PERMANENT PUBLIC UTILITY AND DRAINAGE EASEMENT
THIS AGREEMENT,made this 1Z day of 1)C144\64421,by and between Roy E.Crist&Randee
L.Tuma-Crist,the Grantor;and the City of Oak Park Heights,a municipal corporation under the laws of the State of
Minnesota,Grantee;
WITNESSETH,that the said Grantor,hereby grants and warrants to said Grantee,its successors and
assigns,a permanent easement for public utility and drainage purposes,and for ingress and egress at any and all
times with all machinery,equipment and materials necessary for the aforesaid purpose,in,over,and upon the
following described property owned by Grantor and situated in Washington County,Minnesota:
A perpetual easement for public Drainage and Utility purposes over,under and across the west 5.00 feet of
the following described property:
All that part of Lots 4,5 and 6,lying West of South Avenue;the Easterly 38.69 feet of Lots 15,16 and 17;the
vacated alley between said Lots 4,5 and 6 and Lots 15, 16 and 17;all in Block 20,ELFELTS ADDITION TO OAK
PARK,Except Parcel 5 of Washington County Highway Right of Way Plat No. 177 C.S.A.H.23,Washington
County,Minnesota.
TO HAVE AND HOLD said Easement unto said Grantee and its assigns. The Grantor hereby warrants the
title to the easement properties and will defend such title against the lawful claims of all persons.
