PERMIT FOR RECREATIONAL TRAIL
THIS AGREEMENT, hereinafter referred to as "Permit", made this day
of , 1994, by and between NORTHERN STATES POWER COMPANY, a
Minnesota corporation, hereinafter referred to as "NSP", and the CITY OF OAK PARK
HEIGHTS, a Minnesota municipal corporation located in Washington County,
Minnesota, hereinafter referred to as "CITY",
WITNESSETH, That NSP, for and in consideration of the terms and covenants
herein contained, and for other good and valuable considerations, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant permission unto
CITY to construct, operate and maintain a trail for recreational purposes to the
extent hereinafter authorized on and across an undefined portion of the following
land situated in the City of Oak Park Heights, Washington County, Minnesota
described as follows:
The South 50 feet of the West 80 feet of the NW1/4 of the NW1/4 of Section
3, Township 29 North, Range 20 West.
The initial term of this Permit shall be for a period of One (1) year
commencing the 1st day of , 1994, and continuing thereafter on
a month-to-month basis until terminated by either party upon 30 days' notice in
writing. This Permit is granted to authorize the City to permit public use of
the premises for recreational purposes as defined in Minnesota Statutes, Chapter
87 and NSP's liability is limited as provided in said Chapter 87.
The trail permitted hereby shall be used only as a pedestrian trail and not
for motorized vehicles. The trail shall be located at least 35 feet from any NSP
transmission structure and construction clearances and ground clearances from
transmission conductors shall not be less than the minimum requirements specified
by the National Electric Safety Code.

It is also understood that the City will reasonably maintain and mow the
trail .
CITY agrees to keep the premises clear of debris and other obstacles.
CITY further agrees to have NSP listed as an additional insured on its
Comprehensive General Liability policy. City agrees it will maintain such
insurance throughout the term of the Permit and that such insurance will have
limits of at least one million dollars.
CITY agrees to accept the leased premises "as is" and upon the termination
hereof to surrender them in reasonably the same condition, or better.
IN WITNESS WHEREOF, the parties hereto have caused this agreement to be
duly executed as of the day and year first above written.
