BACKGROUND
Mr. Jack Krongard has requested a variance in the minimum lot width from
80 feet to 75 feet to construct duplex residences on the site. The properties
are in the Oak Park Heights Addition, Block Eight, Lots 5, 6, 7 and 8. The
zoning is R-2 for these parcels .
ISSUES AND ANALYSIS
The lot and building requirements for an R-2 district are as follows:
Setbacks: Front Yard - 30 feet
Side Yard - 10 feet (30 feet for corner lots)
Rear Yard - 30 feet
Minimum Lot Width: 80 feet
Specifications of the existing lots show the lot width of both to be just
75 feet, thereby violating the Zoning Ordinance requirement of an 80 foot
minimum lot width for two family dwellings in an R-2 district.
Section 401.03.B.4.b. of the Oak Park Heights Zoning Ordinance makes provision
for single family detached construction when, as they are here, the lots are of
record before the date of enactment of the Ordinance. Additionally, Section
401. 17.D. enables the City Council to approve a variance in:
". . .a situation whereby some reason of narrowness, shallowness, or shape
of a specific parcel of property or by reason of exceptional topographic
or water conditions of a specific parcel of land or lot, the strict
application of this Ordinance would result in exceptional and unique
difficulties when utilizing the parcel or lot in a manner customary
and legally permissable within the district in which said lot or parcel
is located."

Although the proposed construction is two family dwelling, and as such not
strictly mitigated under Section 401.03.B.4.b. , the narrowness of the lots
is a pre-existing condition and two family dwellings are a permitted land
use in the R-2 district. The variance request is therefore recommended
to be approved.
It should be noted that if the variance is approved for the prescribed pro-
perty, it will then be necessary for the applicant to request a resubdivision
of the four lots into two lots. As the situation is now, it would be impossible
for the applicant to meet the setback requirements of all four lots .
