Mayor McComber: Mayor McComber reported that the two bills HF- 2695/Sla-2157 and HF-2698/SF-2156 were ready to go when the legislature started; she attended the Women in Municipal Government meeting on January 21 and the Small Cities legislative agenda meeting on January 25; she would be attending the Coalition of Utility Cities meeting, a Metropolitan Council meeting on affordable housing, the NLC transportation meeting, a LMC regional meeting in Oakdale, the Advanced Leadership Conference, and the Regional Council of Mayors meeting. She reported that LMC cancelled the "Day on the Hill," the Minnesota Association of Small Cities legislative reception was cancelled, and the NLC Conference in Washington would be in-person with no virtual option. B. Councilmember Dougherty: He reported he attended the Parks and Trails Commission meeting on January 24 and there were vacancies on the Commission, they postponed their annual election of officers, and they discussed the Swager Park playground equipment and the Summer Park Program Coordinator position. Stillwater Mountain Bike Team Championship—Sign_Presentation: Councilmember Johnson presented the team with a new sign and a 2021 sign rider. Traffic Calming on 58h Street: Mayor McComber reported that she received an email from High School student Alexis Schmitz proposing that the City consider a speed radar sign on the speed limit sign on 58`" Street. Chief Hansen reported he was concerned about traffic congestion on 58�h Street with the upcoming Norell Avenue and.Highway 36 construction. He said he was looking at options for safety during that time. Councilmember Liljegren, seconded by Councilmember Johnson, moved to direct Chief Hansen, Public Works Director Kegley, and Ms. Schmitz to Page 7 of 42 City Council Meeting Minutes January 25, 2022 Page 3 of 3 meet to discuss options and bring the item back to the City Council. Other Council Items or Announcements- City Administrator Johnson provided the City Council with a memo outlining concerns and Statutes related to remote public meetings. The City Council discussed the provisions of the two Statutes and the desire to meet virtually until COVID numbers recede. The City Council discussed the upcoming scheduled worksessions and decided it was best to cancel those and reschedule at a future date when it was feasible to meet in person. Councilmember Johnson, seconded by Councilmember LiIjegren, moved that it was practical and prudent that all public meetings for the next 30 days be held remotely and that all worksessions scheduled in February be postponed. The NLC City Summit is compliant and consistent with the City's policy(attached) as it is an annual conference for local government officials to learn about what other cities are doing,interact with other local leaders from around the country and participate in policy discussions that provide direction to the NLC. The NLC is non-partisan and works to support the benefit cities across the nation. Information on the City Summit can be found at https:Hcitysummit.nlc.org/ Page 15 of 42 0 CITY OF OAK PARK HEIGHTS POLICY ON FUNDING FOR TRAVEL, CONFERNCES AND SCHOOLS FOR ELECTED OFFICIALS Purpose: The City of Oak Park Heights recognizes that its elected officials may receive value from traveling for workshops, conferences, events and other assignments outside of the City. This policy sets forth the conditions under which travel, conferences and schools will be reimbursed(or paid directly)by the City. It is the further intention of this Policy to comply with Minnesota Statute 471.661. At the time of the creation of the City's Annual Budget and as resources permit, the Council may identify and allocate a total amount to Fund 9101-40100-203(1)as it deems reasonable to accomplish the purposes of this Policy for the forthcoming year. 2. If funds are allocated in the budget process, the Fund may then be utilized for the following"in-State"purposes without further Council action and in the following order of priority as funds permit: a. The Fund shall be first utilized for the attendance of any City elected official to the League of Minnesota Cities(LMC)Annual Conference and its related travel and lodging expenses. b. the Fund shall also provide the Office of the Mayor resources for attendance to the Minnesota Mayor's Association Annual Conference including its related travel and lodging expenses. Page 16 of 42 c. The Fund shall cover the related travel, registration and expenses of LMC Newly Elected Officials Training for any newly elected officials, (within the first 12 months in office). d. Metro area meetings (such as those held by the LMC, METRO CITIES, MAOSC and the Coalition of Utility Cities; including but not limited to their related policy development and adoption meetings, Experienced Elected Officials Training or other general training these groups may offer) where overnight accommodations are not necessary. 3. In order to expend any other amounts from this Fund (or any other fund); the event, workshop, conference or assignment(in or out-of-State) must be approved in advance by a majority of the City Council at an open meeting and must include an estimate of the costs including the event, travel and /or lodging. In evaluating the request, the Council will consider the following: • Whether the elected official will be receiving training on issues relevant to the City or to his or her role as the Mayor or as a council member; • Whether the elected official will be meeting and networking with other elected officials to exchange ideas on topics of relevance to the City or on the official roles of local elected officials. • Whether the elected official will be viewing a city facility or function that is similar in nature to one that is currently operating at, or under consideration by the City where the purpose for the trip is to study the facility or function to bring back ideas for the consideration of the full council. • Whether the elected official has been specifically assigned by the Council to testify on behalf of the city or to otherwise meet with elected state or elected federal officials on behalf of the city. • Whether the city has sufficient funding available in the budgeted Fund to pay the cost of the trip. If the budgeted Fund does not have resources, the Council will be required to identify and approve an alternative funding source. 4. No reimbursements will be made for attendance at events sponsored by or affiliated with political parties. 5. The City may make payments in advance for airfare, lodging and registration if necessary. Otherwise all payments will be made as reimbursements to the elected official. 6. Use of the most cost-efficient mode of travel available, taking into consideration reasonable time constraints, is required. 7. Airfare will be reimbursed at the coach rate. Page 17 of 42 8. Mileage will be reimbursed at the IRS rate. If two or more council members travel together by car, only the driver will receive reimbursement. The City will reimburse for the cost of renting an automobile if necessary, to conduct city business. 9. Lodging and meal costs are limited to those which are reasonable and necessary. 10. Receipts are required for lodging, airfare, and meals and should accompany an expense report form. It is not necessary to have receipts for cabs and tips. The expense report form shall be submitted to the City Clerk(or Finance Department) for payment within 30 days after the event. 11. The City will not reimburse for alcoholic beverages, personal telephone calls, costs associated with the attendance of a family member,rental of luxury vehicles, separate meal expenses when otherwise included in the cost of registration, or recreational expenses such as golf or tennis. 12. Elected officials are encouraged to give oral or written reports on the results of the trip /event at the next Council meeting and are encouraged to collect and share reasonable materials received to the balance of the Council. 13. The City Council may make exceptions to the policy as deemed reasonable and necessary by a majority of the City Council. They claim incorrectly that these basic regulatory functions are prohibiting the building of more affordable housing stock, when market factors such as labor costs, land, and materials are largely creating market challenges we see today. For example, this is particularly obvious in Greater Minnesota cities and can also be seen in metro data indicating that 84% of metro cities have zoning districts that allow residential property to be built on a 1/4-acre lot or less. Accordingly,the League of Minnesota Cities has a model resolution supporting the authority of local elected officials and city staff to make land use decisions in their community and is seeking City Councils to adopt the resolution (attached) and forward it to their local legislators. The 800 Mhz system allows for enhanced radio communication, being able to track each individual portable and vehicle radio by ID and user to allow for accountability at emergency scenes. One of the issues with the 800 Mhz radio system is that it is unable to penetrate some buildings due to their construction and/or ability for one of the radio towers to connect to the portable radio 2020 Minnesota State Fire Code (MSFC) Appendix P enables local agencies to require the review of radio coverage in existing and new buildings and require the building owners to add appropriate devices such as repeaters, additional antennas, etc., to provide adequate emergency responder coverage within the building. The requirement would be applied to new construction and specific permitted reconstruction/remodel/alteration of commercial and institutional buildings. There is hereby adopted by the City of Oak Park Heights for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code and standards known as the Uniform Fire Code, including Appendix Chapters 1-A, 1-B, 11C, 1V-A, V-A,V1-D P-and the Uniform Fire Code Standards as published by the International Fire Code Institute, being particularly the 1991 Edition thereof and the whole thereof, and all amendments and changes thereto adopted by the Minnesota Commissioner of Public Safety through the Division of the State Fire Marshal and set forth in Minnesota State Rules and Regulations of the Department of Public Safety, Fire Marshal Division, Chapter 7511, save and except such portions as are hereafter deleted, modified, or amended by this Ordinance. One copy of this code and the standards prescribed pursuant thereto must be and are now filed in the Office of the City Clerk in and for the City of Oak Park Heights, and the same are hereby adopted and incorporated as fully as if set forth at length herein, and from the date an whiehon which this Ordinance shall take effect,the provisions thereof shall be controlling within the limits of the City of Oak Park Heights. 1115.02 Definitions. "Jurisdiction" means the City of Oak Park Heights. 1115.03 Establishment and Duties of a Bureau of Fire Prevention. A. The Uniform Fire Code shall be enforced by the Bureau of Fire Prevention in the Fire Department of the Bayport Volunteer Fire Department which is hereby established and which shall be operated under the supervision of the Chief of that fire department. B. The Chief(or Marshal) in charge of the Bureau of Fire Prevention shall be appointed by the Bayport Volunteer Fire Department on the basis of established procedures. Page 24 of 42 C. The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be required or necessary. The Chief of the Fire Department shall recommend to the Bayport Volunteer Fire Department the employment of technical inspectors who, when authorization is made, shall be selected through an examination to determine their fitness for the position. The examination shall be open to members and non-members of the Fire Department and appointments made after examination shall be for an indefinite term with removal only for cause. 1115.04 Appeals. Whenever the Chief disapproves an application or refuses to grant a permit applied for, or when it is claimed that the provisions of the Code do not apply or that the true intent of the Code does not apply or has been misconstrued or has been wrongly interpreted, the applicant may appeal from the decision of the Chief of the fire department to the City of Oak Park Heights within thirty (30)days of the date of the decision appealed. 1115.05 New Construction and Renovation. All plans and specifications for new commercial construction and renovation of commercial or public buildings shall be submitted to and reviewed by the Fire Department and the fire prevention officer prior to the issuance of the building permit. 1115.050 Indoor and outdoor storage of fireworks and related products. There shall be regulated within the City of Oak Park Heights the storage for sale or other purposes, of fireworks, and toy pistols,toy guns in which paper caps containing 25/100 grains or less of explosive material are used and toy caps which contain less than 20/100 grains of explosive mixture,wire or wood sparklers of not more than 100 grams of mixture per item, other sparkling items which are non-explosive and non- aerial and containing 75 grams or less of chemical mixture per tube, or a total of 200 grams or less from multiple tubes, snakes, glowworms, smoke devices or trick noisemakers which include paper streamers, parry poppers, string poppers, snappers, and drop pops, each containing not more than 25/100 grains of explosive mixture. The storage of each or any of these materials outside of the principal structure located upon the lot upon which the storage is occurring, shall be permitted subject to the following regulations: 1. All such materials must be located at least 100 feet from the principal structure on the lot. 2. The area in which the storage of these items occur shall be prominently posted"No Smoking." 3. There shall be no parking of motor vehicles within 25 feet of the structure containing these items. 2 Page 25 of 42 4. There shall be a minimum of two fire extinguishers present within the storage area in which these items are kept. 5. The storage area shall adhere to applicable Minnesota Fire Codes and NFPA Codes. 6. The property owner shall provide a listing of the items to be stored within the area,together with a site plan,to the Fire Code Official with the City of Oak Park Heights prior to implementing the storage on the site and shall obtain a permit for the storage of these items for which there shall be no charge. The above-referenced items may be stored within the principal structure located upon the lot provided that the principal structure is fully sprinkled pursuant to the city ordinances for Fire Suppression Systems, and: 1. The material shall not be located in the building within one hundred (100)feet of any combustible liquid fuel dispensing or storage facility. 2. The principal structure and the storage of the items within same shall adhere fully to the Minnesota Uniform Fire Codes and the NFPA Codes. 3. The property owner shall file a site plan with Building and Fire Code Officials for the City of Oak Park Heights identifying the place of storage of such materials and shall receive a permit therefor,for which there shall be no charge. 1115.06 Penalty. Any person violating the provisions of this Ordinance shall be guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine not to exceed Seven Hundred Dollars($700.00)or imprisonment for a period not to exceed ninety (90) days, or both. The Parks and Trails Commission reviewed the applications, made a recommendation for interviews, and held those interviews at their January 24, 2022 Commission meeting. The Parks and Trails Commission ultimately took action to recommend to the City Council that Annie Catherine Berres be offered the contracted position of Summer Park Program Coordinator for 2022. Ms. Berres is an Oak Park Heights resident with a background in early childhood education and currently works as a teacher at Dodge Nature Preschool. She has attended many of the previous park programs and plans to incorporate those types of events into her plan, along with some nature-based events. The Parks and Trails Commission has had an opportunity to get to know Annie as she has been on the Parks and Trails Commission since August 2021 and felt she was a great fit for the position. Such increases would move the City's total costs for 2022 from$223,122 to$225,290.
