Re: Valley View Estates 4th Addition
Dear Kris:
Scott Richards' attached Memo inquires about the possibility of vacating
the roadway easement depicted therein. If the Council wishes to consider vacation of this
easement it may initiate the action by resolution or by a petition brought by a majority of
the property owners who abut the land to be vacated.
The Council must hold a public hearing on the proposal following two
weeks published and posted notice. The City must provide written notice to each
affected property owner at least 10 days before the hearing. If the land to be vacated
abuts or terminates on any public water the City must give written notice to the
Commissioner of Natural Resources. I assume it does not abut on any public water.
Whether to ask for compensation for the easement is a matter for the discretion of the
City Council. Vacation must be found to be in the public interest.
If our office is provided with the legal description we can put together the
resolution and notice of vacation necessary to complete this matter. Please let me know
if you require anything further in this respect.
