No new applications have been received for the April Planning Commission meeting date. 2. The City continues to pursue final agreements with MNDOT for the Norell Project.This however also includes finalizing commitments and permits with the BCWD.The Clty is required to document—amongst other things—the City land rights to the BCWD.See enclosed letter doing so.On a related note,staff did meet with the local WAL MART manager to bring him up to speed on the upcoming project;we reached out to him as we unfortunately expected him to know nothing of the project—we were correct and did provide him layout map and timeline—he was appreciative. 3. One code enforcement letter related to pool repairs and its nuisance condition is enclosed. 4. The Park Dental Group related to their proposed redevelopment of that site,mistakenly believed they had permissions from the MSCWMO to install an INFILTRATION BASIN to deal with their storm water. MSCWMO never stated as such-as this final decision comes from the City.The City is responsible for aquifer protection.Unfortunately,after MSCWMO review,Park Dental engineers did NOT loop back with the City in a timely fashion to check this and are now surprised that the City would not allow this as final permitting is close.Storm water rules and process are well known—or should be-by their consultants.Please see the STANTEC letter enclosed related to infiltration ponds in the DWSMA as proposed and why it is not recommended nor permitted.This was also conveyed to Park Dental in the Sept 2021 plan review and is part of the issued P.U.D. PERMIT. All this said,staff will be meeting with them next week to see how or if they can convert their infiltration basin to a filtration basin. COVID-19 Matters: • This is the Governor's-PORTAL https://mn.gov/covidl9—Many documents/Exec.Orders can be found. Washington County has initiated a County Dashboard containing more localized COVID-19 Impacts and rates LINK->>HERE. Oak Park Heights, MN 55082 Re: Above Ground Swimming Pool Dear Mr. Cici: I was contacted by the property adjacent to you with regard to water coming into the home and made a site investigation to the home. It appears that the melting snow accumulated to the unlined pool at your yard may be the source or is likely contributing to the situation. The pool has not been maintained and is beginning to fail structurally. The following observations were made at the time of site investigation today: 1. The wall supports are showing signs of failure to the pool wall at the desk side. 2. The pool Iiner is not in place and has pulled away from the frame. 3. The pool does not have a cover, nor does it appear to have had one in place. 4. Access to the pool is not closed off from the deck/stairway by guards and/or a gate. 5. Guards are not fully in place at the deck as required per the MN Residential Building Code. The condition of the above ground swimming pool at your home is in a state of disrepair and is in violation of City Nuisance Ordinance 1109, City Ordinance 1303 as it relates to swimming pools, and Minnesota Residential Building Code Section R312 as it relates to Guards. These Ordinances and Code section, along with some site photos have been enclosed for your review. This letter serves as the City's request for Code Compliance to abate the nuisance of the pool condition either by its full repair or removal and abatement of MN Residential Code violation by placement of compliant guards and/or gate to the deck. Sincerely, PLANNING & CODE ENFORCEMENT Ju 'e Hultman, B ild'ng Official Enclosures C 0y 9 of 24 Tree City U.S.A. ® Stantec Memo To: Eric Johnson, Oak Park Heights From: Mark Janovec Lee Mann, Stantec Stantec Minneapolis File: 193800151 Date: March 25, 2022 Reference: Proposed Stormwater Infiltration at Park Dental Site We have reviewed the higher-level engineering review prepared by EOR on October 18, 2021 regarding the proposed stormwater infiltration at the Park Dental site. The need for the higher-level engineering review was identified in the guidance prepared for the Minnesota Pollution Control Agency's Minnesota Stormwater Manual. Specifically, the review was required because the proposed stormwater infiltration site is located with the highly-vulnerable Drinking Water Supply Management Area (DWSMA)for the Oak Park Heights Wellhead Protection Plan. The higher-level engineering review concluded that infiltration of stormwater at the site is acceptable because it was outside of the one-year capture zone for the City's wells, also known as the Emergency Response Area (ERA), and that no other receptors were within a one-year time-of travel of the proposed infiltration site. Despite these conclusions from the EOR review, we have identified several points of concern with the proposed stormwater infiltration site: 1. The delineated ERA for the Wellhead Protection Plan was based on a computer model that relied upon parameters that are estimates. Groundwater flow systems are very complex and the accuracy of modeled capture zones is only an approximation of groundwater flow conditions. The Park Dental site is located between two "lobes" of the ERA. If the actual aquifer parameters differ slightly from the estimated (modeled) aquifer parameters, there is a likelihood that the actual one-year capture zone for the City's wells may already include the Park Dental property. 2. The delineated ERA was based on pumping volumes from the City's wells from 2007 to 2011. That delineation will be due for an update by 2023. If pumping volumes from the City's wells have increased over the past ten years, the amended ERA will mostly likely encompass the Park Dental site. 3. The Jordan bedrock aquifer that the City's wells utilize lies directly below the highly-fractured Prairie du Chien bedrock layer. Flow within this fractured bedrock is very difficult to simulate with computer models because the location and layout of specific fractures cannot be easily mapped. A contaminant that infiltrates to the Prairie du Chien bedrock could quickly migrate horizontally before entering the underlying Jordan aquifer. The travel times for groundwater flow in reality may vary from the estimated travel times indicated by the model in the Wellhead Protection Plan. 4. The Park Dental site is immediately upgradient of both City wells with regards to groundwater flow direction. A spill that infiltrates at this site has a strong potential to contaminant both City wells. While the Park Dental site is outside the currently-delineated ERA, the site is still well within the highly- vulnerable capture zone of these wells. Therefore, any contaminants that reach groundwater at this site can still be expected to reach the City's wells. Based on the proximity of the Park Dental site to the ERA, one could still expect that a spill at the site could contaminate the City's wells in approximately one year. That leaves little time for the City to identify alternate site(s) for replacement wells, obtain property easements, design and construct new wells, modify the distribution system, and complete State permitting to utilize the wells. ml c:lusersllman nldesktoploph_stantec_park dental memo_03-25-2022.docx 10 of 24 March 25,2022 Eric Johnson,Oak Park Heights Page 2of2 Reference: Proposed Stormwater Infiltration at Park Dental Site For the reasons outlined above, we do not recommend stormwater infiltration at the Park Dental site. It should be noted that the Minnesota Stormwater Manual is a guidance for making decisions on stormwater infiltration. The guidance cannot encompass all situations in which infiltration is proposed. It is reasonable that any review of proposed stormwater infiltration look beyond the guidance to assess all risks. With the Park Dental site located in a highly-vulnerable DWSMA, immediately upgradient of the City's only water supply wells, we feel the risks are too great to recommend infiltration at this site. Unlike many communities, Oak Park Heights does not assess costs for MILL and OVERLAY projects.These costs are recovered through general property taxes. Although some failed curb sections will be replaced, generally curbing, driveway aprons and sidewalks are typically not affected with this type of project. However, there will be some localized disruption to your local street and which may cause you some temporary delay, undue noise and of course the traditional construction happenings. This work is slated to commence after the completion of the current school year and it may cause various disruptions in the area for approximately 60 days however except for some very short term delays all roads are expected to be generally passable. Please use caution when moving through these areas. When a more specific schedule is firm, the City will send out a second letter.
