -- whether or not there will be an increase or decrease in the amount of property tax to be collected. The tone is intended to be informal and friendly, and to communicate that you genuinely want the public to attend the hearing. The Department of Revenue is now eliminating a portion of those instructions which concerned the selection of newspapers in which to publish budget and /or levy hearing notices, and it is replacing another portion. The following instructions requiring publication of a notice announcing the reconvening of a recessed meeting are eliminated: for counties: paragraph 20, sections h and i for school districts: paragraph 6, sections g and h for cities with populations over 2,500: paragraph 14, sections g and h The instructions establishing criteria for selection of a newspaper or newspapers in which to publish notice of budget and /or levy hearings are replaced with the instructions given below. Since counties theoretically must notify every citizen in the county and school districts must notify every citizen in the school district, and since counties and school districts often cover large geographic areas, the new instructions may require local governments outside the Twin Cities area to publish the notice in more than one newspaper.
