PLANNING COMMISSION MEETING MINUTES
Thursday,November 18,2021
Call to Order/Pledge of Allegiance:
Chair Freeman called the meeting to order @ 6:00 p.m.
Present: Commissioners Freeman, Husby, VanDyke and White; City Administrator
Johnson, City Planner Richards, and City Councilmember Liaison Representative Liljegren.
Absent: Commissioner Van Denburgh
II. Approval of Agenda:
Commissioner VanDyke, seconded by Commissioner White, moved to approve the Agenda
as presented. Carried 4-0.
III. Approval of October 14, 2021 Meeting Minutes:
Commissioner White, seconded by Commissioner VanDyke, moved to approve the Minutes
as presented. Carried 4-0.
IV. Department/Commission Liaison/Other Reports:
City Councilmember Liaison Liljegren noted that the next City Council meeting is
scheduled for November 23,2021. Chair Freeman noted that the A.S. King Advisory Panel
met November 17t. He and City Administrator Johnson provided an update to the Panel's
activities.
V. Visitors/Public Comment: None.
VI. Public Hearings:
A. LCI Landscapes Land Reclamation & Grading CUP: Review and consider request
for a Conditional Use Permit for Land Reclamation & Grading per City Ordinance
308.08 with regard to proposed rear-yard landscaping at 5675 Newell Circle N.
City Planner Richards reviewed the November 10, 2021 Planning Report to the
request, provided an issue analysis and discussed the same. Richards stated that staff
recommends approval, subject to the conditions noted within the planning report.
Chair Freeman invited the applicant to address the Commission. The applicant, Tim
O'Connor representing LCI Landscapes was present and stated that he had nothing
to add and made himself available for questions.

Chair Freeman opened the public hearing at 6:08 p.m. and invited public comment.
There being no visitors to the public hearing, Commissioner VanDyke, seconded by
Commissioner Husby,moved to close the public hearing. Carried 4-0.
Discussion was had as to the City Ordinance provisions regarding the land
reclamation and easement requirement, City Engineer recommendation regarding
placement of the proposed boulder retaining wall no closer than three feet from the
rear property line and whether or not there were any potential drainage problems that
might arise in the future as a result of the wall placement.
Commissioner Husby, seconded by Commissioner VanDyke, moved to recommend
City Council approval of the request subject to the amended conditions of the
October 6, 2021 Planning Report, specifically,that:
1. The Owner and Applicant shall comply with all provisions of Chapter 308 of the
City Code.
2. All conditions of the City Engineer's letter dated November 9, 2021, shall be
complied with, including placement of the boulder wall no closer than three feet
from the rear property line.
3. The Owner acknowledges that their project encroaches into existing public
drainage and utility easements and Owner is fully responsible for any damages,
repairs or encumbrances impacting such areas should these unreasonably
interfere with such easements. Further,the Owner acknowledges that the City is
not responsible for any damages or repairs to the Owner's improvements should
the City need to perform any maintenance or other actions deemed necessary for
public drainage or utility purposes in such areas.
4. The Owner and Applicant may not install underground stormwater piping
connecting eaves or roof downspouts to a point of discharge below the top grade
of the proposed rock wall. All stormwater structures and piping(including
downspouts) form such roof areas must be above grade, ensuring continued
overland drainage.
Carried 4-0.
VII. New Business:
A. 2022 Meeting Calendar& Commission Representative Schedule:
Commissioner White, seconded by Commissioner VanDyke moved to approve
the schedule as presented. Carried 4-0.
